Oliver Wendell Holmes, Jr. is, arguably, the most important American jurist of the twentieth century, and his essay The Path of the Law, first published in 1898, is the seminal work in American legal theory. This Article addresses a different sort of legal transplant — one in which outside legal doctrines are imported in order to be cabined, treated as normative counterpoints, and identified as the legal other. Legal primitivism is a kind of anti-transplant. It heightens the persistent differences between a dominant legal system and its understanding of primitive rules. An often ignored legal literature depicting legal primitivism emerged in the second half of the nineteenth century and in the early twentieth century. Mapping the (...) differences between America’s modern legal system and its antecedents, this immense literature, which included works by OliverWendell Holmes, James Coolidge Carter, and John Henry Wigmore, described an archaic legalism which sometimes belonged to tribal societies, and sometimes was simply conjured out of thin air. Exploring the project of constructing geographies of legal knowledge assists in our understanding of American law in a period of significant change. What elements of primitive law were valorized? Which were seen as archaic or repugnant? And what was the purpose of constructing a legal doppelgänger? By examining these cultural negotiations, and holding legal primitivism up as a mirror to modern law, it is possible to uncover the anxieties of legal modernism. (shrink)

In this issue of the Hastings Center Report, Moti Gorin, Steven Joffe, Neal Dickert, and Scott Halpern offer a comprehensive defense of the use of nudging techniques in the clinical context, with the aim of promoting the best interests of patients. Their argument is built on three important claims: Nudging is ubiquitous and inescapable in clinical choice situations, and there is no neutral way of informing patients about their treatment choices; many patients do not have authentic preferences concerning their (...) treatment choices, and those that do can easily resist nudging; and, finally, since many people lack authentic preferences and those that do can still act on their preferences, nudging in the patients’ best interest is justified. I agree with the authors that if these three claims stand up to scrutiny, then they will provide a justification for many types of clinical nudging. I am, however, skeptical as to whether the claims can be sustained, despite the valiant efforts of Gorin and colleagues. (shrink)

We have been asked to respond because our work in Acceptance and Commitment Therapy (ACT; Hayes, Strosahl, and Wilson 1999) and Relational Frame Theory (RFT; Hayes, Barnes-Holmes, and Roche 2001) are part of the foundational work in EA, and thus in this short commentary we comment on the article from the point of view of our research program.The article notes several areas of overlap between the ACT/RFT work on EA and their Sartrian perspective on superstition, such as the holistic and contextualistic nature of the analysis, but also several differences which the authors feel advantage their own view.It is difficult to compare the two lines of work without appreciating their context and purpose. Sartre was not a scientific psychologist; ACT/RFT are part of a specific effort at scientific system building, which we term here “contextual behavioral science” (AKA, post-Skinnerian behavior analysis).Contextual behavioral science is a social enterprise that has as its purpose the development of increasingly organized statements of relations among events that allow actions embedded in their historical and situational context to be predicted and influenced with precision, scope, and depth. “Precision” means that a limited set of analytic constructs apply to any one event; “scope” means that a limited set of constructs are needed to analyze a broad range of events; and “depth” means that constructs should cohere across different levels of analysis.Although a real world (or at least the one world) is assumed, the partitioning of the world is thought to be the result of our continuous interactions in and with it. These partitions are not ontological constructions from the perspective of contextual behavioral science because they, too, are actions that are purposive and embedded in their historical and situational contexts. The [End Page 269] deliberate attempt to analyze the world scientifically does not contradict the holistic standpoint of contextualism. When analytic goals are accomplished, constructs are “true,” but multiple truths are possible given multiple goals and historical and situational contexts. Conversely, all forms of contextualism become dogmatic and self-contradictory if their goals are not stated. It is common for contextualists of all varieties to state and defend the ultimate apprehension of reality as a whole, for example, without realizing that any statement about the world including such a defense is a form of breaking down this whole into parts. As we will try to show, the target article seems to fall into this usual contextualistic trap by arguing for what is better, without stating clearly “better for what, assessed how” and without viewing concepts with relevance to their purpose.Prediction and influence with precision, scope, and depth is a purpose, stated naked and in the wind. It is not defended, justified, or given ontological status. For example, Pérez-Álvarez and Sass (2008) identify a-dualism, or monism, as a common feature. In functional contextualism, the whole is divided into functional units for the purpose of prediction and influence. A three-term contingency (antecedent–behavior–consequence) in behavior analysis is viewed as a [End Page 255] whole event with pragmatically distinguishable aspects, not an assemblage. As the authors point out, this results in a dialectic tension between stimulus control, action, and reinforcer because none are distinct units, and each is defined with reference to the others much as the front of a coin cannot exist without the back. These are not ontological entities, but functional units that are abstracted from the whole for pragmatic purposes. What is “radical” about radical behaviorism is that the philosopher, psychologist, or researcher participates in the event they are observing, and their own acts of scientific observation are identified based on their own functional properties.Behavioral ThinkingIn the service of further developing this philosophical and theoretical foundation and considering it along side phenomenology, we need to examine two aspects of the target article. In 2017 Ploug and Holm argued that anonymizing individuals in the Danish circumcision registry was insufficient to protect these individuals from what they regard as the potential harms of being in the registry. We argue that Ploug and Holm’s fears in each of the areas are misguided, not supported by the evidence, and could interfere with the gathering of accurate data. The extent of the risks and harms associated with ritual circumcision is not well known. The anonymized personal health data (...) supplemented with the circumcision registry will enable more precise research into the medical consequences of ritual circumcision, and allow parents to make more fully informed decisions about circumcision with minimal, if any, adverse consequences. Steven Crowell has been for many years a leading voice in debates on twentieth-century European philosophy. This volume presents thirteen recent essays that together provide a systematic account of the relation between meaningful experience and responsiveness to norms. This chapter proposed a novel design methodology called Value-Sensitive Design and its potential application to the field of artificial intelligence research and design. It discusses the imperatives in adopting a design philosophy that embeds values into the design of artificial agents at the early stages of AI development. Because of the high risk stakes in the unmitigated design of artificial agents, this chapter proposes that even though VSD may turn out to be a less-than-optimal design methodology, it currently provides a (...) framework that has the potential to embed stakeholder values and incorporate current design methods. Jean-Jacques Rousseau's main work in political philosophy, the _Social Contract_, contains two beginnings; on the one hand, it commences, quite conventionally, with a social contract between individuals, on the other hand it also states that a lawmaker needs to precede the agreement of such a contract. This curious co-existence of two beginnings in the text has usually been ignored or played down by interpreters. This article, on the other hand, presents a reading of their interplay inspired by Zizek's theory of (...) ideology. It demonstrates how one of the beginnings, if seen from this point of view, may be understood as the truth about the other, and how the figure of the lawmaker specifically reveals the text as torn apart by contradictory internal tendencies. Arendt wrote thoughtfully about the role of sensibility and aesthetic judgment in political life and on the power of art to enrich human experience. This book introduces an account of cognitive architecture, Cognitive Pluralism, on which the basic units of understanding are models of particular content domains. Having many mental models is a good adaptive strategy for cognition, but models can be incompatible with one another, leading to paradoxes and inconsistencies of belief, and it may not be possible to integrate the understanding supplied by multiple models into a comprehensive and self-consistent "super model". While there are many competing accounts and scales of intellectual humility, philosophers and psychologists are generally united in treating it as an epistemically _beneficial_ disposition of _individual_ agents. I call the research guided by this supposition the _traditional approach_ to studying intellectual humility. The traditional approach is entirely understandable in light of recent findings that individual differences in intellectual humility are associated with various deleterious epistemic tendencies. Nonetheless, I argue that its near monopoly has resulted in an underestimation of important (...) limitations of human cognition. In particular, it neglects the fact that intellectual arrogance can be both deeply recalcitrant and significantly beneficial for bounded cognitive agents whose reliance on one another is profound. I propose to integrate these insights into the study of intellectual humility by treating it as a _collective virtue_ that gets manifested in the structure of epistemic environments. More specifically, it is an interactive virtue that harnesses and constrains intellectual arrogance to yield benefits for both individuals and collectives. I claim that this can happen only within _humbling environments_, such as forecasting tournaments and open institutional science. (shrink)

This chapter analyzes the ethical issues that arise in the context of the use of physical enhancement techniques, i.e.techniques that aim at enhancing one or more physical functions of human beings. First, it discusses the different types of physical enhancement and points doping in sports is only a minor part of the whole enhancement field. Considerable attention is devoted to enhancement in sports, primarily because of the extensive extant literature. Then, the chapter moves on to problematize the concept of enhancement. (...) It shows that deciding whether something should count as an enhancement is not a matter for pure personal decision. The chapter engages with the ethical arguments put forward in the enhancement debate, showing that the validity of both the pro‐ and the anti‐enhancement arguments is context‐dependent and the growth hormone treatment can only be justifiably claimed if it aims at giving someone a height in the normal range. Richard Arthur and I proposed that the present in Minkowski spacetime should be thought of as a small causal diamond. That is, given two timelike separated events p and q, with p earlier than q, they suggested that the present is the set I+ ∩ I-. Mauro Dorato presents three criticisms of this proposal. I rebut all three and then offer two more plausible criticisms of the Arthur/Savitt proposal. I argue that these criticisms also fail.

The leading models of disability struggle to fully encompass all aspects of “disability.” This difficulty arises, the author argues, because the models fundamentally misunderstand the nature of disability. Current theoretical approaches to disability can be understood as “nounal,” in that they understand disability as a thing that is caused or embodied. In contrast, this paper presents an adverbial perspective on disability, which shows that disability is experienced as a personally irremediable impediment to daily-living tasks or goals-like-ours. The picture theory of (...) disability technically constitutes a species of relational approach because its analysis references the interplay between an individual and their environment; it differs from other relational accounts, however, by interpreting disability as a certain kind of negative experience—rather than a function of that relationship. This purely descriptive theory makes no normative claims about disability and operates as both a mechanism for the evaluation of the experience of disability and a heuristic device for the proper interpretation of disability. When disability is reframed in this way, the theory offers a particularist perspective which shows if, when, where, and how disability is experienced. (shrink)

In "Nietzsche's Perspectivism", Steven Hales and Rex Welshon offer an analytic approach to Nietzsche's important idea that truth is perspectival. Drawing on Nietzsche's entire published corpus, along with manuscripts he never saw to press, they assess the different perspectivisms at work in Nietzsche's views with regard to truth, logic, causality, knowledge, consciousness, and the self. They also examine Nietzsche's perspectivist ontology of power and the attendant claims that substances and subjects are illusory while forces and alliances of power constitute (...) the only reality. Hales and Welshon present Nietzsche's treatment of perspectivism as both more complex and more fruitful than the common view of it as a doctrine that truth is not objective. Neither a metaphor nor a methodology, perspectivism emerges as a protean concept akin to a unifying theme; an alternative to the absolutism that recurs in science, philosophy, and religion; and a technique for revealing the unimagined possibilities open to every individual. The privileged insights and perspectives that women bring to the consideration of technologies in human reproduction are the subject (...) of these volumes, which constitute the revised and edited record of a Workshop on "Ethical Issues in Human Reproduction Technology: Analysis by Women" (EIRTAW), held in June, 1979, at Hampshire College in Amherst, Massachusetts. Some 80 members of the workshop, 90 percent of them women (from 24 states), represented diverse occupations and personal histories, different races and classes, varied political commitments. They included doctors, nurses, and scientists, lay midwives, consumer advocates, historians, and sociologists, lawyers, policy analysts, and ethicists. Steven Shapin argues that science, for all its immense authority and power, is and always has been a human endeavor, subject to human capacities and limits.

This paper introduces phenomenology as a distinctive form of transcendental philosophy by exploring a problem that arises with the phenomenological concept of “constitution,” namely, the “paradox of human subjectivity” – the idea that under the transcendental reduction the human subject is both a entity in the world and the ground of all such constitution. Focusing on the question of what conditions must obtain for something to be the bearer of normatively structured intentional content, the paper argues that the appearance of (...) paradox here rests upon a certain naturalistic assumption – namely, that the aspect of subjectivity responsible for transcendental constitution is consciousness conceived as the kind of phenomenal experience we share with other animals. In a final section I try to suggest how transcendentalism and a certain naturalism might nevertheless be reconciled on phenomenological grounds. (shrink)

Linguistic intuitions are a central source of evidence across a variety of linguistic domains. They have also long been a source of controversy. This chapter aims to illuminate the etiology and evidential status of at least some linguistic intuitions by relating them to error signals of the sort posited by accounts of on-line monitoring of speech production and comprehension. The suggestion is framed as a novel reply to Michael Devitt’s claim that linguistic intuitions are theory-laden “central systems” responses, rather than (...) endorsed outputs of a modularized language faculty (the “Voice of Competence”). Along the way, it is argued that linguistic intuitions may not constitute a natural kind with a common etiology; and that, for a range of cases, the process by which intuitions used in linguistics are generated amounts to little more than comprehension. Worsening energy crises and the growing effects of climate change have spurred, among other things, concerted efforts to tackle global problems through what the United Nations calls Sustainable Development Goals (SDGs). These are in turn argued to be best achieved via the adoption of environmental, social, and corporate governance (ESG) as the vehicle for guiding our efforts. However, though these things are often presented as the solution to global issues, they are increasingly being used as a means to centralize power (...) and exacerbate growing authoritarian trends. In the mid-nineteenth century, the house sparrow ( Passer domesticus) was introduced to the United States, quickly spreading across the country. For a brief period in the late nineteenth and early twentieth centuries, the observation of sparrow behavior was something of an urban pastime. Traits such as intelligence, reason, persistence, and craftsmanship were conferred onto sparrows by American urbanites. This paper argues that sparrow intelligence was often conflated with domestication: the ability of the birds to adapt to living alongside humans. (...) Praise for the ingenuity of sparrows generally revolved around their nest building, particularly when such structures overcame the challenges posed by urban infrastructure and technology. Sparrows were far less praiseworthy when they caused electricity outages or contaminated water supplies. The sparrow in the United States demonstrates how the relationship between these anecdotes and their implications for animal minds was mediated by the technology and infrastructure of cities. Admirers of sparrows were not measuring the birds’ mental capacity, but rather their ability to adapt to human habitations. Sparrows were only granted intelligence once they had demonstrated their ability to become domesticated. (shrink)
