Este artículo intenta demostrar la falta de sacralidad de los soberanos magrebíes, a los que no se atribuye ningún tipo de poder taumatúrgico o milagroso. Antes bien, el poder es considerado como algo pernicioso, sujeto siempre a la oposición de los círculos religiosos, santos y alfaquíes, oposición que se resuelve en el rechazo del contacto con el sultán o en las críticas a la fiscalidad del Majzan.

Given current constraints on universal treatment campaigns, recent advances in public health prevention initiatives have revitalized efforts to stem the tide of HIV transmission. Yet, despite a growing imperative for prevention—supported by the promise of behavioral, structural and biomedical approaches to lower the incidence of HIV—human rights frameworks remain limited in addressing collective prevention policy through global health governance. Assessing the evolution of rights-based approaches to global HIV/AIDS policy, this review finds that human rights have shifted from collective public health (...) to individual treatment access. While the advent of the HIV/AIDS pandemic gave meaning to rights in framing global health policy, the application of rights in treatment access litigation came at the expense of public health prevention efforts. Where the human rights framework remains limited to individual rights enforced against a state duty bearer, such rights have faced constrained application in framing population-level policy to realize the public good of HIV prevention. Concluding that human rights frameworks must be developed to reflect the complementarity of individual treatment and collective prevention, this article conceptualizes collective rights to public health, structuring collective combination prevention to alleviate limitations on individual rights frameworks and frame rights-based global HIV/AIDS policy to assure research expansion, prevention access and health system integration. Las fuentes hagiográficas de la Edad Media presentan un catálogo impresionante de enfermedades, pues Dios pone a prueba a sus fieles por medio de males espectaculares, signos visibles de la elección divina. Por su parte, el santo está en lucha perpetua con su cuerpo: vestidos que hieren la piel, privaciones de alimento, de sueño y de cualquier placer. A pesar de la debilidad física producida por estas privaciones y enfermedades, las capacidades de estos cuerpos son impresionantes. Cuanto más se domina (...) el cuerpo, más se domina el mundo material y más espectaculares son los milagros. El artículo examina también las virtudes y carisma del cuerpo muerto del santo y de su lugar de enterramiento, así como la relación entre maestro y discípulo, fuertemente emocional y casi física. El libro contiene doce lecciones dadas por el autor en la Universidad Central de Madrid en 1933. Ortega desarrolla el planteamiento de los problemas generales de la historia y de la "historiología". Analiza los acontecimientos que causaron el inicio y evolución del pensamiento moderno. La vida de Galileo, en su opinión, marca el inicio del imperio de la razón pura, que comienza con la "rebelión de las ciencias" frente al dominio precedente de la teología. Se hace un estudio del cristianismo (...) como forma de vida, su aparición, justificación histórica y desarrollo, hasta convertirse en el elemento central de la cultura occidental. El autor analiza el cristianismo al margen de la fe y de cualquier dimensión sobrenatural, lo que le lleva a tratar la religión como una más entre las teorías filosóficas existentes. Ortega considera equivocadamente que la base del cristianismo es el reconocimiento de la nulidad del hombre y de la naturaleza. La verdadera línea de desarrollo de la filosofía cristiana --marcada, según él, por Duns Scoto, Eckhart y Nicolás Cusano--, desemboca necesariamente en una completa ruptura entre la fe y la razón. La doctrina de Santo Tomás habría supuesto, en cambio, una deformación del cristianismo, un intento de "racionalizar la fe" mediante la introducción del aristotelismo en el estudio de la teología. Geiger considers dilettantism as an aesthetic attitude (inner concentration) that undermines the subject's ability to truly perceive the essential value of the artwork and thus calls for outer concentration to actualize the justice of the work itself. Geiger's position suggests that we must pay equitable attention to artworks and that this attitude requires a theory of aesthetic perception -- phenomenological realism. However, the complexity of the aesthetic experience presents Geiger with several challenges, not least of which is the realisation of (...) an attitude that bridges emotion and value in aesthetic experience. This paper will attempt to defend and develop the legitimacy of Geiger's position. First, I will clarify Geiger's critique of dilettantism and suggest how this critique distinguishes him from other aesthetic claims; second, I argue that Geiger argues for an aesthetic attitude that distinguishes everyday emotions and thus ensures the value of the work of art as its own; finally, I will complete Geiger's position by drawing on later phenomenology that answers the question of how we realise the perception of artworks. The author discusses the thesis proposed by H. Hazlitt that jurisprudence has developed such methods and principles of solving legal problems that could also serve as a guide in solving ethical problems. The article critically reviews the reasoning behind this thesis made by H. Hazlitt and L. Yeager. A special attention is paid to the influence of J. Bentham’s utilitarian ideas on the formation of Hazlitt’s conception. Not being a lawyer, Hazlitt in the work The Foundations of Morality argued that (...) the law affects morality. In Hazlitt’s ethical theory judicial precedents affect the formation of moral rules. Hazlitt compares the formation of general rules in the sphere of morality and law. Using the formula of evaluation of moral rules proposed by Hazlitt, situations should be considered from three positions: subject of action, object of action, and impartial observer. Even though Yeager develops the ideas of Hazlitt, the former uses different arguments to substantiate the main thesis. Yeager believes that the laws have to declare the norms of morality. However, the arguments of Hazlitt and Yeager should be considered critically, as some researchers have done. As an additional argument to support the article’s main thesis, it is proposed to use the mechanism of conciliation procedures as a model for solving ethical problems. The article concludes that the thesis proposed by Hazlitt is valid but requires further reasoning and research by the philosophers of law. (shrink)

İslam dünyasında oldukça etkili isimlerden biri olan Gazzâlî’nin düşünceleri, birçok konuda oldukça muğlaktır. Onun görüşlerini tespit etmedeki zorluk, genel olarak, Gazzâlî’nin eserleri arasında gözlemlenen farklılıklardan kaynaklanır. Bu farklılıklar, yalnızca üslupla alakalı olmayıp zaman zaman Gazzâlî’nin birbiriyle çelişen görüşleri savunması şeklinde de tezahür etmektedir. Ruhun tabiatı meselesi de bunlardan biridir. Gazzâlî, farklı eserleri karşılaştırıldığında, ruhun tabiatı hakkında çelişen görüşler öne sürüyor gözükmektedir. Bir taraftan el-İḳtiṣād fī’l-İtiḳād adlı eserinde ruhun yer kaplayan ve maddi bir varlık olduğunu ima ederken, diğer bazı eserlerinde ise (...) bu görüşün tersini savunmakta ve ruhun gayri-maddi olduğunu vurgulamaktadır. Gazzâlî’nin, farklı eserlerinde ruhun tabiatına ilişkin farklı görüşler serdetmesi, görünürdeki bu farklılıkların nasıl yorumlanması gerektiğine ilişkin Michael E. Marmura, Richard Frank, Timothy Gionatti, Ayman Shihadeh, Frank Griffel gibi Gazzâlî yorumcuları arasında süregiden bir tartışmaya da önayak olmuştur. Bu çalışmada ben, öncelikle, Gazzâlî’nin gerçek düşüncesine ilişkin süregiden bu tartışmayı kısaca özetleyeceğim. Sonrasında ise onun çelişiyor gözüken düşünceleri üzerine bazı mümkün uzlaştırma önerilerinde bulunacağım. (shrink)

The apolipoprotein E gene plays an important role in the pathogenesis of Alzheimer's disease , and amyloid plaque comprised mostly of the amyloid-beta peptide ) is one of the major hallmarks of AD. However, the relationship between these two important molecules is poorly understood. We examined how A treatment affects APOE expression in cultured cells and tested the role of the transcription factor NF-B in APOE gene regulation. To delineate NF-B's role, we have characterized a 1098 nucleotide segment containing the (...) 5'-flanking region of the human APOE gene . Sequence analysis of this region suggests the presence of two potential NF-B elements. To demonstrate promoter activity, the region was cloned upstream of a promoterless luciferase gene. This segment was able to drive expression of luciferase in transient transfections of human fetal glial cells. Promoter activity was stimulated twofold by A treatment. Pretreatment with double-stranded DNA decoy oligonucleotides against NF-B reduced A stimulation. Deletion and mutagenetic analyses demonstrated that the distal NF-B element was functional and showed a strong DNA-protein complex band in gel shift analysis, similar to that from control NF-B consensus element. An anti-inflammatory and anti-NF-B drug, sodium salicylate, significantly blocked A-induced APOE promoter function. Our data provide evidence that upregulation of APOE by A in astroglial cells is mediated by an NF-B-element present in the 5'-flanking region of the APOE gene. (shrink)

Recent reports from 2023 and 2024 have brought to light alarming instances of healthcare professionals in China being involved in commercial surrogacy arrangements. These cases reveal the dual roles these professionals play: active facilitation, which includes actions such as selling fraudulent birth certificates that contribute to baby trafficking, and passive involvement, where routine medical care is provided to surrogate mothers without full awareness of the surrogacy context. Current regulations in China broadly prohibit surrogacy-related medical activities but fail to differentiate between (...) healthcare professionals who actively facilitate surrogacy arrangements and those who fulfil their professional obligations to patients. Drawing on professional ethics outlined in the revised 2021 Medical Practitioners Law of the People’s Republic of China and recent developments in modern slavery scholarship that emphasize the critical role of healthcare professionals in identifying and preventing exploitation, this paper argues that China has an opportunity to clarify and broaden the role of healthcare professionals in the context of surrogacy. Healthcare professionals should not be prohibited from providing medical care to surrogate mothers, provided they are not actively facilitating surrogacy arrangements. Simultaneously, they should be empowered to act as gatekeepers against exploitation. This would be an important step toward enhancing the current regulatory framework, ensuring better protections for children and women involved in surrogacy. (shrink)

Peygamber; doğumu (mevlid), mucizeleri (mi ʻ râciyye), fazileti (fazîletnâme), risâleti (bi’setnâme), savaşları (gazavât), sözleri (kırk, yüz, bin hadîs), fizikî ve ahlakî yönleriyle şemâili (şemâil, hilye), isimleri-sıfatları (esmâ-i nebî, evsâf-ı nebî), nesebi (neseb-i şerîf), vefatı (vefât-ı nebî) kısacası hayatının (siyer/sîre) tüm yönleri mensûr, manzûm, manzûm-mensûr gibi tarzlarla çeşitli şekillerde ele alınmıştır. Bunların dışında ilk dönem ürünlerinden itibaren Türk İslam Edebiyatında O’nu övmek maksadıyla hemen her şair tarafından kaleme alınan na ʻ tların nitelik ve nicelik itibariyle Hz. Peygamber (...) ile ilgili edebî türler içerisinde ayrı bir yeri bulunmaktadır. Bu türün özellikle nicelik bakımından ön plana çıkmasında; Hz. Peygamber’e duyulan derin sevginin tezahür etmesinin yanı sıra İslâmî telîf tertibinde kitaplara besmele ve hamdelenin yanı sıra salvele ile başlanması, dîvân ya da mesnevîlere tevhîd ve münâcâttan sonra na ʻ t ile devam edilmesi geleneği de etki etmiştir. Hatta edebî eser özelinde her şair na ʻ t yazmaya çalıştığı gibi tertip ettikleri eserlerini sadece na ʻ tlardan oluşturan (dîvân-ı nu ʻ ût) şairler de mevcuttur. Ayrıca farklı şairlerin gerek dinî gerekse de tasavvufî biçim ve muhtevayla kaleme aldıkları na ʻ tların derlenerek na ʻ t mecmualarının oluşturulduğu da görülmektedir. Tanıtmaya ve değerlendirmeye temel alınan eserin de hareket merkezini bu mecmualarda yer alan na ʻ tlar oluşturmaktadır. Tasavvuf düşüncesindeki Hz. Peygamber telakkisinin/tasavvururun Türk İslam toplumuna, kültürüne özelde ise na ʻ tlara etkisinin ve kaynaklığının yansımasını hedef alan çalışma; varlık, bilgi ve ahlak konuları ekseninde na ʻ t yazarlarının, metinlerini oluştururken temellerine bu düşünceden neleri koyduklarını ilmî veriler ışığında ve örnekler eşliğinde ele almaktadır. Çocuklar ölümü düşünürler, ölümle ilgili duyguları ve tasavvurları vardır. Hayallerinde, oyunlarında ve çizimlerinde ölüme yer verirler. Çocukların ölümü nasıl tasavvur ettikleri onların yaşamla bağlarını belirler. Aynı şekilde birbirinin zıddı gibi görünen ölüm ve yaşam olgularını birlikte düşünmeleri bütünleyici bir kavrayışa ulaşmalarına da yardım edebilir. Bu nedenle çocukların dünyasında ölüm ve yaşam olgusunun bilimsel olarak incelenmesi önemlidir. Benmerkezcilik, animizm ve antropomorfizm gibi çocukluk dönemine ait bazı zihinsel özellikleri onların olayları anlama ve hayal etme becerilerinde etkilidir. Ayrıca yaş ve cinsiyet de farklılıklar (...) yaratmaktadır. Bu çalışmada çocukların ölümü ve yaşamı nasıl anladıkları ve tasavvur ettikleri araştırılmıştır. Nitel araştırma yaklaşımlarından durum çalışması deseninin kullanıldığı araştırmada verilerin analizi için projektif bir yöntem olan resim analizi tekniği uygulanmıştır. 2019’da Türkiye’de Müslüman ailelerin çocukları üzerinde gerçekleştirilen araştırma için ebeveynlerinden onam alınan yaşları 9 ile 13 yaş arasında değişen 57 çocuktan ölüm ve yaşam hakkında resim yapmaları istenmiştir. Resimler çocukların cinsiyet, yaş ve bilişsel gelişim dönemleri göz önünde bulundurularak tematik olarak analiz edilmiştir. Çözümlemeler için MAXQDA 2022 nitel veri analizi yazılım programı kullanılmıştır. Araştırmada çocukların ölüm ve hayat hakkında çizdikleri resimlerde cinsiyetlerine, yaşlarına, bilişsel gelişim dönemlerine, bireysel tecrübelerine, dinî ve kültürel alt yapılarına göre farklı kompozisyonlar ve figürler kullandıkları görülmektedir. Literatür eşliğinde çözümlenen resimlerdeki somut ve soyut temalar kodlanmış ve hiyerarşik kod modelleri, kod bulutları, cinsiyet ve gelişim dönemi farklılıklarına göre çapraz analizler sunulmuştur. Bireysel farklılıklara göre resimlerden örnekler sunularak bulgular eşliğinde yorumlanmıştır. (shrink)

La presente investigación tiene como meta el tratamiento del espacio y del tiempo como objetos de la imaginación en el pensamiento de Leonardo Polo. El tratamiento del espacio imaginado es oportuno en un estudio sobre su filosofía jurídica toda vez que Polo sostiene que es el “lugar” en donde se elabora lo técnico. Así pues, ahí tendría su origen todo ars humano, dentro de los cuales ocuparía un lugar destacado el ars iuris. Los juristas romanos entendían el ius como el (...) “ars boni et aequi”, lo cual indicaría que la jurisprudencia desde antiguo era considerada un arte o técnica. (shrink)
