The common view is that insider trading is always unethical and illegal. But such is not the case. Some forms of insider trading are legal. Furthermore, applying ethical principles to insider trading causes one to conclude that it is also sometimes ethical. This paper attempts to get past the hype, the press reports, and the political grandstanding to get to the truth of the matter. The author applies two sets of ethical principles – utilitarianism and rights theory – in an (...) attempt to determine when, and in what circumstances, insider trading is ethical. The views of Henry Manne, an early proponent of insider trading, are critically examined, as are the major arguments against insider trading. Is insider trading good for the company if it is used as a form of executive compensation which makes it possible to pay lower salaries than would otherwise be the case? Does insider trading cause the stock market to work more efficiently? If insider trading does increase efficiency, is that sufficient to call for its total legalization, or are there other things to be considered? Several arguments against insider trading have been put forth over the last few decades but there are problems with all of them. One of the main arguments is the fairness argument. The problem with this argument is that different people have different definitions of unfairness. A closely related argument is the level playing field argument, which advocates wider dissemination of information so that it is less asymmetric. One problem with the level playing field argument is that it is better applied to sporting competitions than to trading in information. Some economists argue that forcing the disclosure of nonpublic information can actually result in more harm than good and must necessarily involve the violation of property rights. Other arguments examined in this chapter include the fiduciary duty argument, the problem of outside traders, the misappropriation doctrine and the restrictions that insider trading laws place on freedom of speech and press. The article concludes by setting forth some principles or guidelines to determine when insider trading should be punished and when it should not. (shrink)

Abstract: Philosophy is often conceived in the Anglophone world today as a subject that focuses on questions in particular “core areas,” pre-eminently epistemology and metaphysics. This article argues that the contemporary conception is a new version of the scholastic “self-indulgence for the few” of which Dewey complained nearly a century ago. Philosophical questions evolve, and a first task for philosophers is to address issues that arise for their own times. The article suggests that a renewal of philosophy today should turn (...) the contemporary conception inside out, attending to and developing further the valuable work being done on the supposed “periphery” and attending to the “core areas” only insofar as is necessary to address genuinely significant questions. This comment on 'Economic theories and their Dueling interpretations' questions the descriptive adequacy of the ‘sociology of economics' proposed by Gilboa, Postlewaite, Samuelson, and Schmeidler (GPSS) (2022). We ask whether economists still perceive the role of microeconomic theory as central as do GPSS. In particular, is present-day economics unified by the principles of maximising, subject to constraints and equilibrium analysis? We argue that this is not the case. GPSS’ appeal to the interpretative flexibility of economic theories appears apologetic, especially the (...) suggestion that theories and models, which once were considered positive descriptions or predictive instruments, are now cast as analytical or methodological exercises. We conclude on a more constructive note, drawing from the recent philosophical discussion of modelling which, quite paradoxically, grants highly idealized and simplified models a more important role than GPSS appear to allow. The standard analysis of supererogation is that of optional actions that are praiseworthy to perform, but not blameworthy to skip. Widespread assumptions are that action beyond the call is at least necessarily equivalent to supererogation ("The Equivalence") and that forgoing certain agent-favoring prerogatives entails supererogation (“The Corollary”). I argue that the classical conception of supererogation is not reconcilable with the Equivalence or the Corollary, and that the classical analysis of supererogation is seriously defective. I sketch an enriched conceptual scheme, “Doing (...) Well Enough (DWE)”, that allows for distinct analyses of action beyond the call and supererogation, among other often neglected fundamental moral notions. Parallels and asymmetries with suberogation are briefly explored. Apparently, DWE’s core act-evaluative notions are more fundamental than the agent-evaluative ones of supererogation/suberogation. Economists have long treated technological phenomena as events transpiring inside a black box and, on the whole, have adhered rather strictly to a self-imposed ordinance not to inquire too seriously into what transpires inside that box. The purpose of Professor Rosenberg's work is to break open and examine the contents of the black box. In so doing, a number of important economic problems be powerfully illuminated. The author clearly shows how specific features of individual technologies have shaped a (...) number of variables of great concern to economists: the rate of productivity improvement, the nature of learning processes underlying technological change itself, the speed of technology transfer, and the effectiveness of government policies that are intended to influence technologies in particular ways. The separate chapters of this book reflect a primary concern with some of the distinctive aspects of industrial technologies in the twentieth century, such as the increasing reliance upon science, but also the considerable subtlety and complexity of the dialectic between science and technology. Other concerns include the rapid growth in the development of costs associated with new technologies as well as the difficulty of predicting the eventual performance characteristics of newly emerging technologies. It has been highly controversial from the beginning of the study of religion to the present day whether it is insiders who follow that religion or outsiders who understand the religion studied the best. It is also questioned if it is really possible to study a religion objectively whether the one who studies is an insider or outsider to that religion. This topic also brings with it the issues that need to be considered, such as emic/ethical positions, ‘experience-near’ and ‘experience-distant’ (...) and the process of reflexivity. Theoretical studies suggest that, when determining the workplace safety level, CEOs face a trade-off between ex ante safety-improving expenditures and the expected losses due to ex post injury and illness occurrences. We examine whether firms with higher CEO inside debt holdings have safer workplaces. Using establishment-level employee workplace injury and illness data, we find that CEOs’ inside debt holdings are negatively associated with employee workplace injury and illness cases. This relationship is more pronounced if workers’ compensation premiums are (...) more sensitive to injury claims and for firms with more government business and less pronounced for firms with higher levels of secured debt. We provide some evidence that our main result stems from CEOs increasing safety investments. Our empirical results are shown to be robust under a batch of robustness tests and when considering potential endogeneity problems. Our findings suggest that CEOs with higher levels of inside debt holdings are more sensitive to wealth loss due to employee injury and illness, leading to a safer workplace. (shrink)

Insider trading has received a bad name in recent decades. The popular press makes it sound like an evil practice where those who engage in it are totally devoid of ethical principles. Yet not all insider trading is unethical and some studies have concluded that certain kinds of insider trading are actually beneficial to the greater investment community. Some scholars in philosophy, law and economics have disputed whether insider trading should be punished at all while others assert that it should (...) be illegal in all cases. This paper explores the nature of insider trading and analyzes the issues to determine the positive and negative aspects of insider trading, and how policy should be changed. The best hope would be for studies to be made that isolate the individuals or groups who are fraudulently harmed by insider trading. If any such groups exist, then clearly worded legislation could be passed to prevent any fraud from being committed against these individuals and groups, while allowing non-fraudulent transactions to be completed without fear of prosecution. Until it can be clearly determined that someone is fraudulently harmed by insider trading, there should be no law or regulation restricting the practice, since such restrictions violate individual rights and will likely have a negative market reaction. The concept of “going native in reverse” reflects the fact that nowadays more and more people involved in new religious movements and esoteric groups participate in academic activities related to the study of religion in general and particularly in the study of their movements. On the one hand, these people bring insider’s perspective in the academia. On the other hand, they bring academic knowledge and critical mind in esoteric community and change it. This situation seems to be a positive tendency (...) in the development of modern spirituality both for insiders and for the society in general, because contemporary knowledge and critical mind can make religious and esoteric currents more subtle and adequate for the modern world. But what is the future of this tendency in regard to an insider/outsider problem? Maybe they can change the academia by bringing new unexpected perspectives in the study of religion and esotericism. However, conservative academic elites can finally reject researchers who try to bring the insider perspective in the academia and even expel them from academic circles. In this case they will turn into a marginal group inside the academia, and for their skeptical colleagues they will remain to be those eccentrics who want “to wear the esoteric and the scholarly hat simultaneously”, as W. J. Hanegraaff put it. On the other hand, such researchers may try to form a new discipline, so to speak an “esoteric divinity” that will fight for the place both in the academia and in the esoteric community in the next decades. However, the esoteric community itself may reject this tendency, because many of its participants today seem to have an inimical attitude toward to rationalism and the academia. (shrink)

According to an influential objection, which Martha Nussbaum has powerfully restated, expressing anger in democratic public discourse is counterproductive from the standpoint of justice. To resist this challenge, this article articulates a crucial yet underappreciated sense in which angry discourse is epistemically productive. Drawing on recent developments in the philosophy of emotion, which emphasize the distinctive phenomenology of emotion, I argue that conveying anger to one’s listeners is epistemically valuable in two respects: first, it can direct listeners’ attention to elusive (...) morally relevant features of the situation; second, it enables them to register injustices that their existing evaluative categories are not yet suited to capturing. Thus, when employed skillfully, angry speech promotes a greater understanding of existing injustices. Computational systems biologists create and manipulate computational models of biological systems, but they do not always have straightforward epistemic access to the content and behavioural profile of such models because of their length, coding idiosyncrasies, and formal complexity. This creates difficulties both for modellers in their research groups and for their bioscience collaborators who rely on these models. In this paper we introduce a new kind of visualization that was developed to address just this sort of epistemic opacity. The visualization (...) is unusual in that it depicts the dynamics and structure of a computer model instead of that model’s target system, and because it is generated algorithmically. Using considerations from epistemology and aesthetics, we explore how this new kind of visualization increases scientific understanding of the content and function of computer models in systems biology to reduce epistemic opacity. Through a Zizekian framework, this article explores a doubled precarity as experienced by individuals involved in groups described as ‘gangs’. This dual precarity being the inability to parallel mainstream discourses of security, and abstracted precarity of mirrored images of ‘mainstream’ groups. The paper outlines brittle relationships between these two poles and the stories relating to learning and be-coming within such groups. These precarious relationships resonate Zizek's proposal of the '... blind leading the blind, or, more precisely, the blind leading the (...) blind...'. This paper explores the precariaty / precariaty of learning to be within such groups and the value of the story of becoming predominantly through the lens of a case study focusing on Participant 1 and supported through vignettes from encounters with other participants. In our daily lives we conceive of our surroundings as an objectively given reality. The world is perceived through our senses, and ~hese provide us, so we believe, with a faithful image of the world. But occ~ipnally we are forced to realize that our senses deceive us, e. g., by illusions. For a while it was believed that the sensation of color is directly r~lated to the frequency of light waves, until E. Land (the inventor of the polaroid camera) showed (...) in detailed experiments that our perception of, say, a colored spot depends on the colors of its surrounding. On the other hand, we may experience hallucinations or dreams as real. Quite evidently, the relationship between the "world" and our "brain" is intricate. Another strange problem is the way in which we perceive time or the "Now". Psychophysical experiments tell us that the psychological "Now" is an extended period of time in the sense of physics. The situation was made still more puzzling when, in the nineteen-twenties, Heisenberg and others realized that, by observing processes in the microscopic world of electrons and other elementary particles, we strongly interfere with that world. The outcome of experiments - at least in general - can only be predicted statistically. What is the nature ofthis strange relationship between "object" and "observer"? This is another crucial problem of the inside-outside or endo-exo dichotomy. (shrink)

There is no strong reason to believe that human-level intelligence represents an upper limit of the capacity of artificial intelligence, should it be realized. This poses serious safety issues, since a superintelligent system would have great power to direct the future according to its possibly flawed motivation system. Solving this issue in general has proven to be considerably harder than expected. This paper looks at one particular approach, Oracle AI. An Oracle AI is an AI that does not act in (...) the world except by answering questions. Even this narrow approach presents considerable challenges. This article provides an ethical analysis of the U.S. practice guideline update on disorders of consciousness. Our analysis focuses on the guideline’s recommendations regarding the use of investigational neuroimaging methods to assess brain‐injured patients. Complex and multifaceted ethical issues have emerged because these methods alter the clinical understanding of consciousness. We address issues of false hope, patient suffering, and cost. We argue that, in spite of these concerns, there is significant benefit to using neuroimaging to assess brain‐injured patients in most (...) cases. (shrink)

Cultural ethical dilemmas occur when ethical research practices, as prescribed by the research ethics codes of Western research institutions, conflict with the cultural and social norms of non-Western researchers and their participants. Thus, insider-researchers working with participants from similar cultural backgrounds may experience ethical dilemmas that result in disconcerting cultural estrangement from their communities. Using reflexive narratives, the author identifies moments of cultural ethical dilemmas that necessitate a choice between two competing sets of values. Working out of a Western university, (...) the narratives reflect on cultural ethical dilemmas relating to non-coercion, confidentiality, and beneficence, encountered during interviews in the researcher’s community. Analyzed through the lens of Confucian social and ethical behavior, the paper asks whether there is a need for East–west polarization, or whether research ethics codes based on Western worldviews can be reconciled with Confucian worldviews. The paper suggests the “Middle Way” approach to reconciling and integrating the diverse worldviews of ethics, through the use of an ethical reflexive process that engenders trust in the research process and resolves cultural ethical dilemmas. In his Paralipomena Johannes Kepler reported an experimentum that he had seen in the Dresden Kunstkammer. In one of the rooms there, which had been turned in its entirety into a camera obscura, he had witnessed the images formed by a lens. I discuss the role of this experiment in the development and foundation of his new theory of optical imagery, which made a distinction between two concepts of image, pictura and imago. My focus is on how Kepler used his (...) report of the experiment inside the camera obscura to criticize the account of image formation given in Giovanbattista Della Porta's Magia naturalis . I argue that this experiment allowed Kepler to sort out the confusion between images 'in the air'—referring to the geometrical locus of images in the perspectivist tradition of optics—and the experimentally produced 'projected images', which were empirically familiar but conceptually alien to perspectivist optics. Abstract:The law of insider trading has progressed from an expansive approach, according to which all trading on nonpublic information was considered illegal, to a constricted approach, under which corporate outsiders are permitted to trade on nonpublic information provided such trading does not breach a fiduciary duty. This article analyzes both the former, expansive theory and the currently utilized constricted theory, within a framework of basic tenets of the American capitalist social contract regarding legitimacy of property claims. The existing constricted approach (...) to the regulation of insider trading is found to be deficient in meeting the expectations of two core components of the social contract: it discourages procedural equality of opportunity, and it endorses claims to property that are not characterized by legitimate methods of acquisition or transfer. Because the old, expansive regulatory interpretation was more consistent with the terms of the social contract in regard to property claims, it served our economic and ethical expectations more effectively than the system presently in place. Accordingly, the article culminates in a recommendation that the expansive approach to regulating insider trading be reestablished under Unites States law. (shrink)

A recent article in this Journal argued that insider trading is an unethical practice leading to an inefficiently functioning market. The debate on this topic has primarily pitted ethical defenses of prohibition against economic arguments extolling its allowance. In addition to being incomplete, this approach ignores other unwanted economic effects of prohibition itself and unethical implications of its existence. This article shows that Adam Smith's free market concept, when properly interpreted, provides all the incentive structure necessary for an efficient and (...) ethical marketplace even when insider trading is permitted. Contrary to adjectives like amusing and touching, certain Ving/ant adjectives have a psych reading without originating from a psych verb, such as jaw-dropping 'surprising' in English and marrant 'amusing' in French. It is a fact that emotions trigger certain characteristic physical effects. The verbs of such adjectives name that physical effect. This article claims that languages can, provided that independent grammatical conditions are respected, display constructs of that phy-inside-psych form, namely, a psych construct with an embedded V naming the (...) physical effect triggered by the psych cause. This articles deals with such adjectives in two different languages, showing similarities and differences due to their particular grammar, and it offers an original analysis of effing adjectives along those lines.
