This article investigates the existence of an original Brazilian legal culture. It parts from a critical examination of the key moments in the history of Brazil through the accounts of its most important scholars, such as Caio Prado Júnior, Darcy Ribeiro, Sérgio Buarque de Holanda, Wilson Martins, Oliveira Viana, Roberto Damatta, José Murilo de Carvalho, among others. It identifies in the Brazilian legal culture something one might call tradition of exception, which can be found in many of its most (...) prominent aspects, such as the persistent denial of any general or abstract regulatory standards, the uncritical introduction of foreign doctrines and legal patterns, the maintenance of aristocratic traditions in social life and the historical disregard of the Brazilian people as political subject. The article also offers a reflection on the problems and potentials of the current historic moment, in which for the first time Brazilians face the possibility of a genuine cultural emancipation. . The semantic collapse problem is perhaps the main difficulty associated to the very powerful mechanism for combining logics known as fibring. In this paper we propose cryptofibred semantics as a generalization of fibred semantics, and show that it provides a solution to the collapsing problem. In particular, given that the collapsing problem is a special case of failure of conservativeness, we formulate and prove a sufficient condition for cryptofibring to yield a conservative extension of the logics being combined. For (...) illustration, we revisit the example of combining intuitionistic and classical propositional logics. (shrink)
A qualitative study with an exploratory, descriptive and documentary design that was conducted with the objective of identifying the elements to constitute a method for the analysis of accusations of and proceedings for professional ethics infringements. The method is based on underlying elements identified inductively during analysis of professional ethics hearings judged by and filed in the archives of the Regional Nursing Board of Santa Catarina, Brazil, between 1999 and 2007. The strategies developed were based on the results of an (...) analysis of the findings of fact (occurrences/infractions, causes and outcomes) contained in the records of 128 professional ethics hearings and on the structural elements (statements, rules and practices) identified in five example professional ethics cases. The strategies suggested for evaluating accusations of ethics infringements and the procedures involved in deliberating on ethics hearings constitute a generic proposal that will require adaptation to the context of specific professional ethics accusations. St. Anselm provides us with a metaphysics of the Logos, whereby things are true in relation to the Divine Intellect, or by the one first truth. Anselm will, as Aquinas after him, consider whether things are more true in the Divine Word than they are in themselves. This question seems to be closely related to the human person’s desire for God, a desire which makes possible the person’s return to God and which involves not only being created true but also (...) doing the truth, or being as the person ought to be. The questions I will treat in this paper will show that Anselm’s metaphysical and ethical thought is heavily indebted to Neoplatonic themes such as measure and order. (shrink)
The aim of this paper is to examine the theoretical status of the hegelian concept of freedom as “being with oneself in one’s other”, as well as the mediation of the category of recognition in the relationship between the objective and subjective face that this concept portrays. In this perspective, no legitimate relations of domination and coercion are rejected on behalf of a intersubjective concept of freedom. The aim is also to highlight the important elements in the hegelian philosophy to (...) understand the meaning of freedom in the constitution of a social theory, which can be expressed in its approximation to the republicanism, in contemporary discussion of political and moral philosophy. The scientific community has debated the importance of “return” activities after ethnobiological studies. This issue has provoked debate because it touches on the ethics of research and the relationships with the people involved in these studies. This case study aimed to investigate community perception of an ethnobotany research project that was carried out in the semi-arid region of northeastern Brazil. Furthermore, we reported how the residents of this rural community felt about participating in the activities of “return” that arose from (...) the projects. Our findings demonstrate that “return” activities should be planned from the design phase of the research until its closure as a lifelong process that allows the communities involved to gradually take ownership of the information and actions that are being generated. Similarly, we argue that such activities must be negotiated with the people of the community so that they have decision-making power and autonomy to decide what is most relevant to their lives. In this paper, I relate two items not commonly related in the literature on Frege: Frege’s argument on the interpretation of identity statements and his problem of referring to functions. First, I expound the argument and conclude that it is sound. Second, I characterize the semantical relations which the argument allows him to introduce. In what follows, I deal with the above mentioned problem and show how it affects Frege’s semantics: those semantical relations become unnameable and, therefore, his semantics turns out to be unexpressible. I consider a possible solution of this problem. (shrink)
Liberalismo. Liberdade. Reconciliação. ABSTRACT The purpose of this article is to analyze the relations between Rawls and Hegel’s political thought – considered by the former as a “liberalism of freedom” – regarding the theme of reconciliation. Firstly, we will analyze the Hegelian concept of reconciliation. Secondly, we will proceed to a reading of some aspects of the Rawlsian theory based in that concept, in order to eventually underscore its value in Rawls’ work. Therefore, the article verifies in which way the critical reception of the Hegelian theme of reconciliation can stimulate an adjustment of the political liberalism to the demands of the historical reality of modern liberal societies, covering, in this manner, a deficit of political liberalism in relation to communitarian criticisms, especially, the question of abstract normativism. KEY WORDS – Hegelianism. Liberalism. Freedom. Reconciliation. (shrink)
Upshot: According to Biology of Cognition and Language (Maturana’s approach) the immune system is not a cognitive system and defining of a cognitive paradigm is not what we understand as a Maturanian approach to immunology. The true cognitive actions in immunology are performed by immunologists acting as observers, not by body organs or systems. Stimuli and responses are not adequate concepts in the description of systems. As a closed network of cellular/molecular interactions, the immune system yields patterns of activity as (...) is transparent in robust conserved profiles of reactivity of natural immunoglobulins, as investigated by Nóbrega et al. and Cohen et al., which offer the opportunity to unravel its natural, spontaneous activity. Dietary materials, products of the commensal microbiome are the most abundant and common elements continuously incorporated to the network activity and, thus, also represent an important avenue of investigation. The “new” paradigm proposed by Shanker & King is neither new nor a significant advance in our understanding of communication. Although we agree that social interaction is important, ignoring the roles of mental processes and the significance of information exchange is theoretically dangerous. Moreover, the “communicative dance” is sequential. If one partner does not lead, how is the other to follow?
This article examines the third objection of Chapter Five of the opusculum De unitate intellectus of Saint Thomas. This section offers a summary of Thomist gnoseology and the most important arguments regarding the unity of the intellect. It also represents a true milestone in Western Philosophy, by specifying the object of intellection and the distinction between id quod intelligitur and in quo intelligitur, fundamental themes in the context of moderate realism in comparison with the other currents of the theory of (...) knowledge. This article examines the relationship between light, splendour and beauty in the thought of Pseudo-Dionysius the Areopagite. From a systematic analysis of the Corpus Dionysiacum, we will see to what point he forged an aesthetic perspective from the property of “splendour” in comparison with “proportion”, to coordinate the conception of light in Christian Revelation and in Neoplatonic Philosophy.

In this article Roberto Balzani, the mayor of Forlì, remembers Roberto Ruffilli, 25 years after his murder. The remembrance reconstructs the steps of his academic career and of his political commitment. Ruffilli graduated at the Catholic University of Milan; his researches in contemporary history placed him in an original position if compared with the Italian studies of the time. The constant attention towards the history of administration and the transformations of the state is the basis on which Ruffilli (...) built his proposals concerning the reform of the insitutional and political system. Balzani concludes the article by affirming that the problems of today aren't any different, that is why Ruffilli's proposals still demonstrate their modernity. (shrink)
