Atheist philosophers Jean-Paul Sartre and Kurt Baier, though from different philosophical traditions, shared a common concern about the traditional Judeo-Christian-Muslim doctrine that human beings are the creations of a Supreme Being. For Sartre, in “Existentialism is a Humanism” (1946), a God who designed us would thereby detract from our freedom and dignity. For Baier, in “The Meaning of Life” (1957), the idea that God designs us to serve his own purposes was deeply offensive in treating us as artifacts, domestic animals, (...) or slaves. Indeed, Baier said explicitly what was implicit in Sartre: that the divine creation of humans as would violate Immanuel Kant’s respect for persons principle. But this Kantian objection is badly flawed in ignoring the crucial role of human free will in traditional Abrahamic theism. Still, if we focus not on the divine-creation doctrine but on the doctrine of eternal torment for non-worshippers of God, then traditional Abrahamic theism does arguably undermine human freedom and dignity. This essay responds to Hirstein, Sifferd and Fagan’s book, Responsible Brains, which claims that executive function is the guiding mechanism that supports both responsible agency and the necessity for some excuses. In contrast, I suggest that executive function is not the universal acid and the neuroscience at present contributes almost nothing to the necessary psychological level of explanation and analysis. To the extent neuroscience can be useful, it is virtually entirely dependent on well-validated psychology to correlate with the neuroscientific variables (...) under investigation. The essay considers what executive function is and what the neuroscience adds to our understanding of it. Then it addresses moral and legal responsibility generally, and specific doctrines. Executive function is seldom found to be the most perspicuous approach to any of the general or specific moral and legal questions. (shrink)

Recently in these pages it has been argued that a relatively straightforward version of an old argument based on evolutionary biology and psychology can be employed to support the view that innate ideas are a naturalistic source of metaphysical knowledge. While sympathetic to the view that the “evolutionary argument” is pregnant with philosophical implications, I show in this paper how it needs to be developed and deployed in order to avoid serious philosophical difficulties and unnecessary complications. I sketch a revised (...) version of the evolutionary argument, place it in a new context, and show that this version in this context is not vulnerable to the standard criticisms levelled against arguments of this general type. The philosophical import of this version of the argument lies not in any metaphysical conclusions it sanctions directly, but in the support it lends to the metaphilosophy of commonsense. (shrink)

War metaphors are ubiquitous in discussions of everything from political campaigns to battles with cancer to wars against crime, drugs, poverty, and even salad. Why are warfare metaphors so common, and what are the potential benefits and costs to using them to frame important social and political issues? We address these questions in a detailed case study by reviewing the empirical literature on the subject and by advancing our own theoretical account of the structure and function of war metaphors in (...) public discourse. We argue that war metaphors are omnipresent because they draw on basic and widely shared schematic knowledge that efficiently structures our ability to reason and communicate about many different types of situations, and they reliably express an urgent, negatively valenced emotional tone that captures attention and motivates action. Nevertheless, we find that the meaning of war metaphors is intimately tied to the context in which they are used, which may result in either positive or negative outcomes, depending on the situation. Thus, blanket statements about whether or not a war frame is useful are misguided or overly constraining. Here we situate our case study results in relation to popular theories of metaphoric representation and processing and offer some guidelines for using a war framing effectively. This work helps illuminate the complex, dynamic, and nuanced functions of metaphor in cognition in general, and in public discourse in particular. (shrink)

The current system of ethical oversight in the United States is based on Institutional Review Board (IRB) review. The system was established in response to well-known and egregious mistreatment of subjects in both biomedical and social and behavioral research. In the decades since the research regulations were enacted, reaction to the burden of IRB oversight has led the system to focus on compliance and limit its active oversight disproportionately to studies that could present the risk of physical harm. At the (...) same time, the characteristics of the research enterprise have changed and methodologies now present novel risks that were not envisioned in the regulations. We convened a group of IRB professionals, academic leaders, and others to discuss limitations of the current system, how that system could be changed to recognize evolving risks and an increasing focus on participant and community voice, and how it could better serve the needs of researchers and support the societal project of science as a public good. Recommendations included a call to reexamine the academic incentive structure, to develop a system to support consideration of ethical principles from the time of study design, and to explicitly provide different ethical support and oversight for high-risk interventional trials and lower risk biomedical and social behavioral research. How can the philosopher use history of science to assess normative methodologies? This paper distinguishes the "intuitionist" meta-methodologies from the "rationability" meta-methodology. The rationability approach is defended by showing that it does not lead to anarchistic conclusions drawn by Feyerabend, Lakatos, and Kuhn; rather, these conclusions are the result of auxiliary assumptions about the nature of rational norms. By freeing the rationability meta-method from these assumptions, the specter of anarchism can be exorcised from it.

According to a natural view of instrumental normativity, if you ought to do φ, and doing ψ is a necessary means for you to do φ, then you ought to do ψ. In “Instrumental Normativity: In Defense of the Transmission Principle,” Benjamin Kiesewetter defends this principle against certain actualist-inspired counterexamples. In this article I argue that Kiesewetter’s defense of the transmission principle fails. His arguments rely on certain principles—Joint Satisfiability and Reason Transmission—which we should not accept in the unqualified forms (...) needed to establish his conclusion. (shrink)

Behavioral and physiological synchronization have important implications for work teams with regard to workload management, coordinated behavior and overall functioning. This study extended previous work on the nonlinear statistical structure of GSR series in dyads to larger teams and included subjective ratings of workload and contributions to problem solving. Eleven teams of 3 or 4 people played a series of six emergency response (ER) games against a single opponent. Seven of the groups worked under a time pressure instruction at the (...) beginning of the first game. The other four groups were not given that instruction until the beginning of the fourth game. The optimal lag length for the teams, which appeared to be phase-locked, was substantially shorter than that obtained previously for loosely-coupled dyads. There was a complex nonlinear effect from the time pressure manipulation on the autocorrelation over time that reflected workload and fatigue dynamics that were operating. The R2 values for linear and nonlinear statistical models differed by less than.01. The average amount of influence from one ER team member to another was 4.5-4.7% of the variance in GSR readings. ER team members were classified as drivers and empaths, based on the autocorrelations and transfer influences to and from other players in the GSR time series. Empaths were rated by their peers as making more types of positive contributions to the problem solving discussions than others, and drivers received the lowest ratings. Larger Lyapunov exponents that were calculated from the GSR time series were positively correlated with individuals’ ratings of subjective workload and were negatively correlated with leadership indicators. We survey students at two Southern United States universities (one public and one private, religiously affiliated). Using a survey instrument that includes 25 vignettes, we test two important hypotheses: whether ethical attitudes are affected by religiosity (H1) and whether ethical attitudes are affected by courses in ethics, religion or theology (H2). Using a definition of religiosity based on behavior (church attendance), our results indicate that religiosity is a statistically significant predictor of responses in a number of ethical scenarios. In seven (...) of the eight vignettes for which religiosity is significant, the effect is negative, implying that it reduces the acceptability of ethically-charged scenarios. Completion of ethics or religion classes, however, was a significant predictor of ethical attitudes in only two of the 25 vignettes (and in the expected direction). We also find that males and younger respondents appear to be more accepting of the ethically-questionable vignettes. We conclude that factors outside of the educational system may be more influential in shaping responses to ethical vignettes than are ethics and religion courses. (shrink)

Transnational corporations have become actors with significant political power and authority which should entail responsibility and liability, specifically direct liability for complicity in human rights violations. Holding TNCs liable for human rights violations is complicated by the discontinuity between the fragmented legal/political structure of the TNC and its integrated strategic reality and the international state system which privileges sovereignty and non-intervention over the protection of individual rights. However, the post-Westphalian transition—the emergence of multiple authorities, increasing ambiguity of borders and jurisdiction (...) and blurring of the line between the public and private spheres—should facilitate imposing direct responsibility on transnational firms. Mechanisms for imposing direct responsibility on TNCs are considered including voluntary agreements and international law. However, I conclude that a hybrid public-private regime which relies on non-hierarchical compliance mechanisms is likely to be both more effective and consistent with the structure of the emerging transnational order. Using Currie's critique as a foil, this paper reconstructs Lakatos's thesis that historiography of science is laden with normative assumptions about scientific rationality. It is argued that this thesis comprises both a heuristic claim and a constitutive claim. The Received Critique of Lakatos fails to see that "internal history" and "rational reconstruction" receive a special meaning (by which they designate "rational preconstructions") when used in the context of the heuristic claim. Currie avoids this mistake, but attributes to Lakatos an "investigation-surrogate (...) claim" which misrepresents the heuristic claim, oversimplifying the relation Lakatos envisions between hard cores and the solutions they generate. This chapter addresses the many topics concerning the mind that Michael Moore has written about for many decades, including the metaphysics of mind and action, the act requirement in criminal law, the basis for the excuse of legal insanity, a volitional or control excuse, and the relation of the new neuroscience to law. Rather than primarily responding to Moore’s influential work, the chapter largely considers issues that are complementary to Moore’s work. The chapter does question whether metaphysical issues must be (...) resolved to engage in constructive legal analysis, but concludes generally that Moore is right about most topics he covers. The author upends traditional understandings of this controversial narrative through a phenomenological midrash or interpretation of Genesis 22 from the Dialogic and Jewish philosophies of Franz Rosenzweig, Martin Buber, and, most notably, Emmanuel Levinas. He intersects Jewish studies, Biblical studies, and philosophy in a literary/midrashic style that challenges traditional Western philosophical epistemology.
