The themes of will and willing form a central but so far largely overlooked level of discourse in Hartmann’s Gregorius. At the heart of this discourse is the opposition between human and divine will, which is negotiated in terms of the tension between controllability and uncontrollability. To this end, Hartmann’s legendary romance takes recourse to a narrative pattern characteristic of, among others, the Latin legend of St. Brendan. Structuring the text and plot of Gregorius, it serves to present the (...) protagonist’s voyages on the water as a surrender to the will of God. When the protagonist decides to leave the monastery island, however, the pattern is conspicuously deviated from. It is through this deviation that the second instance of incest emerges as a personally attributable result of the protagonist’s attitude toward his creaturely will – which requires correction – rather than as guilt in the moral-theological sense. In Hartmann, a quasi-mystical theology of the will is molded into a narrative. In clear contrast to its French source, his adaptation thus reflects on the limits of human self-determination and controllability from an immanent perspective, the relationship to the world, as well as a transcendental perspective, the relationship to God. The prologue and Gregorius’s tablet suggest that Hartmann’s legend also deals with uncontrollability on a meta-level, as it ponders the problem of how the transcendent can be represented through narrative. This paper discusses three theses of the neo-republican analysis of the market. According to the first, one of the advantages of the market is its impersonality, meaning that no one needs to be tied to others because there are multiple possible partners. If freedom is identified with the lack of personal dependence on the uncontrolled power of third parties, then the market promotes free and horizontal relations. According to the second thesis, market exchanges have something distinctive to preserve freedom because (...) they allow participants to operate through offers instead of penalties. The paper examines various possible meanings of ‘dependence' and ‘independence' and argues, against the traditional interpretation, that personal dependence and penalties are significant aspects but not necessary conditions for domination. We can be exposed to uncontrolled power, thus to domination, even if we have multiple partners to turn to and without anyone being able to threaten or penalise us into accepting a deal. Finally, the third thesis asserts that market competition can nullify domination. The paper argues that domination could exist even with perfect competition. Nevertheless, it concludes by claiming that while we cannot take the three discussed arguments at face value, we must recognise their grain of truth. The market could disperse decision-making capacity, generating new opportunities and efficiency; however, to put it in a slogan: no decentralisation suffices without the effective dispersion of power. Since the publication of ChatGPT and Dall-E, there has been heavy discussions on the possible dangers of generative artificial intelligence (AI) for society. These discussions question the extent to which the development of AI can be regulated by politics, law, and civic actors. An important arena for discourse on AI is the news media. The news media discursively construct AI as a technology that is more or less possible to regulate. There are various reasons for an assumed regulatability. Some voices (...) highlight the predominant capitalism of modern society as an ideology that enforces an uncontrolled development of AI. Others call on the rationality of civic society, which will push AI toward a development that serves humankind. Summarized, the discourse on AI floats between positions of technological and social determinism. The article conducts a discourse analysis on 113 articles from the German newspapers Süddeutsche Zeitung and Frankfurter Allgemeine Zeitung. The analysis shows how these center-left and center-right media frame the AI development in terms of social and technological determinism. As these newspapers reach out to a large audience, the article shows the kinds of perspectives on AI that confront civic society in Germany every day. News media can motivate or impede social action, as they frame the potential necessity of society and its members to intervene against certain developments. The article shows how the newspapers promote an understanding of AI, by which citizens will feel motivated to insist on a regulation of AI by politics and law. (shrink)

Uncontrolled donation after circulatory death, which occurs when an individual has experienced unexpected cardiac arrest, usually not in a hospital, generates both excitement and concern. On the one hand, uDCD programs have the capacity to significantly increase organ donation rates, with good transplant outcomes—mainly for kidneys, but also for livers and lungs. On the other hand, uDCD raises a number of ethical challenges. In this essay, we focus on an issue that is central to all uDCD protocols: When should we (...) cease resuscitation and shift to organ preservation? Do current uDCD protocols prematurely consider as potential donors patients who could still have some chances of meaningful survival? Can the best interest of patients be fostered once they are considered and treated as potential donors? (shrink)

It is well established that beliefs provide powerful cues that influence reasoning. Over the last decade research has revealed that judgments based upon logical structure may also pre-empt deliberative reasoning. Evidence for ‘intuitive logic’ has been claimed using a range of measures (i.e. confidence ratings or latency of response on conflict problems). However, it is unclear how well such measures genuinely reflect logical intuition. In this paper we introduce a new method designed to test for evidence of intuitive logic. In (...) two experiments participants were asked to make random judgments about the logical validity of a series of simple and complex syllogistic arguments. For simple arguments there was an effect of logical validity on random responding, which was absent for complex arguments. These findings provide a novel demonstration that people are intuitively sensitive to logical structure. (shrink)

Ruben Östlund’s film Force Majeure was mostly received as a depiction of the crisis of masculinity. And it is, but that particular theme is also placed within a larger context concerning questions of value, understanding, order, and control, questions asked not only on a thematic level but also through cutting, framing, and the use of camera views. Not accepting any simple dichotomy between form and meaning, Force Majeure places itself firmly in an avant- garde and modernist tradition. Thereby the film (...) is also related to this tradition’s ambition of investigating Western thought, knowledge and art anew, problematising given forms of rational thinking in order for something new to emerge. In the wake of World War II it was, for thinkers like Adorno, Foucault, Stockhausen, and Boulez, seen as unavoidable and urgent to deconstruct the conventions and norms that had made Auschwitz possible. It is still urgent. This article takes its starting point in the connections between avant-garde serialism in music, Foucault’s serialist methods of research and Deleuze’s theories of modernist film, in order to grasp how the aesthetics of Force Majeure continues to deconstruct. In the bracket mushroom, Schizophyllum commune, a recessive genetic alteration, mnd, causes abnormally hyperplastic three‐dimensional mounds of hyphae to rise from the surface of both haploid and dikaryotic mycelia. mnd, although not a genetic block in the fruiting body developmental pathway, is at least partially epistatic to fruiting. Within dikaryons containing both mutant and wild‐type nuclei, [mnd + mnd+], a nonreciprocal somatic recombination event can lead to stable conversion of the mnd+ region of the wild‐type nucleus to mnd. This transformation (...) to the homoallelic [mnd + mnd] condition involves no genomic areas other than the mnd region and permanently prevents any further fruiting. Studies relating to the recombination mechanism have ruled out a diploid intermediate state and other concomitants of orthodox somatic recombination, as well as whole chromosome transfer. Instead, a novel form of internuclear genetic transfer is postulated whereby a nearby locus, mob+, controls the mobilization of the mnd chromosomal region alone from one nucleus to the other within the binucleate cells of dikaryotic mycelia. The most controversial issue in organ donation after the circulatory determination of death is whether the donor was truly dead at the moment death is declared. My colleagues and I further analyzed this issue by showing the relevance of the distinction between the “permanent” and the “irreversible” loss of circulatory functions. Permanent cessation means that circulatory function will not return because it will not be restored spontaneously and medical attempts to restore it will not be conducted. By contrast, irreversible cessation (...) means that circulatory function cannot be restored using currently available technology. In this issue of the Report, Kevin Munjal and colleagues criticize the unjustified application of the permanent‐irreversible distinction, which my colleagues and I developed for cDCDD, to their well‐designed and carefully conducted experimental protocol of uncontrolled DCDD (uDCDD) in New York City, for which our analysis was not targeted. They claimed that to determine a donor's death in uDCDD, it is unnecessary to show that permanence is a valid surrogate indicator of irreversibility because the unsuccessful attempt to resuscitate the patient comprises prima facie evidence of circulatory irreversibility. Ironically, that potent justification defending death determination in uDCDD yields limitations that are similar to those created when our permanent‐irreversible distinction is applied to death determination in cDCDD. This chapter argues that doubts about the scientific status of the field sciences often rest on mistaken preconceptions about the nature of the evaluative relation between empirical evidence and hypothesis or theory, namely, that it is some sort of formal logical relation. It argues that there is a potentially more fruitful approach to understanding the nature of the support offered by empirical evidence to scientific hypotheses. The first part of the chapter briefly reviews the traditional philosophical take on the scientific (...) method in order to clarify its most serious problems. It shows that these problems are greatly exacerbated when science moves from the artificially controlled environment of the laboratory to the messy uncontrollable world of nature. The second part ferrets out some highly general, causal components in the methodological reasoning of nonhistorical field scientists. It argues that differences in patterns of evidential reasoning in the experimental sciences versus the field sciences, and in the historical versus nonhistorical field sciences, seem tailored to pervasive causal differences in their epistemic situations. This article contains a reply to Guido Vanheeswijck’s critical study of my book Vloeibare waarden. Politiek, zorg en onderwijs in de laatmoderne tijd. I respond to his criticisms on the following topics: what is behind the liquidity of values; conservatism and the sacred; autonomy and the transcendence of values. The discussion also contains insights relevant to these topics from the work of Leszek Kolakowki.

Given the colexification of perception and cognition, Georgakopoulos et al. (2022. Universal and macro-areal patterns in the lexicon: A case-study in the perception-cognition domain. Linguistic Typology 26(2). 439–487) claim that uncontrolled experience rather than controlled activity has a direct linkage to cognition. To test whether this is a universal tendency, this study conducts a contrastive behavioral profile analysis of two basic vision verbs in Mandarin: kàn, a controlled activity verb, and jiàn, an uncontrolled experience verb. The results show that (i) (...) both kàn and jiàn colexify visual activity and cognitive senses; (ii) kàn is able to express a wider range of cognitive meanings, i.e., know, understand, and think, whereas jiàn only extends into know; and (iii) visual and cognitive meanings have more proximal relationships in the colexification pattern of kàn than that of jiàn. The study confirms the universality of the colexification between vision and cognition while providing counterexamples to the above-mentioned large data-based findings. Accordingly, a dichotomy of controlled activity versus uncontrolled experience is proposed for the colexification of vision and cognition in cognitive typology. (shrink)

The act-pattern model of altruism is primarily a brand-equity model, which holds that being altruistic can be traded for social benefits. This is a variant of the “selfish” altruism that Rachlin decries, with altruism being dictated by cold calculations. Moreover, personal and social “self-control” may not be as similar as Rachlin suggests – although we have good (biological) reasons to sacrifice the interests of our current selves in favour of our future selves, we have no such reason to sacrifice ourselves (...) for our neighbours. When we do sacrifice ourselves – giving in to true altruism – we will be repaid with extinction. (shrink)

In the early days of organ transplantation from deceased donors, the surgical team would bring the donor into the operating room with the recipient, the respirator would be stopped, and the team would wait for the donor’s heart to cease beating. This type of organ donation has been defined as donation after cardiac death, also referred to as non-heart-beating donation. These donors were not declared dead using neurological criteria, but rather using conventional cardiorespiratory criteria. In 1959, Mollaret and Goulon coined (...) the term “coma dépassé” for the patients with an irreversible state of coma and apnea. Jean Morelle and Guy Alexandre of the Catholic University of Louvain, Belgium, were the first to introduce a set of brain death criteria based on the description of coma dépassé, and carried out, in 1963, the first transplants from a brain dead donor in their country and in the world. Multiple sensory signals from visual, somatosensory and vestibular systems are used for human postural control. To maintain postural stability, the central nervous system keeps the center of mass (CoM) within the base of support. The influence of the stomatognathic motor system on postural control has been established under static conditions, but it has not yet been investigated during dynamic steady-state balance. The purpose of the study was to investigate the effects of controlled stomatognathic motor activity on the control and stability (...) of the CoM during dynamic steady-state balance. A total of 48 physically active and healthy adults were assigned to three groups with different stomatognathic motor conditions: jaw clenching, tongue pressing and habitual stomatognathic behavior. Dynamic steady-state balance was assessed using an oscillating platform and the kinematic data were collected with a 3D motion capturing system. The path length (PL) of the 3D CoM trajectory was used for quantifying CoM sway. Temporal dynamics of the CoM movement was assessed with a detrended fluctuation analysis (DFA). An uncontrolled manifold (UCM) analysis was applied to assess the stability and control of the CoM with a subject-specific anthropometric 3D model. The statistical analysis revealed that the groups did not differ significantly in PL, DFA scaling exponents or UCM parameters. The results indicated that deliberate jaw clenching or tongue pressing did not seem to affect the sway, control or stability of the CoM on an oscillating platform significantly. Because of the task-specificity of balance, further research investigating the effects of stomatognathic motor activities on dynamic steady-state balance with different movement tasks are needed. Additionally, further analysis by use of muscle synergies or co-contractions may reveal effects on the level of muscles, which were not visible on the level of kinematics. This study can contribute to the understanding of postural control mechanisms, particularly in relation to stomatognathic motor activities and under dynamic conditions. (shrink)

Despite successful transplantation outcomes in Europe, uncontrolled organ donation after circulatory determination of death has essentially been a non-starter in North America. In this paper, I identify and explore a set of interesting, ethics-related considerations that are of relevance to this organ donation-transplantation practice. The analysis provides a theoretical platform for my development of a proposal for the creation of a particular ethical practice and policy space for kidney uDCDD in the U.S. and Canada that recognizes and aims to effectively (...) address the various, identified challenges and constraints. Ontologies formally represent reality in a way that limits ambiguity and facilitates automated reasoning and data fusion, but is often daunting to the non-technical user. Thus, many researchers have endeavored to hide the formal syntax and semantics of ontologies behind the constructs of Controlled Natural Languages (CNLs), which retain the formal properties of ontologies while simultaneously presenting that information in a comprehensible natural language format. In this paper, we build upon previous work in this field by evaluating prospects of implementing (...) International Technology Alliance Controlled English (ITACE) as a middleware for ontology editing. We also discuss at length a prototype of a natural language conversational interface application designed to facilitate ontology editing via the formulation of CNL constructs. (shrink)

Organ donation after cessation of circulation and respiration, both controlled and uncontrolled, has been proposed by the Institute of Medicine as a way to increase opportunities for organ procurement. Despite claims to the contrary, both forms of controlled and uncontrolled donation after cardiac death raise significant ethical and legal issues. Identified causes for concern include absence of agreement on criteria for the declaration of death, nonexistence of universal guidelines for duration before stopping resuscitation efforts and techniques, and assumption of presumed (...) intent to donate for the purpose of initiating temporary organ-preservation interventions when no expressed consent to donate is present. From a legal point of view, not having scientifically valid criteria of cessation of circulation and respiration for declaring death could lead to a conclusion that organ procurement itself is the proximate cause of death. Although the revised Uniform Anatomical Gift Act of 2006 provides broad immunity to those involved in organ-procurement activities, courts have yet to provide an opinion on whether persons can be held liable for injuries arising from the determination of death itself. Preserving organs in uncontrolled donation after cardiac death requires the administration of life-support systems such as extracorporeal membrane oxygenation. These life-support systems can lead to return of signs of life that, in turn, have to be deliberately suppressed by the administration of pharmacological agents. Finally, allowing temporary organ-preservation interventions without expressed consent is inherently a violation of the principle of respect for a person's autonomy. Proponents of organ donation from uncontrolled donation after cardiac death, on the other hand, claim that these nonconsensual interventions enhance respect for autonomy by allowing people, through surrogate decision making, to execute their right to donate organs. However, the lack of transparency and the absence of protection of individual autonomy, for the sake of maximizing procurement opportunities, have placed the current organ-donation system of opting-in in great jeopardy. Equally as important, current policies enabling and enhancing organ procurement practices, pose challenges to the constitutional rights of individuals in a pluralistic society as these policies are founded on flawed medical standards for declaring death. Background: Omalizumab, an anti-immunoglobulin E antibody, reduces exacerbations and symptoms in uncontrolled allergic asthma. The study objective was to estimate the costs and consequences of omalizumab compared to usual care from a US payer perspective. Methods: We estimated payer costs, quality-adjusted survival (QALYs), and the incremental cost-effectiveness ratio (ICER) of omalizumab compared to usual care using a state-transition simulation model that included sensitivity analyses. Every 2 weeks, patients could transition between chronic asthma and exacerbation health states. The best available evidence (...) informed the clinical and cost input estimates. Five years of omalizumab treatment followed by usual care was assumed to estimate a lifetime horizon. Omalizumab responders (60.5% of treated) were modeled as a separate scenario where nonresponders reverted back to usual care after 16 weeks of active treatment. Results: The mean lifetime discounted costs and QALYs were $83 400 and 13.87 for usual care and $174 500 and 14.19 for omalizumab plus usual care resulting in $287 200/QALY (95% interval: $219 300, $557 900). The ICER was $172 300/QALY when comparing omalizumab to usual care in the responder scenario. One-way sensitivity analyses indicated that the results were sensitive to the difference in treatment-specific utilities for the chronic state, exacerbation-associated mortality, omalizumab price, exacerbation rates, and response definition. Conclusions: The results suggest that adding omalizumab to usual care improves QALYs at an increase in direct medical costs. The cost-effectiveness of omalizumab is similar to other chronic disease biologics. The value increases when omalizumab response is used to guide long-term treatment. (shrink)

For some time now, I have written and talked about Thomas Jay Oord as the most "cutting edge" person on the theological scene today. This may sound like a bold claim, but what Oord has accomplished in bridging the gap between evangelicals and liberals is remarkable both in terms of background and personal commitment. He has a foot in the evangelical camp, yet as a product of Claremont Graduate University, he has another foot solidly in the liberal camp. Intellectually, at (...) least, Oord has had an easygoing relationship with both camps. As a result of his indefatigable efforts, the Open and Relational Theologies Group of the American Academy of Religion has been one of the best attended and most successful groups... (shrink)

One of the most controversial aspects in uncontrolled donation of organs after circulatory death is the initiation of preservation measures before death. I argue that in so-called opting-out systems only under very stringent conditions we might presume consent to the instauration of those measures. Given its current legal framework, I claim that this is not the case of Spain, a well-known country in which consent is presumed—albeit only formally—and where uDCD is currently practiced.

Most donated organs in the United States come from brain dead donors, while a small percentage come from patients who die in “controlled,” or expected, circumstances, typically after the family or surrogate makes a decision to withdraw life support. The number of organs available for transplant could be substantially if donations were permitted in “uncontrolled” circumstances–that is, from people who die unexpectedly, often outside the hospital. According to projections from the Institute of Medicine, establishing programs permitting “uncontrolled donation after circulatory (...) determination of death,” or uDCDD, throughout the United States has the potential to provide 22,000 more donation opportunities annually. In contrast, U.S. controlled donation after circulatory determination of death, or cDCDD, cases have increased progressively over the past decade from 87 to 848 donors, but currently account for only 10.6 percent of all deceased donors. Following the IOM recommendations, several projects exploring the feasibility of uDCDD were funded by the federal government, including a grant from the Health Resources and Services Administration that supported a pilot project in New York City in which the authors of this article participated.A key feature of our protocol, and indeed of many uDCDD protocols, is the initiation of preservation methods such as chest compressions and extracorporeal membrane oxygenation shortly after death in order to perfuse and preserve the donor's organs. Critics of uDCDD argue that the means of determining death deviates from generally ascribed principles. They assert that reinstituting circulation in order to preserve organs has the effect of “undoing” the prior determination of death. The result is that cDCDD is widely accepted and practiced routinely even though it only marginally increases the number of organs available for transplantation, and uDCDD is widely considered unacceptable despite being ethically embraced and proven to significantly increase organ donation opportunities in other countries. This article explores the evolution of this counterintuitive state of affairs and calls for a policy that, in line with the IOM report, allows for both cDCDD and uDCDD protocols. (shrink)

The ever‐increasing demand for organs led Spain, France, and other European countries to promote uncontrolled donation after circulatory determination of death (uDCDD). For the same reason, New York City has recently developed its own uDCDD protocol, which differs from European programs in some key ways. The New York protocol incorporates a series of technical and management improvements that address some practical problems identified in response to European uDCDD protocols. However, the more fundamental issue of whether uDCDD donors are dead when (...) organs are procured remains problematic for the New York City protocol and, indeed, for all uDCDD protocols. In the United States, two amendments to the legal criteria of death have been suggested to avoid a formal violation of the dead donor rule in DCDD protocols: first, replacing the requirement “irreversible” with the weaker term “permanent,” and second, using the term “circulatory” instead of “cardiac” to identify the key function that must be lost to declare death. While intended to facilitate controlled DCDD, these modifications create a problem for uDCDD protocols: if extracorporeal membrane oxygenation is introduced to preserve the organs, then circulation is restored after death is declared. In this issue of the Hastings Center Report, Kevin Munjal and colleagues call for a new ethical construct and policy so that uncontrolled and controlled DCDD can coexist. (shrink)

The features are obtained, modeled and stored for further reference when the system is to be tested. Decision whether to accept or reject speakers are taken based on parameters of the data modeling techniques. Real world offers various degradations to the signal that hamper the signal quality. The degradations may be due (...) to ambient background noise, reverberation or multispeaker scenario. This paper presents a survey of various feature extraction, data modeling methods, metrics that are used to take the decisions and methods that can be used to preprocess the degraded data that have been used to perform the task of speaker recognition. In this paper, we assume that organ donation policy in the United States will continue to be based on an opt-in model, requiring express consent to donate, and that families will continue to have the prerogative to make donation decisions whenever the deceased person has not recorded his or her own preferences in advance. The limited question addressed here is what should be done when a potential donor dies unexpectedly, without any recorded expression of his or her wishes at hand, (...) while a family decision is being sought. The COVID-19 crisis has forced a difficult trade-off between limiting the health impacts of the virus and maintaining economic activity. Welfare economics offers tools to conceptualize this trade-off so that policy-makers and the public can see clearly what is at stake. We review four such tools: the Value of Statistical Life (VSL); the Value of Statistical Life Years (VSLYs); Quality-Adjusted Life-Years (QALYs); and social welfare analysis, and argue that the latter are superior. We also discuss how to choose policies that (...) differentially affect people’s wellbeing. We argue in favor of evaluating policies using a Social Welfare Function (SWF), which evaluates the possible distributions of wellbeing across individuals that may result from a policy. Such a function, we argue, should regard increases in the wellbeing of the less well-off as especially valuable. We then use a model to illustrate how such a framework can help evaluate two broad policy types in response to the pandemic: eradication of the virus, and more lenient control of the spread. Our model reveals how such evaluations depend on many empirical facts but also on key value judgments about the relative importance of health and on the extent of special concern for the worse off. The purpose of this brief is not to make precise recommendations, as conditions vary widely across countries and over time, but to provide a methodology. (shrink)

Canonical utility theory may have adopted its selfishness postulate because it lacked theoretical rationales for two major kinds of incentive: empathic utility and self-signaling. Empathy – using vicarious experiences to occasion your emotions – gives these experiences market value as a means of avoiding the staleness of self-generated emotion. Self-signaling is inevitable in anyone trying to overcome a perceived character flaw. Hyperbolic discounting of future reward supplies incentive mechanisms for both empathic utility and self-signaling. Neither can be effectively suppressed for (...) an experimental game. (shrink)

This is a review of Thomas Jay Oord’s book on The Uncontrolling Love of God in which he develops a very persuasive and highly original process account of how God’s love, power, and providence relate to matters of human freedom, randomness in nature and history, natural laws, miracles, and evil. This review summarizes the main points in each of his eight chapters and offers a few critical and constructive comments on them.

As of January 1, 2008, over 98,000 people are waiting for organ transplants in the United States of America. Of those, nearly 75,000 are waiting for a kidney. In this calendar year, fewer than 15,000 will receive a kidney transplant from a deceased donor. The average waiting time for a deceased donor kidney now exceeds five years in virtually all metropolitan areas. Sadly, nearly as many people die waiting as there are deceased donors each year, despite monumental efforts by the (...) entire transplant community to increase both the number of organ donors and the number of organs recovered from each donor. The imbalance between demand and supply has led to considerable efforts to expand the criteria for what is considered an acceptable organ donor by the Organ Procurement and Transplant Network, thereby hoping somewhat to assuage the shortfall of donor organs. So-called Expanded Criteria Donors may be older than 50, have history of hypertension, or have died from intracerebral hemorrhage and/or have impaired renal function. ECDs now make up nearly 40% of the donor population. (shrink)
