While many of our modern associations with (...) the term may find some of their origins traceable as far back as Petrarch's career, the term "solitude" carried with it much different associations in his century than it does for us today, influenced as we are by the Romantic tradition and especially by Wordsworth's absorption with the idea of solitude as an ideal state for self-conscious reflection on the individual's personal history and its meaning. No less than three of Petrarch's major prose works--the De otio religioso, the De vita solitaria, and the Secretum--confront the topic of solitude directly, and we can also point to many letters, poems, and portions of his treatises that either directly or indirectly reflect Petrarch's virtual obsession with solitude. In Petrarch we are confronted with an author who was at once the most politically connected intellectual of his century--we are even tempted to call him a "public intellectual"--and yet who constantly invoked his desire for solitude, for an escape from the many distractions and seductions that the cities and courts of his society offered. For Petrarch these were invariably places where desire lurked and power held sway, so that the life of solitude was often invoked as an alternative--a counter-cultural locus, perhaps--where freedom from temptation and subjection was imagined as an escape from the negotium of worldly life. There is much in Petrarch's writings on the solitary life that is wishful and that we might characterize as merely compensatory in a life that was otherwise quite active and engaged, but there is also a [End Page 401] strain of thought in these works that indicates a certain intransigence beneath Petrarch's overdetermined attachment to the idea, if not the practice, of withdrawal and detachment. An inquiry into Petrarch's idealization of the solitary life may even yield a somewhat reactionary aspect of his complex mind, a conservative strain in an author who was in almost every other way the literary herald of a humanism that was at the center of the cultural avant-garde of the Trecento. Is the Petrarch that in so many accounts of his character is construed as the "first modern man" actually something else, a reluctant ascetic holdover from the Middle Ages? How did Petrarch use his unique understanding of the life of solitude, of ascesis, as a pose from which to construct his sense of himself as an author and intellectual? Or are we simply confronted in the figure of a worldly and an ascetic Petrarch with yet another set of contradictions so appropriate to the "immensely complex" author whose poetic signature was the oxymoron? 1"Asceticism" and "solitude" are of course not synonymous terms, but any examination of a number of Petrarch's works as they fall within what might be called a genealogy of asceticism must recognize from the start that Petrarch's brand of asceticism was somewhat unique, especially insofar as it was deeply influenced by ancient Stoicism as well as by his reading in authors from the early Christian era. The most useful expression for our purposes may be the medieval concept of the "contemplative life," since much of the analysis in what follows will focus on how Petrarch often used his self-proclaimed pose of detachment and withdrawal as a technique for carrying on what were otherwise quite engaged dialogues with those worldly formations of power and authority that are normally conceived of as belonging to the "active" sphere of human existence. 2 For despite Petrarch's participation in or association with a number of political and civic ventures during his long and productive career, he likely never would have freely chosen... In an interesting article entitled ‘XOPOY in the Plutus’ Mr. E. W. Handley questions the accuracy of some observations of mine on this subject, and complains of my ‘failure to state facts’. He quotes my remark that ‘the editors freely insert () in the Plutus; but, according to Weissinger , the only example afforded by the MSS. is after 770; and here there is no lapse of time’. I added in a footnote that R inserts XOPOY after line 801, according (...) to the Oxford text. Handley's own researches have shown him that R has KOMMATION XOPOY between 770 and 771, and that R has inserted XOPOY between 801 and 802. (shrink)

In The Retreat to Commitment , Professor W. W. Bartley III argues for a certain theory of rationality and contends that by this criterion it is not possible for a christian theist to be rational. His theory of rationality has already aroused considerable criticism, but his application of it to religious belief in particular, has not hitherto been widely considered.

My subject is the place of myth in philosophy, not in religion. If I were dealing with the philosophy of religion, I should, of course, have much to say on the place of myth in theology; and what I have to say may have some bearing on this subject; but I am not dealing with particular dogmas of Christianity or of any other religion. My thesis is that when the mind communes with the world of values its natural and inevitable (...) language is the language of poetry, symbol, and myth. And, further, that philosophy has to deal with a number of irreducible surds which cannot be rationalized. They must be accepted as given material for reason to work upon. For example, we do not know why there is a world; we cannot unify the world of what we call facts and the world of values; there are antinomies in space and time which do not seem to disappear when we put a hyphen between them. Our reason–some would say reason itself— has reached its limits. We are driven to mythologize, confessing that we have left the realm of scientific fact. We give rein to the imagination, not exactly claiming with Wordsworth that it is reason in her most exalted mood, but hoping that the creative imagination may reveal to us some of the real meaning of questions which we cannot answer. The phrase philosophia perennis is said to have been first used by Leibniz. It has been adopted and freely employed by the Catholic Neo-Thomists, for whom it means a development of the Aristotelianism, modified by strong Neoplatonic elements, which Arabian scholars transmitted to the first Renaissance in the West. It claims also to be a return to the early Christian philosophy of religion, a fusion of Hellenistic and Jewish thought, the latter itself a syncretistic religion with many Persian and other (...) borrowings. The controversy, directed against various modern philosophies, has been conducted with great ability by such writers as Gilson, Maritain, Sheen, Watkin, Dawson and D'Arcy, whose books would perhaps have received more attention from independent thinkers, but for the suspicion which surrounds apparent attempts to revive the methods and inhibitions of the medieval schoolmen. There has been a parallel movement in the Orthodox Eastern Church, represented in Russian by Frank, Bardyaeff, Solovioff and Lossky. These writers are more Platonic and more fearlessly mystical than the Thomists. Origen in the East has more weight than Augustine. (shrink)

The United States Court of Appeals for the Seventh Circuit held, in Murrey v. United States ), that claims for a physician's failure to obtain a patient's informed consent are not barred by the Federal Tort Claims Act as a species of misrepresentation. The court further held that the claim was not barred by the failure to include the issue of informed consent in the administrative claim. This decision reduces the burden on plaintiffs to state every cognizable claim consistent with (...) the facts in an administrative proceeding; the failure to do so would prevent them from raising the claim in court.The patient, Thomas Murrey, a sixty-eight-year-old U.S. veteran, sought treatment at a Veteran's Administration hospital in North Chicago, Illinois. The article is concerned with the question of how legal institutions are structured with the use of constitutive, institutive, consequential, and terminative rules. To that end, the regulation of international treaties as laid down in the Vienna Convention on the Law of Treaties of 1969 is analysed. This leads to the discovery of two additional categories of rules: content rules and invalidating rules. Finally, the special status of unique legal institutions is investigated. Unique legal institutions – for example, heads of (...) state, parliaments, and supreme courts – enjoy validity in a legal system to the exclusion of the validity of any other legal institution of the same category in that system. When he was four years old, the Dutch West Indies Company's preacher in Ghana sent him to Holland to be baptized and educated in the Bible for future service in Ghana. However, the Company headquarters, undesirous of any interference with its lucrative trade in slaves, turned little Amo over to the German Duke Anton Ulric‐Wolfenbuttel.
