At first glance, freedom and coercion, or constraint, appear to be clearcut oppositions. However, in many contexts we find that the two are closely interwoven. Freedom and coercion then rather resemble a continuum: Without notice, elements of freedom resurface as forces of - or preconditions for - constraint and vice versa. The trans-jurisdictional discourse on criminal justice is often hampered by mutual misunderstandings. The translation of legal concepts from English into other languages and vice versa is subject to ambiguity and potential error: the same term may assume different meanings in different legal contexts. More importantly, legal systems may choose differing theoretical or policy approaches to resolving the same issues, which sometimes – but not always – lead to similar outcomes. Eine interdisziplinäre Verständigung über Kultur ist fällig und notwendig, um dem gegenwärtig weit verbreiteten Eindruck entgegenzuwirken, „Kultur“ habe sich als semantisches Irrlicht und als obsolet gewordener Gegenstand von Forschung erwiesen, weil der Begriff unüberschaubare wie unvereinbare Bedeutungsmomente bündele und aus einem bloßen Gespinst von Mehrdeutigkeiten bestehe. Demgegenüber wird in diesem Buch die Überzeugung vertreten, dass es gewinnbringend ist, die spezifischen Kompetenzen aus der Kultursoziologie und Populärkulturforschung, aus der Theorie des Kulturmanagements und der Medienkultur sowie aus der Kulturphilosophie zusammenzubringen, um zu (...) zeigen, dass es trotz und gleichsam unterhalb der notorischen Vieldeutigkeit des Wortes „Kultur“ einen gemeinsamen Sachzusammenhang namens Kultur gibt, von dem die einzelnen Fachdisziplinen jeweils bestimmte Faktoren in den Blick nehmen und kraft ihrer eigenen Methoden erhellen. The goal is to present how shared decision-making in paediatric oncology occurs from the viewpoints of parents and physicians. Eight Swiss Pediatric Oncology Group centres participated in this prospective study. The sample comprised a parent and physician of the minor patient. Surveys were statistically analysed by comparing physicians’ and parents’ perspectives and by evaluating factors associated with children’s actual involvement. Perspectives of ninety-one parents and twenty physicians were obtained for 151 children. Results indicate that for six aspects of information provision (...) examined, parents’ and physicians’ perceptions differed. Moreover, parents felt that the children were more competent to understand diagnosis and prognosis, assessed the disease of the children as worse, and reported higher satisfaction with decision-making on the part of the children. A patient’s age and gender predicted involvement. Older children and girls were more likely to be involved. In the decision-making process, parents held a less active role than they actually wanted. Physicians should take measures to ensure that provided information is understood correctly. Furthermore, they should work towards creating awareness for systematic differences between parents and physicians with respect to the perception of the child, the disease, and shared decision-making. CASUS is an authoring system, which should enable physicians to produce problem-based computer learning programs with minimal technical effort and give them sound instructional support. The theoretical background of CASUS are constructivist approaches to learning and instruction, which deal mainly with the question, how to design problem-based learning environments. The paper presents the constructivist concept of CASUS and results of a forma-tive evaluation. Four authors were observed and interviewed while developing a learning case with CASUS. The evaluation pursued mainly the (...) question of which difficulties arise while producing a case with CASUS and which measures are necessary in order to improve the authoring system. Results show that with regard to technical aspects physicians can produce learning cases even without any special prior knowledge. There were far more problems with instructional aspects of the production of cases. Most of these difficulties were very specific to the content of the cases. Therefore, it seems that an appropriate way to design learning cases with high quality, is a cooperation between some authors with different expertise. (shrink)

Die sog. "Schwarzen Hefte" haben umfassender und deutlicher als je zuvor die Verbindungen zwischen Philosophie und Politik bei Heidegger sichtbar werden lassen und damit eine neue Debatte uber den Rang dieses Denkens entfacht. DEnn die dort enthaltenen Texte demonstrieren, dass Philosophie, Metapolitik und Politik bei Heidegger eine Einheit bilden, zu der die Befurwortung des Nationalsozialismus und der Antisemitismus gehoren. INs Zentrum der kritischen Revision ruckt das erste Hauptwerk von 1927, "Sein und Zeit", das nahezu unangefochten als epochaler Beitrag zur Philosophie (...) des 20. JAhrhunderts gilt. DIe "Schwarzen Hefte" fordern eine "Destruktion" dieses Werks auch insofern heraus, als die dort prasentierten Selbstinterpretationen das philosophische Profil dieses Denkens scharfen und neue Gesichtspunkte fur die Diskussion seiner Substanz im philosophischen und ideologischen Kontext des 20. JAhrhunderts eroffnen. 90 Jahre nach seinem Erscheinen stellt sich der philosophischen Forschung die kritische Auseinandersetzung mit "Sein und Zeit" als unabweisbare Aufgabe. IM Vordergrund stehen hierbei zwei Fragen: Wie ist das Unternehmen einer in der "Fundamentalontologie" des Daseins begrundeten temporalen Ontologie der systematischen Intention und Durchfuhrung fachphilosophisch zu beurteilen? In Thomas Thomson's System of chemistry of 1802 Bergman and Scheele are actually considered as creators of the analytical concept of an element. With regard to this, a detailed investigation of the work of Bergman and Scheele shows that Thomson's statement contains mistakes as well as inadmissable simplifications and generalizations. It is correct, however, that Bergman in 1774–1777 specifically anticipated in essential aspects the analytical element concept proposed by Lavoisier in 1787–1789.

The last kilometers of the Berlin Wall were finally torn down during this last week before Christmas, but mentally, socially, economically it continues to exist, and for some in what used to be East Berlin it isn’t so clear anymore whether the actual wall made of concrete wasn’t easier to bear. To be sure, the wall that once separated the largest cities in each of the two Germanys is still present as a scar of empty space; but distances have shrunk, (...) and old views of the city have been reestablished—at least geographically, Berlin, no doubt, is slowly becoming one again. However, the social and economic differences as well as the mental walls erected in forty years of separate existence still divide the eastern from the western part. Now that the euphoria of unification has finally subsided, gains and losses are being counted, and many East Germans are beginning to ask themselves whether the price they paid for political freedom was not too high after all. The moral and economic bankruptcy of the old regime daily becomes more apparent: its structures of corruption and repression, its system of total surveillance that had become a part of everyday life and made use of even those whom the state had marginalized. And yet that system, corrupt as it was, had also provided a measure of stability, a predictable life that, although it had restricted individual choice, can now evoke nostalgic memories of warmth and security. Heinz Ickstadt is professor of American literature at the John F. Kennedy Institute for North American Studies at the Free University in Berlin. He has written and edited books on Hart Crane, Thomas Pynchon, and the 1930s, and has published widely on American literature and culture in the late nineteenth century, American modernism, postmodern fiction, and on the relation of literature and painting. Religious experience can acquire plausibility within a religious tradition not only because of its "immediate giveness" but also through its objective validity and relevance. In medieval theology the doctrine of spiritual senses (sensus spiritualesj was an important locus for discussing the veracity of religious experience. The following paper examines the discourse of mystic experience in Fourteenth Century England and its historical background on the basis of the doctrine of spiritual senses - with the voices of Bonaventure, Richard Rolle, Margery Kempe, (...) Walter Hilton, Thomas Basset and the author of the Cloud of Unknowing. The theological position of the anonymous Cloud-author is of particular interest. This article suggests that the Cloud-author diagnoses a naive "mysticism experienced" as the underlying principle of some works of religious instruction. Hence the anonymous author antagonizes this experientialism with a critical epistemology, limiting the "sensational field" of mystic experience to a rather naked "cognitive nucleus". /// A experiência religiosa pode adquirir plausibilidade dentro de uma tradição religiosa não apenas por causa da sua facticidade imediata, mas também através da sua validade objectiva e relevância. Na teologia medieval, a doutrina dos sentidos espirituais (sensus spirituales) constituía um lugar importante para a discussão da veracidade da experiência religiosa. O presente artigo analisa o discurso acerca da experiência mística na Inglaterra do século XIV bem como o seu contexto histórico com base na doutrina dos sentidos espirituais, dando espaço às vozes de S. Boaventura, Richard Rolle, Margery Kempe, Walter Hilton, Thomas Basset e o autor da obra Cloud of Unknowing. Mostra-se por que razão a posição teológica do autor anónimo da Cloud of Unknowing é particularmente interessante. O artigo sugere que o autor desta importante obra diagnostica como naive o experiencialismo místico considerado como basilar a algumas obras de instrução religiosa. Daí que o autor anónimo antagonize este experiencialismo com base numa epistemologia crítica, limitando o "campo sensacional" da experiência mística a um simples "núcleo cognitivo". (shrink)

GILBERT JEAN FACCARELLO (Paris, 1950) is professor of economics at Université Panthéon-Assas, Paris, and a member of the Triangle research centre (École Normale Supérieure de Lyon and CNRS). He is presently chair of the ESHET Council (European Society for the History of Economic Thought). He completed his doctoral research in economics at Université de Paris X Nanterre. He has previously taught at the Université de Paris-Dauphine, Université du Maine and École Normale Supérieure de Fontenay/Saint-Cloud (now École Normale Supérieure de Lyon). (...) Als in der spätscholastischen Epoche der philosophische Ausdruck sich von der streng theologischen und religiösen Exegese entfernt und einer genuin humanen Selbstvertretung annähert, ist Ockham am ehesten und im Grunde allein erfolgreich in der Formulierung eines rationalen Formativs, worin der Mensch zur Gegenstellung gegen die göttliche Person, ihre Intellektion und Willenshaltung und die offenbarte Wahrheit gelangt. Er erweist sich als brillant und virtuos in der Handhabung von Induktion, persuasio und Reprobation, d.h. im Prinzip: der Widerlegung fremder Meinungen. Er ist weniger (...) erfolgreich bei der direkten Fixierung der Fehlgriffe anderer Scholastiker, wenn sie methodisch nicht ausgewiesenen Lösungen zuneigen, worin jede Problematik unterlaufen wird. Ockham hat da, ausser bei Duns Scotus, auch keine aristotelische Expertise mehr zur Verfügung. Das verweist darauf, dass neuzeitliche wissenschaftliche Antworten gefordert waren, die mit der scholastischen Einstellung nichts mehr gemein hatten. Das war in der mittelalterlichen Epoche aber nicht verhandelbar. Ebenso konnten Ockhams Abgrenzungsversuche nicht verstanden werden. Schon die Bestrebungen, Scholastiker umstandslos vor kirchliche Strafgerichte zu ziehen, offenbaren die Erschöpfung des Zeitalters"-- Back cover. (shrink)

Thomas Reid was a philosopher who founded the Scottish school of 'common sense'. Much of Reid's work is a critique of his contemporary, David Hume, whose empiricism he rejects. In this work, written after Reid's appointment to a professorship at the university of Glasgow, and published in 1785, he turns his attention to ideas about perception, memory, conception, abstraction, judgement, reasoning and taste. He examines the work of his predecessors and contemporaries, arguing that 'when we find philosophers maintaining that there (...) is no heat in the fire, nor colour in the rainbow … we may be apt to think the whole to be only a dream of fanciful men, who have entangled themselves in cobwebs spun out of their own brain'. Die hundertste Wiederkehr des Geburtstages Max Schelers war im Jahre 1974 der Anlaß zu zahlreichen Gelegenheitsveröffentlichungen, die jedoch wahrscheinlich lediglich als ein kurzes Auffiammen des Interesses an der Philosophie dieses Denkers eingeschätzt werden dürfen. Sowohl die Reichhaltigkeit wie die Vielseitigkeit seines Werkes dürfte der vornehmlichste Grund für die Tatsache sein, daß nur wenige Denker und um Darstellung bzw. Interpretation bemühte Forscher sich ein gehend und umfassend mit Schelers Philosophie befaßt haben. Hinzu kommt die Unvollendetheit dieses Schaffens, die einerseits auf seinen (...) frühen Tod zurückzuführen ist, die andererseits aber wesentlich in der Eigenart seines Philosophierens verankert ist. Es besteht jedoch die berechtigte Hoffnung, daß die Herausgabe des unveröffentlichten Nach lasses diese Unvollendetheit zwar nicht aufheben, sie aber in ihren Grenzen präziser als bisher möglich umreißen wird, und dies insbeson dere in bezug auf die von ihm geplante Metaphysik und Anthropologie. Vorliegender Arbeit lag der Versuch zugrunde, zwei der wesentlich sten Grundpfeiler dieser Philosophie freizulegen und somit zur Ausar beitung der diesem Denken "noch fehlenden architektonischen Ordnung" beizutragen. Abgesehen von einigen geringfügigen Änderungen für den Druck wurde diese Arbeit im Juni 1974 von der Philosophischen Fakultät der Universite Catholique de Louvain als Doktoratsthese angenommen.
