Transgender legal protections have long been contentious issues, with courts often pathologizing or refusing recognition of transgender identities. Recently, however, courts adjudicating asylum claims have recognized “transgender” as a legitimate category of protection. I take this legal development as an opportunity to ask how courts determine if individuals are transgender. While previous work has shown how courts maintain the gender binary, asylum law offers the first chance to analyze how recognizing a distinct transgender category affects the legal gender order and (...) the classification of trans claimants. Drawing on court decisions, ethnographic observations, and interviews, I argue that the recognition of transgender as a category implicitly acknowledges the malleability of gender. Yet, the adjudication of transgender asylum cases continues to uphold a fixed and binary conception of gender by assuming a “born into the wrong body” narrative and that claimants should always already know their gender identities. Courts thus enforce a cis–trans binary wherein only certain claimants are found “trans enough.”. (shrink)

How ought you to evaluate your options if you’re uncertain about which axiology is true? One prominent response is Expected Moral Value Maximisation, the view that under axiological uncertainty, an option is better than another if and only if it has the greater expected moral value across axiologies. EMVM raises two fundamental questions. First, there’s a question about what it should even mean. In particular, it presupposes that we can compare moral value across axiologies. So to even understand EMVM, we (...) need to explain what it is for such comparisons to hold. Second, assuming that we understand it, there’s a question about whether EMVM is true. Since there are many plausible rivals, we need an argument to defend it. In this paper, I’ll introduce a representation theorem for axiological uncertainty to answer these two questions. Roughly, the theorem shows that if all our axiologies satisfy the von Neumann–Morgenstern axioms, and if the facts about which options are better than which in light of your uncertainty also satisfy these axioms as well as a Pareto condition, then these facts have a relevantly unique expected utility representation. If I’m right, this theorem at once affords us a compelling way to understand EMVM—and specifically intertheoretic comparisons—and a systematic argument for its truth. (shrink)

Many people think that if you're uncertain about which moral theory is correct, you ought to maximize the expected choice-worthiness of your actions. This idea presupposes that the strengths of our moral reasons are comparable across theories – for instance, that our reasons to create new people, according to total utilitarianism, can be stronger than our reasons to benefit an existing person, according to a person-affecting view. But how can we make sense of such comparisons? In this article, I introduce (...) a constructivist account of intertheoretic comparisons. On this account, such comparisons don't hold independently of facts about morally uncertain agents. They're simply the result of an ideal deliberation in terms of certain epistemic norms about what you ought to do in light of your uncertainty. If I'm right, this account is metaphysically more parsimonious than some existing proposals, and yet has plausible and strong implications. (shrink)

It is widely recognized that the innate versus acquired distinction is a false dichotomy. Yet many scientists continue to describe certain traits as “innate” and take this to imply that those traits are not acquired, or “unlearned.” This article asks what cognitive role, if any, the concept of innateness should play in the psychological and behavioural sciences. I consider three arguments for eliminating innateness from scientific discourse. First, the classification of a trait as innate is thought to discourage empirical research (...) into its developmental origin. Second, this concept lumps together a number of different biological properties that ought to be treated as distinct. Third, innateness is associated with the outmoded folk biological theory of essentialism. In response to these objections, I consider two attempts to revise the concept of innateness which aim to make it more suitable for scientific explanation and research. One proposal is that innateness can be defined in terms of the biological property of environmental canalization. On this view, a trait is innate to the extent that it is developmentally buffered against a range of different environments. Another proposal is that innateness serves as an explanatory primitive for cognitive science. This view holds that there exist a sharp boundary between psychological and biological explanations and that to identify a trait as innate means that it falls into the latter explanatory domain. The article analyses practices, perceptions and political dramatizations of bone marrow donation in Cyprus. Based on empirical data from an ethnographic study on practices of organ and bone marrow transplantation in postcolonial Cyprus, forms of oppositional biopolitics are analysed that are not bound by the modern, étatist regime of governing populations but capitalize on new developments in biomedicine, on new political movements, as well as on transformations in the political sphere. These reconfigurations are interpreted as instances of an emerging bio-subpolitics (...) that transcends national borders and produces new complexities, interrelations, associations and social forms that come into being alongside biomedicine. At the same time, these developments co-produce cosmopolitan citizens and new subjectivities, transcending nationally bound regimes of political deliberation and identification. These forms of biopolitics mobilize local historical experiences and take advantage of affordances provided by biomedical platforms operating on a global scale that make available an opportunity structure for a cosmopolitan bio-subpolitics. ZUSAMMENFASSUNGDie antik-jüdische Apokalyptik liefert einen wichtigen Beitrag zur Erschließung einer Biblischen Theologie, insofern man von einem offenen Kanon ausgeht, der Quellen auch jenseits seiner Grenzen berücksichtigt. Unter Einbeziehung der historisch-kritischen Methode zeigen sich in der apokalyptischen Literatur »Strukturen«, deren Sinn- und Wirkzusammenhang für eine gesamtbiblische Theologie von konstitutiver Bedeutung ist. Als wichtiger Baustein einer Biblischen Theologie fungiert die Apokalyptik. Und zwar auch deshalb, weil etwa die beiderseits auswertbare Struktur der »Verkehrung« im apokalyptischen Transzendierungskonzept eine zentrale Rolle spielt. Zum Erweis dient (...) als material-exegetisches Paradigma die alttestamentliche Gerichtsprophetie in Verbindung mit der Einsicht, dass ihre Aussagen zu »Schuld« und »Gericht« neutestamentlich erst über einen »apokalyptischen Filter« rezipiert worden sind. Relevante Motive sind die Rede von der Verkehrung der »Bitternis«, der personifizierte Tod und der Herrscher- bzw. Satanssturz, wie sie in den antik-jüdischen Texten des Testaments Abrahams und des äthiopischen Henochbuchs verarbeitet werden. Zwar greift das Diktum Käsemanns von der »Apokalyptik als Mutter aller christlichen Theologie« zu weit, mahnt aber zugleich, die apokalyptische Dimension Biblischer Theologie erst wieder zu entdecken. It is sometimes mentioned that Bernard Bolzano’s work on grounding anticipates many insights of the current debate on metaphysical grounding. The present paper discusses a certain part of Bolzano’s theory of grounding that has thus far not been discussed in the literature. This part does not so much anticipate what are nowadays common assumptions about grounding, but rather goes beyond them. Central to the discussion will be a thesis of Bolzano’s by which he tries to establish a connection between grounding (...) and unification. The paper spells out this thesis in detail and discusses the assumptions on which it rests. Next to this mainly historical aim, the paper also presents reasons why philosophers who are not interested in the historical Bolzano should find the thesis interesting by relating it to a certain view on unification and explanation that has been put forward by Kim. A final part of the paper provides a critical evaluation of the thesis against the background of current accounts of grounding. (shrink)

The dissertation provides a reconstruction of Bernard Bolzano's theory of grounding (both in early and late works) against the background of a classical conception of science and scientific explanation.

The culture of honour hypothesis offers a compelling example of how human psychology differentially adapts to pastoral and horticultural environments. However, there is disagreement over whether this pattern is best explained by a memetic, evolutionary psychological, dual inheritance, or niche construction model. I argue that this disagreement stems from two shortcomings: lack of clarity about the theoretical commitments of these models and inadequate comparative data for testing them. To resolve the first problem, I offer a theoretical framework for deriving competing (...) predictions from each of the four models. In particular, this involves a novel interpretation of the difference between dual inheritance theory and cultural niche construction. I then illustrate a strategy for testing their predictions using data from the Human Relations Area File. Empirical results suggest that the aggressive psychological phenotype typically associated with honour culture is more common among pastoral societies than among horticultural societies. Theoretical considerations suggest that this pattern is best explained as a case of cultural niche construction. (shrink)

My aim in this article is to widen the scope of the current debate on peer disagreement by applying it to a kind of case it has hitherto remained silent about – namely, to cases of disagreement in which one of the disagreeing parties bases her opinion on a private religious experience to which the other party has no access. In order to do this, I will introduce a modified version of the notion of peerhood – a version that, in (...) contrast to the one employed in the current debate, can be fruitfully applied to the troublesome kind of case in question. I will then employ this new notion in order to specify the degree of conciliation rationally required from the disagreeing parties in the kind of case in question. (shrink)

Ethos wird von B. Echeverría verstanden als die Gesamtheit aller materiellen und ideellen Alltagsformen, einschließlich der je spezifischen Gebrauchswerte. Die parallele Existenz vier verschiedener Ethos-Grundformen: das realistische, das romantische, das klassische und das barocke Ethos, bildet die begriffliche Grundlage eines nicht-progressistischen Erklärungsmodells innerhalb einer materialistischen Kulturtheorie. Die Anmaßung des heute vorherrschenden realistischen Ethos, „einmalig” und „modern” zu sein, wird nicht mit einem Schuss Postmoderne, sondern mit einer kritischen Theorie des vierfachen Ethos der kapitalistischen Moderne quittiert.

Unter Vorsehung verstehe ich ein die Geschicke von Individuum und Menschheit beeinflussendes, einem überzeitlichen Heilsplan folgendes Wirken Gottes in Geschichte.

Un phénomène intéressant apparaît dans de multiples cultures juridiques : afin de concilier la lettre de la loi et son esprit, certaines lois sont contournées – légalement. Ce contournement, qui consiste à vider la loi de son esprit tout en faisant mine de respecter sa formulation (un loophole en anglais), pose d’un point de vue éthique la question de savoir s’il n’y a pas là hypocrisie. La loi juive est ici étudiée car les contournements qu’elle autorise sont critiqués par ses (...) détracteurs, mais également de l’intérieur : tous les contournements ne sont pas approuvés, loin s’en faut. As conservation biology has developed as a distinct discipline from ecology, conservation guidelines based on ecological theory have been largely cast aside in favor of theory-independent decision procedures for designing conservation reserves. I argue that this transition has failed to advance the field toward its aim of preserving biodiversity. The abandonment of island biogeography theory in favor of complementarity-based algorithms is a case in point. In what follows, I consider the four central objections raised against island biogeographic conservation guidelines, arguing (...) that they fail to undermine the credibility of this framework as a conservation tool. At best, these objections call for a more careful application of this framework to conservation problems, not its wholesale abandonment. At the same time, complementarily-based algorithms are biased in favor of networks of small reserves containing non-overlapping species. These conditions threaten to promote inbreeding depression, genetic drift and other factors that increase a population’s risk of extinction. Therefore, recent developments in the field of conservation biology have arguably not contributed to its ultimate aim of preserving the maximum amount of biodiversity in the long run. (shrink)

Quantum mechanics of a particle in an infinite square well under the influence of a time-dependent electric field is reconsidered. In some gauge, the Hamiltonian depends linearly on the momentum operator, which is symmetric but not self-adjoint when defined on a finite interval. In spite of this symmetric part, the Hamiltonian operator is shown to be self-adjoint. This follows from a theorem by Kato and Rellich which guarantees the stability of a self-adjoint operator under certain symmetric perturbations. The result, which (...) has been assumed tacitly by other authors, is important in order to establish the equivalence of different Hamiltonian operators related to each other by quantum gauge transformations. Proceeding from our absolute space-time conceptions, we obtain the formula for the gravitational frequency shift in an extremely simple way. Using our “burst” model for photons, we show that the different rates of clocks placed in spatial regions with different gravitational potentials appear as a direct result of the gravitational frequency shift and the axiomatic assumption that at any space point the time unit is to be defined by light clocks with equal “arms,” i.e., that at any space point the (...) light velocity (in moving frames the “there-and-back” velocity) has the same numerical valuec. Considering the principle of equivalence, we come to the logical conclusion that the kinematic (Einstein-Lorentz) time dilation is an absolute phenomenon. (shrink)

Ethical aspects of management control systems are attracting increasing attention among scholars and practitioners. Much of the work centers on their aims. We complement this scholarship by applying the ethical principle of “no harm,” i.e., non-maleficence, to examine how those aims are achieved. We illustrate this approach by exploring the effects of four MCS designs on job-related stress drawing on the differentiation of stress into two dimensions: a challenge and a threat dimension. Results from a lagged field-survey with 471 managers (...) and employees from the UK and the U.S. support key predictions and offer first insights into designing MCS based on a “no harm” ethics. Our study highlights the benefits of interdisciplinary research in business ethics and hopefully encourages more work on MCS from a perspective based on the non-maleficence principle. (shrink)

Given the increasing potential of automation in the primary and industrial sectors of the economy, it is helpful to take a mesoeconomic, i. e. sectoral, look at the concept of a basic income. We present a thought experiment centred on societies in which labour takes place only in the service sector. We identify service sectors like prostitution in which it may be advantageous to shift away from the market and sectors like health services where public involvement is indispensable. Introducing a (...) basic income may also generate social capital, which usually accompanies service provision in the sphere of cooperation. (shrink)

Apart from achievements and reforms undertaken, further ones - based on another approach: considering the diversity principle - are proposed in order to reach equitable and fair trading negotiations outcomes in benefits of all members.

This inspiration has entered our culture and helped to shape much of the technology of the early 21st Century.
