In 2010, the Venter lab announced that it had created the first bacterium with an entirely synthetic genome. This was reported to be the first instance of ‘artificial life,’ and in the ethical and policy discussions that followed it was widely assumed that the creation of artificial life is in itself morally significant. We cast doubt on this assumption. First we offer an account of the creation of artificial life that distinguishes this from the derivation of organisms from existing life (...) and clarify what we mean in asking whether the creation of artificial life has moral significance. We then articulate and evaluate three attempts to establish that the creation of artificial life is morally significant. These appeal to the claim that the creation of artificial life involves playing God, as expressed in three distinct formulations; the claim that the creation of artificial life will encourage reductionist attitudes toward the living world that undermine the special moral value accorded to life; and the worry that artificial organisms will have an uncertain functional status and consequently an uncertain moral status. We argue that all three attempts to ground the moral significance of the creation of artificial life fail, because none of them establishes that the creation of artificial life is morally problematic in a way that the derivation of organisms from existing life forms is not. We conclude that the decisive moral consideration is not how life is created but what non-genealogical properties it possesses. (shrink)

This is a book that contrary to common practice, shows the commonalities of ancient and modern theories of freedom, law, and rational actions. Studying the works of the ancients is necessary to understanding those that follow. Thomas Chaimowicz challenges current trends in research on antiquity in his examination of Montesquieu's and Burk's path of inquiry. He focuses on ideas of balance and freedom. Montesquieu and Burke believe that freedom and balance are closely connected, for without balance within a state (...) there can be no freedom. When Montesquieu speaks of republics, he means those of antiquity as they were understood in the eighteenth century. In this view, freedom can develop only within the framework of established tradition. Edmund Burke's greatest service to political thought may lie in making use of this idea when he fought against the abstractions of the French Revolutionaries. Antiquity as the Source of Modernity examines Montesquieu's "Roman mind," meaning not an attitude influenced by the ancients, but one primarily influenced by Roman heritage. It speaks to the antithesis of monarchy and despotism in Montesquieu's thought and the influence of Tacitus and Pliny the Younger on him. The separation of powers and its relation to the concept of the mixed constitution as well as Montesquieu's smaller masterpiece Considerations on the Causes of the Grandeur and Decadence of the Romans are examined in detail. Finally, the discussion leads seamlessly to Burke, who, as a critical admirer of Montesquieu, partly incorporated his interpretation of the English constitution into his own thinking threatened by teachings of the French Revolution and its British adherents. The central idea of Antiquity as the Source of Modernity is timeless. It is that the ancient past can lead to a clearer understanding of what follows. This perspective represents a reversal of the conventional procedures for conducting this kind of research, but it is a reversal that Chaimowicz embraces in order to add a new dimension to the study and impetration of both Montesquieu and Burke. Thomas Chaimowicz was a distinguished visiting professor at the International Academy of Philosophy in the Principality of Liechtenstein and honorary professor of Roman Lay at the University of Salzburg. Because many of Aquinas’s most distinctive philosophical claims are embedded in theological works, in order to see what his philosophy comes to it is necessary to do a great deal of extracting and reconstructing. A major school of interpretation, however, cautions that such efforts are misguided, since Aquinas’ philosophy and theology are inextricably bound together. We respond that some versions of this inseparability thesis are too strong to be true and the remainder too weak to stand in the way of (...) renewed efforts to identify Aquinas’ pure philosophical systems. Nonetheless, a good deal is to be learned about Aquinas (and about other religious philosophers) by pondering the inseparablist challenge to rational reconstruction. (shrink)

Vulnerability acts as a touchstone in this issue as we find our contributors reflecting on its intersection with gender and sexuality in different ways. Saeidzadeh draws out the significance of misrecognition in her consideration of responses to transsexuality in Iran, while Doonan highlights the potential pitfalls of relying on situational vulnerability in her critique of anti-trafficking legal discourse in the US. Lindsey considers the legal potential of situational vulnerability as a tool to address the ‘persistent failure to take action against (...) abuse’ in the UK. Durojaye and Oluduro contribute to the recent revitalisation in asking ‘the woman question’ by drawing on African law and literature to flesh out the development of a gender-sensitive, substantive equality approach from the jurisprudence of the African Commission on Human and Peoples’ Rights as it addresses vulnerability to violence. The reviewers continue this international conversation as they address recent contributions on sexuality, family formation and social security. (shrink)

Similar to parasites, malignant cells exploit the host for energy, resources and protection, thereby impairing host health and fitness. Although cancer is widespread in the animal kingdom, its impact on life history traits and strategies have rarely been documented. Devil facial tumour disease, a transmissible cancer, afflicting Tasmanian devils, provides an ideal model system to monitor the impact of cancer on host life-history, and to elucidate the evolutionary arms-race between malignant cells and their hosts. Here we provide an overview of (...) parasite-induced host life history adaptations, then both phenotypic plasticity of LH responses and changes in allele frequencies that affect LH traits of Tasmanian devils in response to DFTD are discussed. We conclude that akin to parasites, cancer can directly and indirectly affect devil LH traits and trigger host evolutionary responses. Consequently, it is important to consider oncogenic processes as a selective force in wildlife. Exposure to transmissible cancer cells, i.e., Tasmanian devil facial tumour cells, can cause changes to life history traits either as the result of phenotypic plasticity in response to exposure during the lifetime of the individual or as the result of evolutionary change in LH traits due to selection over generations.Photo credits: Frédéric Thomas, Sarah Peck, Geordie Jennings. The contributors to this issue focus on legal internationalism, including hybrid mixes with nationalist forms. They have provoked us as editors to think more about these sites and forms of engagement. Sankey shows how civic participation in the ECCC has played a key role in surfacing the gendered harms of separation and starvation. Turan highlights the problems with ICC exclusion of the experience of men and boys from sexual violence. Peroni expresses her hesitations over the Istanbul Convention given an association (...) between assumed vulnerability and migrant women, while admiring its uncoupling of violence and culture. Cruz’s interview with Wendy Brown contextualizes and expands on these themes as they consider, with other participants, the future of feminist theory in the context of neo-liberal capturing of rights and legal space. Thinking more about internationalism and commitment in this context also helps us hold a mirror up to ourselves as we reflect more critically on our own naming of FLS as an ‘international’ journal. Together these contributions, and the reviews of new work, play a role in fleshing out an editorial commitment to enacting the journal as a living thing that ‘hangs together somehow’ even as it is known differently in different places. Since the last issue of Feminist Legal Studies, we editorial board members have had lots of conversations about comfort, displacement and alienation. As we developed the programme for #FLaK2016 we thought about it as a kind of pulling ourselves out of our comfort zone, if academic events and journals ever have a comfort zone. Drawing on a mix of feminist live performance methods and a science and technology studies-type curiosity for objects of experimentation, we tried out a kitchen table method (...) of hosting a live research conversation with activists, artists and academics over two days. But we had not fully anticipated the way that the Brexit result would contribute to and complicate discomfort. A fuller analysis of FLaK awaits a later moment, but here we pick out this one aspect of our gathering—feelings of discomfort – as they animate the contributions to this issue in interesting ways. The central thesis of this paper is that the scope and structure of Hume's Treatise of Human Nature is modelled, or planned, after that of Hobbes's The Elements of Law and that in this respect there exists an important and unique relationship between these works. This relationship is of some importance for at least two reasons. First, it is indicative of the fundamental similarity between Hobbes's and Hume's project of the study of man. Second, and what is more important, by (...) recognizing this relationship between Hume's and Hobbes's works we can come to appreciate the unity of the project of the Treatise itself. My discussion will proceed in three stages. In section I present the evidence for my central thesis. In the second section I shall consider why Hume does not, as one might expect, acknowledge this important debt to Hobbes in the Introduction to the Treatise or in the Abstract. Finally, in the third section I shall note a few points of some importance to the understanding of Hume's philosophy which this relationship between Hobbes's and Hume's work touches upon. (shrink)

Picking up the question of what FLaK might be, this editorial considers the relationship between openness and closure in feminist legal studies. How do we draw on feminist struggles for openness in common resources, from security to knowledge, as we inhabit a compromised space in commercial publishing? We think about this first in relation to the content of this issue: on image-based abuse continuums, asylum struggles, trials of protestors, customary justice, and not-so-timely reparations. Our thoughts take us through the different (...) ways that openness and closure work in struggles against violence, cruel welcomes, and re-arrangements of code and custom. Secondly, we share some reflections on methodological openness and closure as the roundtable conversation on asylum, and the interview with Riles, remind us of #FLaK2016 and its method of scattering sources as we think about how best to mix knowledges. Thirdly, prompted by the FLaK kitchen table conversations on openness, publishing and ‘getting the word out’, we respond to Kember’s call to ‘open up open access’. We explain the different current arrangements for opening up FLS content and how green open access, the sharedit initiative, author request and publisher discretion present alternatives to gold open access. Finally drawing on Franklin and Spade, we show how there are a range of ‘wench tactics’—adapting gifts, stalling and resting—which we deploy as academic editors who are trying to have an impact on the access, use and circulation of our journal, even though we do not own the journal we edit. These wench tactics are alternatives to the more obvious or reported tactic of resignation, or withdrawing academic labour from editing and reviewing altogether. They help us think about brewing editorial time, what ambivalence over our 25th birthday might mean, and how to inhabit painful places. In this, we respond in our own impure, compromised way to da Silva’s call not to forget the native and slave as we do FLaK, and repurpose shrapnel, in our common commitments. (shrink)

This article examines the free will problem as it arises within Thomas Hobbes' naturalistic science of morals in early modern Europe. It explains that during this period, the problem of moral and legal responsibility became acute as mechanical philosophy was extended to human psychology and as a result human choices were explained in terms of desires and preferences rather than being represented as acts of an autonomous faculty. It describes how Hobbes changed the face of moral philosophy, through his (...) Leviathan, in ways that still structure and resonate within the contemporary debate. (shrink)

FREE WILL. The problem of "free will" has generally been interpreted in modern times in terms of the question of whether or not moral freedom and responsibility are compatible with causality and determinism. Philosophers in the empiricist tradition have defended, with remarkable consistency, a compatibilist position on this issue. Moreover, most of the major figures of the empiricist tradition (i.e. Hobbes, Locke, Hume, Mill, Schlick, and Ayer) are understood to have endorsed and contributed to a single, unified strategy on this (...) subject. The position that these philosophers developed reflects, in large measure, the "antimetaphysical" and naturalistic orientation of empiricist philosophy.... -/- . (shrink)

Principles of procreative beneficence (PPBs) hold that parents have good reasons to select the child with the best life prospects. Sparrow (2010) claims that PPBs imply that we should select only female children, unlesswe attach normative significance to “normal” human capacities. We argue that this claim fails on both empirical and logical grounds. Empirically, Sparrow’s argument for greater female wellbeing rests on a selective reading of the evidence and the incorrect assumption that an advantage for females would persist even when (...) a serious gender imbalance is obtained. Logically, PPBs cite only pro tanto reasons and allow that the good of an individual child could be outweighed by other morally relevant considerations, such as those which take collectively suboptimal outcomes into account. There is thus no need to attach value to the “normal.”. (shrink)

This paper presents a new approach to the class-theoretic paradoxes. In the first part of the paper, I will distinguish classes from sets, describe the function of class talk, and present several reasons for postulating type-free classes. This involves applications to the problem of unrestricted quantification, reduction of properties, natural language semantics, and the epistemology of mathematics. In the second part of the paper, I will present some axioms for type-free classes. My approach is loosely based on the Gödel–Russell (...) idea of limited ranges of significance. It is shown how to derive the second-order Dedekind–Peano axioms within that theory. I conclude by discussing whether the theory can be used as a solution to the problem of unrestricted quantification. In an appendix, I prove the consistency of the class theory relative to Zermelo–Fraenkel set theory. (shrink)

Nella teologia trinitaria di Enrico di Gand, e in particolare nell'uso della nozione di verbum mentis, confluiscono ad avviso dell'A. tre diverse tradizioni che vengono rielaborate in un sistema coerente dal maestro agostiniano. La prima, quella cui aderiscono Tommaso e Bonaventura, insiste sul fatto che le persone sono distinte tra loro proprie per mezzo di relazioni opposte. La seconda, rappresentata da Riccardo di san Vittore, che attribuisce la differenza tra le persone al loro diverso modo di emanazione e di origine. (...) La terza che riprende il modello psicologico della trinità di Agostino ed in particolare l'immagine del Figlio come Verbum. Enrico incorpora i diversi elementi di queste tradizioni in modo originale e sostiene che il Figlio è distinto dalle altre due persone in base al diverso modo di emanazione , ma che è diverso dal Padre e dallo Spirito Santo anche perché è Verbum. The debate surrounding eliminative materialism, and the role of empiricism more broadly, has been one of the more prominent philosophical debates of the last half-century. But too often what is at stake in this debate has been left implicit. This essay surveys the rhetoric of two participants in this debate, Paul Churchland and Thomas Nagel, on the question of whether or not scientific explanations will do away with the need for nonscientific descriptions. Both philosophers talk about this possibility in (...) language reminiscent of revolutionary politics. These authors do not see eliminative materialism merely as an idea to be evaluated, but a revolution to be welcomed or quashed. After surveying their rhetoric, the paper turns to the work of four philosophers—G.E.M. Anscombe, Peter Winch, Paul Holmer, and G.H. von Wright—to suggest that there is within Wittgensteinian tradition a ‘nonrevolutionary’ approach to the question of eliminative materialism. (shrink)

Michael Oakeshott and Carl Schmitt are two of the most prominent critics of rationalism in politics. They also both draw heavily on the work of Thomas Hobbes. This paper connects these themes and indicates that Oakeshott's and Schmitt's concerns about rationalism are reflected in their writings on Hobbes, especially in their use of the idea of myth. Notwithstanding certain connections between their understanding of, and concerns about, modern rationalism, comparing Oakeshott and Schmitt through their readings of Hobbes helps to (...) elucidate the more important differences between their political theories as a whole. Using Oakeshott's own terminology, this paper suggests that the differences between the two theorists can be understood as a difference between a ‘politics of faith’ and a ‘political of scepticism’ . Where Schmitt turned to Hobbes to find a political theology to combat the forces of liberal scepticism and ground the practice of modern authority, Oakeshott drew from Hobbes the idea — often associated with liberalism — that authority arises from a scepticism about the possibility of finding such a foundation. The paper concludes with the observation that the risks attending the politics of faith, as Schmitt's experience attests, are more severe than those of scepticism. (shrink)

Russell famously propounded scepticism about memory in The Analysis of Mind (1921). As he there acknowledged, one way to counter this sceptical position is to hold that memory involves direct acquaintance with past, and this is in fact a thesis Russell had advanced in The Problems of Philosophy (1911). Indeed he had there used the case of memory to develop a sophisticated falibilist, non-sceptical, epistemology. By 1921, however, Russell had rejected the early conception of memory as incompatible (...) with the neutral monism he now affirmed. In its place he argued that memory involves a distinctive type of belief whose content is given by imagery. Russell's language here is off-putting but without much distortion his later position can be interpreted as an early formulation of a functionalist theory of mind based on a causal theory of mental representation. Thus interpreted it provides the basis for a different response to Russell's sceptical thesis. (shrink)
