As the title of the article suggests, “The Burqa Ban”: Legal Precursors for Denmark, American Experiences and Experiments, and Philosophical and Critical Examinations, the authors embark on a factually investigative as well as a reflective response. More precisely, they use The 2018 Danish “Burqa Ban”: Joining a European Trend and Sending a National Message (published as a concurrent but separate article in this issue of INTERNATIONAL STUDIES JOURNAL) as a platform for further analysis and discussion of different perspectives. These include (...) case-law at the international level while focusing attention on recent rulings and judicial reasoning by the ECtHR and the ECJ; critical thought-experiments in religion, morality, human rights, and the democratic public space; a contextualized account of burqa-wearing interventions by federal and state governments and, moreover, various courts in the United States; and philosophical commentary and, in some instances, criticism of the Danish and/or European (French, etc.) approach. The different contributions have different aims. The section on case-law at the international level reports on those central judgments that, in effect, helped to pave the path for the Kingdom of Denmark’s burqa ban. Concerning the concurring judges at the ECtHR, the opinions served to uphold a preexisting ban and to grant a wide margin of appreciation to the national authorities, thereby limiting the Court’s own review. -/- As regards to the ECJ, the legality of company rules that contain a policy of neutrality for the workplace was examined, with a similar outcome. The authors who discuss religion, morality, human rights and the democratic public space are endeavoring to, respectively, appeal to ethics as a testing stone for law and to both challenge and address several forms of “expressivist worry” in connection with face veils. In doing so, the authors ask a number of thought-provoking questions that hopefully will inspire public policymakers to careful analysis. While the section that is devoted to American perspectives highlights a comprehensive survey of political and legal responses to, in particular, full-face veils like the burqa, the relevant author also incorporates public perceptions and, in the course of examining these, draws a parallel to “the fate” of the hoodie. The constitutionality of burqa-wearing in America, so it also appears, is partially an open question, but differentiating between religious, political, or personal reasons is a de jure premise. Given that the Danish legislators who drafted law L 219 to ban burqa-wearing in public places rely on a reference to political Islam, they relegate religious and personal reasons to the private domain, thereby also adopting secularism as a premise. This is explored in the last author response of the article, more precisely, in an account of the underlying materialism that, in turn, is applied to Muslim women. If policymakers and legislators engaged in Thinking Things Through exercises, they could, as a minimum, avoid law-making strategies that are not in the spirit of the theory they themselves invoke, albeit tacitly. While the aim of, as it were, arresting culturally self-contradicting legislators is unique for the section in question, all the authors who contribute to the joint research project have one end-goal in common, namely to inform about important perspectives while at the same time opening up for parameters for (more) fruitful, constructive and (if need be) critical debate in the future. With this in mind, four recommendations are presented by the research director for the project. Legally, politically, socially and culturally, conflict-resolution should not translate the relationship between rulers and the ruled into a separation ideology, an instance of controllers versus the controlled. Social screening of investments calls not only for investment policy and criteria, but also for information about companies, their policies, practices and performance. The Global Reporting Initiative (GRI) and its June 2000 Sustainability Reporting Guidelines have the potential to significantly improve the usefulness and quality of information reported by companies about their environmental, social and economic impacts and performance. The GRI aims to develop a voluntary reporting framework that will elevate sustainability reporting practices to a level equivalent to that of (...) financial reporting in rigour, comparability, auditability and general acceptance. This will be a welcome and efficient supplement to the questionnaires, interviews, press releases, media reports and other sources of information traditionally used for screening in investment decision making - social/ethical and mainstream. The Dow Jones Sustainability Group Index, the Jantzi Social Index and the Innovest EcoValue'21 analytical platform, together with the SRI community, are all likely to benefit from GRI-style sustainability reports. One of the GRI's key challenges is to accommodate the broad variety of disclosure needs and expectations of a wide range of report users and company stakeholders. To maximize the usefulness of the GRI Guidelines, report users, including the SRI community, need to be engaged in the process of developing and refining the Guidelines over time. The GRI Guidelines are emerging as an important instrument in enabling companies to communicate with their stakeholders about performance and accountability beyond just the financial bottom line. Nor can it be reduced to an aversion on the part of women to a morality of the signifier, as maintained by a certain reading of Freud. Very precisely, the persistent note in feminine restlessness is a certain relationship of the subject to the insufficiency of the signifier, which the quest for love registers. The fact that (...) language lacks the very quality that would make it credible and that would guarantee that discourse corresponds to what desire attests to is what delivers femininity over to the unnameable. In love she requires from the other member of the social bond the signifier that is lacking within the structure of femininity and that causes the call to jouissance in her body that drives her to distraction. Thus, the structure at stake in femininity, to which Alex's hysterical passion bears witness, defines in writing, that is, by a mark left on the body, the limitation of the reality of a jouissance which persists beyond the signifier and the object of the fantasy. When the analyst's desire offers support to this quest for a limit to jouissance on the part of a subject, it is in desire that the reality of sex and the other is linked to the signifier that would testify to the truth of the amorous discourse in the unconscious. Thus from one man to another, from the love of the father to the loss of a son, including the desire of the lover and the law of the husband, a woman finds herself supporting, with the letter of her body, the signifier which in its words testifies to jouissance as a place to lose oneself. This is a Supplement to that bibliography and contains references to works in English that have appeared since 1966 through 1975 or that inadvertently were not included in the original bibliography. The Supplement is in three parts: (A) Translations and Reference Works, (B) Books, and (C) Articles. In (C), I have also included chapters (...) of books that can be read independently and that may be of interest to students of Descartes. There were of course borderline cases in which I had to decide whether an article contained enough material about Descartes to be included in the bibliography. On the whole, I believe I have followed a rather liberal policy in making these decisions. (shrink)

ObjectivesThe end of life is an ethically challenging time requiring complex decision-making. This study describes ethical frameworks among physician trainees, explores how these frameworks manifest and relates these frameworks to experiences delivering end-of-life care.DesignWe conducted semistructured in-depth exploratory qualitative interviews with physician trainees about experiences of end-of-life care and moral distress. We analysed the interviews using thematic analysis.SettingAcademic teaching hospitals in the United States and United Kingdom.ParticipantsWe interviewed 30 physician trainees. We purposefully sampled across three domains we expected to be (...) associated with individual ethics in order to elicit a diversity of ethical and experiential perspectives.ResultsSome trainees subscribed to a best interest ethical framework, characterised by offering recommendations consistent with the patient’s goals and values, presenting only medically appropriate choices and supporting shared decision-making between the patient/family and medical team. Others endorsed an autonomy framework, characterised by presenting all technologically feasible choices, refraining from offering recommendations and prioritising the voice of patient/family as the decision-maker.ConclusionsThis study describes how physician trainees conceptualise their roles as being rooted in an autonomy or best interest framework. Physician trainees have limited clinical experience and decision-making autonomy and may have ethical frameworks that are dynamic and potentially highly influenced by experiences providing end-of-life care. A better understanding of how individual physicians’ ethical frameworks influences the care they give provides opportunities to improve patient communication and advance the role of shared decision-making to ensure goal-aligned end-of-life care. Willis (bio)Margaret Watkins’s elegant text, The Philosophical Progress of Hume’s Essays (2019),1 is marked by a Humean approach: it fosters philosophical consideration of both the faculties of the mind and the affective features of experience in ways that bear on practical, moral issues. Ever-attentive to the meaning of Hume’s various nuances and strategic ambiguities, (...) Watkins’s even-handed approach guides us into a broad swath of Hume’s ideas and marches us through a trajectory of secondary interlocutors. It also establishes Watkins as an integral part of Hume’s lineage, in the sense that she understands that thoughtful writing itself is an intellectual virtue. Her “unusual sensitivity, not to life’s daily vicissitudes but to beauties and deformities” (193)2 richly textures her overall argument that positions Hume’s Essays as a filter for his vision of “true philosophy:” that reflective turn towards nature and common life that openly challenges abstruse reasoning, fluently embraces historicism and perspectivalism, and deftly foregrounds the usefulness of ideas over their logical certainty.As much as Watkins reveals Hume’s vision for philosophy, she also extends it; for, among other things, her consideration of Hume’s unique endeavor in philosophical literature (ultimately collected under the title Essays, Moral, Political and Literary [1758]), makes an important twofold contribution to Hume studies. It brings greater attention to Hume’s notion of “public spirit,” a distinct mode of human excellence that combines “benevolence” with “greatness of mind.” And, it aestheticizes some practical dimensions of human life (noted in chapter titles, for example, “Working,” [End Page 143] “Thinking,” “Loving”) without losing track of their socio-political valences. I shall return to these two main points below. As an introductory gesture, I want to note that Watkins’s writing both nicely elaborates Hume’s philosophical vision and thoughtfully broadens his literary insights. It does “the job of putting the audience into a responsive relation with the work of art,” what literary critic R. P. Blackmur identified as “the job of intermediary.”3Generally speaking, Watkins’s mediation filters salient themes and terms from Hume’s corpus through a particularly close reading of the Essays. Cast through her richly stylized analysis, Hume’s foundational ideas of “sympathy,” “convention,” “impressions,” “association,” “imagination,” “artifice,” the “passions” (and more) find fresh interpretive air. An example of this in her first chapter tracks Hume’s use of both “artifice” and “convention” from the Treatise through the second Enquiry to the Essays. For Watkins, a through-line for Hume is that “governing” can be thought of as repeated actions that bridge institutional policy to individual character. To think about governing in this way is to open ourselves to new ways of conceiving potential overlaps between nature and artifice (say, in the instance of a moral virtue like courage [50]). To link categories in the Essays back to their antecedent texts along the lines that Watkins does is to situate them in the context of Hume’s larger thought-project and, indirectly, confirm connections between the individual essays. These conjoinings, for Watkins, suggest Hume’s Essays can be treated together, without either blending their disparate themes or diluting their individual subject matter.4This point stands in opposition to Hume’s own semi-admonishment (1741) that “The Reader must not look for any connexion among these Essays but must consider each of them as a Work apart.”5 Watkins’s response—indicative of the graciousness of her overall tone—is to warmly acknowledge Hume’s reproach and affirm the distinctiveness of each of the essays. She proclaims: “The Essays are not unified” (5). Her thinking about them separately, however, reveals a common practical thread in their form. Watkins characterizes this form as serving “to promote public benefit” (4). I think about this form as being philosophical in the way that Richard Rorty conceives of philosophy as cultural criticism.
