  2. Hart's Methodological Positivism: Stephen R. Perry.Stephen R. Perry - 1998 - Legal Theory 4 (4):427-467.
To understand H.L.A. Hart's general theory of law, it is helpful to distinguish between substantive and methodological legal positivism. Substantive legal positivism is the view that there is no necessary connection between morality and the content of law. Methodological legal positivism is the view that legal theory can and should offer a normatively neutral description of a particular social phenomenon, namely law. Methodological positivism holds, we might say, not that there is no necessary connection between morality and law, but rather (...)

Oughts V. Ends: Seeking an Ethical Normative Standard for Journal Acceptance Rate Calculation Methods. [REVIEW]Maria A. Moore & Stephen D. Perry - 2012 - Journal of Academic Ethics 10 (2):113-121.
As a leading measure of journal quality, acceptance rates of journals can influence faculty recruitment, salary, tenure and promotion decisions; subscription decisions; and authors’ intention to submit manuscripts. Recent literature from both the Communication and Hospitality Management disciplines suggests that there are wide differences in the formulas used by editors to calculate acceptance rates. Because differing methods of acceptance rate calculation potentially impact significant decisions, a universally accepted and applied standard could be developed. A normative standard, grounded in a specific (...)

A Computational and Empirical Investigation of Graphemes in Reading.Conrad Perry, Johannes C. Ziegler & Marco Zorzi - 2013 - Cognitive Science 37 (5):800-828.
It is often assumed that graphemes are a crucial level of orthographic representation above letters. Current connectionist models of reading, however, do not address how the mapping from letters to graphemes is learned. One major challenge for computational modeling is therefore developing a model that learns this mapping and can assign the graphemes to linguistically meaningful categories such as the onset, vowel, and coda of a syllable. Here, we present a model that learns to do this in English for strings (...)

Political Authority and Political Obligation.Stephen R. Perry - 2013 - In Oxford Studies in Philosophy of Law: Volume 2. Oxford: Oxford University Press. pp. 1-74.
Legitimate political authority is often said to involve a “right to rule,” which is most plausibly understood as a Hohfeldian moral power on the part of the state to impose obligations on its subjects (or otherwise to change their normative situation). Many writers have taken the state’s moral power (if and when it exists) to be a correlate, in some sense, of an obligation on the part of the state’s subjects to obey its directives. Thus legitimate political authority is said (...)

Trust and Transparency: Patient Perceptions of Physicians' Financial Relationships with Pharmaceutical Companies.Joshua E. Perry, Dena Cox & Anthony D. Cox - 2014 - Journal of Law, Medicine & Ethics 42 (4):475-491.
Financial ties between physicians and pharmaceutical companies are pervasive and controversial. However, little is known about how patients perceive such ties. This paper describes an experiment examining how a national sample of U.S. adults perceived a variety of financial relationships between physicians and drug companies. Each respondent read a single scenario about a hypothetical physician and his financial ties to the pharmaceutical industry; scenarios varied in terms of payment type of and amount. Respondents then evaluated the physician on several dimensions (...)

  17. Childhood Experience and the Expression of Genetic Potential: What Childhood Neglect Tells Us About Nature and Nurture. [REVIEW]Bruce D. Perry - 2002 - Brain and Mind 3 (1):79-100.
Studies of childhood abuse and neglect haveimportant lessons for considerations of natureand nurture. While each child has uniquegenetic potentials, both human and animalstudies point to important needs that everychild has, and severe long-term consequencesfor brain function if those needs are not met. The effects of the childhood environment, favorable or unfavorable, interact with all theprocesses of neurodevelopment (neurogenesis, migration, differentiation, apoptosis, arborization, synaptogenesis, synapticsculpting, and myelination). The time coursesof all these neural processes are reviewed herealong with statements of core principles forboth genetic and (...)

Beyond the Distinction Between Positivism and Non-Positivism.Stephen Perry - 2009 - Ratio Juris 22 (3):311-325.
In this article I discuss a number of issues raised by Professor Jules Coleman's recent article "Beyond the Separability Thesis." I suggest, to begin, that Coleman is correct that neither a narrow nor a broad formulation of the separability thesis takes us very far towards a robust distinction between legal positivism and legal non-positivism. I then offer a brief discussion of methodology in jurisprudence, suggesting that Coleman accepts, at least implicitly, what I call a "methodology of necessary features." Since there (...)
