This paper presents a theory of reasoning with evidence in order to determine the facts in a criminal case. The focus is on the process of proof, in which the facts of the case are determined, rather than on related legal issues, such as the admissibility of evidence. In the literature, two approaches to reasoning with evidence can be distinguished, one argument-based and one story-based. In an argument-based approach to reasoning with evidence, the reasons for and against the occurrence of (...) an event, e.g., based on witness testimony, are central. In a story-based approach, evidence is evaluated and interpreted from the perspective of the factual stories as they may have occurred in a case, e.g., as they are defended by the prosecution. In this paper, we argue that both arguments and narratives are relevant and useful in the reasoning with and interpretation of evidence. Therefore, a hybrid approach is proposed and formally developed, doing justice to both the argument-based and the narrative-based perspective. By the formalization of the theory and the associated graphical representations, our proposal is the basis for the design of software developed as a tool to make sense of the evidence in complex cases. This paper studies the modelling of legal reasoning about evidence within general theories of defeasible reasoning and argumentation. In particular, Wigmore's method for charting evidence and its use by modern legal evidence scholars is studied in order to give a formal underpinning in terms of logics for defeasible argumentation. Two notions turn out to be crucial, viz. argumentation schemes and empirical generalisations.

Dialetheists believe some sentences are both true and false. Objectors have argued that this makes it unclear how people can disagree with each other because, given the dialetheist’s commitments, if I make a claim and you tell me my claim is false, we might both be correct. Graham Priest (2006a) thinks that people disagree by rejecting or denying what is said rather than ascribing falsehood to it. We build on the work of Julien Murzi and Massimiliano Carrara (2015) and show (...) that Priest’s approach cannot succeed: given the same dialetheist’s commitments you may be correct to reject a claim that I correctly believe. We argue further that any attempt to solve the problem by identifying a new attitude of disagreement will also fail. The culprit, we claim, is the attempt to find a pair of attitudes that satisfy ‘exclusivity’—that is, attitudes such that both cannot be simultaneously correct. Instead of identifying disagreement by the kinds of attitudes involved, we propose dialetheists focus on the normative landscape and identify it in part by whether parties have reasons to change their attitudes. We offer our own normative theory of disagreement to help dialetheists with this challenge. (shrink)

A broadly liberal politics requires political compassion; not simply in the sense of compassion for the victims of injustice, but also for opponents confronted through political protest and (more broadly) dissent. There are times when, out of a sense of compassion, a just cause should not be pressed. There are times when we need to accommodate the dreadfulness of loss for opponents, even when the cause for which they fight is unjust. We may also have to come to terms with (...) the irreversibility of historic injustice and reconcile. Political compassion of this sort carries risks. Pushed too far, it may weaken our commitment to justice through too great a sympathy for those on the other side. It would be convenient if such compassion could be constrained by a clear set of political principles. But principles run the quite different risk of promoting an 'ossified dissent', unable to respond to change. In this book, Tony Milligan argues that principles are only a limited guide to dissent in unique, contingent circumstances. They will not tell us how to deal with the truly difficult cases such as the following: Should the Lakota celebrate Thanksgiving? When is the crossing of a picket-line justified? What kind of toleration must animal rights advocates cultivate to make progress within a broadly liberal political domain? And how should we respond to the entangling of aspiration towards social justice with anger and prejudice (such as the 'anti-Zionist' discourse)? We may be tempted to answer these questions by presupposing that alignment (the business of choosing sides) is ultimately more important than compassion, but sometimes political compassion trumps alignment. To address the underrepresentation of women in philosophy effectively, we must understand the causes of the early loss of women. In this paper we challenge one of the few explanations that has focused on why women might leave philosophy at early stages. Wesley Buckwalter and Stephen Stich offer some evidence that women have different intuitions than men about philosophical thought experiments. We present some concerns about their evidence and we discuss our own study, in which we attempted to replicate their (...) results for 23 different responses to 14 scenarios . We also conducted a literature search to see if other philosophers or psychologists have tested for gender differences in philosophical intuitions. Based on our findings, we argue that that it is unlikely that gender differences in intuitions play a significant role in driving women from philosophy. (shrink)

We explore the computational complexity of justification, stability and relevance in incomplete argumentation frameworks (IAFs). IAFs are abstract argumentation frameworks that encode qualitative uncertainty by distinguishing between certain and uncertain arguments and attacks. These IAFs can be completed by deciding for each uncertain argument or attack whether it is present or absent. Such a completion is an abstract argumentation framework, for which it can be decided which arguments are acceptable under a given semantics. The justification status of an argument in (...) a completion then expresses whether the argument is accepted (in), not accepted because it is attacked by an accepted argument (out) or neither (undec). For a given IAF and certain argument, the justification status of that argument need not be the same in all completions. This is the issue of stability, where an argument is stable if its justification status is the same in all completions. For arguments that are not stable in an IAF, the relevance problem is of interest: which uncertain arguments or attacks should be investigated for the argument to become stable? In this paper, we define justification, stability and relevance for IAFs and provide a complexity analysis for these problems under grounded, complete, preferred and stable semantics. (shrink)

The aesthetic exception theorises anew the relation between art and politics. It challenges critical trends that discount the role of aesthetic autonomy, to impulsively reassert art as an effective form of social engagement. But it equally challenges those on the flipside of the efficacy debate, who insist that art's politics is limited to a recondite space of 'autonomous resistance'. The book shows how each side of the efficacy debate overlooks art's exceptional status and its social mediations. Scholars from a wide variety of fields respond to his work by addressing such issues as the politics of the memorial, poetry, trauma, film, neoliberalism, the novel, and psychoanalysis--and then, in the processes of revision, they respond to each other.

Decisions concerning proof of facts in criminal law must be rational because of what is at stake, but the decision‐making process must also be cognitively feasible because of cognitive limitations, and it must obey the relevant legal–procedural constraints. In this topic three approaches to rational reasoning about evidence in criminal law are compared in light of these demands: arguments, probabilities, and scenarios. This is done in six case studies in which different authors analyze a manslaughter case from different theoretical perspectives, (...) plus four commentaries on these case studies. The aim of this topic is to obtain more insight into how the different approaches can be applied in a legal context. This will advance the discussion on rational reasoning about evidence in law and will contribute more widely to cognitive science on a number of topics, including the value of probabilistic accounts of cognition and the problem of dealing with cognitive biases in reasoning under uncertainty in practical contexts. Bex analyzes the case with an informal version of his hybrid theory, which combines scenario construction and argumentation. Arguments based on evidence can be used to reason about alternative scenarios. Bex claims that his hybrid theory provides the best of both worlds by combining cognitively feasible story‐based reasoning with more detailed rational argumentation. However, like the argument‐based approach, the hybrid theory does not provide a systematic account of uncertainty.

Gratitude, the proper or fitting response to benevolence, has often been conceptualized as a virtue—a temporally stable disposition to perceive, think, feel, and act in certain characteristic ways in certain situations. Many accounts of gratitude as a virtue, however, have not analyzed this disposition accurately, and as a result, they have not revealed the rich variety of ways in which someone can fail to be a grateful person. A lesson from cognitive behavior therapy (CBT) is that it is possible for people to change their beliefs and attitudes in ways that enhance mood. This chapter discusses mainly how the ideas from positive psychology combined with the therapeutic methods developed in CBT might provide ways of helping individuals to enhance their mood and increase happiness. The best single perspective from which to gain an understanding of positive psychology is that of evolutionary psychology, even though it is underdeveloped and contentious. (...) Evolutionary psychology bridges the gap between individual history and the general features of the human condition that helps to explain both our capacity for happiness and some of the barriers to achieving it. If ethical expressivism is true, then moral judgements are motivational desire-like states and do not robustly represent reality. This gives rise to the problem of how to understand moral error. How can we be mistaken if there is no moral reality to be mistaken about? The standard expressivist explanation of moral doubt is couched in terms of our fear that our judgements may not survive improvements to our epistemic situation. There is a debate between Egan :205–219, 2007), Blackburn :201–213, 2009), (...) Köhler :161–165, 2015) and Ridge :1–21, 2015) on the adequacy of this explanation when it comes to the phenomenon of fundamental moral error. This paper is my contribution to the debate. I argue, contrary to Blackburn and Ridge, that expressivism is committed to some first-order anti-realist sounding claims, and thus quasi-realism fails. If expressivism is true, none of us can coherently believe we might be fundamentally mistaken. However, contrary to Egan and Köhler, I do not think this is bad. Expressivists can still do what motivated the project of quasi-realism in the first place: they can interpret, make sense of, and vindicate ordinary moral discourse. I end by showing it yields some positive results for moral philosophers too – it effectively amounts to a transcendental argument against unhealthy moral scepticism. (shrink)

In this paper, we present a particular role for abductive reasoning in law by applying it in the context of an argumentation scheme for practical reasoning. We present a particular scheme, based on an established scheme for practical reasoning, that can be used to reason abductively about how an agent might have acted to reach a particular scenario, and the motivations for doing so. Plausibility here depends on a satisfactory explanation of why this particular agent followed these motivations in the (...) particular situation. Real living wages (RLWs) are an important ethical and moral policy to ensure that employees earn enough to live on. In providing ‘a fair day's pay for a fair day's work’, they set an ethical foundation for liveability. This article explores the ethics and moral economy of the RLW for lower-paid staff in the overlooked economy context of UK professional football, illustrated by a qualitative case study of Luton Town Football Club (LTFC). The article provides theoretical insights grounded in moral (...) economy concepts about how a RLW contributes to a broader common good means of enabling fuller human participation in decent working and living conditions. Applying these concepts using a multi-disciplinary moral economy interpretation offers deeper theoretical contributions than economistic interpretations restricted to mainly technocratic economic distributive issues. LTFC are evidently ethically embedded in a moral economy as a local community club paying a RLW, and part of the overlooked economy. The research also contributes to contemporary debates on ‘Common Good’ HRM regarding the role of living wages in addressing grand common good challenges like inequality and quality of working lives. Many people believe that if you identify as a particular gender, then you are that gender. This paper is my attempt at making sense of this claim. I propose to conceive of genders as names: determined by the individual and not requiring any specific biological or psychological qualities, yet still important to the bearer.

In this paper, we continue our research on a hybrid narrative-argumentative approach to evidential reasoning in the law by showing the interaction between factual reasoning (providing a proof for ‘what happened’ in a case) and legal reasoning (making a decision based on the proof). First we extend the hybrid theory by making the connection with reasoning towards legal consequences. We then emphasise the role of legal stories (as opposed to the factual stories of the hybrid theory). Legal stories provide a (...) coherent, holistic legal perspective on a case. They steer what needs to be proven but are also selected on the basis of what can be proven. We show how these legal stories can be used to model a shift of the legal perspective on a case, and we discuss how gaps in a legal story can be filled using a factual story (i.e. the process of reasoning with circumstantial evidence). Our model is illustrated by a discussion of the Dutch Wamel murder case. (shrink)

Recently, there is a renewed debate concerning the role of perspective in vision. Morales et al. (2020) present evidence that, in the case of viewing a rotated coin, the visual system is sensitive to what has often been called “perspectival shapes.” It has generated vigorous discussions, including an online symposium by Morales and Cohen, an exchange between Linton (2021) and Morales et al. (2021), and most recently, a fierce critique by Burge and Burge (2022), in which they launch various conceptual (...) and empirical objections. Although Morales and Firestone (2022) have responded to them recently, and we are in agreement with Morales and Firestone in general, there are further problems in Burge and Burge (2022) that are worth highlighting. The main point of this comment is that what the Burge–Burge team call “viewpoint-dependent relational properties” are simply instances of what the Morales–Firestone team call “perspectival shapes”; the confusion arises from Burge and Burge’s misconstrual of Morales et al.’s claims. This shows that conceptually, the two teams are in large agreement, as Morales and Firestone (2022) also point out, and the focus should be put on the empirical disagreements, which has been covered by Morales and Firestone (2022). Relatedly, we argue that Burge and Burge (2022) misinterpret Morales et al. (2020) as supporting a new entity in perception science, and that this misinterpretation is a primary source of their apparent disagreement. This is worth pointing out because such misunderstanding generates many unnecessary quarrels that hinder progress. (shrink)

Hybrid expressivists claim to solve the Frege-Geach problem by offloading the explanation of the logico-semantic properties of moral sentences onto beliefs that are components of hybrid states they express. We argue that this strategy is undermined by one of hybrid expressivism’s own commitments: that the truth of the belief-component is neither necessary nor sufficient for the truth of the hybrid state it composes. We articulate a new approach. Instead of explaining head-on what it is for, say, a pair of moral (...) sentences to be inconsistent, expressivists should “sidestep” and explain what it is _to think that_ a pair of moral sentences is inconsistent. To think so is to think they cannot both be true – a modal notion. Since expressivists have given accounts of such modals, we illustrate how sentences like ‘“lying is wrong” and “lying is not wrong” are inconsistent’ express sensible – and rationally compelling – states of mind. Stories can be powerful argumentative vehicles, and they are often used to present arguments from analogy, most notably as parables, fables or allegories where the story invites the hearer to infer an important claim of the argument. Case Based Reasoning in Law has many similar features: the current case is compared to previously decided cases, and in case the similarity between the previous and current cases is deemed sufficient, a similar conclusion can be drawn for the current case. In this (...) article, we want to take a further step towards computationally modelling the connection between stories and argumentation in analogical reasoning. We show how story schemes can be used to investigate and determine story similarity, and how the point of a story – that is, the conclusion that the storyteller intends the hearer to draw – can be likened to the ratio decidendi in a legal case. This eagerly anticipated new book from Tony Lawson contends that economics can profit from a more explicit concern with ontology than has been its custom. By admitting that economics is not exactly a picture of health at the moment, Lawson hopes that we can move away from the bafflingly intransigent belief that economics is at its core reliant upon mathematical modelling. This maths-envy is the reason why economics is in a state of such disarray. Far from being a polemic (...) against the mainstream, this excellent new book is concerned that if economics is to be saved from itself then there must be a realistic dialogue between the classical heterodox fields. When theorising about disagreement, it is tempting to begin with a person's belief that p and ask what mental state one must have in order to disagree with it. This is the wrong way to go; the paper argues that people may also disagree with attitudes that are not beliefs. It then examines whether several existing theories of disagreement can account for this phenomenon. It argues that its own normative theory of disagreement gives the best account, and so, given that (...) there is good reason to believe disagreement without belief is possible, there is good reason to think that disagreement itself is normative. The social sciences often fail to examine in any systematic way the nature of their subject matter. This article argues that "gratitude to" and "gratitude that" are fundamentally different concepts. The former (prepositional gratitude) is properly a response to benevolent attitudes, and entails special concern on the part of the beneficiary for a benefactor, while the latter (propositional gratitude) is a response to beneficial states of affairs, and entails no special concern for anyone. Propositional gratitude, it is argued, ultimately amounts to a species of appreciation. The tendency to see prepositional gratitude and propositional “gratitude” as two species (...) of the same genus results from several deep-seated social and psychological factors, but must be resisted if we are to engage in constructive philosophizing about both gratitude and appreciation. In God and Human Freedom: A Kierkegaardian Perspective Tony Kim discusses Søren Kierkegaard’s concept of historical unity between the divine and human without disparaging their absolute distinction. Kim’s central analysis between the relation of God and human freedom in Kierkegaard presents God’s absoluteness as superseding human freedom, intervening at every point of His relation with the world and informing humanity of their existentially passive being. Kim argues Kierkegaard is not a strict voluntarist but deeply acknowledges God’s absoluteness and initiative (...) over and against human life. Moreover, the author’s exploration of unity in Kierkegaard points to the very ethics of who God is, one who loves the world.
