In this article, we analyze the intractability of the low-level radioactive waste debate in California through the construction and examination of policy frames and their associated policy narratives. Relying primarily on reports, formal comments, and written correspondence, we reconstruct three policy frames and explore their interaction in the public debate through the policy stories told by the actors. We analyze how policy actors using these policy frames appropriate available information, value scientific input, and respond to uncertainty in technical and regulatory (...) information to create policy stories. These policy frames and their associated policy narratives demonstrate how policy actors differ in their drivers for action, bases for trusting claims, and response to uncertainty. These differences lead to divergent characterizations of the risk of low-level radio-active waste disposal. This analysis provides insight into the dynamics of intractable policy controversies. The effect of oxytocin on cognitive bias was investigated in rats in a modified conditioned place preference (CPP) paradigm. Fifteen male rats were trained to discriminate between two different cue combinations, one paired with palatable foods (reward training), and the other paired with unpalatable food (aversive training). Next, their reactions to two ambiguous cue combinations were evaluated and their latency to contact the goal pot recorded. Rats were injected with either oxytocin (OT) or saline with the prediction that rats administered (...) oxytocin would display a shorter average latency to approach on ambiguous trials. There was no significant difference between latencies to approach on ambiguous trials compared to reward trials, but the rats were significantly slower on the aversive compared to the ambiguous conditions. Oxytocin did not affect approach time; however, it was unclear, after follow-up testing, whether the OT doses tested were sufficient to produce the desired effects on cognitive bias. When laws or legal principles mention mental states such as intentions to form a contract, knowledge of risk, or purposely causing a death, what parts of the brain are they speaking about? We argue here that these principles are tacitly directed at our prefrontal executive processes. Our current best theories of consciousness portray it as a workspace in which executive processes operate, but what is important to the law is what is done with the workspace content rather than the content (...) itself. This makes executive processes more important to the law than consciousness, since they are responsible for channeling conscious decision-making into intentions and actions, or inhibiting action.We provide a summary of the current state of our knowledge about executive processes, which consists primarily of information about which portions of the prefrontal lobes perform which executive processes. Then we describe several examples in which legal principles can be understood as tacitly singling out executive processes, including principles regarding defendants’ intentions or plans to commit crimes and their awareness that certain facts are the case, as well as excusatory principles which result in lesser responsibility for those who are juveniles, mentally ill, sleepwalking, hypnotized, or who suffer from psychopathy. According to new mechanists, mechanisms explain how specific biological phenomena are produced. New mechanists have had little to say about how mechanisms relate to the organism in which they reside. A key feature of organisms, emphasized by the autonomy tradition, is that organisms maintain themselves. To do this, they rely on mechanisms. But mechanisms must be controlled so that they produce the phenomena for which they are responsible when and in the manner needed by the organism. To account for how (...) they are controlled, we characterize mechanisms as sets of constraints on the flow of free energy. Some constraints are flexible and can be acted on by other mechanisms, control mechanisms, that utilize information procured from the organism and its environment to alter the flexible constraints in other mechanisms so that they produce phenomena appropriate to the circumstances. We further show that control mechanisms in living organisms are organized heterarchically—control is carried out primarily by local controllers that integrate information they acquire as well as that which they procure from other control mechanisms. The result is not a hierarchy of control but an integrated network of control mechanisms that has been crafted over the course of evolution. (shrink)

Interrogating received knowledge is constitutive to any critical project, and recently there has been a wave of scholarship which argues for locating the origin of racist-thinking prior to modern Europe—even prior to the Common Era—without any real consideration of the potential dangers accompanying such a seismic redefinition. By expanding “racism” to include potentially any pre-modern xenophobic or ethnicist atrocity, even well-meaning scholarship dilutes the peculiar injustice of modern Europe’s most successful epistemological weapon. As a result, we lose any criteria to (...) distinguish ubiquitous oppressive projects from specifically racist-projects of hegemony and domination. However laudable its intent, such scholarship falls prey to methodological, epistemological, and practical errors that hamstring the ameliorative impact of contemporary anti-racist work while ironically diminishing racism’s impact. For if every conflict is racist, then contemporary colorblindness is correct: if white supremacy isn’t particularly white, then racism is a distinction without a difference. (shrink)

The different ways in which the three medieval societies of Byzantium, Latin Christendom, and Islam institutionalized the charitable impulse present in their respective faiths reflected the fundamentally different religious values which motivated these civilizations as well as their different levels of material and intellectual development. All three societies exalted the relief of human suffering, especially the care of the sick, as a religiously sanctioned gesture; and all three invented or adopted institutional means for attaining this pious objective. The various medieval (...) counterparts of the modern “hospital”—the Byzantine nosocomeion or xenodocheion, the European hospitale, and the Islamic maristan—differed significantly, however, with respect to their organization and operation, the clientele which they served, and the ultimate intent of their charitable efforts. Accordingly, a comparison of these social welfare institutions reveals the contrasting ways in which the two Christendoms and Islam defined and applied the ideals of “piety” and “charity” during the middle ages. Early in his career Richard Rorty became well known for advocating what became known as eliminative materialism. This position depended on the radical idea that the main elements of commonsense psychology, including ordinary sensations, do not really exist. This chapter argues that on a closer reading of Rorty's relevant articles, it is clear that Rorty was not an eliminative materialist in any normal sense, but rather a more conventional materialist who made some misguided claims about what mind–brain identity involves.

An analysis of two heuristic strategies for the development of mechanistic models, illustrated with historical examples from the life sciences. In Discovering Complexity, William Bechtel and Robert Richardson examine two heuristics that guided the development of mechanistic models in the life sciences: decomposition and localization. Drawing on historical cases from disciplines including cell biology, cognitive neuroscience, and genetics, they identify a number of "choice points" that life scientists confront in developing mechanistic explanations and show how different choices result in (...) divergent explanatory models. Describing decomposition as the attempt to differentiate functional and structural components of a system and localization as the assignment of responsibility for specific functions to specific structures, Bechtel and Richardson examine the usefulness of these heuristics as well as their fallibility—the sometimes false assumption underlying them that nature is significantly decomposable and hierarchically organized. When Discovering Complexity was originally published in 1993, few philosophers of science perceived the centrality of seeking mechanisms to explain phenomena in biology, relying instead on the model of nomological explanation advanced by the logical positivists (a model Bechtel and Richardson found to be utterly inapplicable to the examples from the life sciences in their study). Since then, mechanism and mechanistic explanation have become widely discussed. In grappling with the micro-macro problem in sociology, philosophers of the field are finding it increasingly useful to associate micro-sociology with theory reduction. In this article I argue that the association is ungrounded and undesirable. Although of a reductive "disposition," micro-sociological theories instantiate something more like "reductive explanation," whereby the causal roles of social wholes are explained in terms of their psychological parts. In this form, micro-sociological theories may actually have a better shot at closing the sociology–psychology explanatory gap, and (...) resist many antireductionist arguments, including the well-known argument from "multiple realization.". This article compares topographical and archaeological remains of the Thermopylae frontier with the ancient testimonia of the sixth century historian Procopius of Caesareia (De aedificiis4.2.1.–22). It was revealed that: many of the frontier fortifications described were initially built before the sixth century; the fortified κλεισούρα mentioned should be equated with the Dhéma Pass; and the commercial settlement of Myropóles is best identified with the modern village of Káto Dhió Vouná. Written in Attic prose, this passage represents a rhetorical exercise, the (...) climax of which turned not on the ancient battlefield of Thermopylae, but rather on a mountain pass and it's highway that neutralized the Thermopylae defenses if they were ever controlled by the enemy. We were told that only the Emperor Justinian's wisdom could grasp this critical fact. Additionally, Procopius employed many rhetorical devices in this narrative: τóπος, χρóνος,, ἄγαλμα, ἔκφρασις, πανηγρικóς and employed imperial propaganda, praise, and exaggeration as well. In short, the passage is a classic example of selective story telling that may have found its inspiration in the Hunnic raid of 539/540 and the Herodotean account of the Persian invasion of 480 BC. While Procopius' account remains our best topographical description of the late antique Thermopylae frontier, one can only say that more archaeological questions were left unanswered than were resolved. In short, as an archaeological source, theDe aedificiisis a disappointing and vexing resource filled with equivocations. Finally, one may doubt that Procopius ever did visit the Thermopylae frontier, even though during his career he certainly had ample opportunity to do so. His account, therefore, must have been based upon secondary sources, whether imperial archival material, itineraries, or military staff reports and were not the result of personal autopsy. (shrink)

Understanding traditional natural law requires us to understand the concept of intrinsic nature, as well related concepts such as intrinsic inclination to an end and nature fulfillment. In this paper, I argue that proponents of traditional natural law theory should be attentive to the work of Martin Heidegger. If Heidegger is right about what he says concerning modern technology, then modern technology poses a threat to our understanding of the concept of intrinsic human nature and other associated concepts, and thus (...) a threat to our understanding of natural law. Heidegger may also provide an insight into how proponents of traditional natural law can respond to the threat of modern technology. Advocates of traditional natural law theory can respond to the threat of modern technology by engaging in, and promoting, certain arts, trades, skills, and activities that reveal natures. Called the “greatest philosophical essayist of his time,” Rorty is both famous and notorious in academic philosophy for his uniquely engaging writing style. While his fellow analytic philosophers look askance at his flamboyant prose, suspicious that it lacks the care and precision that their discipline demands, literary intellectuals who champion the essay genre can have their qualms about Rorty as well: his work is too professional and specialized to be properly called essays. I argue not only that Rorty's work fits (...) into the essay genre, but also that his use of the essay form is integral to his rhetorical project of advancing his ideal of pragmatic liberalism. Rorty writes essays because the essay is a pragmatic literary genre: it is anti‐essentialist, conversational, and experimentalist and provocatively aims at “breaking the crust of convention,” in Dewey's phrase. Using the essay, Rorty “joshes” us to becoming more pragmatic and, therefore, better liberals. (shrink)

Skyrms' investigations of dynamic deliberation are traced through his book of 1990 and his subsequent investigation of dynamic deliberation based on inductive rules to his recent results about chaos generated by evolutionary game dynamics. It is argued that the dynamics studied in the book, and the inductive dynamics as well, need to be supplemented to yield the correct recommendation in an example game. Some features about information feedback are pointed out. Finally, it is suggested that more work is needed to (...) assess whether Skyrms' results about chaos have any interesting implications for plausible game theoretic representations of interactions among human agents. The distinctions taken between the necessary and the contingent, in philosophical discussion no less than in common life, are ordinarily supposed to be so definitive and are permitted so deeply to influence our conceptions that it seems well worth one's while to examine them in their origin. And the Aristotelian system will best serve our purpose as a corpus vile for very obvious reasons. In the first place, Aristotle is the earliest systematic philosopher who essayed to (...) treat consistently of all the greater problems of life and thought, and whose works remain to be studied. His method, too, was such that, standing as he did just on the verge of formalism, the definitions which he attempted still bear definite traces of the purely functional meaning of those terms, while his formulation of their significance has led naturally to their solidification as objective facts in the world. For Aristotle was wont to preface his own conclusions by inquiring, rather superficially to be sure, into the psychology of the conceptions in question ; yet, while the inadequacy of his psychology is now admitted on all hands, the inferences as to fact which he deduced therefrom are even now in part accepted as conclusive. When one reflects upon it this state of the question strikes one as absurd. For this reason there appears to be the greater justification for an analysis of the presuppositions on which these conceptions rest. If one grants their validity, the conclusions and the resultant contradictions of the system must be accepted as ultimate. But I am convinced that Aristotle's presuppositions and his real problems were wholly unreconcilable with each other, and so his contradictions serve all the better to point out the direction in which their solution lay. Plato made the acute observation that surprise is the beginning of philosophy, and Aristotle appropriated and further applied the thought.' The full sweep of the truth contained in these words is vastly greater, however, than they knew. The feeling of wonder is indeed the point of departure for philosophy ; but what precisely does it mean? It indicates first of all that an old habit has been broken up. Old conceptions, like the proverbial old bottles, have become so surcharged with the new wine of meaning that they have burst. But to say this is to describe the phenomenon merely as A brute fact without according it any symbolic value. This state of surprise must acquire an ideal worth, an indicative function, if it is really to become the parent of philosophy. Briefly, then, we may say : surprise indicates the need of reconstructing our supposed facts. In this book William G. Lycan offers an epistemology of philosophy itself, a partial method for philosophical inquiry. The epistemology features three ultimate sources of justified philosophical belief. First, common sense, in a carefully restricted sense of the term-the sorts of contingentpropositions Moore defended against idealists and skeptics. Second, the deliverances of well confirmed science. Third and more fundamentally, intuitions about cases in a carefully specified sense of that term. The first half of On Evidence in Philosophy expounds a (...) version of Moore's method and applies it to each of several issues. This version is shown to resist all the standard objections to Moore; most of them do not even apply. It is argued, in Chapters 5 and 6, that philosophical method is far lesspowerful than most have taken it to be. In particular, deductive argument can accomplish very little, and hardly ever is an opposing position refuted except by common sense or by science. The final two chapters defend the evidential status of intuitions and the Goodmanian method of reflectiveequilibrium; it is argued that philosophy always and everywhere depends on them. The method is then set within a more general explanatory-coherentist epistemology, which is shown to resist standard forms of skepticism.In sum, William G. Lycan advocates a picture of philosophy as a very wide explanatory reflective equilibrium incorporating common sense, science, and our firmest intuitions on any topic-and nothing more, not ever. Many philosophers have claimed that we might do well to adopt a hybrid theory of well-being: a theory that incorporates both an objective-value constraint and a pro-attitude constraint. Hybrid theories are attractive for two main reasons. First, unlike desire theories of well-being, hybrid theories need not worry about the problem of defective desires. This is so because, unlike desire theories, hybrid theories place an objective-value constraint on well-being. Second, unlike objectivist theories of well-being, hybrid theories need not worry about being (...) overly alienating. This is so because, unlike objectivist theories, hybrid theories place a pro-attitude constraint on well-being. However, from the point of view of objectivists, hybrid theories are not objectivist enough, and this can be seen clearly in missing-desires cases. For instance, hybrid theories entail that, if someone lacks the desire for health, then health is not a component of her well-being. This, objectivists say, is implausible. It is obvious, objectivists say, that someone’s life goes better for herself inasmuch as she is healthy, and hence that health is a component of her welfare. This paper focuses on the missing-desires objection (as leveled by objectivists) to hybrid theories of well-being. My argument is that the missing-desires objection can be answered in a way that is generally convincing and, in particular, in a way that pays a good deal of respect to objectivist intuitions about well-being. My hope, then, is that this paper will help to persuade objectivists about well-being to become hybrid theorists. (shrink)
