Prominent Kantian scholars, such as Korsgaard and Waldron, claim that the very existence of juridical-political institutions is sufficient to render laws authoritative. Critics argue that this view is unpersuasive as it requires subjects to obey grossly unjust laws. Here, I identify two problems facing scholars who reject the absolutist view of political authority proffered by Korsgaard and Waldron. First, when there is reasonable disagreement regarding a law’s legitimacy the Principle of Right generates contradictory obligations as it commands both (...) disobedience and compliance. In clarifying this problem, I argue that individuals must disobey illegitimate laws where this requirement is co-extensive with the duty to leave the state of nature. However, disobedience amounts to domination when individuals are subjected to private judgments regarding the conditions of freedom. The Principle of Right cannot overcome this impasse as it does not offer reasons in favor of compliance that are distinct from those reasons legitimating the law. To address this issue, I supplement Kant’s account with Joseph Raz’s ‘service conception’ of authority to show that compliance can be rendered compatible with the Principle of Right. A second problem emerges when laws are blatantly illegitimate such that obedience cannot be justified. In these cases, the Principle of Right cannot guide legislative reform in an intuitively appealing way as it fails to address considerations of proportionality. Though this latter problem is not resolved here, identifying it helps to further clarify the relationship between Kant’s moral and political principles. (shrink)

Using the Yanomami controversy—one of anthropology's most famous and explosive imbroglios—as its starting point, this book draws readers into not only reflecting on but refashioning the very heart and soul of the discipline. It is both the most up-to-date and thorough public discussion of the Yanomami controversy available and an innovative and searching assessment of (...) the current state of anthropology. The Yanomami controversy came to public attention through the publication of Patrick Tierney's best-selling book, _Darkness in El Dorado,_ in which he accuses James Neel, a prominent geneticist who belonged to the National Academy of Sciences, as well as Napoleon Chagnon, whose introductory text on the Yanomami is perhaps the best-selling anthropological monograph of all time, of serious human rights violations. This book identifies the ethical dilemmas of the controversy and raises deeper, structural questions about the discipline. A portion of the book is devoted to a unique roundtable in which important scholars on different sides of the issues debate back and forth with each other. This format draws readers into deciding, for themselves, where they stand on the controversy’s—and many of anthropology’s—central concerns. Both courts of law and political theorists have grappled with the problem of giving the concept of ‘need’ a place in our reasoning about the rights and wrongs of property regimes. But in the U.K., legal changes in the last fifteen years have eroded the legal possibilities for striking some compromise between the claims of the needy and the rights of property owners. Against this backdrop this article compares three theoretical accounts of how the fact of human need should impact (...) upon our thinking about property rights: the rights-based arguments of Jeremy Waldron, the radical democratic theory of Lawrence Hamilton and the anarchist commentary of Colin Ward. While ‘theories’ of need have paid much attention to the nature of need ‘itself’, the article argues that this comparison reveals another issue that is just as important: where and how should claims of need be registered in legal and political processes? In September 2000, the self-styled “anthropological journalist” Patrick Tierney began to make public his work claiming that the Yanomamö people of South America had been actively—indeed brutally—harmed by the sociobiological anthropologist Napoleon Chagnon and the geneticist-physician James Neel. Following a florid summary of Tierney’s claims by the anthropologists Terence Turner and Leslie Sponsel, the American Anthropological Association (AAA) saw fit to take Tierney’s claims seriously by conducting a major investigation into the matter. This paper focuses on the AAA’s (...) problematic actions in this case but also provides previously unpublished information on Tierney’s falsehoods. The work presented is based on a year of research by a historian of medicine and science. The author intends the work to function as a cautionary tale to scholarly associations, which have the challenging duty of protecting scholarship and scholars from baseless and sensationalistic charges in the era of the Internet and twenty-four-hour news cycles. Language agents are AI systems that combine large language models with other elements to facilitate interaction with an environment. They include LLM-based chatbots but can have a wide range of additional features to support learning, reasoning and decision-making. Goldstein and Kirk-Giannini. Citationm.s. [AI wellbeing] argue that some language agents have beliefs and desires, but it is not obvious that they are agents at all, since they select outputs by querying language models. This paper investigates agency and desires in language agents.

ABSTRACT This article addresses two related questions about belief, inquiry, and persuasion. The first is a question about the nature of epistemic paternalism, which is, roughly, the activity of interfering in other people’s inquiry, for their own epistemic benefit. The second question is about rational persuasion, and whether it can ever be paternalistic, or (better) whether it can be disrespectful and prima facie wrong in the same way that at least some cases of paternalism are disrespectful and prima facie wrong. (...) The article argues that if rational persuasion is paternalistic, it is epistemically paternalistic. It then considers how best to characterize epistemic paternalism and answers a challenge to its justifiability. Finally, the article responds to George Tsai’s view that rational persuasion can be problematically paternalistic, arguing that Tsai’s central case falls short of the ideal of rational persuasion. During the academic years 1972-1973 and 1973-1974, an intensive sem inar on the foundations of quantum mechanics met at Stanford on a regular basis. The extensive exploration of ideas in the seminar led to the org~ization of a double issue of Synthese concerned with the foundations of quantum mechanics, especially with the role of logic and probability in quantum meChanics. About half of the articles in the volume grew out of this seminar. The remaining articles have been so licited explicitly (...) from individuals who are actively working in the foun dations of quantum mechanics. Seventeen of the twenty-one articles appeared in Volume 29 of Syn these. Four additional articles and a bibliography on -the history and philosophy of quantum mechanics have been added to the present volume. In particular, the articles by Bub, Demopoulos, and Lande, as well as the second article by Zanotti and myself, appear for the first time in the present volume. The past thirty years have seen a surge of empirical research into political decision making and the influence of framing effects — the phenomenon that occurs when different but equivalent presentations of a decision problem elicit different judgments or preferences. During the same period, political philosophers have become increasingly interested in democratic theory, particularly in deliberative theories of democracy. Unfortunately, the empirical and philosophical studies of democracy have largely proceeded in isolation from each other. As a result, philosophical treatments of (...) democracy have overlooked recent developments in psychology, while the empirical study of framing effects has ignored much contemporary work in political philosophy. In Framing Democracy, Jamie Terence Kelly bridges this divide by explaining the relevance of framing effects for normative theories of democracy. -/- Employing a behavioral approach, Kelly argues for rejecting the rational actor model of decision making and replacing it with an understanding of choice imported from psychology and social science. Innovative therapy is the name we give to novel medical interventions, radically different from the standard of care, provided in order to benefit a patient, rather than to acquire new knowledge. They are paradigmshifting, not incremental, responses to serious patient problems that standard medical care inadequately addresses. Innovative therapies are often devised by clinicians, not basic science researchers; they do not follow the linear model of basic research, to translation, to clinical research, to application. Instead, they come from thinking backwards (...) from the patient’s circumstances, and forward from deep knowledge of how the body functions, to challenge the limits of current mechanisms for effecting cures. Does science successfully uncover the deep structure of the natural world? Or are the depths forever beyond our epistemic grasp? Since the decline of logical positivism and logical empiricism, scientific realism has become the consensus view: of course our scientific theories apprehend the deep structure of the world. What else could explain the remarkable success of science? This is the explanationist defense of scientific realism, the “ultimate argument.” Kyle Stanford starts here and, using the history of theorizing about biological inheritance (...) as his case study, constructs a convincing argument against the realist consensus in his thought provoking book, Exceeding Our Grasp.1 Here I will review the core of Stanford’s new argument for instrumentalism (§ 1) and discuss his considered view of theoretical science (§ 2). In this paper, I offer a theory of substance. There are three steps in the argument. First, I present and explain my definition of substance. Second, I argue that the definition yields the right results: that is, my definition rules that (among other things) events and universals, privations and piles of trash, are not substances, but at least some ordinary physical objects are. Third, I defend the definition by rebutting two obvious objections to it.

The well-known classification of legal procedure into “four feet” presents certain conceptual problems for the Indian legal tradition that various Smṛtikāras and commentators have attempted to resolve in different and sometimes contradictory ways. These difficulties arise because the four feet originally referred in Indian legal theory to four distinct, hierarchical legal domains rather than procedural means for reaching a verdict. The earliest attested discussion of the four feet, found in Kauṭilya’s Arthaśāstra, indicates that early legal theorists understood the greater legal (...) order as being comprised of four hierarchical domains and that these domains were ordered by the state as expressed in the original formulation of the four feet. Among the four legal domains, that of vyavahāra was developed by the state itself as a realm of public, transactional law meant to address disputes that could not be resolved in other legal forums. From this we can conclude that the origin of Indian jurisprudence lies with state efforts to formalize and enforce the laws of public transactions. The reinterpretation of the four feet by later jurists was motivated perhaps by resistance to one of the fundamental relationships expressed in the four feet, namely that royal authority possessed the greatest legal authority, independent of Brāhmaṇical law. After defining nanotechnology and briefly discussing its status as a discipline, about which there exists a meta-controversy, this introduction turns to a discussion of the status of nanoethics and lays out particular issues of concern in the field, both current and emerging.

Thomas & Karmiloff- Smith raise the excellent and, in retrospect, obvious point that in a dynamic learning environment where feedback is possible, we should expect networks to adapt to damage by altering details of their behavior. We should therefore not expect that developmental disorders should result in “normal” modules. The implications of this point go much further, since interprocess dependency in the brain does not rely only on learned neural connections. This argues strongly against behavioral and process-related definitions, as opposed (...) to structural and architecture-related definitions, of mental modularity. (shrink)

The distinction between “passive” and “active” euthanasia, though problematic and highly criticized, retains a certain intuitive appeal. When a patient is allowed to die, nature appears simply to be taking its course. Yet when a patient is killed by, say, a lethal injection, humans appear to be causing his or her death. Guilt seems to follow naturally from the latter act while not from the former. Yet this view only holds up if age‐old and vague ideasabout “nature” and “artifice” go (...) unscrutinized. Once examined more closely the functional relevance of particular machines to particular bodies becomes evident. And the innocence and guilt less clear. (shrink)

The distinction between distributive and non-distributive profiles figures prominently in current evaluations of the ethical and epistemological risks that are associated with automated profiling practices. The diagnosis that non-distributive profiles may coincidentally situate an individual in the wrong category is often perceived as the central shortcoming of such profiles. According to this diagnosis, most risks can be retraced to the use of non-universal generalisations and various other statistical associations. This article develops a top-down analysis of non-distributive profiles in which this (...) fallibility of non-distributive profiles is no longer central. Instead, it focuses on how profiling creates various asymmetries between an individual data-subject and a profiler. The emergence of informational, interest, and perspectival asymmetries between data-subject and profiler explains how non-distributive profiles weaken the epistemic position of a profiled individual. This alternative analysis provides a more balanced assessment of the epistemic risks associated with non-distributive profiles. (shrink)

Albert Einstein's attitude towards quantum mechanics—and statistical physics in general—was a puzzle to many of his contemporaries, and has remained a puzzle to the present. Though he made many significant contributions to statistical physics, he continually refused to regard that branch of science as fundamental. The present essay demonstrates that his attitude towards statistical physics was formed during his earliest investigations—between 1901 and 1903. In particular, it is shown that in Einstein's view, statistical laws are based upon non-statistical assumptions. This (...) view influenced much of his later thinking. Researchers in the fields of sign language and gesture studies frequently present their participants with video stimuli showing actors performing linguistic signs or co-speech gestures. Up to now, such video stimuli have been mostly controlled only for some of the technical aspects of the video material, leaving open the possibility that systematic differences in video stimulus materials may be concealed in the actual motion properties of the actor’s movements. Computer vision methods such as OpenPose enable the fitting of body-pose models (...) to the consecutive frames of a video clip and thereby make it possible to recover the movements performed by the actor in a particular video clip without the use of a point-based or markerless motion-tracking system during recording. The OpenPoseR package provides a straightforward and reproducible way of working with these body-pose model data extracted from video clips using OpenPose, allowing researchers in the fields of sign language and gesture studies to quantify the amount of motion pertaining only to the movements performed by the actor in a video clip. These quantitative measures can be used for controlling differences in the movements of an actor in stimulus video clips or, for example, between different conditions of an experiment. In addition, the package also provides a set of functions for generating plots for data visualization, as well as an easy-to-use way of automatically extracting metadata from large sets of video files. PresentationThis article is the first English translation of French scholar Patrick Wotling’s extensive research on Nietzsche. In order to understand Nietzsche’s work, Patrick Wotling follows closely Nietzsche’s well-known injunction to his readers: “learn to read me well!” Hence, he seeks to do a close reading of Nietzsche’s texts, which often resemble a seemingly random juxtaposition of ideas, looking for signs that allow the reader to follow Nietzsche’s thought and weave together a correct interpretation. In so doing it is (...) imperative to reject any reading based on an interpretive framework that is not found in the text itself. This approach is tied to the specificity of Nietzsche’s work in that unlike philosophers before him, he does not hold the pursuit of truth to be the genuine goal of philosophy, and therefore does not write traditional systematic treatises. It is thus necessary to use this close reading approach to reveal the new patterns of thought that Nietzsche uses in place of traditional logical frameworks. Using this method, P. Wotling contends that Nietzsche’s thinking is organized along two tightly bound lines: on the one hand there is a genealogical inquiry, which consists of identifying and evaluating the value of values, and on the other hand there is a concern for the cultivation, or breeding of human life, which aims at putting in place certain values with the goal of elevating humanity and creating human flourishing. The second goal implies the first, meaning that before knowing what values should be instituted, it is necessary to establish the hierarchy of values, in order to identify which ones are the most useful for the cultivation and enrichment of humanity.What are Nietzsche’s reasons for criticizing truth? How far does such criticism extend, and how does Nietzsche understand the consequences of his position as regards the philosophical praxis? The discovery of a radical opposition between truth and thought shows that being irrefutable cannot be assimilated to being true, and, at the same time, that truth is interpretation. On closer scrutiny, it appears to be not an essence, but a value, that is to say a type of error that has become essential for the continuation of our life, linked to a long process of physical-psychological absorption, and now productive of a deceptive feeling of necessity. As a consequence, philosophy cannot be equated with the pursuit of truth any longer: first, because, as a free spirit, the genuine philosopher is to be thought of as a lover of riddles, shaped on Epicurus’ pattern rather than on Plato’s; and more importantly, because the philosopher’s real aim is to investigate the value of all particular values for the development of human life, and, in accordance, to create and impose new “truths.”.
