The objective of this article is to contribute towards a fuller critical understanding of gender relations/politics in mid-19th-century Spanish America. Its aim is to provide an account of the relationship Mexican President General Antonio López de Santa Anna established with his two wives. This study is particularly concerned with the representative value of Santa Anna's case in terms of 19th-century gender relations and the macho stereotype of the caudillo. Do Santa Anna's marital and extra-marital relationships confirm or question traditional views (...) on the position of women in Spanish America following the achievement of Independence? Do they conform with the ‘rock-star’ lifestyle generally attributed to the early 19th-century caudillo? A key aim of this study is to test the extent to which the relatively recent claim that women were more independent and influential than had been previously noted is borne out by case-studies of the women who shared their lives with the promiscuous six-times president Santa Anna. This study explores the relationship between board environmental committees and corporate environmental performance. We propose that board environmental committees will be positively associated with CEP. Moreover, we argue that the composition of the committee as well as the presence of a sustainability manager will influence this relationship. Our results find support for a positive association between board environmental committees and CEP. Further, the presence of a senior-level environmental manager positively moderates this relationship, but is not effective in isolation. (...) Research suggests that international assignment experience enhances awareness of societal stakeholders, influences personal values, and provides rare and valuable resources. Based on these arguments, we hypothesize that CEO international assignment experience will lead to increased corporate social performance (CSP) and will be moderated by the CEO's functional background. Using a sample of 393 CEOs of S&P 500 companies and three independent data sources, we find that CEO international assignment experience is positively related to CSP and is significantly moderated (...) by the CEO's functional background. Specifically, CEOs with international assignment experience and an output functional background (e.g., marketing and sales) are positively associated with greater CSP. (shrink)

This paper examines two recent examples of compulsory licensing legislation: one globally embraced regime and one internationally controversial regime operating under the same WTO rules. In particular, we consider Canadian legislation and the use of compulsory licensing for HIV/AIDS drugs destined for a developing country. This is then contrasted with the conditions under which Thai authorities are pursuing compulsory licenses, the outcomes of their compulsory licenses, as well as the likely impact of the Thai policy. Finally, we construct a rubric (...) to evaluate characteristics of a successful regime. This is used to analyze the Canadian and Thai regimes and frame the expected implications of each national policy. It is hoped that the assessment will guide changes to compulsory licensing design to ensure that legitimate regimes are embraced while illegitimate ones are disallowed. (shrink)

Regardless of how health reform proceeds, we will continue to need public insurance programs to care for the poor, cover health problems not addressed by private insurance, and support the nation's health care infrastructure. This article examines that continuing role.

As we write this paper in spring 2008, many are hopeful that November’s election will open the door to some form of comprehensive health care reform. In all likelihood, we will elect a president who has campaigned to a greater or lesser extent on promises of improving access to health care, improving quality, and reducing costs. Equally important, it seems likely that the 111th Congress is preparing to undertake meaningful health care reform. And perhaps most important, despite recent (...) attention to energy issues and the economy, opinion polls consistently show that the American public continues to rank health care as one of the two or three most important domestic issues in the fall elections and supports comprehensive health care reform. Based on brain imaging findings, we present a model according to which addiction emerges as an imbalance in the information processing and integration among various brain circuits and functions. The dysfunctions reflect (a) decreased sensitivity of reward circuits, (b) enhanced sensitivity of memory circuits to conditioned expectations to drugs and drug cues, stress reactivity, and (c) negative mood, and a weakened control circuit. Although initial experimentation with a drug of abuse is largely a voluntary behavior, continued drug use can eventually (...) impair neuronal circuits in the brain that are involved in free will, turning drug use into an automatic compulsive behavior. The ability of addictive drugs to co‐opt neurotransmitter signals between neurons (including dopamine, glutamate, and GABA) modifies the function of different neuronal circuits, which begin to falter at different stages of an addiction trajectory. Upon exposure to the drug, drug cues or stress this results in unrestrained hyperactivation of the motivation/drive circuit that results in the compulsive drug intake that characterizes addiction. Although the ability to perform gene therapy in human germ-line cells is still hypothetical, the rate of progress in molecular and cell biology suggests that it will only be a matter of time before reliable clinical techniques will be within reach. Three sets of arguments are commonly advanced against developing those techniques, respectively pointing to the clinical risks, social dangers and better alternatives. In this paper we analyze those arguments from the perspective of the client-centered ethos that traditionally (...) governs practice in medical genetics. This perspective clarifies the merits of these arguments for geneticists, and suggests useful new directions for the professional discussion of germ-line gene therapy. It suggests, for example, that the much discussed prospect of germ-line therapy in human pre-embryos may always be more problematic for medical genetics than adult germ-line interventions, even though the latter faces greater technical difficulties. Sister (Sr.) Marie Simone Roach, of the Sisters of St. Martha of Antigonish, Nova Scotia, died at the Motherhouse on 2 July 2016 at the age of 93, leaving behind a rich legacy of theoretical and practical work in the areas of care, caring and nursing ethics. She was a humble soul whose deep and scholarly thinking thrust her onto the global nursing stage where she will forever be tied to a central concept in nursing, caring, through her Six (...) Cs of Caring model. In Canada, she was the lead architect of the Canadian Nurses Association's first code of ethics, and her influence on revisions to it is still profound more than 35 years later. In this paper, four global scholars in nursing and ethics are invited to reflect on Sr. Simone's contribution to nursing and health‐care, and we link her work to nursing and health‐care going forward. Hydrogen energy systems are being developed to replace fossil fuels–based systems for transportation and stationary application. One of the challenges facing the widespread adoption of hydrogen as an energy vector is the lack of an efficient, economical, and sustainable method of hydrogen production. In the short term, hydrogen produced from fossil fuels will facilitate a transition to the hydrogen economy. In the long term, renewable hydrogen production methods will have to be adopted as resources become scarce, causing the (...) price of fossil fuels to rise. In this work, a number of methods have been considered for the renewable production of solar hydrogen, and thermochemical sulphur-iodine cycles proved to be the most promising. The sulphur-iodine cycles have the highest efficiencies and use widely available reactants with relatively straightforward reaction mechanisms, which make them the most economical and technically feasible option for renewable hydrogen production. Burnout and depression are no strangers to academics. For both students and faculty, these psychological phenomena can plague and even end careers. In this article, it is proposed that burnout and depression among both graduate students and faculty are a primary manifestation of the underlying discourse that is prevalent among many academic institutions. Through the lens of Lacanian discourse theory we will look at the unconscious communication within academia that may be perpetuating the modern dilemma of depression and burnout (...) for both students and professors. Initially, we will look at the concepts of burnout and depression in terms of their clinical manifestations and prevalence. From there, we will consider Lacan’s discourse theory, most notably the concept of the university discourse, and how the unconscious dimension of communication may be effectively propagating psychological distress in academia. Lastly, the article will conclude possible avenues that the academic field can take in order to avoid the pitfalls of such a discourse. (shrink)

Early contractarians such as Thomas Hobbes and Jean-Jacques Rousseau stretched the idea of contract to encompass all realms of society: the political, the economic, the familial. Contract is still a fundamental concept for many modern disciplines; indeed, it names fields in political philosophy, in economics, and in law. There was no such governing notion of contract in the fourteenth century, no metaphor of exchange that could link together ideas about agency, conditions, profit, and responsibility from different disciplines and provide a (...) theory of the basis of society itself. Retrospectively it may seem that scattered ideas about contract were, in fact, being developed: for instance, by the common law in the actions called debt, covenant, and trespass; by constitutional theory, in conciliarism; by economic thought, in a miscellany of glosses and laws redressing fraud and regulating prices and markets; by theology, in discussions of will, intention, and the marriage sacrament; by the civil law, in Roman law of contract; and by canon law, in treatments of individual consent and incapacity in marriage. Yet nothing about this discontinuous hodgepodge predicts that a fundamental connection among those topics will emerge in later political theory. To find a powerful combination of social analysis and political philosophy that takes up the issues deliberated by the later contractarians, we can call upon a medieval allegorist. (shrink)

This book defends morality against the critiques of egoims, subjectivism, and relativism. It argues that we can and should construe some moral standards as objective and that justice and self-development are the cornerstones of healthy morality. Opening with a dialogue meant to tease and provoke the reader, the book's subsequent chapters treat misconceptions about morality, the possibility of unselfish action, the nature of free will and moral responsibility, and the identity of moral right and wrong.

Zubiri introduced the concept of reality by postulation in order to explain the reality ofmathematical objects and literary characters. But the idea flows naturally from his view ofreality as formality rather than a zone of things. It can readily be extended to other areas,including political reality. In this study, we will examine how science postulates reality,and how this new understanding of science can resolve longstanding issues and providenew insights into: the scientific method; paradigm shifts in science; science fiction; and (...) expression of scientific laws. With respect to the laws, we noted that reality ispostulated in two senses: direct and emergent. The emergent sense is associated with thenotion of probability and stochastic processes, now an integral part of many areas of science. We observed that the emergent reality may be related to the reality field, instead ofindividual objects, since probability refers to aggregates of things and not individuals. Finally, we note that Zubiri’s approach resolves the longstanding problem faced by realistphilosophers, of why scientific theories can be used to describe reality at all.Zubiri introdujo el concepto de realidad por postulación para explicar la realidad de objetos matemáticos y los caracteres literarios. Rapid advances in computer technology and what is termed ‘Artificial Intelligence’ in the past 70 years have led to speculation about the ultimate capabilities of electronic devices, including speculation about whether they will make humans obsolete at some future time. Zubiri’s distinction between sensible intelligence and sentient intelligence can be applied to understanding of the limitations of AI. Machines can only operate on the sensible intelligence paradigm, which entails limits. Sentient intelligence allows humans to carry out functions that sensible (...) intelligence-based devices can never do. Sensible intelligence-based devices, including AI, will therefore be restricted to amplifying human (i.e. sentient intelligence) capabilities, but never replacing them. Historically, extravagant claims for AI have not been borne out, despite many orders of magnitude increase in computation speed and memory capacity. Theoretical arguments, based on Godel’s Incompleteness Theorem, also confirm this. (shrink)

When we attend a dance performance we expect to see human beings performing various sorts of bodily movements. Movement is, uncontroversially, the primary medium of a dance. Our intuition, then, is to think that our response to and understanding of the dance must be connected in some way to this movement. Attempts to relate our understanding of a dance, specifically our grasping the meaning of a dance, to the medium of movement, through a movement-oriented response have taken the form of (...) theories that rely on a notion of kinesthetic response or kinesthetic empathy. My intentions in this essay are to show that the intuition that our understanding of a dance is kinesthetically based is correct and that how the kinesthetic brings us to understand the dance is different from the earlier empathy theories, in a number of important ways. But I will also argue that current analytic strategies will not suffice and that the full defense of kinesthetic understanding, as I will call it, will require a different manner of explaining and understanding of the activities of human beings. My own analysis will draw on a number of resources, primarily the case study of Alexander Technique, a body therapy that seems to give us access to the kinesthetic organization of our activities and the philosophical work of a number of people, centrally Maurice Merleau-Ponty, who argues strongly for the role movement plays in constituting our world. I will show how kinesthetic understanding, given the historical trajectories permitted by tradition and the mechanics of the human body, can bring dancers, choreographers, and critics to a point of intersection where they can experience and talk about dance in terms of its kinesthetic basis, and that without this intersection the kind of meaning in movement I am discussing cannot take place. They will miss the preferred intersection unless they achieve kinesthetic understanding. (shrink)

In this paper we will discuss some of the issues related to the attempts of Ralph Howard Fowler and Nevil Vincent Sidgwick to create a legitimizing space for quantum and theoretical chemistry in Britain. Although neither Fowler nor Sidgwick made original contributions to quantum chemistry, they followed closely the developments in the discipline, participated in meetings and discussions and delivered lectures, talks and addresses, where methodological topics, ontological questions and implicitly the problem of autonomy of the new (...) discipline vis-à-vis both physics and chemistry were taken to be pressing issues. In particular, they encouraged young people to work within the nascent discipline. Viewing quantum chemistry as a branch of applied mathematics became an emblematic characteristic of the practice of the new discipline in Great Britain. (shrink)

Imperial Plato presents new translations of three introductions to Plato's thought from the second half of the second century CE: the Introduction to Plato by Albinus of Smyrna, Dissertation 11 of Maximus of Tyre, and On Plato and his Teaching by Apuleius of Madaurus. These three presentations of Plato's ideas--one a Greek dialectic introduction with a suggested reading order for Plato's dialogues, another a Greek speech in the sophistic style of the time, and one a lengthy doxological study in Latin--are (...) examples by three distinct authors using divergent methods of the assorted ways in which Plato and Platonism were understood and discussed during the revival of Hellenism and Greek Philosophy, and the period of the Roman Empire often referred to as the Second Sophistic. Review of extant research on the corporate environmental performance (CEP) and corporate financial performance (CFP) link generally demonstrates a positive relationship. However, some arguments and empirical results have demonstrated otherwise. As a result, researchers have called for a contingency approach to this research stream, which moves beyond the basic question “does it pay to be green?” and instead asks “when does it pay to be green?” In answering this call, we provide a meta-analytic review of CEP–CFP literature in which we (...) identify potential moderators to the CEP–CFP relationship including environmental performance type (e.g., reactive vs. proactive performance), firm characteristics (e.g., large vs. small firms), and methodological issues (e.g., self-report measures). By analyzing these contingencies, this study attempts to provide a basis on which to draw conclusions regarding some inconsistencies and debates in the CEP–CFP research. Some of the results of the moderator analysis suggest that small firms benefit from environmental performance as much or more than large firms, US firms seem to benefit more than international counterparts, and environmental performance seems to have the strongest influence on market-measures of financial performance. Process models are valuable conceptual tools to help in understanding the approaches to value creation in social enterprises. This teaching case illustrates the application of a process model about creating, building, and sustaining a social enterprise with a mission to provide clean water to communities in need. The social enterprise generates revenue in support of community water projects and works with community stakeholders in different locations throughout the world to provide sustainable clean water solutions. The case study uses primary data (...) from semi-structured interviews, direct observations of a community project, and archival sources to demonstrate application of the process model. The study shows how the social enterprise developed as a promising idea; was implemented through an operating model with resources to support social impact; and continues to build and evolve while guided by the social mission. The paper concludes with a discussion and teaching note on ways to use the case for educational purposes to enhance learning about the social value creation process. (shrink)

The work draws together a rich tapestry of material across many different disciplines, covering the crucial relationship between medicine and law from the early apothecaries to the modern-day general practitioner. It presents an invaluable overview of the subject and offers vital background reading to anyone interested in medico-legal medicine, as well as providing a springboard for students of medicine and law interested in researching the field through its remarkable diversity of reference resources.

We identified nearly 180 Black women who earned medical degrees prior to the start of the Second World War and found information regarding their family and social connections, premedical and medical educations, and internship experience or lack thereof for many of these women. Through their collective history, we observed large-scale trends, especially regarding the importance of “separatist” medical education and declining medical school attendance among African American women in the 1910s as medicine became an increasingly exclusionary profession. While our research (...) uncovered trends specific to Black women physicians, the implications of our research can be applied far more widely to other historically marginalized scientific practitioners. This research reminds us of the longstanding and shifting presence of Black women in science and medicine, despite the enduring popular belief that white men represent who participates in science, both historically and today. Crito is a dialogue by the ancient Greek philosopher Plato. It depicts a conversation between Socrates and his wealthy friend Crito regarding justice, injustice, and the appropriate response to injustice. Socrates thinks that injustice may not be answered with injustice, and refuses Crito's offer to finance his escape from prison. The dialogue contains an ancient statement of the social contract theory of government.

The Novum Organum, (or Novum Organum Scientiarum - "New Instrument of Science"), is a philosophical work by Francis Bacon, originally published in 1620. The title is a reference to Aristotle's work Organon, which was his treatise on logic and syllogism. In Novum Organum, Bacon details a new system of logic he believes to be superior to the old ways of syllogism. This is now known as the Baconian method.

It is plausible that the universe exists: a thing such that absolutely everything is a part of it. It is also plausible that singular, structured propositions exist: propositions that literally have individuals as parts. Furthermore, it is plausible that for each thing, there is a singular, structured proposition that has it as a part. Finally, it is plausible that parthood is a partial ordering: reflexive, transitive, and anti-symmetric. These plausible claims cannot all be correct. We canvass some costs of denying (...) each claim and conclude that parthood is not a partial ordering. Provided that the relevant entities exist, parthood is not anti-symmetric and proper parthood is neither asymmetric nor transitive. (shrink)

However, recent public inquiries, including the Francis Inquiry reveal that a duty of candour in practise, are at times compromised. Consequently, the duty of candour became a statutory requirement in England. This study aimed to explore clinicians’ perspectives of the implications of the legislation for medical ethics education, as raising standards to improve patient safety remains an international concern.MethodsOne-to-one interviews with clinical educators from various specialties who (...) contribute to the MBChB programme at the authors’ university.
