Drawing on social exchange theory and benevolent leadership literature, we show how the largesse associated with benevolent leadership can cause subordinates to feel obliged to undertake illegitimate tasks assignments that go beyond their job duties. The hypotheses are tested in a scenario experimental study and a multisource, time-lagged field survey. Both studies indicate that benevolent leadership evokes indebtedness in subordinates (called felt obligation), which is then indirectly related to their willingness to undertake illegitimate tasks. The second study shows (...) that subordinates who try to avoid actions that damage relationships (called disintegration avoidance) and those who feel job insecurity are most willing to perform illegitimate assignments. Employees perceive illegitimate tasks as inappropriate assignments because such tasks are beyond what they expect to do in any given job position. Extant literature indicates that, in addition to creating psychological strain and reducing well-being, illegitimate task assignments can result in counterproductive work behavior. This study extends the literature by examining whether illegitimate tasks may lead to two specific forms of CWB targeting organizations: destructive voice and time theft. To understand how and when this happens, we (...) investigate the mediating role of moral disengagement and the moderating role of psychological entitlement. Survey results based on 258 supervisor–subordinate dyads in China reveal that illegitimate tasks are positively related to destructive voice and time theft through moral disengagement. Furthermore, psychological entitlement strengthens the positive relationship between illegitimate tasks and moral disengagement and the indirect effect of illegitimate tasks on destructive voice and time theft. Unsustainable HR practices impose illegitimate tasks on employees due to a shortage of resources. These illegitimate tasks bring counterproductive work behavior in terms of workplace incivility that creates a sense of ostracism in employees. To address these issues, the study examined the relationship among unsustainable HR practices in terms of illegitimate tasks and workplace ostracism. Whereas workplace incivility is defined as an underlying reason through which this association exists. Adopting a theoretical framework from earlier research, the study (...) used cross-sectional data and subsequently a method of quantitative research, and the sample comprised permanent faculty members of private universities in Pakistan working in different departments with different role titles. Smart PLS was applied to run multiple statistics analyzed on the obtained data. The results from the study supported the hypothesis by depicting a positive and significant association between illegitimate tasks and workplace ostracism. Further, workplace incivility was playing the mediating role between illegitimate tasks and workplace ostracism. The results from the study carry significant implications for managers and researchers. Recommendations and future research directions are also discussed in the paper. (shrink)

As a prevalent source of work stress, illegitimate tasks offend employees’ professional identity and threaten individual self-view, then create many negative organizational outcomes. However, current studies have paid inadequate attention to the impact of IT on work disengagement and its influencing path, failing to comprehensively identify the negative effects of illegitimate tasks. Based on stress-as-offense-to-self theory and ego depletion theory, the influencing path of illegitimate tasks on WD is explored, and coworker emotional support and leisure crafting are (...) introduced to explore the intervention conditions on the impact of illegitimate tasks. By analyzing data from a survey of 260 employees, this study reveals the following findings: illegitimate tasks have a significantly positive impact on work disengagement; ED fully transmits the positive impact of illegitimate tasks on work disengagement; CES and LC not only attenuate the effect of illegitimate tasks on ego depletion, but also negatively moderate the indirect effect of illegitimate tasks on work disengagement through ego depletion. In recent years, a new factor for work stress has been studied along with stress as an offense to self-theory. Illegitimate tasks refer to assignments that are unnecessary or are not related to the employee’s role. Because of this, the Bern Illegitimate Tasks Scale was developed, which measures illegitimate tasks in terms of unreasonable tasks and unnecessary tasks. There are no studies in Latin America on illegitimate tasks, so the purpose of this research is to translate (...) and validate the Bern Illegitimate Tasks Scale. The study was performed with a sample of nursing staff from a hospital in Guayaquil, Ecuador. Written informed consent was obtained from each of the participants. The reliability of the questionnaire was evaluated and its structural validity was verified by exploratory factor analysis and confirmatory factor analysis. The internal consistency of the whole scale, measured by Cronbach’s alpha, was 0.857. Moreover, the unnecessary and unreasonable subscales measure were 0.846 and 0.841, respectively. The exploratory factor analysis supported a two-factor model that explained 73.96% of the variance. Additionally, the confirmatory factor analysis showed good indexes of fit. The Spanish version of the Bern Illegitimate Tasks Scale presents good psychometric properties and can be applied to nurses in the Ecuadorian population. (shrink)

This article summarizes the second edition of the Core Competencies for Health Care Ethics Consultation report of the American Society for Bioethics and Humanities. The core knowledge and skills competencies identified in the first edition of Core Competencies have been adopted by various ethics consultation services and education programs, providing evidence of their endorsement as health care ethics consultation (HCEC) standards. This revised report was prompted (...) by thinking in the field that has evolved since the original report. Patients, family members, and health care providers who encounter ethical questions or concerns that ethics consultants could help address deserve access to efficient, effective, and accountable HCEC services. In the paper contemporary approaches to argumentation are compared with a number of ways of understanding sophistic including ancient, medieval and contemporary ‘faces’ of the latter. It is argued that the current stage is characterized by a negative evaluative understanding of sophistic which is taken mostly as sophistry. In the paper, I also show how these different approaches to sophistic such as illegitimate argumentation, particular illegitimate arguments and scholastic method of formulating and solving tasks grow out of its (...) ancient and medieval historical forms, found in Aristotle, Plato, the Sophists and the Medieval thinkers. To illustrate this distinction I use a medieval sophism combined with a famous ancient anecdote. The distinction between three contemporary approaches which is set forward in the paper is based on semantic, procedural, pragmatic, communicative and speech-oriented criteria, and develops logical and cognitive approaches to argumentation. Despite this fact he has received little attention from scholars of the French Renaissance. Perhaps the problem is that Seyssel does not seem to fit (...) neatly into any category. He was neither French nor Italian but a Savoyard, not truly noble but the illegitimate son of a noble family, not truly a historian but a writer of history-based propaganda and a translator of histories. He began his career as a jurist, became a royal councillor, then a bishop, and in the end died as the Archbishop of Turin. Before his death Seyssel left numerous works, his most famous being a political treatise entitled La Monarchie de France, a work contemporaneous with The Prince by Machiavelli, with whom he shared a similar view of the political world. 1Much like Seyssel himself the genre of history translation has been rather neglected by scholars. A notable exception is a recent article by A.C. Dionisotti, which also examines the translations of Seyssel. The article's intention is to continue a project proposed by Arnaldo Momigliano, to collect evidence that "would help us to understand where and on what occasions and by what people books of history were written and read." 2 This essay attempts to continue this project by asking the following questions: Why did Seyssel undertake the translations? For whom were they intended? How did Seyssel conceive his task as translator? Finally, what can be inferred from his technique of translation? One of many itinerant scholar-diplomats hired by the states of Europe at that time, Seyssel had been teaching law at the University of Turin when he was called into the service of France by the newly crowned Louis XII in 1498. Seyssel was of value to the court because of his reputation as a jurist as well as his connections with the court of Savoy, the state which held the mountain passes leading to Italy. This was especially important because the conquest of Milan was the main goal of Louis XII throughout his reign. Seyssel played an active role in the French occupational government in several Italian cities. Although Seyssel spent much of his time in Italy, he often followed the king around France or was in transit on diplomatic missions to England, to Flanders, and to the Swiss cantons.It is amazing that Seyssel even found the time to write, but by the end of his life, he had left an astounding variety of written works: legal commentaries, translations, works of propaganda for the French monarchy, a political treatise, and at the end of his life several religious tracts. Despite the copiousness of his written works, however, Seyssel remained outside the circle of writers at the French court. He had no connections either with Budé or with the Grands Rhetoriqueurs, such as Jean Lemaire de Belges, nor did he leave any friendly and eloquent correspondence to other humanists. If Seyssel lived during the budding years of the French renaissance, he showed few signs of appreciating it. Jürgen Habermas has argued that religious views form a legitimate background for contributions to an open public debate, and that religion plays a particular role in formulating moral intuitions. Translating religious arguments into “generally accessible language” (Habermas, Eur J Philos 14(1):1–25, 2006) to enable them to play a role in political decisions is a common task for religious and non-religious citizens. The article discusses Habermas’ view, questioning the particular role of religion, but accepting the significance of including such counter-voices (...) to the predominant views. Furthermore it is pointed out that not only religious but also numerous secular views stand in need of translation to be able to bear on policy matters. Accepting Habermas’ general framework, I raise the question whether experts (such as clinicians working in relevant specialised areas of care) participating in political debates on biomedical issues have a duty to state their religious worldview, and to what extent the American government decision to restrict embryo stem cell research is an illegitimate transgression of the State-Church divide. This article considers the significance of Kant’s schematized categories in the Critique of Pure Reason for contemporary metaphysics. I present Kant’s understanding of the schematism and how it functions within his critique of the limits of pure reason. Then I argue that, although the true role of the schemata is a relatively late development in Kant’s thought, it is nevertheless a core notion, and the central task of the first Critique can be sufficiently articulated in the language of the (...) schematism. A surprising result of Kant’s doctrine of the schematism is that a limited form of metaphysics is possible even within the parameters set out in the first Critique. To show this, I offer contrasting examples of legitimate and illegitimate forays into metaphysics in light of the condition of the schematized categories. (shrink)

In this paper, I argue that to the extent that non-combatants benefit from the attempt to fight (...) justly, and to the extent that wars in which combatants attempt to fight justly can be understood as a system of social cooperation which produces both burdens and benefits, non-combatants have a responsibility to shoulder their fair share of these burdens. Thus, if combatants (and by extension enemy non-combatants) are disproportionately burdened in a conflict, non-combatants ought to take on some costs, for instance in order to reduce the strain imposed on combatants by systemic factors such as the availability and distribution of resources. Written in an extremely enjoyable style and divided into chapters of just the perfect length, this page-turner deserves the highest praise. It will likely take its place alongside George Weigel's famous (and equally massive) biography of Pope John Paul II, Witness to Hope.The German biography has been divided into two volumes in English (vol. 2 was just published in November of 2021). Volume 1 deals with the years 1927–1965, dominated by two historic "Twos": World War II and Vatican II. Theologically, this is the period of the progressive Ratzinger (regardless of whether he "converted" to a more conservative stance later on), or as Seewald puts it, a man formed by "liberal Bavarian Catholicism" (124).Seewald provides lots of new and interesting information about Joseph Ratzinger, both bitter and sweet. One example from the early chapters concerns the origins of Ratzinger's mother. It turns out that she was an illegitimate child and not actually from South Tyrol, contrary to what her children had thought. A local historian has discovered that Ratzinger's mother Maria was actually born in Mühlbach "in the district of Rosenheim,... in a house that specialized in helping unmarried pregnant women to give birth" (15).For the romantic, the sweetest story of the book comes when Seewald [End Page 963] pushes the reserved Pope Emeritus to reveal more about the "painful decisions" that the young Munich seminarian had to make in relation to his vocation as a celibate priest. "'Were you in love with a girl?' 'Perhaps.' 'So, yes?' 'It could be interpreted like that.' 'How long did this passionate time last? A few weeks? A few months?' 'Longer'" (219). Ratzinger was in love! Or at least it could be interpreted like that! Other heart-warming details include the revelation that Ratzinger's childhood teddy from Marktl followed him all the way to the Apostolic Palace, as well as the fact that, when his blind brother Georg (now deceased) needed a housekeeper, Benedict XVI personally organized the job interview in the Vatican gardens.A darker episode, minimized in Ratzinger's autobiographical memoirs, concerns his role in the radar crew of the German anti-aircraft forces in World War II. The future Pope was entrusted with the task of targeting British bombers. Seewald fills in the narrative: "Ratzinger delivered readings for three guns,.... The more precisely Joseph measured, the higher the hit rate. As the war demanded" (101). Years later, Ratzinger confessed that these experiences still occasionally gave him sweaty nightmares.Seewald goes on to describe the exceptional postwar context in which Ratzinger prepared for the priesthood. The future priests knew that they would soon have to hear confessions of ex-Nazis who had shot people in the war (153). Indeed, after the war, many old Nazis turned to the Church and attempted to get de-Nazification certificates. Ratzinger's parish priest even joked that one day "they will say the only Nazis were the priests" (131).As did everyone, Ratzinger also felt the effects of poverty in postwar Germany. Whenever a festive dinner had to be given for a visitor at the seminary, "we went hungry on the most meagre rations for four long weeks in order to gather the ingredients" (189). Modernity and What Has Been Lost comes out of a conference held at the Jagiellonian University in Krakw̤, Poland, on June 4-5, 2009 that sought to identify Leo Strauss's intellectual background in re: the repudiation of a modern idea of homogenous, universal state (considered as an illegitimate synthesis of Jerusalem and Athens, i.e., the claims of Reason and Revelation). The world we live in, molded by science and historical relativism, may be described as hostile to human dignity or perfection, (...) or abhorrent to those who love the search for wisdom. Straussian teaching consisted in the steady effort to reopen "the quarrel between the Ancients and the Moderns," and refers to the esoteric way of writing practiced by the most profound thinkers of the past which has been apparently forgotten in the last three centuries. Strauss binds the concept of natural right with the question of maintenance of conditions for philosophizing, and it probably seems to him that such defense of philosophy is the highest task in our times. However, one must be well aware that philosophizing always means a perilous way of life. Indeed, it may be destructive of the city (polis) itself as far as the city exists due to some crucial beliefs the philosopher might put in doubt. Values have always been a central topic in both philosophy and the social sciences. Statements about what is good or bad, fair or unfair, legitimate or illegitimate, express clear beliefs about human existence. The fact that values differ from culture to culture and century to century opens many questions. In "The Origin of Values," Raymond Boudon offers empirical, data-based analysis of existing theories about values, while developing his own perspective as to why people accept or reject value statements. In that motto we find, allegedly, all the close-minded, ahistorical rigidity and complacency that Vatican II's spirit of openness, aggiornamento, and reform tried to overcome. Such a caricature of both Councils, however, seems to violate the hermeneutical principle taught by the bishops gathered at the extraordinary synod of 1985, for any aggiornamento or reform that moves outside established tradition is an aggiornamento or reform that separates the spirit from the letter of the Council.In the same way, it is not legitimate to separate the spirit and the letter of the [Second Vatican] Council. Moreover, the Council must be understood in continuity with the great tradition of the Church, and at the same time we must receive light from the Council's own doctrine for today's Church and the men of our time. The Church is one and the same throughout all the councils.2An erroneous understanding of a conciliar spirit as an ecclesiastical license for a theological free-for-all might cause one to question the language of "spirit" in relation to a council. But this statement by the bishops suggests that there is a legitimate (and illegitimate) way of attributing a "spirit" to a council. Rightly understood, the spirit of any council is an ethos or shared disposition, catalyzed by that council, according to which the Church seeks to move forward on her pilgrim journey through history—the temps de l'église—which will come to a halt only at the second coming of the Son. (One might say that history's councils are the smaller events that help guide the Church in her mission to communicate the fruits that stem from the ultimate event of salvation history: namely, the dual sending of the Son and the Spirit.) Emancipation serves not only as a midwife for progressive agendas such as greater equality and sustainability but also as their gravedigger. This diagnosis underpins Ingolfur Blühdorn’s ‘dialectic of emancipation’, which depicts a dilemma but offers no perspective on how to deal with it. By drawing on Foucault, this article suggests conceiving of emancipation as a task moderns are confronted with even if a given emancipatory project has come to devour its children. Claiming autonomy from given social constellations is key (...) to this task; key also is judging between legitimate and illegitimate claims to autonomy. In late modernity, the criteria for such judgement are no longer universally given. Instead of regarding the latter as entry into mere subjectivism, this article presents judgement as a key political, ‘world building’-activity, a critical social theory may join in, by not only observing the world but by also taking sides in it. Kellert Keywords chaos, metaphor, rhetoric, values Ever since the popularization of chaos the-ory in the 1980s, there has been an explo-sion of interest in work in nonlinear dynamics generally and the study of strange attractors in particular. From law to economics to theology, researchers in the social (...) sciences and the humanities have sought to make use of the concepts, methods, and results of chaos theory. Previous generations have seen similar attempts to explore the consequences of relativity theory or quantum mechanics for their own areas of inquiry. In examining the implications of chaos for the treatment of mental illness, Douglas Heinrichs provides an example of this phenomenon, which I call "borrowed knowledge." Lacking expertise in the areas of psychotherapy or psychopharmacology, I view his suggestions as a case study in the ways that knowledge gets used across disciplinary boundaries. In these remarks, I examine some of the different functions that borrowed knowledge can serve in order to argue that although cross-disciplinary borrowing can be a fruitful source of new insights, it is not without its dangers. I look at the persuasive function that borrowed knowledge can serve in making one's ideas plausible candidates for further exploration, as well as in motivating methodological change. I look at the conceptual work performed by metaphors, paying special attention to the question of how we can judge whether or not a nonliteral use of knowledge from the natural sciences is fruitful. And finally, I look at the ways in which borrowed knowledge can be used to address evaluative questions—in this case, questions about autonomy and appropriate therapeutic practice. I do not mean for these various functions to be thought of as exclusive categories. Instead, they overlap, interact, and combine in various ways. Rhetorical Functions, Disciplinary Prestige, and Methodologic Change In examining the persuasive uses of chaos theory, I should make it clear that by "persuasive" I do not mean illegitimate or deceptive. When Heinrichs points out that what he calls the traditional model of brain function is used to [End Page 239] present and explain the use of antidepressants (ADs) to clinicians and the general public, it becomes clear that he believes an alternative model can be useful for explicating and justifying the use of ADs for clinicians and patients. This descriptive function of the metaphorical appeal to a chaotic "attractor landscape" shows up where Heinrichs discusses the use of the chaotic model for patient education and the "rationale for pharmacotherapy," giving patients "appropriate expectations."But the rhetorical functions of chaos theory also come into play with audiences other than patients; they apply to the audience for the scholarly article itself, perhaps attracting attention because of the novelty or promise of a new field of research, but also harnessing the considerable disciplinary prestige that the natural sciences wield in our culture. All of these functions are useful in directing attention to the author's suggestions for further research, especially where he suggests that it would provide the clinician with guidance in working with an individual patient. Here I take it that Heinrichs has made fruitful use of the work of Thelen and others on the variability of individual developmental trajectories. This proposal for methodological change suggests that focusing on the dynamics of system and its evolution through time may be important in addition to focusing on equilibrium states. The disciplinary prestige of the natural sciences can provide a valuable and legitimate resource for the persuasive task of encouraging one's colleagues to explore a new methodological approach.A further rhetorical use is found in the appeal to the unpredictability of chaotic systems to account for the variability of results in the application of ADs. We see this where Heinrichs says, "a meaningful science of persons is possible even in the face of their ultimate unpredictability" (2005, 221). The present considerations discuss the systematic opposition between a practice of nonviolence to experienced social injustice and violent relationships. At the point, we see existential decisions about war and violence, there are signs of misconduct of responsibility waiver form – the Security Council unable to act, the protective effect for the affected people lapsed, the effectiveness of international law too weak. What emerges in this starting position, especially for the present considerations as a problem, is nothing less than the question (...) of a meaningful rule between legitimate power and illegitimate violence, hence a question that has a historical and a fundamental anthropological side. In the present case should be explicitly asked for the meaning of criteria of modern violence ability. The modern power capability opens up a complex and challenging task field. Physicians, nurses, and other clinicians readily acknowledge being troubled by encounters with patients who trigger moral judgments. For decades social scientists have noted that moral judgment of patients is pervasive, occurring not only in egregious and criminal cases but also in everyday situations in which appraisals of patients' social worth and culpability are routine. There is scant literature, however, on the actual prevalence and dynamics of moral judgment in healthcare. The indirect evidence available suggests that moral appraisals function via a (...) complex calculus that reflects variation in patient characteristics, clinician characteristics, task, and organizational factors. The full impact of moral judgment on healthcare relationships, patient outcomes, and clinicians' own well-being is yet unknown. The paucity of attention to moral judgment, despite its significance for patient-centered care, communication, empathy, professionalism, healthcare education, stereotyping, and outcome disparities, represents a blind spot that merits explanation and repair. New methodologies in social psychology and neuroscience have yielded models for how moral judgment operates in healthcare and how research in this area should proceed. Clinicians, educators, and researchers would do well to recognize both the legitimate and illegitimate moral appraisals that are apt to occur in healthcare settings. (shrink)

In the philosophy of science, it is a common proposal that values are illegitimate in science and should be counteracted whenever they drive inquiry to the confirmation of predetermined conclusions. Drawing on recent cognitive scientific research on human reasoning and confirmation bias, I argue that this view should be rejected. Advocates of it have overlooked that values that drive inquiry to the confirmation of predetermined conclusions can contribute to the reliability of scientific inquiry at the group level even when (...) they negatively affect an individual’s cognition. This casts doubt on the proposal that such values should always be illegitimate in science. It also suggests that advocates of that proposal assume a narrow, individualistic account of science that threatens to undermine their own project of ensuring reliable belief formation in science. Some of the recent criticisms published during and after the last revision process of the Declaration of Helsinki are directed at its basic legitimacy. In this article we want to have a closer look at the two criticisms we consider to be the most fundamental. The first criticism questions the legitimate authorship of the World Medical Association to publish a document such as the Declaration. The second fundamental criticism we want to examine argues that the last revision process failed to (...) meet the standards for fair, democratic procedures. Although both criticisms deny the formal legitimacy of the Declaration in the most fundamental way, they have never been addressed in detail in a single article. We refute most of the related arguments. However, acknowledging some of the points made, improvements for future revision processes and versions of the Declaration of Helsinki are outlined. (shrink)

The theory of granular partitions (TGP) is a new approach to the understanding of ontologies and other classificatory systems. The paper explores the use of this new theory in the treatment of task-based clinical guidelines as a means for better understanding the relations between different clinical tasks, both within the framework of a single guideline and between related guidelines. We used as our starting point a DAML+OIL-based ontology for the WHO guideline for hypertension management, comparing this with related guidelines (...) and attempting to show that TGP provides a flexible and highly expressive basis for the manipulation of ontologies of a sort which might be useful in providing more adequate Computer Interpretable Guideline Models (CIGMs) in the future. While it is widely acknowledged that science is not “free” of non-epistemic values, there is disagreement about the roles that values can appropriately play. Several have argued that non-epistemic values can play important roles in modeling decisions, particularly in addressing uncertainties ; Risbey 2007; Biddle and Winsberg 2010; Winsberg : 111-137, 2012); van der Sluijs 359-389, 2012). On the other hand, such values can lead to bias ; Bray ; Oreskes and Conway 2010). Thus, it is important to identify when (...) it is legitimate to appeal to non-epistemic values in modeling decisions. An approach is defended here whereby such value judgments are legitimate when they promote democratically endorsed epistemological and social aims of research. This framework accounts for why it is legitimate to appeal to non-epistemic values in a range of modeling decisions, while addressing concerns that the presence of such values will lead to bias or give scientists disproportionate power in deciding what values ought to be endorsed. Background: The division of non-paid labor in heterosexual parents in the West is usually still gender-based, with mothers taking on the majority of direct caregiving responsibilities. However, in same-sex couples, gender cannot be the deciding factor. Inspired by Feinberg’s ecological model of co-parenting, this study investigated whether infant temperament, parent factors (biological relatedness to child, psychological adjustment, parenting stress, and work status), and partner relationship quality explained how first-time gay, lesbian, and heterosexual parents divided labor (childcare and family decision-making) when (...) their infants were four months and 12 months old. We also tested whether family type acted as a moderator. Method: Participants were drawn from [MASKED FOR REVIEW]. Only those who provided information about their biological relatedness (yes or no) to their child (N = 263 parents) were included. When infants were four months (T1), parents completed a password-protected online questionnaire exploring their demographic characteristics including work status and standardized online-questionnaires on task division (childcare and family decision-making), infant temperament, parental anxiety, parental depression, parental stress, and partner relationship satisfaction. When infants were 12-months-old (T2), parents provided information about task division and their biological relatedness to their children. Results: Linear mixed models showed that no factor explained the division of family decision making at T1 and T2. For relative time spent on childcare tasks at T1, biological relatedness mattered for lesbian mothers only: biologically related mothers appeared to spend more time on childcare tasks than did non-related mothers. Results showed that, regardless of family type, parents who were not working or were working part-time at T1 performed more childcare tasks at T1. This was still true at T2. The other factors did not significantly contribute to relative time spent on childcare tasks at T2. Conclusion: We had the opportunity to analyze the division of non-paid tasks in families where parenting was necessarily planned and in which gender could not affect that division. Although Feinberg’s model of co-parenting suggests that various factors are related to task division, we found that paid work outside the home was most important during the first year of parenthood in determining caregiving roles.
