Based on Fricker’s conceptualization of epistemic injustice and moral justice forgiveness, I propose an analysis of the relationship between epistemic injustice and redundant blame. Situated in the Colombian post-conflict context, it is argued that the negative identity prejudices applied to former guerrilla members produce a kind of epis- temic injustice and redundant blame that yields structural violence. It is suggested that a proper understanding of JEP and the Truth Commission’s work, as well as the concept of transitional justice, would work (...) as interpretative resources to favour the ex-rebels testimonial credibility. I conclude that the exercise of power which manipulates the in- terpretative resources available for a collective understanding of practices of justice and forgiveness in the post-conflict, is the cause of the structural violence against ex-rebels. Deliberative Transformative Moments (DTM) is a new concept that serves as an amendment to the DQI. With this new concept it is easier to get at the quick give-and-take of discussions of small groups of ordinary citizens. As an illustration, we apply the concept to discussions about the peace process among Colombian ex-combatants, ex-guerrillas and ex-paramilitaries. Specifically, we show how personal stories can transform a discussion from a low to a high level of deliberation and how they can have (...) the opposite effect. To increase the level of deliberation in the general population, we recommend that good illustrations of DTM’s should be part of the school programs from an early age on, so that children learn how to discuss with others who have different opinions and values. In group discussions of any kind there tends to be an up and down in the level of deliberation. To capture this dynamic we coined the concept of Deliberative Transformative Moments (DTM). In deeply divided societies deliberation is particularly important in order to arrive at peace and stability, but deliberation is also very difficult to be attained. Therefore, we wanted to learn about the conditions that in group discussions across the deep divisions of such societies help deliberation. We organized such (...) group discussions between ex-guerrillas and ex-paramilitaries in Colombia, Serbs and Bosnjaks in Srebrenica, and poor residents and local police officers in the favelas (slums) of Brazil. We could identify factors that help to transform discussions from low to high deliberation and risk transformations in the opposite direction. We could also identify factors that help to keep a discussion at a high level of deliberation, and, in a next step, we could determine to what extent long sequences of deliberation had a positive impact on the outcomes of the discussions. Finally, we show how our research results can have a long term effect if it is used in schools of such deeply divided societies. (shrink)

If, as asserted by the French collective Tiqqun, we are essentially living in a global colony, where the 1% control the 99%, then it follows that the revolutionary struggle should strategically reorient itself as guerrilla warfare. The agents of this war, Tiqqun characterize, in part, by drawing on ethnologists Pierre de Clastres and Ernesto de Martino, specifically their figures of the Indigenous American warrior and the Southern Italian sorcerer, respectively. Hybridizing these two figures into that of the “warrior-mage,” the present (...) article posits an actionable exemplar thereof in players of the massively popular trading and online card game, Magic: The Gathering (MTG). More specifically, I propose a strategic mapping of MTG’s five colors of magic onto the five divisions of a coalition against late capitalist Empire, which I call the “Warrior-Mage Guild,” including liberation clerics, animal rights activists, propagandists, anti-psychiatrists, hackers, saboteurs, and those who threaten decolonizing force contra Empire. Automated decision making for sentencing is the use of a software algorithm to analyse a convicted offender’s case and deliver a sentence. This chapter reviews the moral arguments for and against employing automated decision making for sentencing and finds that its use is in principle morally permissible. Specifically, it argues that well-designed automated decision making for sentencing will better approximate the just sentence than human sentencers. Moreover, it dismisses common concerns about transparency, privacy and bias as unpersuasive or inapplicable. The (...) chapter also notes that moral disagreement about theories of just sentencing are plausibly resolved by applying the principle of maximising expected moral choiceworthiness, and that automated decision making is better suited to the resulting ensemble model. Finally, the chapter considers the challenge posed by penal populism. The dispiriting conclusion is that although it is in theory morally desirable to use automated decision-making for criminal sentencing, it may well be the case that we ought not to try. (shrink)

Full of drama, dedication, and humor, this book narrates the author's often frustrating experiences working as an experimental physicist in Cuba after the disintegration of the so-called socialist block. Lacking finance and infrastructure, faced with makeshift equipment, unpredictable supplies, and unreliable IT, Altshuler tells how he and his students overcame numerous challenges to make novel and interesting contributions to several fields of science. Along the way, he explains the science - from studies of ant colonies to superconductivity - either qualitatively (...) or quantitatively, but always at a level fully understandable to an undergraduate student of natural sciences or engineering. An even wider audience, however, may skip the technical sections without missing the essence. With numerous anecdotes, photographs and the author's own delightful cartoons, the book tells a remarkable, and often amusing story of how successful science can be performed against all odds. CRISPR-Cas9 genome editing can and has altered human genomes, bringing bioethical debates about this capability to the forefront of philosophical and policy considerations. Here, I consider the underexplored implications of CRISPR-Cas9 gene drives for heritable human genome editing. Modification gene drives applied to heritable human genome editing would introduce a novel form of involuntary eugenic practice that I term guerrilla eugenics. Once introduced into a genome, stealth genetic editing by a gene drive genetic element would occur each subsequent generation irrespective (...) of whether reproductive partners consent to it and irrespective of whether the genetic change confers any benefit. By overriding the ability to ‘opt in’ to genome editing, gene drives compromise the autonomy of carrier individuals and their reproductive partners to choose to use or avoid genome editing and impose additional burdens on those who hope to ‘opt out’ of further genome editing. High incidence of an initially rare gene drive in small human communities could occur within 200 years, with evolutionary fixation globally in a timeframe that is thousands of times sooner than achievable by non-drive germline editing. Following any introduction of heritable gene drives into human genomes, practices intended for surveillance or reversal also create fundamental ethical problems. Current policy guidelines do not comment explicitly on gene drives in humans. These considerations motivate an explicit moratorium as being warranted on gene drive development in heritable human genome editing. (shrink)

The escalation of violence committed by the Revolutionary Armed Forces of Colombia guerrillas against noncombatant civilians triggered a shift in the theoretical orientation of scholars who study Colombia’s political economy. While previous explanations emphasized the sociopolitical “grievances” underlying guerrilla activities, recent explanations emphasize the “greed” motive, including guerrilla involvement in Colombia’s illegal narcotics trade. In this article, the author posits an alternative explanation using Charles Tilly’s theories of state formation to explain FARC activities in Caquetá, Colombia. Drawing from a (...) longitudinal data set that documents the war making, state making, extraction, and protection activities of the FARC between 1975 and 2007, in addition to historical sociological methods, the author finds that increases in FARC repression stem from the growing militarization and paramilitarization of the region, which pressured the FARC to extract resources from the local population in a way that no longer served that population’s legitimate protection interests. According to contractualist theories in ethics, whether an action is wrong is determined by whether it could be justified to others on grounds no one could reasonably reject. Contractualists then think that reasonable rejectability of principles depends on the strength of the personal objections individuals can make to them. There is, however, a deep disagreement between contractualists concerning from which temporal perspective the relevant objections to different principles are to be made. Are they to be made on the basis of (...) the prospects the principles give to different individuals ex ante or on the basis of the outcomes of the principles ex post? Both answers have been found to be problematic. The ex ante views make irrelevant information about personal identity morally significant and lead to objectionable ex ante rules, whereas ex post views lead to counterintuitive results in the so-called different harm and social risk imposition cases. The aim of this article is to provide a new synthesis of these views that can avoid the problems of the previous alternatives. I call the proposal ‘risk-acknowledging’ ex post contractualism. The crux of the view is to take into account in the comparisons of different objections both the realized harms and the risks under which individuals have to live. (shrink)

In a recent article Yvonne Chiu argues that nonuniformed combat is impermissible. However, her argument that by fighting without uniforms nonuniformed guerillas coerce civilians into participating in the armed conflict and thus into surrendering their immunity (their right not to be attacked) fails: there is no coercion, no participation, and no surrendering of immunity. Yet even if this argument of hers were correct, it would still not show that such “coercion” would amount to a rights infringement. Moreover, even if it (...) did, there are examples that show that such an infringement would sometimes be perfectly justified. Finally, if she were right that forcing civilians into a moral position that they have not accepted or chosen is absolutely wrong, then this would affect the moral status of uniformed combatants no less than it would affect the moral status of nonuniformed ones. Anna Mahtani describes a puzzle meant to show that the Ex-Ante Pareto Principle is incomplete as it stands and, since it cannot be completed in a satisfactory manner, decades of debate in welfare economics and ethics are undermined. In this paper, we provide a better solution to the puzzle which saves the Ex-Ante Pareto Principle from this challenge. We also explain how the plausibility of our solution is reinforced by its similarity to a standard solution to an analogous puzzle in (...) quantified epistemic logic. We also show that even if the puzzle were to remain unsolved, its impact on welfare economics and ethics would be limited. (shrink)

Individuals convicted of crimes are often subject to numerous restrictions — on housing, employment, the vote, public assistance, and other goods — well after they have completed their sentences, and in some cases permanently. The question of whether — and if so, when — ex-offender restrictions are morally permissible has received surprisingly little philosophical scrutiny. This article first examines the significance of completing punishment, of paying one's debt to society, and contends that when offenders' debts are paid, they should be (...) restored to full standing as citizens. Thus all ex-offender restrictions are presumptively unjustified. Nonconsequentialist defences of these restrictions are ultimately unsuccessful in defeating the presumption against them. In a limited range of cases, consequentialist considerations — namely, of risk reduction — may be sufficient to override the presumptive case against these restrictions. The article concludes by suggesting a number of criteria for assessing whether particular restrictive measures are permissible on grounds of risk reduction. (shrink)

The concept of ‘pareto superiority’ plays a central role in ethics, economics, and law. Pareto superiority is sometimes taken as a relation between outcomes, and sometimes as a relation between actions—even where the outcomes of the actions are uncertain. Whether one action is classed as (ex ante) pareto superior to another depends on the prospects under the actions for each person concerned. I argue that a person’s prospects (in this context) can depend on how that person is designated. Without any (...) constraints on acceptable designators, then, the concept of pareto superiority is ill defined and gives inconsistent results. I consider various ways of completing the definition and draw out some surprising implications. (shrink)

Prioritarianism is a variant of utilitarianism. It differs from utilitarianism in that benefiting individuals matters more the worse off these individuals are. On this view, there are two standard ways of handling risky prospects: Ex-Post Prioritarianism adjusts for prioritizing the worse off in final outcomes and then values prospects by the expectation of the sum total of those adjusted values, whereas Ex-Ante Prioritarianism adjusts for prioritizing the worse off on each individual's expectation and then values prospects by the sum total (...) of those adjusted expectations. A standard objection to Ex-Post Prioritarianism is that it violates Ex-Ante Pareto, that is, it prescribes choices that worsen the expectations for everyone. In this article, I argue that Ex-Ante Prioritarianism suffers from much the same problem: it violates a sequential version of Ex-Ante Pareto, that is, it prescribes sequences of choices that worsen the expectations for everyone. Communication and behaviour of animals living ex situ has been one of the major sources of knowledge about wild animals. Nevertheless, it is also acknowledged that depending on the environment that the animals inhabit, there are differences in their communication and behaviour. With some species it is difficult to reproduce their natural environment to an extent that excludes deviations from the behaviour and communication exhibited by animals living in situ. In zoological gardens, welfare measures are introduced in order to counteract (...) the effects of the captive environment and to grant an individual’s good physical and psychological well-being. The relation between good welfare and species-specific communication and behaviour is discussed, and as a result, a general model of ex situ animal communication and behaviour is proposed. The suggested model is inclusive of differences between captive animals and free-ranging animals and serves to explain the welfare-related reasons underlying individual animal’s deviations from species-specific behaviour and communication. It’s constitutive of classical theism that there is a necessarily existent personal god who is also the creator of the universe, where the latter claim includes at least the following three theses: (i) God is wholly distinct from the natural world; (ii) God is the originating or sustaining cause of the natural world; and (iii) God created the natural world ex nihilo, i.e., without the use of pre-existing materials. Call this tripartite component of classical theism the classical view of creation. (...) In this paper, I offer a new argument against classical theism. In particular, I argue that creation ex nihilo is prima facie impossible, and that since the doctrine of creation ex nihilo is constitutive of classical theism, classical theism is false. (shrink)

In dealing with the radical politicization of psychoanalysis from a geopolitical standpoint, this essay argues that psychoanalysis has to be capable to rethink and reembody itself with every contingent and immanent dislocations of its transcendental horizons. Through a reading of Slavoj Žižek and Alain Badiou on Mao Tse-Tung, we can think about the notion of dislocation and localization of the Idea. We will argue that this has historically happened in psychoanalysis in the transition from Freud to Lacan; however, the issue (...) is that this dislocation has undergone a retroactivity of necessity which makes a vanishing mediator out of the contingent scrap of reality that it initially relied on—and this forms the quilting point of the contemporary Lacanian ideology. Through Gabriel Tupinambá›s _The Desire of Psychoanalysis_, we will inspect the notion of generic psychoanalysis. We will insist that while generic psychoanalysis is crucial for the refiguring of psychoanalytic politics in a dislocative matter, we need to take this outlook to the end onto a psychoanalysis that is willing to impurify itself through localization as this is the only psychoanalysis worthy of the name. Ex ante contractualism holds that in situations involving risk we ought to act in accordance with principles that license the action that satisfies the strongest individual claim, where those claims are a function of the expected value that a given policy gives each person ex ante. I here challenge ex ante contractualism on contractualist grounds. I argue that adopting ex ante contractualism would have far reaching implications that contractualists, or many nonconsequentialist in general, would find very hard to accept. The article explores Chinese rural migrants’ perspective on work and their relations with each other and with the Chinese state by drawing upon the ethnographical study of a group of rural home renovators in Beijing in the 1990s. The rural renovators were dubbed “guerrilla” workers because of their physical mobility, irregular employment, and unregistered status. After considering the novelty of guerrilla workfare in China, the article demonstrates the bifurcation of migrants’ social networks along the lines of work and everyday association, (...) locates the politics of worker-state interaction at the place of their everyday living, and explores their understanding of work that is remarkably devoid of nostalgia for state socialism. Over the last few years, virtually all forms of non-state violence have been labeled as “terrorism”. As a result, differences between various forms of war and violence are lost in the analysis. This article proposes a conceptual distinction between terrorism and guerrilla warfare by analyzing their differences and similarities. Definitions of terrorism and guerrilla warfare are presented. Starting with these definitions, the question of the legitimacy of terrorism and guerrilla violence is answered with reference to just war theory. This article examines the moral issues of guerrilla, and counter-guerrilla, warfare. Just war theorists who have studied the phenomenon tend to claim that the guerrilla tactic of wearing civilian clothes and hiding among the civilian population is rather difficult, if at all, to reconcile with the ius in bello principle of discrimination (the principle according to which combatants have to distinguish between combatants and non-combatants and may only target the former “directly”). I argue that this ever-repeated assessment is profoundly confused. (...) I also argue, conversely, against the claim that this guerrilla tactic makes it somehow easier for the counter-insurgents to comply with the principle of discrimination, thereby easily allowing them to resort to tactics like area bombardment. Finally, I demonstrate that, contrary to common opinion, guerrilla war does not face greater difficulties in complying with ius ad bellum requirements than conventional or counter-insurgency war does. In this article, I formulate a Deweyan argument in support of guerrilla gardening, or the political activity of reclaiming unused urban land, sometimes illicitly, for cultivation and beautification through gardening. Historically, gardening movements in the United States have been associated with relief projects during periods of economic downturn and crisis, urban blight and gentrication, as well as nationalism, nativism and racism. Despite these last few unfortunate associations, the American philosopher John Dewey detached gardening from the nativist’s tool-kit, portraying it as (...) a gateway for young people toward enriched adult experiences, not as a technique for assimilating immigrant children to a distinctly American way of life. One of those experiences that school gardening can prepare children for is political activism, particularly involvement in gardening movements. Dewey did not mention this collateral benefit. Nevertheless, an argument can be made that garden advocacy—or, more specifically, participation in politically-motivated gardening movements such as guerrilla gardening—is an acceptable interpretation, or elaboration, of what Dewey meant by “a civic turn” to school and community gardening. Once upon a time it was assumed that speaking literally and directly is the norm and that speaking nonliterally or indirectly is the exception. The assumption was that normally what a speaker means can be read off of the meaning of the sentence he utters, and that departures from this, if not uncommon, are at least easily distinguished from normal utterances and explainable along Gricean lines. The departures were thought to be limited to obvious cases like figurative speech and conversational (...) implicature. However, people have come to appreciate that the meaning of a typical sentence, at least one we are at all likely to use, is impoverished, at least relative to what we are likely to mean in uttering it. In other words, what a speaker normally means in uttering a sentence, even without speaking figuratively or obliquely, is an enriched version of what could be predicted from the meaning of the sentence alone. This can be because the sentence expresses a “minimal” (or “skeletal”) proposition or even because it fails to express a complete proposition at all.1 Indeed, it is now a platitude that linguistic meaning generally underdetermines speaker meaning. That is, generally what a speaker means in uttering a sentence, even if the sentence is devoid of ambiguity, vagueness, or indexicality, goes beyond what the sentence means. The question is what to make of this Contextualist Platitude, as I’ll call it. It may be a truism, but does it require a radical revision of the older conception of the relation between what sentences mean and what speakers mean in uttering them? Does it lead to a major modification, or perhaps even outright rejection, of the semantic-pragmatic distinction? I think.. (shrink)

This paper explores how engaging in and with philosophy in the streets has unique and special potential for children doing philosophy both inside and outside the classroom. We highlight techniques drawn from research into the political, social and activist potential of street art, and we illustrate how to apply these techniques in a P4C context in what we call guerrilla philosophy. We argue that guerrilla philosophy is a pedagogically powerful method to philosophically engage students whose ages range from 11-13. In (...) calling attention to the power of guerrilla philosophy to engage students philosophically, we are tacitly assuming a Deweyan philosophical approach, which emphasises the importance of promoting civic-mindedness as a social value; the reliance on imaginative, creative and experiential forms of learning as essential to education ; and a vision of the classroom as an embodiment of the larger civic community to which we all belong and in which we all must cooperate and engage. This paper traces these three themes in Dewey’s philosophical views of education and democracy, and considers how they are given a twenty-first century interpretation through street art, guerrilla philosophy and children’s activism. Ces essais ont été élaborés dans un même esprit au sein d'une équipe dont les jeunes philosophes partagent le désir commun de renouveler le style philosophique par une (...) discipline de philo-fiction. -/- The relationship between the machine and thought is as old as it is enigmatic, always awaiting a solution. It's a myth that philosophy feeds on. Here it is revisited in the context of our current situation: science fiction with Matrix, logic and the computer with Turing, and theoretical development with cognitivism and non-philosophy. These essays have been drawn up in the same spirit by a team of young philosophers who share a common desire to renew the philosophical style through a discipline of philo-fiction. (shrink)

This paper is part of an attempt to clarify the relationship between explanatory reasons and justificatory reasons for actions of various kinds. It draws on a distinction between two notions of rationalization, viz., ex ante and ex post rationalization, to recast the akratic case on the one hand and to explicate an adequate sense in which an explanatory but non-justificatory reason for an action rationalizes the latter on the other hand. The explication is helped by analysis of a hypothetical example, (...) and the name "quasi-rational" is legitimated for the type of actions this example represents. Last, but not least, the paper demonstrates that an implication of the argument is the falsity of one well-known principle in Davidson's action theory, i.e., the principle claiming that the (primary) reason for an action is also its cause. Frances Kamm distinguishes between changes or enhancements that are made before a child exists (ex ante changes) and those that are made once a child exists (ex post changes), and she argues that ex ante changes do not show disrespect or, as Michael Sandel would put it, lack of love, for a person, since the person does not yet exist. In this paper, I argue that it is important to distinguish between ex ante enhancements that are morally neutral and those (...) that are morally dubious, and that the latter ones are morally objectionable even if the persons do not yet exist.
