The question of whether we can perceive absences, in addition to ‘positives’, has received recent attention in the literature on the nature of vision and audition. The aim is to demonstrate that there can be objectless forms of perceptual consciousness; specifically, to show that such episodes can be distinguished from those in which there is merely no perception at all. The current article explores this question for the domain of olfaction, and argues that there can be experiences of the absence (...) of odours, in addition to positive smell perception. The aim of this paper is to begin a conversation about how we read and write about Nietzsche and, related to this, other figures in the history of philosophy. The principle of charity can appear to be a way to bridge two dif-ferent interpretative goals: getting the meaning of the text right and offering the best philosophy. I argue that the principle of charity is multiply ambiguous along three different dimensions, which I call “unit,” “mode,” and “strength”: consequently, it is (...) not a single, neutral or independent principle to which we can helpfully appeal and it cannot, in itself, perform this bridging function. Nietzsche, I suggest, is particularly ill suited to some forms of charitable reading. I compare charity to what I call “misreporting” a philosopher’s words, in order to highlight some problematic structural similarities. Finally, I assess what charity might be doing instead, if it is not intended to bridge meaning and best philosophy. (shrink)

‘Natural-History’ is one of the key concepts in the thought of the Frankfurt School critical theorist Theodor W. Adorno, appearing from his very earliest work through to his very last. Unfortunately, the existing literature provides little illumination as to what Adorno’s concept of natural-history is, or what it is supposed to do. This paper thus seeks to supply the required understanding. Ultimately, I argue that ‘natural-history’ is best understood as a sort of ‘therapeutic’ concept, intended to dissolve certain philosophical anxieties (...) which might otherwise present obstacles to our being able to obtain a critical-theoretical understanding of reality. In Section 1, I outline the history of natural law theory, covering Plato, Aristotle, the Stoics and Aquinas. In Section 2, I explore two alternative traditions of natural law, and explain why these constitute rivals to the Aristotelian tradition. In Section 3, I go on to elaborate a via negativa along which natural law norms can be discovered. On this basis, I unpack what I call three 'experiments in being', each of which illustrates the cogency of this method. In Section (...) 4, I investigate and rebut two seminal challenges to natural law methodology, namely, the fact/value distinction in metaethics and Darwinian evolutionary biology. In Section 5, I then outline and criticise the 'new' natural law theory, which is an attempt to revise natural law thought in light of the two challenges above. We argue that abduction does not work in isolation from other inference mechanisms and illustrate this through an inference scheme designed to evaluate multiple hypotheses. We use game theory to relate the abductive system to actions that produce new information. To enable evaluation of the implications of this approach we have implemented the procedures used to calculate the impact of new information in a computer model. Experiments with this model display a number of features of collective belief-revision leading to consensus-formation, (...) such as the influence of bias and prejudice. The scheme of inferential calculations invokes a Peircian concept of ‘belief’ as the propensity to choose a particular course of action. (shrink)

Many researchers from robotics, machine ethics, and adjacent fields seem to assume that norms represent good behavior that social robots should learn to benefit their users and society. We would like to complicate this view and present seven key troubles with norm-compliant robots: (1) norm biases, (2) paternalism (3) tyrannies of the majority, (4) pluralistic ignorance, (5) paths of least resistance, (6) outdated norms, and (7) technologically-induced norm change. Because discussions of why norm-compliant robots can be problematic are noticeably absent (...) from the robot and machine ethics literature, this paper fills an important research gap. We argue that it is critical for researchers to take these issues into account if they wish to make norm-compliant robots. (shrink)

In their papers in this supplement, Ruth Faden and colleagues conclude that research ethics and regulation must change to accommodate a changed and changing health care environment. The reality, however, is that the widely understood and accepted ethical framework embedded in the regulatory requirements known as the Common Rule, and recent proposals to modify the Common Rule have become stalled, at least for the foreseeable future, if not permanently. Meaningful systemic modernization of the Common Rule is not likely to occur (...) any time soon. All the same, modernization of the Common Rule is desperately needed. In the short term, the agencies responsible for implementing it must be willing to develop practical guidance for implementing the current regulatory requirements in a way that promotes clarity and understanding and allocates human and fiscal resources based on the level of risk to subjects. To this end, the Veterans Health Administration recently implemented policy to address the research‐practice distinction—a distinction that is especially relevant to VHA's current challenges and that the authors of the “ethical framework” articles have identified as particularly outmoded. I argue that the theory of happiness now dominant among philosophers embraces a flawed, technicizing model that represents happiness as a set of mental states produced by actions and events. This view contrasts with Aristotle’s conception, according to which happiness is not produced by (but is tantamount to) long-term activity and incorporates (but is not reducible to) a set of mental states. I then go on to criticize the skill model of happiness on three main grounds. First, unlike the Aristotelian (...) model, it necessarily instrumentalizes activity while setting no principled limit to the manipulation of human action and experience. Second, and again contra Aristotle, it privileges an efficient (rather than formal) conception of causation while obscuring the way in which happiness is inextricably grounded in its conditions, which in turn has various deleterious upshots. Third and finally, the skill model yields a highly questionable notion of happiness as measurable. (shrink)

Patents on biotech products have a scope that goes well beyond what is covered by the most widely applied ethical justifications of intellectual property. Neither natural rights theory from Locke, nor public interest theory of IP rights justifies the wide scope of legal protection. The article takes human genes as an example, focusing on the component that is not invented but persists as unaltered gene information even in the synthetically produced complementary DNA, the cDNA. It is argued that patent on (...) cDNA holds this information captive, or illegitimately appropriates it in limiting other researchers and inventors’ opportunity to explore new functions and uses based on this non-invented information. A tighter connection between legal IP protection and the use description stated in the patent claim is suggested. By binding protection to the product’s foreseeable functions and use, instead of the product itself and all future uses of it, legitimacy of biotech product patents is restored. (shrink)

Il existe certes des liens entre une juste interprétation (...) de Hobbes et la philosophie politique du XXe siècle, mais je suggère que ces derniers résident dans un usage déflationniste de la redescription. C’est dans cette perspective que je m’efforce de montrer qu’il existe une comparaison valide entre Hobbes et le philosophe britannique John Gray.Hobbes’s uses of the state of nature are often misunderstood by Anglo-American philosophers, even distinguished Hobbes commentators like Gauthier and Hampton. Contrary to Gauthier, I argue that Hobbes is not notably interested in naturalising the basis of moral motivation, and I dispute Hampton’s interpretation of the lasting value of Hobbesian as opposed to Kantian contractualism. There are connections between Hobbes as he ought to be understood and twentieth century political philosophy, but I suggest these lie in a certain use of deflationary redescription. This chapter considers Adam Smith’s largely empirical methodology and the relationship between that and his normative moral views in the light of its importance for understanding his work and the assessment of the relevance of his approach to contemporary circumstances. This involves an analysis of Smith’s version of Newtonianism within his theory of moral systems, noting the importance of his deistic theological assumptions for the understanding of the symbiotic relationship between Smith’s explanatory and prescriptive enterprises. In this chapter, I argue that Plato and Aristotle provide analyses of virtue and practical reason that are strongly shaped by the structure of the technai. Socrates assimilates virtue to skill, while Aristotle assimilates practical reason to a means-end technique. While both philosophers are sensitive to the problems these technē models generate, and try either to escape or to remedy them, they nonetheless remain under the impress of those models. In this paper I systematically criticise Feldman’s and Haybron’s theories of happiness as subjective well-being [SWB]. Having elaborated their trichotomy between SWB, welfare and virtue, I then outline Aristotle’s rival ethical schema, which construes these as aspects within an inextricable, organic whole, viz. eudaimonia. In order to vindicate this rival schema, I begin with four thought-experiments: Feldman’s Bertha, the indoctrinated housewife, Haybron’s ‘happy slave’, and two of my own. I argue that these demonstrate – contra Feldman and Haybron, but in (...) line with Aristotle – that happiness is essentially conditioned by objective welfare-goods. I then move on to how such goods are essentially conditioned, in turn, by the virtues. It follows that happiness itself is both logically and ontologically conditioned by the practice of the virtues. Although this Aristotelian conclusion faces charges of being moralistic and counter-evidential, it can overcome these, thereby securing – pace Feldman and Haybron – an authentic, sustainable conception of happiness. In today’s world driven by technological innovation and change, publisher John Brockman has proclaimed scientists as the new “humanists”. Many in the science arena have seized the public podium not only to discuss advances in their area of expertise, but often to speak almost ex cathedra, on the social and philosophical implications for humans and the planet itself. The break with The Church in the 15th & 16th century set in motion a secular humanism which began the movement within the (...) scholarly communities to separate knowledge into disciplines. Following the Enlightenment, many in the social arena turned from the theory based, deductive, approaches toward the sciences with the hope that this inductive methodology would yield the same success found in the bio-physical arena. While this approach has failed to achieve such heights, “science envy” is now driving academic institutions, particularly in the United States and manydeveloping countries, to reposition The Academy to become innovative and contribute to both the private and public sector much in the same manner that Science’s handmaiden, Technology, has contributed in the bio/physical arena.The Humanities, as sensed by Brockman and others, has turned inward or has been ineffective in responding except to utter the mantra that its area represents humanity’s soul and thus provides the critical knowledge needed to save the planet and thus humans. Yet philosophy has not been able, or is unwilling, to accept the challenge and enter the academic lists or command the public pulpit. In this default, a surrogate, religious fundamentalism, has raised its head above the trenches reminiscent of the ancient Science/ Church confrontation and seeks to restore the idea of salvation in the next world, hoping to destroy the Gnostic ideal of humans being able to create such peace on earth. Instead of impeding access to essential medicines in developing countries, the essay explores why and how patents can serve as a source of funding for the much needed access to medicine. Instead of a weakening of patents, prolonged protection periods are suggested in circumstances where there is widespread lack of access. The revenues from extended patents are seen as a source of funding for drug donations to the least developed countries.

I argue that, in analysing the structure and development of moral traditions, MacIntyre relies primarily on Kuhn's model of scientific tradition, rather than on Lakatos' model. I unpack three foci of Kuhn's conception of the sciences, namely: the ‘crisis’ conception of scientific development, what I call the ‘systematic conception’ of scientific paradigms, and the view that successive paradigms are incommensurable. I then show that these three foci are integrated into MacIntyre's account of the development of moral traditions with a surprising (...) degree of faithfulness to Kuhn. And crucially, I argue against the overall cogency of his account, given the disparities I pinpoint between scientific and moral traditions. My overall critique is, however, fundamentally friendly, since nothing I have to say invalidates the very notion of a moral tradition, and all I am calling for are less problematic construals of that notion. The purpose of this paper is to study bertram wolfe's views of marx and marxism, and in particular to call attention to his insistence on the basic ambiguity of the classical doctrines and the exploitation of that ambiguity within differing concepts of marxist orthodoxy. i suggest that the importance of wolfe's views of marx and marxism lies less in the specific theses he advances or in the details of his discussion. in opposition to the more usual approach to marxism as (...) a unified phenomenon, wolfe stands nearly alone in the analytical form of his historical approach, in which emphasis lies less in the depiction of a synthetic vision than in the patient, historical analysis of the chronological evolution of marx's position, classical marxism, and the wider marxist tradition. The aim of this informal paper is to direct (or redirect) attention to the importance of Croce’s historicism. Though he is sometimes described as the best known Italian intellectual since Galileo, and though his influence remains strong in Italy, his impact outside Italy is not as important as it should be. Other than through Collingwood, his only well known English-language disciple, Croce has had very little influence on those writing in English. His theories, including his historicism, on which I will (...) be focusing here, are only infrequently discussed in English, especially by philosophers.Historicism is a doctrine which receives almost no attention in English-speaking lands but looms very large in Italian thought.For purposes of this paper, I will treat Croce’s historicism as arising out of his readings of three very different thinkers, different from himself and from each other, who are committed to varying forms of epistemological historicism, and who are important for the development of his own position, Vico, Hegel and Marx. Croce studies these thinkers early in his very long career in inverse chronological order, beginning with Marx (1900), turning next to Hegel (1907), and then concerning himself later with Vico (1911). In considering Croce’s interpretation of three other historicists, it will be useful to keep in mind that, as an original thinker, he is never only an interpreter of other theories, always in the process of thinking for himself with and against whatever ideas he is interpreting. In each case, he made important contributions to our understanding of these thinkers while continuing to work out his own view. (shrink)
