This work offers a new theory of what it means to be a legal person and suggests that it is best understood as a cluster property. The book explores the origins of legal personhood, the issues afflicting a traditional understanding of the concept, and the numerous debates surrounding the topic.

This article introduces a new formulation of the interest theory of rights. The focus is on ‘Bentham’s test’, which was devised by Matthew Kramer to limit the expansiveness of the interest theory. According to the test, a party holds a right correlative to a duty only if that party stands to undergo a development that is typically detrimental if the duty is breached. The article shows how the entire interest theory can be reformulated in terms of the test. The article (...) then focuses on a further strength of the interest theory, brought to the fore by the new formulation. In any Western legal system, the tortious maltreatment of a child or a mentally disabled individual results in a compensatory duty. The interest theory can account for such duties in a simple and elegant way. The will theory, on the other hand, struggles to explain such compensatory duties unless it abandons some of its main tenets. (shrink)

Freethinking seems to be desirable because the human being is seen as an independently thinking being. However, as is well known, freethinking should not be taken for granted: ideological indoctrination, manipulation and propaganda, inter alia, are versatile tools for rulers and, in consequence, regularly repeated phenomena. One of the most drastic intellectual turning points in history occurred in the seventeenth and eighteenth centuries, when the incontestable religious world view of European civilization changed along with early modern science and the Age (...) of Enlightenment. Although freethinking and religion do not have to be thought of as opposed, the period in question includes instances of complex and delicate phenomena, which in this article are termed intellectual purism and socio-intellectual control. This edited work collates novel contributions on contemporary topics that are related to human rights. The essays address analytic-descriptive questions, such as what legal personality actually means, and normative questions, such as who or what should be recognised as a legal person. As is well-known among jurists, the law has a special conception of personhood: corporations are persons, whereas slaves have traditionally been considered property rather than persons. This odd state of affairs has not garnered the interest of legal theorists (...) for a while and the theory of legal personhood has been a relatively peripheral topic in jurisprudence for at least 50 years. As readers will see, there have recently been many developments and debates that justify a theoretical investigation of this topic. Animal rights activists have been demanding that some animals be recognized as legal persons. The field of robotics has prompted questions about driverless cars: should they be granted a limited legal personality, so that the car itself would be responsible for damages? This book explores such concepts and touches on matters of bioethics, animal law and medical law. This article examines the embeddedness of corporate social responsibility (CSR) communications in strategic planning. By drawing on the idea that talk and texts about CSR are an essential part of responsibility practices, I study how CSR aspirations—responsibility-related organizational self-descriptions, goals, and ideals that the organization cannot yet live up to or that the organizational constituents deem necessary to maintain—are intertwined with strategy texts and strategic episodes. Conducting a qualitative case study on a series of biennial strategy processes over a 20-year (...) period, I show how CSR aspirations are established in authoritative strategy documents during stakeholder interactions, elaborated in consecutive strategic episodes, extended to new business areas, and evaluated in subsequent communications. These findings contribute to the CSR and strategy literature by showing how (a) aspirational talk can be established and perpetuated through recurrent communicative processes, (b) stakeholder engagement in CSR issues can influence strategy texts and how strategy texts become a part of intertextual organizational communications, and (c) strategic context can be conducive to progressive performativity. The chapter argues that the traditional theories of legal personhood, which associate legal personhood with the holding of rights, are outdated and should be reassessed. Many modern theories of rights come into conflict with our convictions regarding who or what is a legal person. For instance, most jurists would agree that foetuses are not natural persons but new-born children are. However, if we apply the so-called interest theory of rights, we will note that foetuses hold various rights, such as rights (...) against certain forms of abortion. If right-holding entails legal personality, then foetuses are already legal persons. On the other hand, if we apply the will theory, which associates right-holding with the power to control others’ duties, then infants do not hold any rights at all – and are consequently not legal persons. This is why the chapter outlines an alternative theory of legal personhood. The main tenets of the theory are: (1) legal personality is not binary but rather a matter of degree, and (2) X’s legal personality involves primarily the endowment of X with incidents of legal personhood, much like ownership can be understood as consisting of separate but interconnected incidents. Rather than being a “solved” theoretical issue, the definition of legal personhood should occupy theorists more in the future. (shrink)

A relatively recent form of animal activism is lawsuits intended to declare some animals as legal persons. A pioneer of this approach is the U.S.-based Nonhuman Rights Project. This organization’s primary strategy has been to invoke the writ of habeas corpus, which protects the right to personal freedom of “persons.” The article criticizes the notion of legal personhood that the NhRP is employing and explains how an alternative understanding of legal personhood could perhaps make nonhuman rights more palatable for courts.

The Article analyzes the notion of legal “thinghood” in the context of the person–thing bifurcation. In legal scholarship, there are numerous assumptions pertaining to this definition that are often not spelled out. In addition, one’s chosen definition of “thing” is often simply taken to be the correct one. The Article scrutinizes these assumptions and definitions. First, a brief history of the bifurcation is offered. Second, three possible definitions of “legal thing” are examined: Things as nonpersons, things as rights and duties, (...) and things as property. The first two definitions are rejected as not being very interesting or serving any heuristic function. Conversely, understanding legal things as property is meaningful, useful, and helps to understand what it means to say that animals are legally things. Defining things as property has certain rather important implications, which are analyzed at the end of the Article. For instance, not everything needs to be either a person or a thing: The historical institution of outlawry involved treating individuals neither as legal persons nor as legal things. One must conclude that the person–thing bifurcation is less fundamental than is often assumed. (shrink)

Hillel Steiner has recently attacked the notion of inalienable rights, basing some of his arguments on the Hohfeldian analysis to show that infinite arrays of legal positions would not be associated with any inalienable rights. This essay addresses the nature of the Hohfeldian infinity: the main argument is that what Steiner claims to be an infinite regress is actually a wholly unproblematic form of infinite recursion. First, the nature of the Hohfeldian recursion is demonstrated. It is shown that infinite recursions (...) of legal positions ensue regardless of whether inalienable rights exist or not. Second, the alleged problems that this might pose for the analysis are discussed. The conclusion is that one should not worry about the recursion as long as one understands correctly the role of the Hohfeldian analysis in normative reasoning. (shrink)

It has been debated whether the so-called attention economy, in which the attention of agents is measured and sold, jeopardizes something of value. One strand of this discussion has focused on so-called attention rights, asking: should attention be legally protected, either by introducing novel rights or by extending the scope of pre-existing rights? In this paper, however, in order to further this discussion, we ask: How is attention already protected legally? In what situations does a person have the right to (...) attention under current law? -/- Unlike (Chomanski, Neuroethics 16:1–11, 2023), who discusses an overall right to attention, or (Puri, Rutgers Law Record 48:206–221, 2021), who discusses an overall right to attentional privacy, in this paper we focus on two types of situations in which a person’s attention is already protected by legal regulation. Sustained attention-requiring tasks can be jeopardized by distractions whereas attentiveness to certain kind of stimuli can be jeopardized by immersive stimuli. That is why distractions are regulated in situations where an agent has what we call a concentration right and immersive stimuli are regulated in situations where an agent has what we call a duty to be attentive. The further analysis of these situations provides an understanding of the legal means by which attention is already regulated, which can be helpful when thinking about how it should be regulated in the future. RNA polymerase II is recruited to DNA double‐strand breaks (DSBs), transcribes the sequences that flank the break and produces a novel RNA type that has been termed damage‐induced long non‐coding RNA (dilncRNA). DilncRNAs can be processed into short, miRNA‐like molecules or degraded by different ribonucleases. They can also form double‐stranded RNAs or DNA:RNA hybrids. The DNA:RNA hybrids formed at DSBs contribute to the recruitment of repair factors during the early steps of homologous recombination (HR) and, in this way, contribute to (...) the accuracy of the DNA repair. However, if not resolved, the DNA:RNA hybrids are highly mutagenic and prevent the recruitment of later HR factors. Here recent discoveries about the synthesis, processing, and degradation of dilncRNAs are revised. The focus is on RNA clearance, a necessary step for the successful repair of DSBs and the aim is to reconcile contradictory findings on the effects of dilncRNAs and DNA:RNA hybrids in HR. (shrink)

In this article, the authors introduce the concept of a “queer counter-mythology.” They do so by discussing a speculative song they wrote as an enactment of research-creation. Research-creation names an interdisciplinary scholarly praxis where artist-scholars create the artefacts they want to think-with, rather than analysing existing cultural productions. The song discussed in this article, “Cosmic Beavers,” proposes a queer counter-mythology that reimagines the historical, colonial archive by foregrounding the stories of giant, trans-dimensional beavers who shred Lewis and Clark and (...) use them to reinforce their Time-Dam. Drawing on this song, as well as queer theories of time and anti-colonial thinkers, the authors suggest that artistic interventions invoke speculative lures that, while not changing history, can complicate state-sanctioned archives and narratives of the past and future: they frame this intervention as a queer counter-mythology. The possibility of seeding other planets with life poses a tricky dilemma. On the one hand, directed panspermia might be extremely good, while, on the other, it might be extremely bad depending on what factors are taken into consideration. Therefore, we need to understand better what is ethically at stake with planetary seeding. I map out possible conditions under which humanity should spread life to other solar systems. I identify two key variables that affect the desirability of propagating life throughout (...) the galaxy. The first is axiological and depends on which value theory in environmental ethics is correct. The second is empirical and depends on whether life is common or not in our region of the universe. I also consider two ethical objections to an interplanetary life-seeding mission: the risk of interfering with indigenous life and the risk of increasing suffering in our galaxy. (shrink)

Humans are unique in their ability to create systematic accounts of the world - theories based on guiding cosmological principles. This book is about the role of cognition in creating cosmologies, and explores this through the ethnography and history of Yijing divination in China. Many of us have encountered a version of what Zachary Horton calls the "cosmic zoom"--a visual journey through the many scales of the universe, from the microscopic to the cosmic. Most of our daily perception operates at a level of scale somewhere between that of quarks and galaxies, and it is this comfort with the immediately visible everyday world that the cosmic zoom unsettles. In Mediating Scale, Horton uses the history of the cosmic zoom to explore (...) how that scale itself has been constructed over the past seventy years. How has cosmic zoom media influenced scientific and popular understanding of the unseen world and how it may be known, accessed, and exploited? Horton insists that scale is the key to understanding and addressing major contemporary issues including climate change and big data, but people working on issues of scale in various disciplines often talk past each other. Horton starts by sketching four common ways of thinking about scale derived from cartography, physics, engineering/biology, and mathematics. In this book, the authors present current research in the study of Cosmic Passion for the Aesthetic. It engages arts from different tradition, showing their cultural contexts and discloses dimensions of awareness that transgress the characteristics of art works. This book delves into the deeper meaning of art, and shows how various cultures attempt to suppress other cultures and their arts, and how the suppressed reappear and reassert themselves in new contexts. It travels through different conceptions, speculations, definitions and (...) portrays how the aesthetic, the expressive, that is not identical with the characteristics of an art work, is what all art works attempt to capture. The aesthetic encompasses the passionate dimension which is not limited or reducible to anything -- it is cosmic. The latter is disclosed by the aesthetic passion that is most apparent in comparative studies of arts, above all through examining the art of India, the text visually captures the aesthetic, cosmic passion. In addition, it questions what is aesthetic value, judgements on art, the authors draw on how the depictions of the cosmic in art can assume a way of understanding specific interpretation of space, time and movement prior to any theological, mythical, theoretical or even scientific explanations and portray a flow of sensuous envelopment which resonates with cosmic passion. This book would interest not only artists, but students of cultures and comparative civilisations, and indeed for those who are interested in the ways that cosmic awareness has been and is being explicated in civilisations. In November 2011, Citizenship and Immigration Canada paused the parents/grandparents (PGP) sponsorship immigration and announced a new Super Visa program simultaneously to facilitate family reunification, specifically among older adults waiting to be reunified with their children in Canada. We conducted a qualitative study to understand the experiences of immigrant families with the Super Visa Program. In total, 19 semi-structured interviews were conducted in Toronto with Chinese immigrants and parents holding a Super Visa. Our findings revealed that Super Visa program is (...) helpful for family reunification, especially for those whose regular visa applications are not successful. However, Super Visa is still a visitor visa and parents/grandparents have to leave after a maximum of two years. This temporary status of their parents does not promote among immigrants a sense of belonging in Canada, but reinforces their feeling of being treated as “foreigner”. They also debunked the stigma that older parents/grandparents come to Canada for better welfare and are non-contributor and a burden to Canadian society. We observe older parents/grandparents are categorized as “undesirable” and their unpaid contributions to immigrant family and Canada society are rendered invisible. We argue there exits an inherent link between PGP policy changes and social injustice. Behind the negative portrayal of older parents/grandparents and policy changes on them is State’s neoliberal governmentality grounded upon market norms and mechanism. The immigration and social injustice inflicting on older PGP migrants manifests that neoliberal immigration regime is still structurally raced, gendered, classed, and may be intertwined with other stigmatizing dynamics such as ageist, ableist etc. within the State’s power relationship. This paper explores a special kind of loop of grounding: cosmic loops. A cosmic loop is a loop that intuitively requires us to go "around" the entire universe to come back to the original ground. After describing several kinds of cosmic loop scenarios, I will discuss what we can learn from these scenarios about constraints on grounding; the conceivability of cosmic loops; the possibility of cosmic loops; and the prospects for salvaging local reflexivity, asymmetry and (...) transitivity of grounding in a world containing a cosmic loop of ground. The considerations raised in this paper also bear on what we should think about relations that are meant to support grounding relations: in particular, revisions to theories of the part-whole relation are discussed. The phrase “cosmic consciousness” has a surprising and fascinating history. I will show how it first enters into circulation in the writings of the remarkable Englishman Edward Carpenter, a socialist, philosopher, and prescient activist for gay rights and prison reform. Carpenter made a trip to India and Sri Lanka in 1890, where he spent two months sitting at the feet of Ramaswami, an Indian sage and disciple of Tilleinathan Swami. Carpenter invents the phrase in order to paraphrase Ramaswami’s teaching, (...) which was itself a commonplace among the Advaita-inspired sages of the period, that there is in human beings the possibility of an all-encompassing consciousness. Later still, in the writings of William James and others, the phrase acquires a new and different meaning in the idea that the cosmos itself exhibits a form of consciousness. James, indeed, uses just this phrase in his early formulation of cosmopsychism. (shrink)

What exists at the fundamental level of reality? On the standard picture, the fundamental reality contains (among other things) fundamental matter, such as particles, fields, or even the quantum state. Non-fundamental facts are explained by facts about fundamental matter, at least in part. In this paper, I introduce a non-standard picture called the "cosmic void” in which the universe is devoid of any fundamental material ontology. Facts about tables and chairs are recovered from a special kind of laws that (...) satisfy strong determinism. All non-fundamental facts are completely explained by nomic facts. I discuss a concrete example of this picture in a strongly deterministic version of the many-worlds theory of quantum mechanics. I discuss some philosophical and scientific challenges to this view, as well as some connections to ontological nihilism. (shrink)

A woman and a man desire to come together stirred by the primal fire of Kama and the man deposits his egg in the womb of the woman. This egg develops into a human undergoing nine or ten months of evolution. This process is the microscopic replication of the method evolved by God to create the universe. Rigveda (10.121) mentions Hiranyagarbha, the Golden Egg as the source of the creation of the universe. It is said that God, wishing to create (...) the world, produced an egg as big as the cosmos. God meditated for a thousand years sitting inside the egg and when the egg burst, the Lord himself was born out of the egg as the Progenitor of the universe (“He made Himself by Himself.”, Taitiriya Upanishad: 2.7.1). The Rishis called the Egg Brahmanda (the Cosmic Egg), and the Progenitor Manu. Scientists have discovered that the universe has an oval shape. Like the nine months of the evolution of the human egg, the Cosmic Egg also undergoes nine stages of evolution before it gets dissolved during what we call ‘Maha Pralaya’. The Puranas mention that Brahmanda has 14 biospheres, seven nether and seven upper inhabited by different types of souls. If we count from the human world, there are ten dimensions of consciousness. Rishis called these astral biospheres Mandalas/Lokas with different wavelengths and colours. Sri Karunakara Guru referred to them as Avasthas, or spiritual stages. The Buddhists and Hindu esoteric sects such as the Theosophical Society explain these levels of the Absolute in terms of Physical plane, Astral plane, Mental plane, Buddhic plane, Atmic plane, Anupadaka plane, Adi plane and Shiv and Shakti. These Avasthas are related to the expanding consciousness reaching up to the core of the Cosmic Egg, the Paramatma. Like a spider which creates a web around it sitting in the centre, and withdraws it in the end, Paramatma creates and withdraws webbed multi-dimensional universes. Nobody can say when it started and when it will end as it is a beginningless and endless process. (shrink)

The multiverse hypothesis is one of the leading proposed explanations of cosmic fine-tuning for life. One common objection to the multiverse hypothesis is that, even if it were true, it would not explain why this universe, our universe, is fine-tuned for life. To think it would so explain is allegedly to commit “the inverse gambler's fallacy.” This paper presents what the inverse gambler's fallacy is supposed to be, then surveys the discussion of it in the philosophical literature of the (...) last 35 years. David Benatar argues that one important consideration in favour of anti-natalism is based on the fact that all humans lack cosmic meaning; we will never transcend space and time such that we will have an impact on the entire universe, forever. Instead of denying Benatar’s claim that we lack cosmic meaning, Thaddeus Metz recently argues that our lack of cosmic meaning is not that significant because we ought not to regret lacking a good that we could not (...) have in the first place. He explains the principle behind this idea in modal terms: “the closer the world in which one could access a benefit, the more reasonable are attitudes such as sadness, disappointment, regret when does not acquire it.” I argue that this principle faces a serious counterexample in the form of death. The possible worlds in which one doesn’t die are incredibly distant. Yet, it is appropriate to express deep sadness, disappointment, and regret at the fact that one must inevitably face death. Metz is wrong that we shouldn’t regret lacking a good unavailable to us in the first place. His criticism of Benatar therefore fails. While it might be objected that immortality is not good, my basic point still stands when considering the fact that our lives are not significantly longer. Benatar’s claims about the significance of our lack of cosmic meaning might not be true, but not for the reasons suggested by Metz. (shrink)

After an introduction in which I rehearse some of the main elements of Stoic physics and psychology, I set out the evidence for the Stoic doctrine that the individual soul is both analogous to the cosmic soul and a part of it, as was held by the early exponents of the school (Section I). I argue that the doctrine threatened to land the Stoics in trouble, unless they were ready to qualify it by applying to it certain distinctions (Section (...) II). Then I consider the doctrine’s historical origins, discussing several possible antecedents of it, with a focus on a Socratic report in Xenophon and on Plato’s dialogues, and showing that the Stoics went beyond all their predecessors (Section III). After this historical excursus I turn to examine some of the arguments advanced by the early Stoics to prove that the cosmos has a soul, including one which compares the relation between the cosmos and the individual human beings to that between a father and his offspring (Section IV). This leads me to analyse in more detail this comparison, which occurs also in other contexts and is sometimes problematically connected with the notion that the individual soul is a part of the cosmic soul (Section V). One of the texts which are relevant to this issue, a report in Sextus Empiricus, is the object of a separate discussion in the final Appendix. (shrink)

I examine Bernard Williams’s forceful challenge that evolutionary science has done away with the sort of teleological worldview that is needed in order to make sense of an Aristotelian virtue ethic perspective. I also consider Rosalind Hursthouse’s response to Williams and argue that it is not sufficient. My main task is to show what is needed in order to meet Williams’s challenge. First, I argue that we need a deeper exploration of the first-personal evaluative standpoint from within our human form (...) of life than we find in Hursthouse’s ethical naturalist perspective. In particular, we need to recognize the important role of “strong evaluation” for identifying what is noblest and best about us as human beings, for this will enable us to address the “mixed bag” problem of human nature. Second, I argue—contra John McDowell’s quietism—that in order to make sense of such a normative account of human nature we must overcome Williams’s tragic cosmic outlook according to which human life is seen as ultimately without meaning and purpose.
