In a number of recent federal court cases parents have sought to have their children exempted from certain school activities on the grounds that the children's participation in those activities violates their (the parents') right to freedom of religion. In Mozert v. Hawkin's County Public Schools (827 F. 2nd 1058) fundamentalist parents of several Tennessee public school children brought civil action against the school board for violating their constitutional right of freedom of religion. These parents sought (...) to prevent their children from exposure to beliefs or practices opposed to their (the parents') religious convictions. This paper begins with a problem stemming from Hume regarding credences about credences. Suppose one has a credence of .95 in p, and suppose one assesses the credence to be such. But suppose one’s second-order credence in this assessment is less than 1. Then, by a standard conditionalization rule, one’s credence in p becomes less than .95. Moreover, such “erosion” can iterate by considering one’s, third-, fourth-, fifth-order credences, etc. (In light of this, some have rejected higher-order credences; however, it (...) is argued that Lewis’ “Principal Principle” forbids this.) The paper then offers a partial solution by describing circumstances under which a person has reason to assign credence 1 to a first-order credence. The solution takes the form of a “transparency” view of self-knowledge from Parent (2017, chapter 8). Briefly, it is argued that when one “reflex-like” utters a sentence “The probability of p is n”, then as a matter of psychological law, the utterance is an expression of one’s own judgment. The Principal Principle then necessitates that one’s credence in p is n, assuming one is being rational. Thus, upon perceiving such an utterance, one can thereby have a reason to assign a second-order credence of 1. (shrink)

The Cartesian thinking self may seem indisputably real. But if it is real, then so thinking, which would undercut mental fictionalism. Thus, in defense of mental fictionalism, this paper argues for fictionalism about the thinking self. In short form, the argument is: (1) If I exist outside of fiction, then I am identical to (some part of/) this biomass [= my body]. (2) If I die at t, I cease to exist at t. (3) If I die at t, no (...) part of this biomass ceases to exist at t. (4) Therefore, no part of this biomass is identical to me. [From (2), (3)] (5) Therefore, I do not exist outside of fiction. [From (4), (1)] One reply to the argument is that the self is an aggregate of electricity in the brain which disperses upon death. The rejoinder is that this, at best, describes the thoughts realized in the brain, and not the subject who thinks the thoughts. A second objection stresses the undeniable sense that the thinking self has a location. In reply, the extended thought-experiment from Dennett’s “Where Am I?” is used to show that the sense of self-location may well be illusory. (shrink)

On 10 December 2007 the Akron City School Board ? following the precedent set by many school systems across the United States and the world ? instituted a policy of mandatory school uniforms for all students in grades K?8. The measure was met with mixed reviews. While many parents supported the measure, a small group of parents from a selective, arts-focussed, middle school (grades 4?8) objected to the policy. It was their contention that children attending this particular school (...) should be exempt from the policy since their children were particularly creative, and the new policy constituted an unjust infringement of their child's freedom of expression. In this article I argue that the actions of the school board, while antithetical to freedom of expression in general, do not violate the children's freedom of expression since such a right cannot properly be said to apply to the majority of children within this age group. In arguing this position, I draw on two primary ideas. The first is based on the idea that children's rights exist on a continuum from rights that protect their interests to those that protect their choices. Since the majority of children at the age specified by the policy fall on the interest side of the rights spectrum, restricting their liberty with respect to dress is not morally problematic. Secondly, I draw upon the idea of the distinction between mere expression as opposed to substantive expression to argue that most children, particularly those in the pre-teen years, lack the cognitive ability to exercise the latter. What are mental states? When we talk about people’s beliefs or desires, are we talking about what is happening inside their heads? If so, might cognitive science show that we are wrong? Might it turn out that mental states do not exist? Mental fictionalism offers a new approach to these longstanding questions about the mind. Its core idea is that mental states are useful fictions. When we talk about mental states, we are not formulating hypotheses about people’s inner machinery. J S Mill used the term ‘dead dogma’ to describe a belief that has gone unquestioned for so long and to such a degree that people have little idea why they accept it or why they continue to believe it. When wives and children were considered chattel, it made sense for the head of a household to have a ‘sovereignal right’ to do as he wished with his property. Now that women and children are considered to have the full complement (...) of human rights and slavery has been abolished, it is no longer acceptable for someone to have a ‘right’ to completely control the life of another human being. Revealingly, parental rights tend to be invoked only when parents want to do something that is arguably not in their child's best interest. Infant male circumcision is a case in point. Instead of parental rights, I claim that parents have an obligation to protect their children's rights as well as to preserve the future options of those children so far as possible. In this essay, it is argued that the notion that parents have a right to make decisions concerning their children's bodies and minds—irrespective of the child's best interests—is a dead dogma. The ramifications of this argument for the circumcision debate are then spelled out and discussed. (shrink)

The purpose of this article is to examine stakeholder identification and prioritization by managers using the power, legitimacy, and urgency framework of Mitchell et al. (Academy of Management Review 22, 853–886; 1997). We use a multi-method, comparative case study of two large-scale sporting event organizing committees, with a particular focus on interviews with managers at three hierarchical levels. We support the positive relationship between number of stakeholder attributes and perceived stakeholder salience. Managers’ hierarchical level and role have direct and moderating (...) effects on stakeholder identification and perceived salience. We also found that most stakeholders were definitive, dominant, or dormant types – the other five types were rare. Power has the most important effect on salience, followed by urgency and legitimacy. Based on our case study, we offer several ways to advance the theory of stakeholder identification and salience. (shrink)

Domestic violence is one of the most serious forms of violation of basic human freedoms and rights regardless of ethnicity, gender, religion, and status. A reflection on many international statistics shows that women are the most frequent victims of domestic violence. Based on the definition of the phenomenon of domestic violence, the forms of abuse, the manner how violence is treated, the possibility of children, men, extramarital spouses, brothers, sisters, and old people living in an extended domestic community, of (...) also being victims is not excluded. Since domestic violence is not only a national problem but a worldwide problem, international organizations have worked towards the eradication of this phenomenon by sanctioning it in various international conventions. Also, the legal systems of many countries prohibit and sanction domestic violence by special laws obliging the state authorities to act in all situations when there are indications that there are direct or indirect violent acts in a family. In this paper, the authors present only the domestic violence against children as an evident problem in families, but which is often unreported. The legal frameworks of the Republic of North Macedonia and Republic of Kosovo are presented in this paper with the aim to describe the material-legal and procedural-legal treatment of domestic violence by pointing out the failure of the state authorities in implementing the laws on protection and prevention of this phenomenon. The authors take the approach of only treating the legal consequences of child abuse by parents that in both legislations is deprivation of parental rights for the violent parent. They conclude that the state authorities should intensify their work in taking control measures towards all the families where there are suspicions that the parental rights are neglected, and the child is abused. Because many cases of abuse have not been detected or reported, and in both countries a special study especially on domestic violence against children does not exist, the possibility that the number for this type of child abuse is great. This article will probe into Kant’s viewpoints about parent-child relationship so as to demonstrate that they are inspiring on the one hand—for example on dealing with the relationship as that pertinent to the thing in itself, but on the other hand, there are many flaws. His strategy on avoiding the difficulty of creating by man a being endowed with freedom depends merely on an one-sided comprehension of time, because according to Kant himself, there is a difference as to the time (...) between sensual forms of intuition and expressive form of transcendental imagination. In the Critique of Pure Reason, Kant gives a profound enunciation with respect to the two and the latter is related to free causality and categorical imperative in his moral philosophy. Once it refers to the rights of a being endowed with freedom and the time it requires to maintain them, it is problematic to assert that the creation of such beings is not concerned with, in any sense whatsoever, time and the sensual, mortal body. What is more, Kant failed to take into full consideration that parents are also beings endowed with freedom whose rights to the child are not totally dependent on the latter’s inherent rights but on their own inherent basis. Granting parents too few natural rights, Kant on the other hand allocates them too much obligations in that the parent-child relation is unbalanced in his field of view. Thirdly, he gives no consideration as to whether or not the empirical process of rearing children itself can also create some rights, which nevertheless, should be taken into account when temporal elements can be found from the very original parent-child relationship. The paper begins with a defence of a new definition of privacy as the absence of undocumented personal knowledge. In the middle section, I criticise alternative accounts of privacy. Finally, I show how my definition can be worked into contemporary American Law.

In the visual representation of ontologies, in particular of part-whole relationships, it is customary to use graph theory as the representational background. We claim here that the standard graph-based approach has a number of limitations, and we propose instead a new representation of part-whole structures for ontologies, and describe the results of experiments designed to show the effectiveness of this new proposal especially as concerns reduction of visual complexity. The proposal is developed to serve visualization of ontologies conformant to the (...) Basic Formal Ontology. But it can be used also for more general applications, particularly in the biomedical domain. (shrink)

Do you know who you are? If the question seems unclear, it might owe to the notion of ‘knowing-wh’ (knowing-who, knowing-what, knowing-when, etc.). Such knowledge contrasts with ‘knowing-that’, the more familiar topic of epistemologists. But these days, knowing-wh is receiving more attention than ever, and here we will survey three current debates on the nature of knowing-wh. These debates concern, respectively, (1) whether all knowing-wh is reducible to knowing-that (‘generalized intellectualism’), (2) whether all knowing-wh is relativized to a contrast proposition (...) (‘contrastivism about knowing-wh’), and (3) whether the context-sensitivity of knowing-wh is a semantic or purely pragmatic phenomenon (‘contextualism vs. invariantism about knowing-wh’). (shrink)

Cette recherche vise à améliorer la compréhension de la façon dont les gens prennent des décisions concernant leur santé et comment mieux comprendre les stratégies et les techniques pour les aider à résoudre les problèmes d’ambivalence de manière efficace et ciblée.MéthodesNous établissons un dialogue avec la phénoménologie de la volonté de Ricoeur afin de comprendre le sens de ces découvertes scientifiques. À partir de la phénoménologie husserlienne, Paul Ricoeur a développé sa pensée en s’éloignant de l’idéalisme transcendantal en émancipant les structures intentionnelles de la volonté du domaine de la perception. Résultats: En introduisant les concepts de volontaire et d’involontaire, Ricoeur s’est. écarté du dualisme cartésien, qui fait du corps un corps d’objet, cible de vicissitudes naturelles. Le nouveau dualisme entre volontaire et involontaire est. traité par référence à ce que Ricoeur a appelé le mystère central de l’existence incarnée, qui considère l’homme “double dans l’humanité, simple dans lavitalité”. Cette dualité permet de considérer le cerveau comme l’organe naturel du comportement dans le corps humain et d’utiliser la psychologie empirique comme moyen d’échapper aux subjectivations superficielles des concepts.ConclusionLa simplicité (ou unité) d’existence invite la médecine à repenser certaines de ses hypothèses philosophiques, de telle sorte que les patients puissent être considérés comme des sujets autonomes avec des projets de vie d’auteur. Over 115 000 people are waiting for life-saving organ transplants, of whom a small fraction will receive transplants and many others will die while waiting. Existing efforts to expand the number of available organs, including increasing the number of registered donors and procuring organs in uncontrolled environments, are crucial but unlikely to address the shortage in the near future and will not improve donor/recipient compatibility or organ quality. If successful, organ bioengineering can solve the shortage and improve functional outcomes. Studying (...) manufactured organs in animal models has produced valuable data, but is not sufficient to understand viability in humans. Before risking manufactured organ experimentation in living humans, study of bioengineered organs in recently deceased humans would facilitate evaluation of the function of engineered tissues and the complex interactions between the host and the transplanted tissue. Although such studies do not pose risk to human subjects, they pose unique ethical challenges concerning the previous wishes of the deceased, rights of surviving family members, effective operation and fair distribution of medical services, and public transparency. This article investigates the ethical, legal and social considerations in performing engineered organ research on the recently deceased. (shrink)

_Self-Reflection for the Opaque Mind_ attempts to solve a grave problem about critical self-reflection. Psychological studies indicate not just that we are bad at detecting our own "ego-threatening" thoughts; they also suggest that we are ignorant of even our ordinary thoughts. However, self-reflection presupposes an ability to know one’s own thoughts. So if ignorance is the norm, why attempt self-reflection? While admitting the psychological data, this book argues that we are infallible in a limited range of self-discerning judgments—that in some (...) cases, these judgments are self-fulfilling or self-verifying. Even so, infallibility does not imply indubitability, and the author does not wish to provide a "foundation" for empirical knowledge. The point is rather to explain how self-reflection as a rational activity is possible. The book will be of interest to scholars working on the issue of self-reflection across a wide range of disciplines, including philosophy, psychology, and cognitive science. (shrink)

Can God create an unliftable stone? Beall & Cotnoir propose that ‘God can create an unliftable stone’ is a truth-value gap (neither true nor false). However, this yields a revenge paradox on whether God can eschew gaps. Can God avoid gappy ascriptions of power? Either way, God’s power seems to have limits. In response, it may be said that ascribing God the power to avoid gaps is itself gappy—it concerns a power that God neither has nor lacks. Yet this ends (...) up being inconsistent, for it implies that God definitely lacks that power. Following Aquinas, perhaps Beall & Cotnoir could accept this lack and still uphold omnipotence, suggesting that the power to avoid gaps is impossible for God. Yet the Aquinian stratagem is enough to block the original paradox, which saps the motivation to proffer truth-value gaps in addition. I conclude that the gappy solution is either inadequate or insufficiently motivated. (shrink)

This chapter introduces several versions of mental fictionalism, along with the main lines of objection and reply. It begins by considering the debate between eliminative materialism (“eliminativism”) versus realism about mental states as conceived in “folk psychology” (i.e., beliefs, desires, intentions, etc.). Mental fictionalism offers a way to transcend the debate by allowing talk of mental states without a commitment to realism. The idea is to treat folk psychology as a “story” and three different elaborations of this are reviewed. First, (...) prefix semantics paraphrases a sentence like ‘Biden believes that Trump lost’ as ‘According to folk psychology, Biden believes that Trump lost’, whereby ontological commitment to belief is avoided. Similarly, pretense theory suggests that we do not assert ‘Biden believes that Trump lost’, but only pretend to assert it. Third, affective theory proposes that such discourse is used in a metaphorical way to understand a person’s affective and dispositional states vis-a-vis the community. The main objections concern whether folk psychology has the features of storytelling, and whether mental fictionalism ends up being self-refuting. The chapter also recaps a less discussed fictionalist view about “qualia” or phenomenal states, and closes by summarizing the papers contained in the volume. (shrink)

Emerging from these critical analyses is a new definition of 'liberty, In the spirit of negative liberalism', Which differentiates it from the related but distinct goods of human autonomy, Opportunity, Ability, Power, And self-Development.

Here I explore the prospects for fictionalism about the mental, modeled after fictionalism about possible worlds. Mental fictionalism holds that the mental states posited by folk psychology do not exist, yet that some sentences of folk psychological discourse are true. This is accomplished by construing truths of folk psychology as “truths according to the mentalistic fiction.” After formulating the view, I identify five ways that the view appears self-refuting. Moreover, I argue that this cannot be fixed by semantic ascent or (...) by a kind of primitivism. Even so, I also show that the “self-refutation” charges are subtly question-begging. Nevertheless, the reply reveals that a mental fictionalist ought to be a kind of quietist. (shrink)

I discuss David Chalmers’ “scrutability thesis,” roughly that a Laplacean intellect could know every truth about the universe from a “compact class” of basic truths. It is argued that despite Chalmers’ remarks to the contrary, the thesis is problematic owing to quantum indeterminacy. Chalmers attempts to “frontload” various principles into the compact class to help out. But though frontloading may succeed in principle, Chalmers does not frontload enough to avoid the problem.

The new familialists argue that the decline of the intact two-parent family is responsible for our most pressing social problems and advocate public policies designed to promote family stability and discourage divorce and nonmarital births. This essay defends the freedom of intimate association and argue that family stability, while an important good, must be balanced with other goods such as equality and justice within the family, happiness, and individual self-development.

The aim of this paper is to strengthen the point made by Horty about the relationship between reason holism and moral particularism. In the literature prima facie obligations have been considered as the only source of reason holism. I strengthen Horty’s point in two ways. First, I show that contrary-to-duties provide another independent support for reason holism. Next I outline a formal theory that is able to capture these two sources of holism. While in simple settings the proposed account coincides (...) with Horty’s one, this is not true in more complicated or “realistic” settings in which more than two norms collide. My chosen formalism is so-called input/output logic. A bottom-line example is introduced. It raises the issue of whether the conventional wisdom is right in assuming that normative reasons run parallel to epistemic ones. (shrink)

Wittgenstein’s rule-following argument suggests that linguistic understanding does not consist in knowing interpretations, whereas Kripkenstein’s version suggests that meaning cannot be metaphysically fixed by interpretations. In the present paper, rule-following considerations are used to suggest that certain ontological questions cannot be answered by interpretations. Specifically, if the aim is to specify the ontology of a language, an interpretation cannot answer what object an expression of L denotes, if the interpretations are themselves L-expressions. Briefly, that’s because the ontology of such interpretations (...) would naturally be in question as much as the expressions they interpret. So in order to settle the question of ontology, the interpretations themselves would need to be interpreted, and thus a regress. I conclude that knowing the answer to what ontology underlies L cannot be a matter of knowing interpretations. The paper ends with a quietist conclusion; the slogan is that empirical science is ontology enough, or rather, it is about all the ontology one should expect. (shrink)

The main contribution of this paper is a completeness result for an axiomatization of Hansson [13]'s deontic system DSDL2, whose semantics involves a non-necessarily transitive betterness relation. Reference is made to a deductive system put forth by Åqvist [2, 3].

This paper reports completeness results for dyadic deontic logics in the tradition of Hansson’s systems. There are two ways to understand the core notion of best antecedent-worlds, which underpins such systems. One is in terms of maximality, and the other in terms of optimality. Depending on the choice being made, one gets different evaluation rules for the deontic modalities, but also different versions of the so-called limit assumption. Four of them are disentangled, and compared. The main observation of this paper (...) is that, even in the partial order case, the contrast between maximality and optimality is not as significant as one could expect, because the logic remains the same whatever notion of best is used. This is established by showing that, given analogous properties for the betterness relation, the same system is sound and complete with respect to its intended modelling. The chief result of this paper concerns Åqvist’s system F supplemented with the principle of cautious monotony. It is established that, under the maximality rule, F + is sound and complete with respect to the class of models in which the betterness relation is required be reflexive and smooth . From this, a number of spin-off results are obtained. First and foremost, it is shown that a similar determination result holds for optimality; that is, under the optimality rule, F + is also sound and complete with respect to the class of models in which the betterness relation is reflexive and smooth . Other spin-off results concern classes of models in which further constraints are placed on the betterness relation, like totalness and transitivity. (shrink)

Descartes held the view that a subject has infallible beliefs about the contents of her thoughts. Here, I first examine a popular contermporary defense of this claim, given by Burge, and find it lacking. I then offer my own defense appealing to a minimal thesis about the compositionality of thoughts. The argument has the virtue of refraining from claims about whether thoughts are “in the head;” thus, it is congenial to both internalists and externalists. The considerations here also illuminate how (...) a subject may have epistemicially priviledged and a priori beliefs about her own thoughts. (shrink)

My principal objective in this essay is to present a much more thorough and carefully wrought argument than Kemp Smith’s on behalf of the thesis that Philo is indeed Hume’s spokesman. To accomplish this objective I must show that Hume would definitely or likely accept all of the basic ideas, principles, and arguments explicitly advanced or implicitly endorsed by Philo, while he would likely or definitely disclaim at least one of Cleanthes’ beliefs and at least one of Demea’s. Moreover, in (...) claiming that Hume would or would not accept a certain thesis put forth in the Dialogues we must refer solely to the principles and arguments he defends in other works. What must be avoided at all costs is to contend, for example, that Philo is Hume’s spokesman because Philo thinks the dispute over theism is verbal without adducing any textual evidence from sources other than the Dialogues pertaining to Hume’s views on verbal disputes which would support this contention. The following analysis seeks to question Rousseau's assumptions concerning the desirability of an �education from things�. In particular, I will focus on the problematic relationship between, on one hand, the development of Emile's sense of freedom and independence, and on the other, his sense of moral autonomy. It is my contention that moral development necessarily entails both what Rousseau provides, namely a well-developed conception of individuality, and something that is sorely lacking in Rousseau's project. Turning to an analysis of the (...) preceptor's role in Emile's education, I will argue that it is precisely this type of connection and commitment to other human beings that Emile's education fails to foster. Ultimately, Emile emerges from his education prepared to deal with other humans on one level, but woefully lacking in other skills that are necessary for moral personhood. (shrink)

This paper attacks the modal ontological argument, as advocated by Plantinga among others. Whereas other criticisms in the literature reject one of its premises, the present line is that the argument is invalid. This becomes apparent once we run the argument assuming fictionalism about possible worlds. Broadly speaking, the problem is that if one defines “x” as something that exists, it does not follow that there is anything satisfying the definition. Yet unlike non-modal ontological arguments, the modal argument commits this (...) “existential fallacy” not in relation to the definition of ‘God’. Rather, it occurs in relation to the modal facts quantified over within a Kripkean modal logic. In brief, we can describe the modal facts by whichever logic we prefer—yet it does not follow that there are genuine modal facts, as opposed to mere facts-according-to-the-fiction. A broader consequence of the discussion is that the existential fallacy is an issue for many projects in “armchair metaphysics.”. (shrink)

It is a consequence of Quine’s confirmation holism that the logical laws are in principle revisable. Some have worried this is at odds with another dictum in Quine, viz., that any translation which construes speakers as systematically illogical is ipso facto inadequate. In this paper, I try to formulate exactly what the problem is here, and offer a solution to it by (1) disambiguating the term ‘logic,’ and (2) appealing to a Quinean understanding of ‘necessity.’ The result is that the (...) different theses in Quine’s philosophy of logic are to be situated within different contexts of inquiry. This exploratory enquiry seeks to examine the largely unexplored potential of semiotics for intercultural training and education. The proposed three-partdiscussion describes the process by which semiotic theoretical principles were selected and progressively refined into an applied model which was then pilotedthrough a 2007 research initiative entitled Tools for Cultural Development. The case study involved six groups of French and Australian trainees from both theacademic and professional sectors, in collaboration with university, government and community partners. The first part of the article (...) summarizes a review of theliterature on approaches to cultural competence training. The study then outlines the transcoding process by which the stated objectives of intercultural educationwere reformulated in semiotic terms, particularly in reference to cultural semiotics on which the theoretical core of the applied model was subsequently based.Relevant principles from other semiotic schools as well as similar theoretical and methodological stances in the social sciences reinforced the established body of theory for the training design. The third part of the study discusses the process by which semiotic principles were further defined as skill-based outcomes and goals for workshop implementation. This pragmatic defining process facilitated development of questionnaires and surveys, thereby allowing participants to evaluate the training experience by examining their perceptions about the workshop outcomes at the beginning and end of the sessions. This article presents the quantitative results of the evaluation and, in discussing the gains and limits of data obtained, provides the context for a follow-up article on the qualitative findingsof the study.
