Euthanasia and physician assisted-suicide are terms used to describe the process in which a doctor of a sick or disabled individual engages in an activity which directly or indirectly leads to their death. This behavior is engaged by the healthcare provider based on their humanistic desire to end suffering and pain. The psychiatrist's involvement may be requested in several distinct situations including evaluation of patient capacity when an appeal for euthanasia is requested on grounds of terminal somatic illness or when (...) the patient is requesting euthanasia due to mental suffering. We compare attitudes of 49 psychiatrists towards euthanasia and assisted suicide with a group of 54 other physicians by means of a questionnaire describing different patients, who either requested physician-assisted suicide or in whom euthanasia as a treatment option was considered, followed by a set of questions relating to euthanasia implementation. When controlled for religious practice, psychiatrists expressed more conservative views regarding euthanasia than did physicians from other medical specialties. Similarly female physicians and orthodox physicians indicated more conservative views. Differences may be due to factors inherent in subspecialty education. We suggest that in light of the unique complexity and context of patient euthanasia requests, based on their training and professional expertise psychiatrists are well suited to take a prominent role in evaluating such requests to die and making a decision as to the relative importance of competing variables. In patients with schizophrenia, consent postmortem for organ donation for transplantation and research is usually obtained from relatives. By means of a questionnaire, the authors investigate whether patients with schizophrenia would agree to family members making such decisions for them as well as compare decisions regarding postmortem organ transplantation and brain donation between patients and significant family members. Study results indicate while most patients would not agree to transplantation or brain donation for research, a proportion would agree. Among patients who (...) declined organ donation for transplantation or brain research, almost half of family members would have agreed to brain donation for research and over 40% to organ transplantation. Male relatives are more likely to agree to organ donation from their deceased relatives for both transplantation and research. The authors argue that it is important to respect autonomy and interests of research subjects even if mentally ill and even if no longer living. Consent may be assisted by appropriate educational interventions prior to patient death. (shrink)

This paper examines the effects of a decrease in auditor litigation risk in a setting that isolates a change in auditor litigation risk from changes in auditor reputation. _StoneRidge Investment Partners v. Scientific Atlanta_ is a 2008 U.S. Supreme Court ruling that restricted secondary actor liability in class action suits, resulting in a decrease in class actions that listed auditors as defendants. We document that the _StoneRidge_ decision is associated with a negative CAR for clients of Big 4 auditors and (...) industry specialist auditors, in particular those associated with high-litigation risk, low cash, and past incidences of modified going concern opinions. These findings are consistent with investor perception of lower potential payoffs from secondary defendants in class action suits, in particular auditors, following the _StoneRidge_ decision. We also document that auditors are more (less) likely to accept (reject) risky clients and charge lower audit fees to risky clients after _StoneRidge_, consistent with a decrease in auditor litigation risk that increases auditor risk tolerance. Finally, we provide evidence that audit firms issue fewer going concern opinions following _StoneRidge_, consistent with a decrease in litigation risk leading to lower audit quality_._ Our results are relevant to policy makers as they consider the disciplinary role of litigation on audit markets. Nursing Inquiry 2012; 19: 128–133 [Epub ahead of print]What makes patients perceive their health care worker as an epistemic authority?Health care workers’ (HCW) perceived epistemic authority (EA) may have an effect on patient decision‐making and compliance. The present study investigated the hypotheses that higher EA is attributed to staff perceived to be experts; to physicians rather than nurses; to HCWs who recommend taking a test more than to the ones who make no recommendation. (...) The study was based on a factorial 2 × 2 × 2 within‐between subjects design. The questionnaire presented four scenarios, each illustrating a HCW presenting information on a devastating genetic disease. The three variables manipulated were: HCW expertise, HCW role, and making a recommendation or not. After each scenario participants were asked questions about the EA they attributed to the HCW in the scenario. The results show main effects for perceived expertise and recommendation/no recommendation on the level of EA attributed. Expert nurses were judged to have the same high EA as expert physicians. But expert physicians who recommended taking a test were judged as having significantly higher EA than expert physicians who made no recommendation. Among nurses who made no recommendation, expert nurses were evaluated as having significantly higher EA than novices. Since expert nurses were perceived to have equal expertise as expert physicians, it follows that information given by both nurses and physicians can reduce patient uncertainty. (shrink)

Power-sharing agreements, despite their disappointing history, are still the prevailing tool used for diffusing intrastate conflicts in Africa. One element that requires additional analysis is the role of third-parties in power-sharing negotiations. An analysis of the role of France in power-sharing negotiations in Chad, Mali, Central African Republic, Rwanda, and the Ivory Coast, suggests a biased approach that harmed the outcomes and sustainability of those negotiations. A better approach is to increase the power of third-parties like the African Union (AU). (...) Currently, this organization lacks the executive capacity to guarantee the implementation of power-sharing negotiations. Empowering the AU’s executive arm through the formation of a military force, should allow for enhanced capacity in power-sharing negotiations. (shrink)

O termo “cogito” designa de modo genérico e impreciso um argumento que Descartes propõe em diversos momentos de sua obra. De um modo geral, os comentadores, tal como o fizeram os interlocutores contemporâneos ao autor, consideram que a expressão “penso, logo existo” (cogito ergo sum), ausente das Meditações Metafísicas, resume adequadamente este argumento único e procuram esclarecê-lo ou criticá-lo, nem sempre levando em consideração as diferentes formulações que recebe e os diferentes contextos em que ocorre. Meu objetivo neste texto é (...) simplesmente analisar o quarto parágrafo da Segunda Meditação (AT VII, 24-25; IX-1,19), no qual ele supostamente apresenta este mesmo argumento sem empregar a famosa expressão. Das muitas, diversas e relevantes questões filosóficas que este argumento suscita, gostaria de me concentrar em investigar se ele pode ser reconstruído sem que seja necessário introduzir – como uma premissa não justificada – a concepção do pensamento como sendo essencialmente consciência de si e, portanto, como envolvendo - por definição, a auto-referência imediata e incorrigível do sujeito a si mesmo. Gostaria de poder mostrar que o argumento não apenas independe dessa concepção como, além disso, conduz a essa concepção; todavia, somente o primeiro passo em direção a esta interpretação será dado neste artigo. Quanto à expressão “penso, logo existo”, minha hipótese é que, embora ausente do texto, ela, de fato, resume o sentido geral da posição cartesiana. Sua ausência explica-se pelo fato de que Descartes pretende apresentar nas Meditações a versão mais completa de seu argumento e a passagem que será aqui analisada constitui, na realidade, apenas uma primeira etapa dessa versão. A análise e a reconstrução que serão propostas supõe que o argumento apresentado no parágrafo 4 deva ser compreendido, como propõe H. G. Frankfurt, como composto de quatro etapas, cujo sentido depende do contexto argumentativo mais amplo no qual estão inseridas, como observou Jean-Claude Pariente, em seu artigo sobre o cogito nas Meditações Metafísicas. O artigo apresenta uma concepção do fluxo de consciência a partir de um modelo de naturalização da consciência de base metafísica não-materialista, inspirado na filosofia de Espinosa. Procura-se responder à questão colocada por Arthur Prior, em seu artigo ?Thank Goodness That?s Over? , acerca do caráter problemático do significado de um certo tipo de proposições indexadas temporalmente no quadro de teorias que recusam a realidade do tempo. Para tanto, defende-se a hipótese de que essas proposições são irredutíveis a proposições não (...) temporalizadas, seu sentido sendo determinado pelo caráter adverbial dos indexadores temporais e pela função de expressar estados subjetivos referencialmente opacos . Essa função, por sua vez, seria determinante para a constituição do mental enquanto tal e para a realidade do domínio prático. // The article proposes a conception of the flow of consciousness based on a non-materialistic metaphysical model of naturalization of consciousness, inspired in Spinoza's philosophy. I will try to answer Arthur Prior’s question (Thank Goodness That's Over, 1959) concerning the problematic character of the meaning of a certain type of propositions containing temporal indexes for the theories that refuse the reality of time. My hypothesis is that those propositions cannot be reduced to tenseless ones since their meaning is determined by the adverbial character of the temporal indexes and since they express subjective referentially opaque states (that are taken to be close to the Spinozistic concept of affection). I will also show that their function is crucial for the constitution of the mental and for the reality of the practical domain. (shrink)

Furthermore, according to Bergman, religion can do what philosophical reasoning is incapable of doing since he considers belief to be stronger than knowledge. A criticalscrutiny of these assumptions involves some interesting implications concerning toleration, freedom-of-thought (...) and dogmatism. Este artigo apresenta a maneira pela qual atualmente compreendo um dos pontos mais controverso: da doutrina cartesiana, a saber, sua concepção de liberdade. Meu interesse nas concepções cartesianas de vontade e de liberdade é exclusivamente epistêmico, e não prático; ou melhor, trata-se de pensar esses conceitos, bem como sua relação a partir do ponto de vista estrito do problema do conhecimento, embora - aparentemente - o próprio Descartes não acreditasse que tal separação fosse possível. Através da análise das relações entre (...) entendimento, vontade e liberdade, procuro mostrar que a razão que leva Descartes a enfatizar a distinção entre antes e durante o momento da decisão da vontade na carta de 9 de fevereiro de 1645 ao Padre Mesland reside precisamente na consideração de que a concepção da liberdade humana deve associar às condições de aplicação do conceito formal de liberdade as condições específicas de seu exercício no caso do espírito humano, enquanto substância finita criada inserida na temporalidade. A análise das condições do exercício da liberdade humana, por sua vez, pode explicar a introdução de um tipo peculiar de necessidade epistêmica associada à percepção de conteúdos fictícios e que gera o problema do qual trata a Quinta Meditação, e cujo exame conduziu-me a investigar concepção cartesiana de liberdade. Some people argue that the distribution of medical resources should be sensitive to agents’ responsibility for their ill-health. In contrast, others point to the social determinants of health to argue that the collective agents that control the conditions in which agents act should bear responsibility. To a large degree, this is a debate in which those who hold individuals responsible currently have the upper hand: warranted appeals to individual responsibility effectively block allocation of any significant degree of responsibility to collective (...) agents. We suggest that a different understanding of individual responsibility might lead to a fairer allocation of blame. Scaffolded agency is individual agency exercised in a context in which opportunities and affordances are structured by others. Appeals to scaffolded agency at once recognize the role of the individual and of the collective agents who have put the scaffolds in place. (shrink)

The paper motivates a novel research programme in the philosophy of action parallel to the ‘Knowledge First’ programme in epistemology. It is argued that much of the grounds for abandoning the quest for a reductive analysis of knowledge in favour of the Knowledge First alternative is mirrored in the case of intentional action, inviting the hypothesis that intentional action is also, like knowledge, metaphysically basic. The paper goes on to demonstrate the sort of explanatory contribution that intentional action can make (...) once it is no longer taken to be a target for reductive analysis, in explaining other, non-intentional kinds of action and voluntariness. A intenção do trabalho é comparar os sentidos atribuídos ao virtual nas obras O que é o Virtual? (1995) e Cibercultura (1997) do filósofo francês Pierre Lévy. Para tal tarefa foi utilizada a metodologia da filosofia analítica da linguagem para distinguir os possíveis significados e sentidos que o termo virtual pode possuir. Na obra de 1995 o virtual é entendido então como potência, oposto ao atual, não ao real. Na obra de 1997 o virtual passa a ter ao menos três (...) sentidos: o comum, o filosófico e o tecnológico. Numa escala de virtualidade, estes sentidos se desdobram em cinco posições, sendo o mais forte a Realidade Virtual e o mais fraco o do Senso Comum. A análise mostrou que o sentido de virtual atribuído em 1995 perde poder explicativo na obra de 1997 por desconsiderar o processo de digitalização como fator fundamental para a geração de elementos virtuais. A conclusão é que o conceito de 1995 é tão amplo que se torna estéril quando se trata de explicar as novas tecnologias da informação e comunicação, por isso ele é relegado a penúltimo lugar na escala dos sentidos do virtual na obra de 1997. McKenna’s critique (rather than criticisms) of idealized approaches to epistemology is an important contribution to the literature. In this brief discussion, I set out his main concerns about more idealized approaches, within and beyond social epistemology, before turning to some issues I think he neglects. I suggest that it’s important to pay attention to the prestige hierarchy in philosophy, and to how that hierarchy can serve ideological purposes. The greater prestige of more abstract approaches plays a role in determining what (...) issues and what voices we attend to. (shrink)

In Marx’s posthumously published manuscripts from 1857–1863, we find a systematic exposition of his concept of subsumption. Though much has been written about it, significant interpretative gaps persist. In this article, I begin filling these gaps by examining the emergence of Marx’s concept of subsumption. I will argue that in the Grundrisse Marx brings together distinct but complementary elements from Hegel’s theories of judgment and teleology to coin two new and well delineated concepts of subsumption that prefigure his later concepts (...) of formal and real subsumption. These two concepts may be defined as: (a) the process of acquiring the social relational property of being a means to an end; (b) the process by which changes in non-relational properties occur in something due to this acquisition – and occur to better suit said end. Science and fiction seem to lie at opposite ends of the cognitive-epistemic spectrum. The former is typically seen as the study of hard, real-world facts in a rigorous manner. The latter is treated as an instrument of play and recreation, dealing in figments of the imagination. Initial appearances notwithstanding, several central features of scientific modeling in fact suggest a close connection with the imagination and recent philosophers have developed detailed accounts of models that treat them, in one way or another, (...) as akin to fictions. This chapter will critically discuss the fictions approach as an epistemology of scientific modeling. (shrink)

In this paper, I argue that Hume’s account of moral judgment is best understood if it is read in light of Hume’s explanatory project. I first lay out the textual support to show that Hume’s account of justice in the Treatise includes both approval of a motive that gives rise to the virtue of justice, and approval of a system of conduct, irrespective of a motive. I then argue that we can allow for such plurality in Hume’s theory of moral (...) judgment if we view it in light of his explanatory project: finding unifying causes for disparate phenomena. Hume offers a unified theory of moral judgment because he can show that the different approvals are explained by the same causes. Finally, I argue that viewing Hume’s account of moral judgment in light of his explanatory project allows us to appreciate a further distinction between the moral judgment of the natural and the artificial virtues: while judgments of the former are fully explained by the causes of a certain motive, the latter are only fully explained by the causes of the motive in the context of a convention, which in turn is partially constituted by non-approved motives. The external world sceptic tells some familiar narratives involving massive deception. Perhaps we are brains in vats. Perhaps we are the victim of a deceitful demon. You know the drill. The sceptic proceeds by observing first that victims of such deceptions know nothing about their external environment and that second, since we cannot rule out being a victim of such deceptions our- selves, our own external world beliefs fail to attain the status of knowledge. Discussions of global external world scepticism (...) tend to focus on the second step, where a number of well-known lines of resistance have been offered. But there has been little attention to the first, seemingly innocuous step. That will be the focus of this paper. Part one – sections 1, 2, and 3 – will explain why these standard narratives are not convincing examples of cases where there is no knowledge of the external world. In part two – section 4 – we shall undertake a useful case study. David Lewis’s ‘Elusive Knowledge’ is often thought of as presenting an epistemological vision that is somewhat friendly to external world scepticism: as Lewis himself presents things, there are contexts where external world knowledge ascriptions are uniformly false, and where true knowledge ascriptions are limited to either axiomatic truths or truths about our inner life. We examine his discussion in the light of the preceding reflections and show that the framework he presents is not so concessionary to global external world scepticism after all. (shrink)

Why is it that the study of Ethics is so unpopular? It is because there are so many systems of Ethics, and they are all in such hopeless contradiction. Why are there so many systems? Because each writer starts with his theory and then attempts to get the facts to agree with it. What is the remedy? The remedy, says Professor Levy-Bruhl, is to start with the practice. And what then? Then, he says, you find that the practice is (...) everything, that you need no theory, and that every ethical writer is in harmony with every other. 'Every ethical doctrine,' says Professor Levy-Bruhl, 'jealously defends the originality of its ethical principle against the objections of others, but it formulates the guiding rules of conduct, the concrete precepts of justice and charity, in the same terms as its rivals, whether its adherent is a disciple of Kant, a critical philosopher, a pessimist, a positivist, an evolutionist, a spiritualist, or a theologian.' The way out of the chaos of theoretical Ethics, then, is to deny its existence. There is no such science. The only science of Ethics is the practical. Its object of study is the conscience of man. Its rules and obligations are what the conscience reveals to experience. It takes Professor Levy-Bruhl half his book to get rid of theoretical ethics. Then, however, he is free, and he moves more rapidly in the discussion of Natural Ethics and Ethical Feeling. He ends with a chapter of Practical Results. -The Expository Times, Vol. 17. (shrink)

Hering’s opponent-colors theory suggests that our color sensations are produced by three mechanisms: a red–green mechanism, a yellow–blue mechanism, and a white–black mechanism. The first two mechanisms give rise to our sensations of hued colors; the third mechanism gives rise to our sensations of hueless colors. Noticeably, whereas the pair of colors produced by each of the hued mechanisms do not mix to yield a phenomenal intermediate (i.e., there are no greenish reds, reddish greens, yellowish blues, or bluish yellows), the (...) colors produced by the hueless mechanism, white and black, do have a phenomenal intermediate—gray. This different behavior of the white–black mechanism poses a problem for Hering’s theory. Several attempts to fix this problem have been suggested. This paper focuses on the suggestion made by Paul Heggelund a century after Hering proposed his theory. In Heggelund’s amendment of Hering’s theory, the hueless colors are not confined to the one-dimensional gamut between black and white, but rather require two components for their full description: a light–dark (or luminous–black) component, where light and dark are mutually exclusive sensations, and a white component, which doesn’t have an opponent counterpart. Here I show that although Heggelund’s theory indeed provides a solution to the problem that the hueless colors pose to Hering’s theory, it is not self-consistent. I go on to revise Heggelund’s theory to obtain a consistent opponent-colors theory. (shrink)

In this book, Tal S. Shamir sets out to identify cinema as a novel medium for philosophy and an important way of manifesting and developing philosophical thought. The volume presents a comprehensive analysis of the nature of philosophy's potential-or, more strongly put, its need-to be manifested cinematically. Drawing on the fields of cinema, philosophy, and media studies, Cinematic Philosophy adds film to the traditional list of ways through which philosophy can be created, concentrating on the unique potential of the cinematic (...) medium to effectively put forward and create philosophy. In the process, the book opens up innovative horizons for new types of knowledge and wisdom grounded in contemporary contexts and philosophical thought. Philosophy, best characterized as the love of wisdom, is not dependent on a specific medium nor solely situated within written text or oral lectures. Most theories and hypotheses in psychology are verbal in nature, yet their evaluation overwhelmingly relies on inferential statistical procedures. The validity of the move from qualitative to quantitative analysis depends on the verbal and statistical expressions of a hypothesis being closely aligned – that is, that the two must refer to roughly the same set of hypothetical observations. Here, I argue that many applications of statistical inference in psychology fail to meet this basic condition. Focusing on the most widely used (...) class of model in psychology – the linear mixed model – I explore the consequences of failing to statistically operationalize verbal hypotheses in a way that respects researchers' actual generalization intentions. I demonstrate that although the “random effect” formalism is used pervasively in psychology to model intersubject variability, few researchers accord the same treatment to other variables they clearly intend to generalize over. The under-specification of random effects imposes far stronger constraints on the generalizability of results than most researchers appreciate. Ignoring these constraints can dramatically inflate false-positive rates, and often leads researchers to draw sweeping verbal generalizations that lack a meaningful connection to the statistical quantities they are putatively based on. I argue that failure to take the alignment between verbal and statistical expressions seriously lies at the heart of many of psychology's ongoing problems, and conclude with a discussion of several potential avenues for improvement. To a large extent, the evidential base of claims in the philosophy of science has switched from thought experiments to case studies. We argue that abandoning thought experiments was a wrong turn, since they can effectively complement case studies. We make our argument via an analogy with the relationship between experiments and observations within science. Just as experiments and ‘natural’ observations can together evidence claims in science, each mitigating the downsides of the other, so too can thought experiments and case (...) studies be mutually supporting. After presenting the main argument, we look at potential concerns about thought experiments, suggesting that a judiciously applied mixed-methods approach can overcome them. (shrink)
