In Critique and Disclosure, Nikolas Kompridis argues provocatively for a richer and more time-responsive critical theory. He calls for a shift in the normative and critical emphasis of critical theory from the narrow concern with rules and procedures of Jürgen Habermas's model to a change-enabling disclosure of possibility and the enlargement of meaning. In response to an impasse, articulated in the late 1980s, the cognitive capacities of ordinary people assumed central place in contemporary critical social theory. The participants’ perspective gained precedence over scientific standards branded as external. The notion of cognition, however, went unchallenged. This article continues the move away from external standards, and discusses two models of critique, which differ based on their underlying notions of cognition. The representational model builds on cognitive content, misrecognition and normativity; three features which are (...) illustrated with positions adopted by prominent exponents of critical social theory. An alternative understanding relies on action-oriented disclosure and the participants’ basic familiarity with the social world. On this reading, what clashes with unequal structures is skilful coping, rather than representations and normative standards. The action-oriented approach may overcome the dilemma of understanding both the impact and the possible transcendence of unequal structures, although it cannot ultimately replace representational critique. For many liberals, the question "Do others live rightly?" feels inappropriate. Liberalism seems to demand a follow-up question: "Who am I to judge?" Peaceful coexistence, in this view, is predicated on restraint from morally evaluating our peers. But Rahel Jaeggi sees the situation differently. Criticizing is not only valid but also useful, she argues. Moral judgment is no error; the error lies in how we go about judging. One way to judge is external, based on universal standards derived from ideas (...) about God or human nature. The other is internal, relying on standards peculiar to a given society. Both approaches have serious flaws and detractors. In On the Critique of Forms of Life, Jaeggi offers a third way, which she calls "immanent" critique. Inspired by Hegelian social philosophy and engaged with Anglo-American theorists such as John Dewey, Michael Walzer, and Alasdair MacIntyre, immanent critique begins with the recognition that ways of life are inherently normative because they assert their own goodness and rightness. They also have a consistent purpose: to solve basic social problems and advance social goods, most of which are common across cultures. Jaeggi argues that we can judge the validity of a society's moral claims by evaluating how well the society adapts to crisis--whether it is able to overcome contradictions that arise from within and continue to fulfill its purpose. Are our beliefs justified only relatively to a specific culture or society? Is it possible to give reasons for the superiority of our scientific, epistemic methods? In On Global Justice, Mathias Risse claims that the earth’s original resources are collectively owned by all human beings in common, such that each individual has a moral right to use the original resources necessary for satisfying her basic needs. He also rejects the rival views that original resources are by nature owned by no one, owned by each human in equal shares, or owned and co-managed jointly by all humans. I argue that Risse’s arguments fail to establish a form (...) of ownership at all and, moreover, that his arguments against the three rival views he considers all fall short. This new translation is an extremely welcome addition to the continuing Cambridge Edition of Kant’s works. English-speaking readers of the third Critique have long been hampered by the lack of an adequate translation of this important and difficult work. James Creed Meredith’s much-reprinted translation has charm and elegance, but it is often too loose to be useful for scholarly purposes. Moreover it does not include the first version of Kant’s introduction, the so-called “First Introduction,” which is now recognized as (...) indispensable for an understanding of the work. Werner Pluhar’s more recent translation, which does include the First Introduction, is highly accurate when it confines itself to rendering Kant’s German. However, it is often more of a reconstruction than a translation, containing so many interpretative interpolations that it is often difficult to separate out Kant’s original text from the translator’s contributions. Paul Guyer and Eric Matthews have provided a translation that compares to or exceeds Pluhar’s in its literal approach to the German, but that confines all interpretative material to footnotes and endnotes, so that the text itself, with all its unclarities and ambiguities, lies open to view. In addition, Guyer, as editor of the volume, has provided a great deal of valuable supplementary material. This includes an introduction with an outline of the work and details of the history of its composition and publication, and a wealth of endnotes offering clarifications of the text, background information, and, most strikingly, many references to related passages in Kant’s voluminous writings, particularly in connection with Kant’s earlier writings related to aesthetics. The edition also records differences among the first three editions of the work, and—of particular interest—erasures from and additions to Kant’s manuscript of the First Introduction. Although the introduction and endnotes reflect interpretative views that are sometimes disputable, this supplementary material makes the present edition into a valuable resource even for those able to read the text in German. When we criticize social institutions and practices, what kinds of reasons can we offer for such criticism? Political philosophers often assume that we must rely on universal moral principles that are not necessarily connected to the particular social practices of our communities. Traditionally,continental critical theory has rejected this claim through its endorsement of the method of immanent critique. Immanent critique is a critique of social practices that draws on norms already present within these practices to demand social (...) change, rather than merely conservatively reproducing them. This book defends the claim that such a critique is not only possible, but also has politically powerful potential. Taking up recent developments in analytic collective intentionality theory and in the philosophy of language, the book argues that all social practices rest on structures of mutual recognition between persons that allow social theorists to reconstruct hidden norms present within these practices. Starting from a comprehensive critique of contemporary critical theory, the book also spells out the consequences of this line of thought for the practice of social critique, for the social sciences and for political philosophy. Robots endowed in this way may be referred to as artificial moral agents. Reasons often given for developing AMAs are: the prevention of harm, the necessity for public trust, the prevention of immoral use, such machines are better moral reasoners than humans, and (...) building these machines would lead to a better understanding of human morality. Although some scholars have challenged the very initiative to develop AMAs, what is currently missing from the debate is a closer examination of the reasons offered by machine ethicists to justify the development of AMAs. This closer examination is especially needed because of the amount of funding currently being allocated to the development of AMAs coupled with the amount of attention researchers and industry leaders receive in the media for their efforts in this direction. The stakes in this debate are high because moral robots would make demands on society; answers to a host of pending questions about what counts as an AMA and whether they are morally responsible for their behavior or not. This paper shifts the burden of proof back to the machine ethicists demanding that they give good reasons to build AMAs. The paper argues that until this is done, the development of commercially available AMAs should not proceed further. (shrink)

In recent decades, left political projects in the United States have taken a strong legalistic turn. From affirmative action to protection against sexual harassment, from indigenous peoples’ rights to gay marriage, the struggle to eliminate subordination or exclusion and to achieve substantive equality has been waged through courts and legislation. At the same time, critiques of legalism have generally come to be regarded by liberal and left reformers as politically irrelevant at best, politically disunifying and disorienting at worst. This conjunction (...) of a turn toward left legalism with a turn away from critique has hardened an intellectually defensive, brittle, and unreflective left sensibility at a moment when precisely the opposite is needed. Certainly, the left can engage strategically with the law, but if it does not also track the effects of this engagement—effects that often exceed or even redound against its explicit aims—it will unwittingly foster political institutions and doctrines strikingly at odds with its own values. Brown and Halley have assembled essays from diverse contributors—law professors, philosophers, political theorists, and literary critics—united chiefly by their willingness to think critically from the left about left legal projects. The essays themselves vary by topic, by theoretical approach, and by conclusion. While some contributors attempt to rework particular left legal projects, others insist upon abandoning or replacing those projects. On Jaeggi’s reading, the immanent and progressive features of ideology critique are rooted in the connection between its explanatory and its normative tasks. I argue that this claim can be cashed out in terms of the mechanisms involved in a functional explanation of ideology and that stability plays a crucial role in this connection. On this reading, beliefs can be said to be ideological if (a) they have the function of supporting existing social practices, (b) they are the output (...) of systematically distorted processes of belief formation, (c) the conditions in which distorting mechanisms trigger can be traced back to structural causal factors shaped by the social practice their outputs are designed to support. Functional problems thus turn out to be interlocked with normative problems because ideology fails to provide principles to regulate cooperation that would be accepted under conditions of non-domination, hence failing to anchor a stable cooperative scheme. By explaining ideology as parasitic on domination, ideology critique points to the conditions under which cooperation stabilizes as those of a practice whose principles are accepted without coercion. Thus, it seems to entail a conception of justice whose principles are articulated as part of a theory of social cooperation. (shrink)

This new translation of the first Critique forms part of a fifteen-volume English-language edition of the works of Immanuel Kant under the general editorship of this volume’s editor-translators, Paul Guyer and Allen Wood. The edition, which is almost complete by now, comprises all of Kant’s published works along with extensive selections from his literary remains, his correspondence, and student transcripts of his lecture courses in metaphysics, ethics, logic, and anthropology. The Cambridge edition aims at a consistent English rendition of (...) Kant’s works, both within a given volume and across volumes. In terms of scope and detail, the Cambridge edition is unrivaled in any language, except for the authoritative Academy edition begun under the directorship of Wilhelm Dilthey in 1900, which, however, is still not completed and several volumes of which are in serious need of re-editing. In one case, that of the Opus postumum, the best edition currently available seems to be the one in the Cambridge edition. (shrink)
The authors use the term “principlism” to refer to the practice of using “principles” to replace both moral theory and particular moral rules and ideals in dealing with the moral problems that arise in medical practice. The authors argue that these “principles” do not function as claimed, and that their use is misleading both practically and theoretically. The “principles” are in fact not guides to action, but rather they are merely names for a collection of sometimes superficially related matters for (...) consideration when dealing with a moral problem. The “principles” lack any systematic relationship to each other, and they often conflict with each other. These conflicts are unresolvable, since there is no unified moral theory from which they are all derived. For comparison the authors sketch the advantages of using a unified moral theory. (shrink)

In his article, The Substance View: a critique, Rob Lovering argues that the substance view – according to which the human embryo is a person entitled to human rights – leads to such implausible implications that this view should be abandoned. In this article I respond to his criticism by arguing that either his arguments fail because the proponents of the substance view are not obligated to hold positions which may be considered absurd, or because the positions which they (...) are assumed to be obligated to hold, are not absurd at all. La volonté de construire une philosophie critique de l histoire est au c ur de la philosophie de Walter Benjamin. De sa dissertation doctorale aux thèses Sur le concept d histoire, Benjamin s est attelé à la tâche de comprendre et de construire les modes de réalisation d une histoire critique en rupture avec une tradition dédiée à la modernité. Cet ouvrage vise à reconstruire les différentes étapes épistémologiques de cette construction majeure et innovante face au modernisme toujours (...) prévalant actuellement dans ce domaine. Trois niveaux de critique sont identifiés qui concernent respectivement le contenu, la forme et la pratique de la critique. Il en ressort que la critique de la critique est le geste philosophique fondamental qui analyse et structure l activité critique en dissociant les différentes opérations à l uvre dans cette dernière. Ce geste philosophique premier ne concerne ni la dénonciation ni la rectification partielle d une situation d oppression mais constitue réellement son émancipation. Il vise la transformation du sujet lui-même dans et par son rôle d intervenant dans l'histoire. C'est en cherchant à trouver et mobiliser les ressources d apprentissage chez le sujet que le geste critique premier parvient à dépasser l'oppression et à engager la production d'une nouvelle forme de vivre ensemble. *** Der Wille, eine kritische Philosophie der Geschichte zu entwerfen, steht im Zentrum der Philosophie Walter Benjamins. Ausgehend von seiner Doktorarbeit bis hin zu seinen Thesen Über den Begriff der Geschichte, hat Benjamin es sich zur Aufgabe gemacht, die verschiedenen Arten der Verwirklichung einer kritischen Geschichte, die mit der Tradition der Moderne bricht, zu verstehen und zu entwerfen. Das vorliegende Werk versucht, die verschiedenen erkenntnistheoretischen Etappen dieses bedeutenden und innovativen Entwurfs, angesichts des heute immer noch auf diesem Gebiet vorherrschenden Modernismus, nachzuzeichnen. Drei Ebenen der Kritik werden identifiziert, die jeweils den Inhalt, die Form und die Praxis der Kritik betreffen. Daraus ergibt sich, dass die Kritik der Kritik die fundamentale philosophische Geste ist, die die kritische Vorgehensweise analysiert und strukturiert, indem sie die verschiedenen Arbeitsschritte in dieser letzteren voneinander trennt. Diese grundlegende philosophische Geste bedeutet weder die Denunziation noch die partielle Rechtfertigung einer Situation der Unterdrückung, sondern stellt in Wirklichkeit ihre Emanzipation dar. Sie hat das Ziel, das Subjekt selbst in und durch seine Rolle zu verwandeln, die darin besteht, in die Geschichte einzugreifen. Indem sie die Quellen der Lernprozesse beim Subjekt sucht und mobilisiert, gelingt es der grundlegenden kritischen Geste, die Unterdrückung zu überwinden und sich für die Einrichtung einer neuen Form des Zusammenlebens einzusetzen.
