Italian Constitutional Justice in Global Context is the first book ever published in English to provide an international examination of the Italian Constitutional Court, offering a comprehensive analysis of its principal lines of jurisprudence, historical origins, organization, procedures, and its current engagement with transnational European law. The ItCC represents one of the strongest and most successful examples of constitutional judicial review, and is distinctive in its structure, institutional dimensions, and well-developed jurisprudence. Moreover, the ItCC has developed a distinctive voice among (...) global constitutional actors in its adjudication of a broad range of topics from fundamental rights and liberties to the allocations of governmental power and regionalism. Nevertheless, in global constitutional dialog, the voice of the ItCC has been almost entirely absent due to a relative lack of both English translations of its decisions and of focused scholarly commentary in English.This book describes the "Italian Style" in global constitutional adjudication, and aims to elevate Italian constitutional jurisprudence to an active participant role in global constitutional discourse. The authors have carefully structured the work to allow the ItCC's own voice to emerge. It presents broad syntheses of major areas of the Court's case law, provides excerpts from notable decisions in a narrative and analytical context, addresses the tension between the ItCC and the Court of Cassation, and positions the development, character, and importance of the ItCC's jurisprudence in the larger arc of global judicial dialog. In this paper I discuss Elias Ashmole’s collections and views about John Dee. I consider Dee as an object of collection against the broader background of Ashmole’s collecting practices. I also look at the uses to which Ashmole put some of his collections relating to Dee, as well as those which he envisaged for posterity. I argue that Ashmole’s interest in Dee stemmed from his ideas about the uses of antiquity in the reconstruction and transmission of knowledge. They partly reflected (...) Ashmole’s interpretation of Francis Bacon’s Advancement of learning as well as the influence of William Backhouse and William Oughtred’s ideas about publishing natural philosophy in English. The goal of this paper is to explore the presuppositionality of factive verbs, with special emphasis on the verbs know and regret. The hypothesis put forward here is that the factivity related to know and the factivity related to regret are two different phenomena, as the former is a semantic implication that is licensed by the conventional meaning of know, while the latter is a purely pragmatic phenomenon that arises conversationally. More specifically, it is argued that know is factive in (...) the sense that it both entails and presupposes p, while regret is factive in the sense that it only presupposes p. In a recent article, Hazlett, 497–522, 2010) shows with authentic examples how know is used non-factively in ordinary language, and he observes in these examples, as he says, “a threat to Factivity.” I argue that non-factive uses of factive verbs, such as know and regret, far from being a threat to factivity, show that, on the one hand, know is ambiguous between a factive and a non-factive sense; on the other hand, in the case of regret, the presupposition of factivity has to be intended as a merely pragmatic implication which can be suspended by the speaker herself. Ist Geschichtsdarstellung ein transparentes Fenster zu einer faktischen Vergangenheit? Oder verlieren Fakten ihre Verbindlichkeit zugunsten der Repräsentation? Der vorliegende Band weist einen vermittelnden Weg zwischen diesen Extremen. Jenseits der positivistisch verstandenen historischen Fakten sowie der infolge des linguistic turn häufig behaupteten Unzugänglichkeit und Unentscheidbarkeit der faktischen Vergangenheit wird die Geschichtsdarstellung selbst als das eigentlich Greifbare zur Geltung gebracht. Geschichte ist demnach in ihrer Darstellung zu suchen – unabhängig davon, ob es sich um historiographische Quellen, literarische Texte, Gemälde oder um Museen (...) als mediale Darstellungsräume handelt. Die Beiträge gehen einem breiten Spektrum unterschiedlicher Dimensionen von Geschichtsdarstellung nach. Medien, Methoden und Strategien bilden dabei die zentralen Koordinaten, anhand derer Geschichtsdarstellung mit ihren narrativen und bildlichen Ausdrucksformen exemplarisch erörtert wird. Die Korrespondenz zwischen körperlichen Merkmalen und dem Charakter eines Menschen, die im 19. Jahrhundert die Matrix für die Naturwissenschaften fungierte, stellt heute die Basis von Lifestyle-Normen oder auch von psychologischer und medizinischer Diagnostik dar. Infolge strukturalistisch-semiotischer Methoden gilt die Physiognomik immer noch als Deutungsdispositiv bei Formen literarischer Personendarstellungen oder philosophischer Deutung menschlichen Antlitzes. In den durch umfangreiche mediale und technische Umwälzungen hervorgebrachten Modellierungen der Sinnlichkeit erweist sich die Physiognomik auch als Paradigma des Enhancements. Der Band untersucht historisch und systematisch die (...) biopolitische Performativität physiognomischer Praktiken der Selbst- und Fremddeutung, ihre Gestaltung sowie ihre Transformationen durch neue Technologien. This essay aims to reappraise Agnes Arber's contribution to the history of science with reference to her work in the history of botany and biology. Both her first and her last books are classics: the former in the history of botany, the latter in that of biology. As such, they are still cited today, albeit with increasing criticism. Her very last book was rejected by Cambridge University Press because it did not meet the publisher's academic standards – we shall return (...) to it in due course. Despite Kathryn Packer's two essays about Arber's life in context, much remains to be done toward a just appreciation of her research. We need such a reappraisal in order to avoid anachronistic criticisms of her contributions to the historiography of botany, or, on the other hand, uncritical applause for her studies in plant morphology. Giordano Bruno’s interest in magic was not a marginal aspect of his philosophy. In the magical works written in 1589 and 1591, Bruno carried out his project of a cultural reform, which he also conceived as a pratical renovatio. In De magia naturali Bruno undertook a careful theoretical reexamination of Renaissance magic in order to ground its "experimental data" on physical foundation. Some traditional notions , which Bruno found in his sources and made use of, are analyzed in his paper (...) to show the deep change they underwent in the light of Bruno’s new ontology and cosmology. Na educação popular brasileira o termo �conscientização� é de uso muito freqüente. Muito citado nos diálogos cotidianos e nas elaborações escritas, não é sempre problematizado e historiado. Muitas vezes, especialmente nos âmbitos da educação formal, a circulação deste termo perdeu o seu sentido mais profundo e suas implicações políticas de transformação da sociedade. Neste artigo se problematiza o termo �conscientização� a partir da reflexão sobre outra palavra que pertence a filosofia política: a �práxis�. We study ultimatum and dictator variants of the generosity game. In this game, the first mover chooses the amount of money to be distributed between the players within a given interval, knowing that her own share is fixed. Thus, the first mover is not confronted with the typical trade-off between her own and the other’s payoff. For each variant of the game, we study three treatments that vary the range of potential pie sizes so as to assess the influence of (...) these changes on the first movers’ generosity. We find that removing the trade-off inspires significant generosity, which is not always affected by the second mover’s veto power. Moreover, the manipulation of the choice set indicates that choices are influenced by the available alternatives. (shrink)

In its literal meaning, the term ἔκστασις (ekstasis) indicates a displacement, ‘being out of immobility’, and ultimately being outside oneself. To some extent, this term takes on a mystical connotation in late Antiquity, notably in book VI.9.11.24 of Plotinus’ Enneads, where ekstasis is described as a non-ordinary way of seeing. The notion of ecstasy, often inseparable from the concept of vision, would keep its mystical role, though altered in some ways, over the centuries, conceptualizing a specific kind of knowledge, which (...) goes beyond the subject-object opposition, addressing the epistemological issues of perceiving and knowing the divine, and often challenging the nature of the self. This issue offers some attempts to track the constant reshaping and migration of the notions of ecstasy and intellectual or spiritual vision over the history of Western thought, unearthing their structural and constant persistence, from the Middle Ages to the contemporary ages, recurrently in many different non-ultimately-dialectical metaphysical systems. The papers in this volume provide some illustrative examples of the tangled history of the divergent meanings that the notions of ecstasy and vision have taken on, and their considerable reassessments and adaptations to constantly evolving conceptual frameworks, often redefining further notions such as those of rapture, prophecy, sleep, dream, and death. -/- . Contemporarily, higher education workplaces are characterised by collaboration, transitions, fluidity and the crossing of boundaries, where individuals are involved in ongoing negotiation of multilayered identities and simultaneous membership to various groups. These conditions impact the negotiation of professional identities, work and work relationships. One group of professionals affected by the impetus to fluidly operate within institutions are academic language and learning advisors. In this article, we explore the identity negotiation of a novice ALL advisor through a positioning lens, focusing on (...) small stories conveyed during an interview. We highlight the ways in which she constructs identities vis-à-vis interactions with students and within the ideological and institutional structures of the contemporary university. This article contributes an important new perspective to existing depictions of ALL advisors as a marginalised group of professionals, making space for the study of advisory agency alongside structural analyses. While continuing to negotiate structural challenges, we argue that the participant’s sense of agency needs to be garnered to strengthen group identity and allow for professionals to transition to the role. Is it true that all conversational implicatures are cancellable? In some recent works (Weiner Analysis 66(2):127–130, 2004, followed by Blome-Tillmann Analysis 68(2):156–160, 2008 and, most recently, by Hazlett 2012), the property of cancellability that, according to Grice (1989), conversational implicatures must possess has been called into question. The aim of this article is to show that the cases on which Weiner builds his argument—the Train Case and the Sex Pistols Case— do not really suffice to endanger Grice’s Cancellability Hypothesis. What (...) Weiner has shown with his examples is that a conversational implicature cannot be cancelled if the speaker, whose utterance gives rise to the implicature, does not intend to cancel it. To implicate is an intentional speech act and, therefore, cancelling an implicature must also be intentional and must be performed by the same speaker whose utterance gives rise to the putative implicature. Ruyer et Bachelard ont en commun de concevoir le travail de la philosophie comme essentiellement lié à la science. Toutefois, alors que Bachelard s’en tient à des positions épistémologiques, Ruyer entend tirer des conclusions métaphysiques des résultats de la physique contemporaine. Il expose ses vues à l’occasion de deux comptes rendus qu’il fait des écrits de Bachelard. Selon Ruyer, les activités structurantes originales qui caractérisent les atomes et les molécules autorisent à les comparer aux êtres biologiques des étages supérieurs et (...) à défendre une vision panpsychiste du réel. L’imagination métaphysique peut alors proposer ce que Ruyer appelle une « lecture du monde » qui en donne une vision unifiée et intensifiée. While the theoretical frameworks varied considerably, they all advocated for the need to overcome ideological, cultural, and spatial barriers in favor of broader, more inclusive approaches to other disciplines, other cultures, other humans, other species. Overall, the conference not only exposed the cultural and economic roots of social inequality and of uneven distribution of resources, thanks to unsustainable modes of capitalist production and consumption, but also highlighted the media’s positive effect in eliciting pro-environmental behaviors.Toward More Sustainable FuturesThe prismatic nature of the concept of sustainability inspired keynote speakers Alexa Weik von Mossner (University of Klagenfurt), Adrian Ivakhiv (University of Vermont), Tim Waterman (University College London), and Antonio López (John Cabot University) to address climate apocalypse impacts on the human physical and psychological well-being from diverse personal and academic backgrounds.In the opening keynote lecture, “Growing Hope: Narratives of Food Justice and Sustainability,” Weik von Mossner explores the psychological implications of affect and emotion in the communication of environmental issues. Her diachronic account illustrates the rise and fall of the South Central Farm in Los Angeles, a sanctuary for locals by providing fresh produce, stimulating a sense of community, and representing a symbol of resilience against systemic inequalities. Weik Von Mossner elucidates the psychological benefits accruing from exposure to such a sustainably inhabited space. Her analysis of Scott Hamilton Kennedy’s documentary, The Garden (2008), affirms that climate change narratives across media may prompt food justice activism (Retzinger 2011, 337) by eliciting the emotional engagement of its audience. Through documentaries, news articles, and online campaigns, the South Central Farm has received national and international attention.
