Restrictive visitation policies produce inequities in healthcare that have meaningful consequences for patients’ health and well-being. There is a surplus of existing literature exploring the consequences of reduced visitation in the setting of pediatric patients lacking decision-making capacity, but relatively little scholarship addressing visitation restriction for less vulnerable adults possessing capacity. Here, we present the case of a patient who suffered serious complications of childbirth, during the delivery of her healthy newborn, leading to prolonged hospitalization. During her treatment course, she (...) was subsequently denied visitation with her newborn, who had been discharged from the hospital, and this had detrimental effects on her recovery. Hospital policies restricting visitation during the COVID-19 pandemic were intended to reduce the risk of disease exposure for both patients and staff, despite conflicting evidence demonstrating this benefit. In contrast, they often have negative effects on patient stress, mood, and physical recovery. The sequelae of this US-based case study argue the need for more holistic hospital visitation policies, placing a specific lens on adult patients receiving a visitation from their newborn children. Taking its lead from analyses of gift exchange by Marcel Mauss and Marshall Sahlins as well as of contact by Charles Long and Jonathan Z Smith, this article elaborates a theory of the exchange, among dominant social subjects, of representations of their subjected proximate others in order to rectify the crisis precipitated by contact with otherness that threatens their claims to autonomy, authority, homogeneity, and universality. Specifically it situates the polemical exchange of representations of women among Friedrich Schlegel, G W (...) F Hegel, and Karl Gutzkow as exemplary German male bourgeois efforts to rectify the crises to subject formation generated, in part, by the emergence of gender-coded bifurcated bourgeois society and signaled by the Kantian and French Revolutions. The public dissemination of apotropaic representations screened the dependence upon proximate others by, and determined the positions among, exchange participants as well as maintained structures of domination. Przesłankę tych oskarżeń często stanowi jednak wolność słowa rozumiana „absolutystycznie” jako bezwzględne dobro. W istocie należy ją zawsze rozumieć jako coś, co prowadzi do innego celu: mającego wymiar obiektywny, subiektywny bądź intersubiektywny. Najczęstszą funkcją wolności słowa jest tworzenie warunków dla epistemologicznego poszukiwania prawdy. Zwracali na to uwagę liberałowie, tacy jak John Stuart Mill, oraz marksiści, tacy jak Herbert (...) Marcuse – twierdzący, że realizację tego celu utrudnia „represywna tolerancja” dla szkodliwych lub błędnych idei. Wolności słowa można bronić również ze względu na wpisaną w nią możliwość wyrażania indywidualnych opinii i uczuć, bez której nie ma mowy o jednostkowej autonomii. Trzecia funkcja wolności słowa ma charakter performatywny: język może służyć do działania w świecie. Współcześnie najczęściej mówi się w tym kontekście o ograniczaniu „mowy nienawiści” jako aktu przemocy symbolicznej, jednak konsekwencje tak rozumianej wolności słowa mogą być również pozytywne. Czwarty telos wolności wypowiedzi – semantyczny raczej niż epistemologiczny, ekspresywny czy performatywny – to tworzenie nowych znaczeń kulturowych bądź krytyka konwencjonalnych. Ponieważ wolność słowa może służyć jednej lub większej liczbie z tych funkcji, warto jej bronić również w niedoskonałym społeczeństwie, niezależnie od tego (przy całym szacunku dla Marcusego), że nie ma ona wartości bezwzględnej. This essay undertakes a phenomenological inquiry into the ‘experiential structure of hip-hop’ – a structure that hip-hop artist Jay-Z (Shawn Carter) gestures towards in his text Decoded. In this book, Jay-Z argues that hip-hop has a particular power to act as the vehicle for the communication of a specific type of experience, i.e. contradictory experiences, or those which do not seem possible under the principle of non-contradiction. For instance, Tupac Shakur says of his mom that “…even as a crack fiend, (...) mama / You always was a Black Queen, mama.” The way in which hip-hop is a powerful vehicle for this communication lies, according to Jay-Z, in its very structure, which he describes using two sets of terms: rhythm/flow and music/rhyme. Using Jay-Z’s general outline, this essay attempts to complete a phenomenological analysis of hip-hop, in the effort to (1) isolate the experiential structure of hip-hop and (2) isolate, within this structure, the way in which hip-hop is able to communicate contradictory experiences. In the final analysis, the author isolates the experiential structure of hip-hop and shows how its multiple layers work to draw listeners in and induce them to experience-with the artist. (shrink)

Honor walks are ceremonies that purportedly honor organ donors as they make their final journey from the ICU to the OR. In this paper, we draw on Ronald Grimes’ work in ritual studies to examine honor walks as ceremonial rituals that display medico-technological power in a symbolic social drama (Grimes, 1982). We argue that while honor walks claim to honor organ donors, ceremonies cannot primarily honor donors, but can only honor donation itself. Honor walks promote the quasi-religious idea of donation (...) as a “good death,” and mask the ambiguity and discomfort inherent in organ donation to promote greater acceptance by the medical community. While some goods may be achieved through honor walks, particularly for donor families, it is still important to examine the negative work done by this practice. (shrink)

Both the metaphorology of Hans Blumenberg and negative dialectics of Theodor W. Adorno recognized the value of the “nonconceptual” as an antidote to the tyranny of rational concepts imposed on a reality that was too diverse, contingent, and qualitatively unique to be subsumed under them. But whereas Blumenberg focused on metaphor and myth as rhetorical alternatives to concepts designed to deal with the incomprehensibility of “absolute reality,” Adorno understood nonconceptuality in terms of the material and corporeal limits to cultural constructivism (...) of any kind. This chapter explicates Theodor W. Adorno's dialectical engagement with inauthenticity and genuineness, two of the central tropes of his mature philosophy. The chapter discusses the extent to which Adorno's critique of genuineness in Minima Moralia and elsewhere was itself deeply indebted to Walter Benjamin's defense of mechanical reproduction against the aura and his notion of the mimetic faculty. It quickly becomes apparent that many of his “own” ideas betray precisely the kind of inauthenticity that he defended against the jargon. Or (...) if one wants to rely on his critical use of the term, it shows the non-auratic authenticity of the intellectual who knows himself not to be in full possession of his own ideas. Paradoxically, in his very lack of originality, his reworking without entirely duplicating many of his friend's most arresting ideas, Adorno took upon himself the stigma he urged everyone to embrace. Madhyamaka and Yogacara are the two principal schools of Mahayana Buddhist philosophy. While Madhyamaka asserts the ultimate emptiness and conventional reality of all phenomena, Yogacara is usually considered to be idealistic. This collection of essays addresses the degree to which these philosophical approaches are consistent or complementary. Indian and Tibetan doxographies often take these two schools to be philosophical rivals. They are grounded in distinct bodies of sutra literature and adopt what appear to be very different positions regarding the analysis (...) of emptiness and the status of mind. Madhyamaka-Yogacara polemics abound in Indian Buddhist literature, and Tibetan doxographies regard them as distinct systems. Nonetheless, scholars have tried to synthesize the two positions for centuries. This volume offers new essays by prominent experts on both these traditions, who address the question of the degree to which these philosophical approaches should be seen as rivals or as allies. The Moral Nexus develops and defends a new interpretation of morality—namely, as a set of requirements that connect agents normatively to other persons in a nexus of moral relations. According to this relational interpretation, moral demands are directed to other individuals, who have claims that the agent comply with these demands. Interpersonal morality, so conceived, is the domain of what we owe to each other, insofar as we are each persons with equal moral standing. The book offers an interpretative argument (...) for the relational approach. Specifically, it highlights neglected advantages of this way of understanding the moral domain; explores important theoretical and practical presuppositions of relational moral duties; and considers the normative implications of understanding morality in relational terms. The book features a novel defense of the relational approach to morality, which emphasizes the special significance that moral requirements have, both for agents who are deliberating about what to do and for those who stand to be affected by their actions. The book argues that relational moral requirements can be understood to link us to all individuals whose interests render them vulnerable to our agency, regardless of whether they stand in any prior relationship to us. It also offers fresh accounts of some of the moral phenomena that have seemed to resist treatment in relational terms, showing that the relational interpretation is a viable framework for understanding our specific moral obligations to other people. As demonstrated by Marx’s fierce defence of his integrity when anonymously accused of lying in 1872, he was a principled believer in both personal honesty and the value of truth in politics. Whether understood as enabling an accurate, ‘scientific’ depiction of the contradictions of the present society or a normative image of a truly just society to come, truth-telling was privileged by Marx over hypocrisy as a political virtue. Contemporary Marxists like Alain Badiou continue this tradition, arguing that revolutionary politics (...) should be understood as a ‘truth procedure’. Drawing on the alternative position of political theorists such as Hannah Arendt, who distrusted tin; monologic and absolutist implications of a strong notion of truth in politics, this paper defends the role that hypocrisy and mendacity, understood in terms of lots of little lies rather than one big one, can play in a pluralist politics, in which, pace Marx, rhetoric, opinion and the clash of values resist being subsumed under a singular notion of the truth.
