This book addresses the implications of Richard Rorty’s rejection of experience. The author argues that there are ways to recover a concept of experience that is consistent with Rorty’s preference for a linguistic style of pragmatism.

Most accounts of cognitive scaffolding focus on ways that external structure can support or augment an agent’s cognitive capacities. We call cases where the interests of the user are served benign scaffolding and argue for the possibility and reality of hostile scaffolding. This is scaffolding which depends on the same capacities of an agent to make cognitive use of external structure as in benign cases, but that undermines or exploits the user while serving the interests of another agent. We develop (...) criteria for scaffolding being hostile and show by reference to examples including the design features of electronic gambling machines and casino management systems that hostile scaffolding exists and can be highly effective. In cases where the scaffolding is deep and permits the offloading of significant cognitive work, hostile scaffolding exploitatively manipulates cognitive processing itself. Scholarship in experimental jurisprudence has reported surprising findings about various concepts of legal significance: _acting intentionally_, _causation_, _consent_, _knowledge, recklessness_, _reasonableness,_ and _law_ itself. Often, these studies examine laypeople’s ordinary concepts and draw broader conclusions about legal experts’ concepts. This Article questions such inferences, from empirical findings about ordinary concepts to conclusions about the concepts of those with legal expertise. It presents a case study concerning what it means to act _intentionally._ An experiment examines intentionality judgments across four populations (N (...) = 774): laypeople, law students, non-law students, and United States judges. Legal training affected judgments in three ways that are consistent with the acquisition of a distinctive legal concept. This case study supports the Article’s broader claim: Laypeople’s ordinary concepts are not equivalent to experts’ legal concepts. In his early philosophy as well as in his middle period, Wittgenstein holds a purely syntactic view of logic and mathematics. However, his syntactic foundation of logic and mathematics is opposed to the axiomatic approach of modern mathematical logic. The object of Wittgenstein’s approach is not the representation of mathematical properties within a logical axiomatic system, but their representation by a symbolism that identifies the properties in question by its syntactic features. It rests on his distinction of descriptions and operations; (...) its aim is to reduce mathematics to operations. Some argue that robots could never be sentient, and thus could never have intrinsic moral status. Others disagree, believing that robots indeed will be sentient and thus will have moral status. But a third group thinks that, even if robots could never have moral status, we still have a strong moral reason to treat some robots as if they do. Drawing on a Kantian argument for indirect animal rights, a number of technology ethicists contend that our treatment of anthropomorphic or (...) even animal-like robots could condition our treatment of humans: treat these robots well, as we would treat humans, or else risk eroding good moral behavior toward humans. But then, this argument also seems to justify giving rights to robots, even if robots lack intrinsic moral status. In recent years, however, this indirect argument in support of robot rights has drawn a number of objections. In this paper I have three goals. First, I will formulate and explicate the Kant-inspired indirect argument meant to support robot rights, making clearer than before its empirical commitments and philosophical presuppositions. Second, I will defend the argument against a number of objections. The result is the fullest explication and defense to date of this well-known and influential but often criticized argument. Third, however, I myself will raise a new concern about the argument’s use as a justification for robot rights. This concern is answerable to some extent, but it cannot be dismissed fully. It shows that, surprisingly, the argument’s advocates have reason to resist, at least somewhat, producing the sorts of robots that, on their view, ought to receive rights. (shrink)

This article offers the first systematic investigation of the linguistic forms in which Kant expresses his transcendental idealism since Gerold Prauss’ seminal book Kant und das Problem der Dinge an sich. It is argued that Prauss’ own argument for the claim that ‘in itself’ is an adverbial expression that standardly modifies verbs of philosophical reflection is flawed and that there is hence very poor exegetical evidence for so-called ‘methodological two-aspect’ interpretations of Kant’s transcendental idealism. A comprehensive investigation of Kant’s adverbial (...) uses of ‘in itself’ rather reveals that there are various groups of verbs that ‘in itself’ modifies, which can more or less all be reduced to a standard use in which ‘in itself’ modifies verbs of predicative being such as the copula. It is also discussed how these findings can be accommodated by the two main alternative kinds of interpretations, that is, two-object and ontological two-aspect interpretations. (shrink)

This article identifies problems with regard to providing criteria that regulate the matching of logical formulae and natural language. We then take on to solve these problems by defining a necessary and sufficient criterion of adequate formalization. On the basis of this criterion we argue that logic should not be seen as an ars iudicandi capable of evaluating the validity or invalidity of informal arguments, but as an ars explicandi that renders transparent the formal structure of informal reasoning.

Die vorliegende Ausarbeitung setzt sich mit der Beziehung auseinander, die Subjekt (Erkenntnisvermögen) und Objekt (Erkenntnisgegenstand) im Denken Theodor W. Adornos zueinander einnehmen. Sie fragt, genauer gefasst, wie das Subjekt den darin angestrebten philosophischen Zugang zu seinem Objekt herstellen kann, der sich aus dezidierter Distanz und enger Nähe zugleich speisen soll. Dazu möchte sie dem dialektischen Gefüge von Subjekt und Objekt, wie es in Adornos Schriften zur Geltung kommt, weiter nachgehen: Sie möchte dessen zentrale Aspekte herausstellen, ihren Zusammenhang kenntlich machen und (...) das bei Adorno Ungesagte weiter ausdeuten. Es wird gezeigt, dass Wittgenstein in seiner Frühphilosophie ein nicht-axiomatisches Beweisverständnis entwickelt, für das sich das Problem der Begründung der Axiome nicht stellt. Nach Wittgensteins Beweisverständnis besteht der Beweis einer formalen Eigenschaft einer Formel – z.B. der logischen Wahrheit einer prädikatenlogischen Formel oder der Gleichheit zweier arithmetischer Ausdrücke – in der Transformation der Formel in eine andere Notation, an deren Eigenschaften sich entscheiden lässt, ob die zu beweisende formale Eigenschaft besteht oder nicht besteht. Dieses Verständnis grenzt Wittgenstein gegenüber einem axiomatischen (...) Beweisverständnis ab. Sein Beweisverständnis bedingt ein Programm der Grundlegung der Mathematik, das eine Alternative zu den Ansätzen des Logizismus, Formalismus und Konstruktivismus darstellt. Wittgensteins Ansatz steht im Widerspruch zu den Ergebnissen der Metamathematik, da er die Möglichkeit der Formulierung von Entscheidungsverfahren in der Prädikatenlogik und Arithmetik voraussetzt. Um seinem Ansatz gegenüber der traditionellen Metamathematik Recht zu geben, müsste gezeigt werden, dass sein Beweisverständnis im Bereich der Logik und Arithmetik – der traditionellen Metamathematik zum Trotz – realisierbar ist. This paper reveals two fallacies in Turing's undecidability proof of first-order logic (FOL), namely, (i) an 'extensional fallacy': from the fact that a sentence is an instance of a provable FOL formula, it is inferred that a meaningful sentence is proven, and (ii) a 'fallacy of substitution': from the fact that a sentence is an instance of a provable FOL formula, it is inferred that a true sentence is proven. The first fallacy erroneously suggests that Turing's proof of the non-existence (...) of a circle-free machine that decides whether an arbitrary machine is circular proves a significant proposition. In vol. 2 of Grundlagen der Mathematik Hilbert and Bernays carry out their undecid- ability proof of predicate logic basing it on their undecidability proof of the arithmeti- cal systemZ00. In this paper, the latter proof is reconstructed and summarized within a formal derivation schema. Formalizing the proof makes the presumed use of a meta language explicit by employing formal predicates as propositional functions, with ex- pressions as their arguments. In the final section of the paper, the proof is analyzed (...) critically by applying Wittgenstein’s view on meta language, which does not lead to a questioning of the assumptions on which the proof is based but of its presumed use of meta language. Finally, it will be argued that determining if it is the undecidability proof or Wittgenstein’s analysis of meta language that is right depends on whether a decision procedure for a predicate that undecidability proofs have seemingly proven undecidable can nonetheless be defined. Thus serious attempts to define a procedure for such a predicate should not be ruled out without studying them. (shrink)

This article gives a basic account of Aquinas’s theory of “synderesis” and conscience. Aquinas understands synderesis as an infallible moral awareness and conscience as the fallible judgment that applies a general moral conviction to a concrete case. The article also compares Aquinas’s and his contemporaries’ theories of whether erring conscience is morally binding, that is, whether to act in accord with erring conscience or against erring conscience is sinful.

OLWIG London: Routledge, 2019 REVIEWED BY TIMM SCHÖNFELDER Landscape is more than spatial scenery that meets the eye: it is an anthropogenic artefact, an intellectual construct, a mirror of culture; it even has its own language.1 This broadness is reflected in the compilation of nine authoritative essays by the geographer and (...) professor of landscape architecture Kenneth R. Olwig that were published during the past quarter of a century and are now molded into a more coherent whole. In this regard, the present volume can be considered the pinnacle of Olwig’s intellectual oeuvre. In a fervent foreword, the anthropologist Tim Ingold sets the tone when he urges the reader to shed the contemporary notion of what he terms “topophobia”—­ a lack of bond betweenpeopleandplaces—­andtoreinstatephilologyasacentralfield of interest after it was “relegated by techno-­ science to the margins of scholarship” (xv). To achieve this, the essays deal with an eclectic set of themes ranging from Ptolemy’s notion of “choros” as something similar to today’s understanding of landscape, to the humanistic geographer Yi-­Fu Tuan’s concept of “topophilia,” which is hailed as a guiding ideal for much of Olwig’s work. The articles are bound together by an introduction that quickly transcendsthegeometricallimitationsoflandscape,ontologicallyquestioning whether these can be representative of the world itself at all (3). The first chapter thus delves right into the etymologies of “landscape” and its historical implications in the Nordic countries and England with detours through Italy and the German lands. In a cursory, highly associative manner Olwig fathoms the respective cultural implications. Central is the idea that the concept of landscape is more than the mere scenicrepresentationofspaceitcametobeknownasinRenaissance art and culture.2 Rather, the Nordic variants of the word, like the Swedish landskap, are used to denote natural regions with their own polity that were then gradually subjected to a monarchic state, not least through the surveying and mapping of their territory (see also chapter two). This culminates in a problematic assessment of Nazi ideology as being motivated by a specific understanding of landscape. Statements like “there can be no doubt that the modern German conception of Landschaft was implicated in the promotion of blood-­ and-­ soil fascist ideology” (42) neglect important literature on the topic.4 Such generalizations are owed to the author’s sweeping tour de force approach. The reviewer would have preferred more guidance through the theoretical thickets by way of a clear, chronologically ordered argument. This is not helped by the occasional seeming inconsistency, as in the claim that the U.S. “inherited the British scenic idea of landscape” as a former colony while also being “very much the inheritor of German romantic ideas concerning the relation of culture to nature as expressed in the physical landscape” (45), which, in turn, showed parallels to “fascist landscapes” in the “attempt to cleanse geography of its environmentalist taint by making it a science of space” (42). This truly is a lot of ground to cover for one essay. The ensuing chapters, however, try to disentangle this inspired jumble. The second article, “Landscape, Place, and the State of Progress,” identifies a switch since the Renaissance from the idea of circuitous development to linear progress towards utopia. For Olwig, there is a “darker, Faustian side” to it that he identifies as the “dialectic of modernity,” which “opposes cosmic dreams of a utopian future to the topian exigencies of present and past”: to advance, the path had to be cleared of traditional elements (52). The article introduces and defends the Nomological Account of ground, a reductive account of the notion of metaphysical explanation in terms of the laws of metaphysics. The paper presents three desiderata that a theory of ground should meet: it should explain the modal force of ground, the generality of ground, and the interplay between ground and certain mereological notions. The bulk of the paper develops the Nomological Account and argues that it meets the three desiderata. The Nomological Account relies on (...) two central notions: the notion of a ‘law of metaphysics’ and the notion of ‘determination via the laws’. The paper offers the constructional conception of the laws of metaphysics, on which the metaphysical laws are general principles that characterize construction–operations such as composition, constitution, or set-formation. The role of determination in the account is explained and some reductive approaches to the notion are sketched. The case for the Nomological Account presented in this article is also a case for the laws of metaphysics. Since the Nomological Account offers a promising approach to metaphysical explanation we should take the laws of metaphysics seriously. (shrink)

Obtaining informed consent from patients is a moral and legal duty and, thus, a key legitimation for medical treatment. The pivotal prerequisite for valid informed consent is decision-making capacity of the patient. Related to the question of whether and when consent should be morally and legally valid, there has been a long-lasting philosophical debate about freedom of will and the connection of freedom and responsibility. The scholarly discussion on decision-making capacity and its clinical evaluation does not sufficiently take into account (...) this fundamental debate. It is contended that the notion of free will must be reflected when evaluating decision-making capacity. Namely, it should be included as a part of the appreciation-criterion for decision-making capacity. The argumentation is mainly drawn on the compatibilism of Harry Frankfurt. A solution is proposed which at the same time takes the notion of free will seriously and enriches the traditional understanding of decision-making capacity, strengthening its justificatory force while remaining clinically applicable. The paper explores a deductive-nomological account of metaphysical explanation: some truths metaphysically explain, or ground, another truth just in case the laws of metaphysics determine the latter truth on the basis of the former. I develop and motivate a specific conception of metaphysical laws, on which they are general rules that regulate the existence and features of derivative entities. I propose an analysis of the notion of ‘determination via the laws’, based on a restricted form of logical entailment. I argue (...) that the DN-account of ground can be defended against the well-known objections to the DN-approach to scientific explanation. The potential for biases being built into algorithms has been known for some time, yet literature has only recently demonstrated the ways algorithmic profiling can result in social sorting and harm marginalised groups. We contend that with increased algorithmic complexity, biases will become more sophisticated and difficult to identify, control for, or contest. Our argument has four steps: first, we show how harnessing algorithms means that data gathered at a particular place and time relating to specific persons, can be used (...) to build group models applied in different contexts to different persons. Thus, privacy and data protection rights, with their focus on individuals, do not protect from the discriminatory potential of algorithmic profiling. Second, we explore the idea that anti-discrimination regulation may be more promising, but acknowledge limitations. Third, we argue that in order to harness anti-discrimination regulation, it needs to confront emergent forms of discrimination or risk creating new invisibilities, including invisibility from existing safeguards. Finally, we outline suggestions to address emergent forms of discrimination and exclusionary invisibilities via intersectional and post-colonial analysis. (shrink)

The random nature of immunoglobulin gene segment rearrangement inevitably leads to the generation of self‐reactive B cells. Avoidance of destructive autoimmune reactions is necessary in order to maintain physiological homeostasis. However, current central and peripheral tolerance concepts fail to explain the massive number of autoantibody‐borne autoimmune diseases. Moreover, recent studies have shown that in physiological mouse models autoreactive B cells were neither clonally deleted nor kept in an anergic state, but were instead able to mount autoantibody responses. We propose that (...) activation of autoreactive B cells is induced by polyvalent autoantigen complexes that can occur under physiological conditions. Repeated encounter of autoantigen complexes leads to the production of affinity‐matured autoreactive IgM that protects its respective self‐targets from degradation. We refer to this novel mechanism as adaptive tolerance. This article discusses the discovery of adaptive tolerance and the unexpected role of high affinity IgM autoantibodies. (shrink)
