Who is a child’s father? Is it the man who raised her, or the one whose genes she carries—or both? We look at the view that men who have raised children they falsely believed to be ‘their own’ have been victims of a form of fraud or are ‘false fathers’. We consider the question of who has been harmed in such cases, and in what the harm consists. We use conceptual analysis, a philosophical method of investigating the use of a (...) concept and the logical implications of its various interpretations. We devise and discuss a number of possible scenarios in which a couple (arguably) become the parents of a child. We use these scenarios to illustrate the tenuousness of the claim that we can simply rely on biology to clarify parent-child relationships. We also discuss some of the underpinnings and implications of the language in which the debate on ‘paternity fraud’ has been framed: ‘duped’ or ‘false’ fathers and ‘cuckoo children’. (shrink)

Whereas women are sure of their biological maternity, men can never be fully certain of paternity and instead need to rely on indirect cues to assess whether they are likely to be father of their putative children. According to the psychological literature, men commonly use the information on the resemblance of offspring to self as an indicator of genetic relatedness. The emerging phenomenon of genetic paternity testing shows how good science and useful social reform can run off the rails. Genetic paternity testing enables us to sort out, in a transparent and decisive way, the age-old but traditionally never-quite-answerable question of whether a child is genetically related to the husband of the child's mother. Given the impossibility of settling this question for certain, British and American law has long held that a biological relationship must almost always be assumed to (...) exist. According to what is known as the “marital presumption” or “presumption of legitimacy,” a child born to a woman within a marital relationship is assumed to be the biological child of the woman's husband unless he was absent, impotent, or sterile. In other words, if paternity was not a physical impossibility for the husband, there was a nearly irrebuttable presumption that he was the father of the child. Fetal ultrasonography has made women's and men's relationship to the fetus more equal. Drawing on information obtained from multiple conjoint interviews with 62 childbearing couples, I suggest that although women and men are both advantaged by fetal ultrasonography, expectant fathers' experience of the fetus is always enhanced, whereas pregnant women's experience may also be attenuated. For men, fetal ultrasonography is like a prosthetic device: an enabling mechanism that permits them access to a female world from which they have been excluded (...) because of their limited biological role in reproduction. Biology is seen not merely as a privileged oppressor of women but as a co-victim of masculinist social assumptions. We see feminist critique as one of the normative controls that any scientist must perform whenever analyzing data, and we seek to demonstrate what has happened when this control has not been utilized. Narratives of fertilization and sex determination traditionally have been modeled on the cultural patterns of male/female interaction, leading to gender associations being placed on cells and their components. Transformations in the biological, medical and legal processes of infertility, substantial modifications in family structure and the advancement of methods and techniques of reproductive technology will affect the next step in both legal and medical terms to address the regulation of bioethics and law in Kosovo. There is a need to establish perspectives in both ethical and professional terms, since the Republic of Kosovo is in the process of drafting a Civil Code. Many of these issues have been raised (...) and addressed during the review and evaluation of family law in the context of harmonisation and inclusion of this law in the Civil Code of the Republic of Kosovo. During the several meetings of official members with different interest groups regarding family law, the need has been raised to regulate family law to be included in the Civil Code for motherhood and fatherhood in the case of reproduction with biomedical assistance, as well as for the birth contract as a donation for another person (so-called surrogate motherhood). Though most children can easily answer the question, "Who's your daddy?", the concept of paternity is complex and multifaceted. Courts have stumbled in answering it. In order to ground paternal rights and obligations in a satisfactory way, we need to disaggregate the various elements of stereotypical paternity. It is not sufficient merely to separate social from biological paternity. The latter concept, itself, is complex. We need to separate the procreative element of paternity from the genetic relationship.

This paper reconnects the personal and the biological by extending the reach of parental causality. First, it argues that the reproductive act is profitably understood in personal terms as an “invitation” to new life and that the egg and sperm are “ambassadors” or “delegates,” because they represent the potential mother and father and are naturally endowed with causal powers to bring about motherhood and fatherhood, two of the most significant roles a person may have. Second, it argues that (...) even though God alone can create a spiritual soul, the human parents are not just the causes of their child’s body; they are the secondary causes of the whole child. In this way, God acts as a kind of “sponsor” who enables the acceptance of the invitation issued by the parents, and he accepts it on behalf of the new human person that comes to be thanks to their invitation. My primary aim is to call into question an influential notion of paternal responsibility, namely, that fathers owe support to their children due to their causal responsibility for their existence. I argue that men who impregnate women unintentionally, and despite having taken preventative measures, do not owe child support to their children as a matter of justice; their children have no right against them to support. I argue for this on the basis of plausible principles of responsibility which have been (...) used to defend abortion rights. I then consider the morally relevant differences between men and women, arguing that while in some cases these differences may justify differential treatment, their import should not be overstated - in many cases, the burden of child support will be too great to impose justly on fathers. This conclusion is not as undesirable as it may seem: I suggest feminist considerations in favor of revising the notion of paternal responsibility and considering alternative arrangements of child support. The tension between equality and singularity, between law and something beyond the law, is what is at stake in Derrida’s The Gift (...) of Death. There, Derrida describes ethics as a paradox between the universal and the individual, between equality and singularity. Kierkegaard’s reading of the story of Abraham and Isaac from Genesis is the centerpiece of Derrida’s analysis. If we read The Gift of Death, with its focus on this story of father and son, in relation to Ricoeur and Levinas on the question of fatherhood, it reads as the culmination of a dialectical tension between the two. In this higher stage of the dialectic of paternity, the murder of the father is replaced by his sacrifice. Oddly, however, Ricoeur’s dialectic remains at the level of the master-slave fight to the death, where—without the Hegelian resolution—the only options available to insure the recognition of the father by the son (or the son by the father) are murder or suicide. For Ricoeur, recognition requires death, symbolic if not imaginary, whereas Hegel insists that recognition comes only when the master and slave are willing to risk death but also realize the necessity of avoiding it; mutual recognition cannot be maintained if one of the parties is dead.For Ricoeur, recognition does not necessitate avoiding death but rather moving away from the realm of the family and the body to the level of the social and the law. Surveys theories of paternity/fatherhood.

The article seeks to purvey a moral philosophical foundation to the apostolic letter. The apostolic letter speaks pointedly of the fatherhood crisis as an issue that needs moral philosophical atrention. The research will use two methods: the philosophical (content) analysis and applied ethical theories. Philosophical analysis is a general term for techniques typically used by philosophers in the analytic tradition that involve breaking down philosophical issues in order to bring clarity, consistence, and coherence. The method is used to analyse (...) concepts like parenthood, fatherhood and shepherdship. Applied ethics is a philosophical examination, from a moral point of view, of particular issues in private and public life which are matters of judgement. However, the punch line, ‘Children today often seem orphans, lacking fathers’, is a direct moral challenge that calls for the application of the ethical theory of hunhu/ubuntu because love is hunhu/ubuntu’s character, nature and responsibility. From hunhu/ubuntu’s view point, I argue that one must acquire personhood primarily first in order to be a father. In hunhu/ubuntu, personhood and fatherhood are dynamic concepts; morally achieved and acquired. Hunhu/ubuntu is not asking that we replace God as the author of our being, but rather that our being as persons in the world is substantially of our own making. As such, we have a victory to win, and the path to that victory lies in the part of our lived morality (hunhu/ubuntu). God created us, but we must mould ourselves into the persons that God wants us to be.Contribution: The intention of this article is to encourage the 21st century generation to be good persons and hence be responsible fathers through drawing moral support and inspiration from hunhu/ubuntu and Saint Joseph. Although ‘new fatherhood’ promises a reconstruction of the domesticity paradigm that positions fathers as breadwinners and mothers as caretakers, it maintains the notion that families are self-supporting entities and thereby neglects the extensive interdependence involved in raising children. As a result, it cannot successfully overturn this paradigm and hampers our ability to reimagine relationships along lines that would better serve parents' and children's wellbeing. This article raises these issues through an exploration of ‘daddy-daughter dances’, which manifest new fatherhood (...) discourse as expressed in public schooling. Although the dances are in some ways peculiarly American, they exemplify tensions and inconsistencies around father's involvement in child-raising that nag most contemporary Western societies. These tensions, the article contends, concern the distribution of public resources among families as well as within them. Drawing on Kittay's theorization of dependence and interdependence, the article argues that contemporary social reconfigurations demand a new reimagination of relationships that starts with the recognition of interdependencies. This claim is based on the belief that fathers and father figures play an important role in constructing unique identities, both in the context of childrearing and in a more general cultural sense. An existential concept of adoption is developed to clarify the notion of credible fatherhood, which is supported, on the one hand, by Dorothee Sölle's analysis of the shift (...) from a religious construction of identity to a post-religious self-construction of identity and, on the other, by Charles Taylor's concept of authenticity. This paper describes the meaning of a father’s presence with a full-term healthy child delivered by caesarean section, as observed during the routine post-operative separation of mother and child. Videotaped observations recorded at a maternity clinic located in the metropolitan area of Stockholm, Sweden formed the basis for the study, in which fifteen fathers with their infants participated within two hours of elective caesarean delivery in the 37th - 40th week of pregnancy. A phenomenological analysis based on Giorgi’s method was (...) conducted on the data. The description of the new father’s experiences that emerged pointed to a process of being and becoming in taking the child to himself. Fatherhood developed gradually as a result of recurrent experiences of the child’s expressions. There was an ebb and flow between taking on the role of being a father and physical withdrawal from the role. The findings of this study not only confirm previous accounts of new fathers’ experiences, but go further in revealing an ebb and flow variation in the fathers’ involvement. What this indicates is that the process of transition to fatherhood requires not only presence but time. The period required for this process thus must not be disturbed, but supported, trusting in the father’s ability to assume his role as a father. It is suggested that, in addition to their relevance in guiding the attitudes and expectations of those professionally involved in postnatal care and community health, these findings could be useful in antenatal courses for parents, and especially in instances when caesarean birth is planned, to highlight the meaning of the role of fathers as caregivers. Youth sports have been recognized as an arena for men to meet increased cultural expectations of being involved in their children’s lives. Indeed, in contrast to other child care practices, many men are eager to take part in their children’s organized sports. Drawing on an ethnographic study of middle-class families in the United States, this study examines how men juggle two contrasting cultural models of masculinity when fathering through sports—a performance-oriented orthodox masculinity that historically has been associated with sports and (...) a caring, inclusive masculinity that promotes the nurturing of one’s children. Through a detailed analysis of how fathers’ sports involvement unfolds on the ground, we show how men, in order to portray themselves as “good” fathers, attempt to strike a balance between pushing their children to excel and supporting them regardless of their performance. We propose that although men may value inclusive masculinity when fathering through youth sports, at the same time they exercise orthodox masculinity in other domestic domains. (shrink)

Analytic metaphysics has recently discovered biology as a means of grounding metaphysical theories. This has resulted in long-standing metaphysical puzzles, such as the problems of personal identity and material constitution, being increasingly addressed by appeal to a biological understanding of identity. This development within metaphysics is in significant tension with the growing tendency amongst philosophers of biology to regard biological identity as a deep puzzle in its own right, especially following recent advances in our understanding of symbiosis, the (...) evolution of multi-cellular organisms and the inherently dynamical character of living systems. Moreover, and building on these biological insights, the broadly substance ontological framework of metaphysical theories of biological identity appears problematic to a growing number of philosophers of biology who invoke process ontology instead. This volume addresses this tension, exploring to what extent it can be dissolved. For this purpose, the volume presents the first selection of essays exclusively focused on biological identity and written by experts in metaphysics, the philosophy of biology and biology. The resulting cross-disciplinary dialogue paves the way for a convincing account of biological identity that is both metaphysically constructive and scientifically informed, and will be of interest to metaphysicians, philosophers of biology and theoretical biologists. During the postpartum period, the paternal brain suffers extensive and complex neurobiological alterations, through the experience of father–infant interactions. Although the impact of such experience in the mother has been increasingly studied over the past years, less is known about the neurobiological correlates of fatherhood—that is, the alterations in the brain and other physiological systems associated with the experience of fatherhood. With the present study, we aimed to perform a scoping review of the available literature on the genetic, (...) neuroendocrine, and brain correlates of fatherhood and identify the main gaps in the current knowledge. PubMed, Scopus, and Web of Science electronic databases were searched for eligible studies on paternal neuroplasticity during the postpartum period, over the past 15 years. Reference lists of relevant key studies and reviews were also hand-searched. The research team independently screened the identified studies based on the established inclusion criteria. Extracted data were analyzed using tables and descriptive synthesis. Among the 29 studies that met our inclusion criteria, the vast majority pertained to neuroendocrine correlates of fatherhood, followed by brain activity or connectivity, association studies of candidate genes, and brain structure correlates. Collectively, studies published during the past 15 years suggest the existence of significant endocrine and neurofunctional alterations as a result of fatherhood, as well as preliminary evidence of genetic variability accounting for individual differences during the postpartum period in fathers. No studies were so far published evaluating epigenetic mechanisms associated with the paternal brain, something that was also the focus of the current review. We highlight the need for further research that examines neuroplasticity during the experience of fatherhood and that considers both the interplay between hormones and simultaneous assessment of the different biomarkers ; data collection protocols and assessment times should also be refined. Exploring what a scientific metaphysics grounded in biological practices could look like and how it might impact the way we investigate the world around us, the contributors to From Biological Practice to Scientific Metaphysics review and discuss long-held objections to metaphysics by natural scientists. They illuminate how, in order to learn about the world as it truly is, we must look not only at what scientists say but also what they do.

In this paper, we present the first stage of an empirical bioethics project exploring the moral sources of paternal responsibilities and rights. In doing so, we present both (1) data on men's normative constructions of fatherhood and (2) the first of a two-stage methodological approach to empirical bioethics. Using data gathered from 12 focus groups run with UK men who have had a variety of different fathering experiences (n = 50), we examine men's perspectives on how paternal responsibilities and (...) rights are generated and the significance of the genetic connection within the father–child relationship. We do not attempt to explore men's experiences of fatherhood or their fathering practices; and neither is the analysis driven from a particular sociological perspective. Rather, we explore men's normative constructions of fatherhood in order to present accessible data that might be of significance to the philosophical/moral debate on the sources of paternal rights and responsibilities. In doing so, I will give an overview of the main scientific findings with regard to how older age in men affects the health of future offspring. I shall demonstrate how the discrepancy between the media coverage and policies on postponed motherhood and postponed fatherhood mistakenly suggests that (...) women are more responsible than men for the health of offspring. Despite wide acceptance that the attributes of living creatures have appeared through a cumulative evolutionary process guided chiefly by natural selection, many human activities have seemed analytically inaccessible through such an approach. Prominent evolutionary biologists, for example, have described morality as contrary to the direction of biological evolution, and moral philosophers rarely regard evolution as relevant to their discussions. -/- The Biology of Moral Systems adopts the position that moral questions arise out of conflicts of interest, and that moral (...) systems are ways of using confluences of interest at lower levels of social organiation to deal with conflicts of interest at higher levels. Moral systems are described as systems of indirect reciprocity: humans gain and lose socially and reproductively not only by direct transactions, but also by the reputations they gain from the everyday flow of social interactions. -/- The author develops a general theory of human interests, using senescence and effort theory from biology, to help analye the patterning of human lifetimes. He argues that the ultimate interests of humans are reproductive, and that the concept of morality has arisen within groups because of its contribution to unity in the context, ultimately, of success in intergroup competition. This essay offers a philosophical analysis of the role of the father-figure in the family. I argue that a Cartesian approach to this question is useless, and that Hegel, while he offers the beginning of an adequate analysis, falls short of the multiple-function model which an adequate analysis requires.

From biology to economics to information theory, the theme of interdependence is in the air, framing our experiences of all sorts of everyday phenomena. Indeed, the network may be the ascendant metaphor of our time. Yet precisely because the language of interdependence has become so commonplace as to be almost banal, we miss some of its most surprising and far-reaching implications.

Recent revisions in child support and paternity establishment legislation enacted under the 1996 welfare reform act, the Personal Responsibility and Work Opportunity Reconciliation Act, significantly alter the American welfare state's relationship to men's fathering. Through a critical review of prior research and social service literature, the authors argue that PRWORA actively constructs fatherhood not only through state policies that maintain males as “breadwinners” but also through state-sponsored social service programs that seek to influence men's identities as fathers.
