Justification, or at least ‘justification’, bulks large in recent epistemology. The view that knowledge consists of true-justified-belief has been prominent in this century, and the justification of belief has attracted considerable attention in its own right. But it is usually not at all clear just what an epistemologist means by ‘justified’, just what concept the term is used to express. An enormous amount of energy has gone into the attempt to specify conditions under which beliefs of one (...) or another sort are justified; but relatively little has been done to explain what it is for a belief to be justified, what that is for which conditions are being sought. The most common procedure has been to proceed on the basis of a number of obvious cases of justified belief, without pausing to determine what property it is of which these cases are instances. Now even if there were some single determinate concept that all these theoriests have implicitly in mind, this procedure would be less than wholly satisfactory. For in the absence of an explicit account of the concept being applied, we lack the most fundamental basis for deciding between supposed intuitions and for evaluating proposed conditions of justification. And in any event, as philosophers we do not seek merely to speak the truth, but also to gain an explicit, reflective understanding of the matters with which we deal. We want to know not only when our beliefs are justified, but also what it is to enjoy that status. True, not every fundamental concept can be explicated, but we shall find that much can be done with this one. (shrink)

In this essay I will discuss the relationship between two of the most basic ideas in political and legal philosophy: the justification of the state and state legitimacy. I plainly cannot aspire here to a complete account of these matters; but I hope to be able to say enough to motivate a way of thinking about the relation between these notions that is, I believe, superior to the approach which seems to be dominant in contemporary political philosophy. Today showing (...) that a state is justified and showing that it is legitimate are typically taken to require the very same arguments. I will argue that this contemporary stance obscures the difference between two central ways in which we should morally evaluate states, and it generates confusions about other serious practical issues, such as those surrounding our moral obligations to comply with law. I begin with brief discussions of the ideas of justification and legitimacy and with an attempt to capture what ought to be most central in our concerns about these ideas. I turn then to two basic ways of thinking about the relation between justification and legitimacy that I want to distinguish: what I will call the Lockean and the Kantian approaches. Next, I argue that the minority Lockean approach to this issue captures essential features of institutional evaluation that the majority Kantian approach does not; and I add brief mention of one further complication facing any adequate account of political evaluation. This collection of papers (including three completely new ones) by one of the foremost philosophers in epistemology transcends two of the most widely misunderstood positions in philosophy--foundationalism and coherentism. Audi proposes a distinctively moderate, internalist foundationalism that incorporates some of the virtues of both coherentism and reliabilism. He develops important distinctions between positive and negative epistemic dependence, substantively and conceptually naturalistic theories, dispositional beliefs and dispositions to believe, episodically and structurally inferential beliefs, first and second order internalism, and rebutting as (...) opposed to refuting skepticism. These contrasts are applied not only to rational belief, but to rational action and the rationality of desires and intentions. The overall position is a pluralist, moderately rationalistic, internalist theory of justification and a partly externalist conception of knowledge. However, by virtue of offering a theory of rationality as well as an account of knowledge and justified belief, it will interest philosophers of ethics, science, and the social sciences and teachers and students of epistemology. This essay grows out of the conviction that recent work by psychologists studying human reasoning has important implications for a broad range of philosophical issues. To illustrate our thesis we focus on Nelson Goodman's elegant and influential attempt to "dissolve" the problem of induction. In the first section of the paper we sketch Goodman's account of what it is for a rule of inference to be justified. We then marshal empirical evidence indicating that, on Goodman's account of justification, patently (...) invalid inferential rules turn out to be "justified." We conclude that something is seriously wrong with Goodman's story about justification. In the second section we attempt to patch Goodman's account. The notion of epistemic authority and the social aspect of justification play central roles in the alternative account of justification that we propose. (shrink)

This work, written from a neo-Pyrrhonian perspective, is an examination of contemporary theories of knowledge and justification. It takes ideas primarily found in Sextus Empiricus's Outlines of Pyrrhonism, restates them in a modern idiom, and then asks whether any contemporary theory of knowledge meets the challenges they raise. The first part, entitled "Gettier and the Problem of Knowledge," attempts to rescue our ordinary concept of knowledge from those philosophers who have assigned burdens to it that it cannot bear. Properly (...) understood, Fogelin shows that the concept of knowledge is unproblematic. The second part of this study, called "Agrippa and the Problem of Justification," examines Agrippa's contribution to Pyrrhonism, a systematic reduction of its procedures which came to be known as the "Five Modes Leading to the Suspension of Belief." These modes present a completely general procedure for refuting any claim a dogmatist might make. Though largely unnoticed, there is, according to Fogelin, an uncanny resemblance between problems posed by Agrippa's "Five Modes" and those that contemporary epistemologists address under the heading of a theory of justification. Fogelin examines the strongest contemporary theories of justification--in both foundationalist and anti-foundationalist forms. The conclusion is that recent philosophical writings on justification have made no significant progress in responding to the Pyrrhonian problems these writings have addressed. (shrink)

Imagine I hold up a Granny Smith apple for all to see. You would thereby gain justified beliefs that it was green, that it was apple, and that it is a Granny Smith apple. Under classical foundationalism, such simple visual beliefs are mediately justified on the basis of reasons concerning your experience. Under dogmatism, some or all of these beliefs are justified immediately by your experience and not by reasons you possess. This paper argues for what I call the looks (...) view of the justification of simple visual beliefs. According to the looks view, such beliefs are mediately justified on the basis of reasons concerning how the relevant things look. Unlike under classical foundationalism, under the looks view as I develop it, these reasons are public. They are public with respect to both their content and possession: with respect to content, they are not about ourselves and our experiences, and with respect to their possession, many people can have the very same looks-related reasons. People often think that their special relationships with family, friends, comrades and compatriots, can ground moral reasons. Among these reasons, they understand some to be duties – pro tanto requirements that have genuine weight when they conflict with other considerations. In this paper I ask: what is the underlying moral structure of associative duties? I first consider and reject the orthodox Teleological Welfarist account, which first observes that special relationships are fundamental for human well-being, then claims that we cannot have (...) these relationships, if we do not recognise associative duties, before concluding that we should therefore recognise associative duties. I then introduce a nonteleological alternative, grounded in the Appropriate Response approach to ethical theory. (shrink)

Say that two goals are normatively coincident just in case one cannot aim for one goal without automatically aiming for the other. While knowledge and justification are distinct epistemic goals, with distinct achievement conditions, this paper begins from the suggestion that they are nevertheless normatively coincident—aiming for knowledge and aiming for justification are one and the same activity. A number of surprising consequences follow from this—both specific consequences about how we can ascribe knowledge and justification in lottery (...) cases and more general consequences about the nature of justification and the relationship between justification and evidential probability. In this paper, I argue that Phenomenal Conservatism (PC) is not superior to alternative theories of basic propositional justification insofar as those theories that reject PC are self-defeating. I show that self-defeat arguments similar to Michael Huemer’s Self-Defeat Argument for PC can be constructed for other theories of basic propositional justification as well. If this is correct, then there is nothing special about PC in that respect. In other words, if self-defeat arguments can be advanced in support of (...) alternatives to PC, then Huemer’s Self-Defeat argument doesn’t uniquely motivate PC. (shrink)

Reichenbach's well-known distinction between the context of discovery and the context of justification has recently come under attack from several quarters. In this paper I attempt to reconsider the distinction and evaluate various recent criticisms of it. These criticisms fall into two main groups: those which directly challenge Reichenbach's distinction; and those which (I argue) indirectly but no less seriously challenge that distinction by rejecting the related distinction between psychology and epistemology, and defending the "naturalizing" of epistemology. I argue (...) that these recent criticisms fail, and that the distinction remains an important conceptual tool necessary for an adequate understanding of the way in which scientific claims purport to appropriately portray our natural environment. I want to discuss philosophically, to glance at the logic of, the parts of this expression “the justification of punishment” and then to draw from this discussion one or two morals for discussions of the justification of punishment. This paper is based on one originally given to the Scots Philosophy Club at its Aberdeen meeting in 1953, as the third part of a symposium on The Justification of Punishment.

Alexander Bird and Darrell Rowbottom have argued for two competing accounts of the concept of scientific progress. For Bird, progress consists in the accumulation of scientific knowledge. For Rowbottom, progress consists in the accumulation of true scientific beliefs. Both appeal to intuitions elicited by thought experiments in support of their views, and it seems fair to say that the debate has reached an impasse. In an attempt to avoid this stalemate, we conduct a systematic study of the factors that underlie (...) judgments about scientific progress. Our results suggest that (internal) justification plays an important role in intuitive judgments about progress, questioning the intuitive support for the claim that the concept of scientific progress is best explained in terms of the accumulation of only true scientific belief. One objection to the principle of public reason is that since there is room for reasonable disagreement about distributive justice as well as about human flourishing, the requirement of reasonable acceptability rules out redistribution as well as perfectionism. In response, some justificatory liberals have invoked the argument from higher-order unanimity, or nested inclusiveness. If it is not reasonable to reject having some system of property rights, and if redistribution is just the enforcement of a different set of property rights, redistribution (...) is legitimate if chosen democratically. This article explores two problems with this response. First, there are different ways to describe the set of possible policies, and so different ways to specify the noncoercive default that obtains in the absence of conclusive justification. Second, if the coercive exercise of political power must be conclusively justified, policies that are more coercive ought to require conclusive justification as against policies that are less coercive. These problems about the baseline with respect to which we require public justification raise the question of how we measure coercion, and whether or in what sense there is a presumption against coercion. Robust metanormative realists think that there are irreducibly normative, metaphysically heavy normative facts. One might wonder how we could be epistemically justified in believing that such facts exist. In this paper, I offer an answer to this question: one’s belief in the existence of robustly real normative facts is epistemically justified because so believing is indispensable to being a successful inquirer for creatures like us. The argument builds on Enoch's (2007, 2011) deliberative indispensability argument for Robust Realism but avoids relying (...) on an overly pragmatic account of the sources of basic epistemic justification. Instead, I suggest that the sources of basic epistemic justification are those belief-forming methods which are indispensable for zetetically indispensable projects, that is, projects which are constitutive of being a successful inquirer for embodied, agential creatures like ourselves. This paper examines the phenomenological and logical cycles of justification undertaken respectively in the emPhenomenology of Spirit/em and the Doctrines of Being and Essence of the emScience of Logic/em in order to offer an account of the meaning and demands of speculative justification. Not all intellectual property rights grant the right to exclude that is indicative of “property rules,” as that term was used by Guido Calabresi and A. Douglas Melamed in their seminal article. Some intellectual property rights are “liability rules,” in which the right holder has an entitlement to compensation for use of the protected invention, not a right to preclude the use. Although patent laws normally grant a right to exclude others from use of the protected invention as a default, (...) most countries’ laws allow the government to convert the patent property rule into a liability rule through a compulsory license. It has been noted, for example, that by the end of the 1950s, the U.S. had issued compulsory licenses covering 40 to 50 thousand patents, including substantial portions of the patent portfolios of AT&T, General Electric, IBM, and Xerox. The U.S. Supreme Court recently expressed a willingness to accept liability rules over injunctions in some patent infringement cases. (shrink)

Many of us care about the existence of ethical facts because they appear crucial to making sense of our practical lives. On one tempting line of thought, this idea can also play a central role in justifying our belief in those facts. David Enoch has developed this thought into a formidable new proposal in moral epistemology: that the deliberative indispensability of ethical facts gives us epistemic justification for believing in such facts. This chapter argues that Enoch’s proposal fails because (...) it conflicts with a central fact about epistemic justification: that the norms of epistemic justification have the content that they do in part because of some positive connection between those norms and the truth of the beliefs that these norms govern. Alternatives to Enoch’s attempt to defend the idea that deliberative indispensability confers epistemic justification fail for parallel reasons. The chapter concludes that deliberative indispensability does not provide epistemic justification. (shrink)

Public justification-based accounts of liberal legitimacy rely on the idea that a polity’s basic structure should, in some sense, be acceptable to its citizens. In this paper I discuss the prospects of that approach through the lens of Gerald Gaus’ critique of John Rawls’ paradigmatic account of democratic public justification. I argue that Gaus does succeed in pointing out some significant problems for Rawls’ political liberalism; yet his alternative, justificatory liberalism, is not voluntaristic enough to satisfy the desiderata (...) of a genuinely democratic theory of public justification. So I contend that—pace Gaus, but also Rawls—rather than simply amending political liberalism, the claims of justificatory liberalism bring out fatal tensions between the desiderata of any theory of liberal-democratic legitimacy through public justification. My starting point is what I call the Normative Authority Conception of justification, where S is justified in their belief that p at t (to some degree n) if and only if their believing that p at t is not ruled out by epistemic norms that have normative authority over S at t. With this in mind, this paper develops an account of doxastic justification by first developing an account of the normative authority of epistemic norms. Drawing from (...) work in political philosophy, I argue that (a) the cognitive and evaluative commitments and concerns behind our actual practices of holding each other and ourselves accountable for our beliefs reveal which epistemic norms we have consented to be under, and that (b) it is because we have consented to be under the authority of these norms – by actually holding ourselves and others accountable to them – that they in turn have normative authority over us. By connecting the authority of epistemic norms to the authority we have over ourselves in this way, the resulting account of doxastic justification (i) explains why it can be appropriate to criticize, resent, or sanction someone for having unjustified beliefs, (ii) avoids the phenomena of normative alienation and normative parochialism, and (iii) respects the social and collective nature of epistemic justification. The distinction between propositional and doxastic justification is normally applied to belief. The goal of this paper is to apply the distinction to faith and hope. Before doing so, I discuss the nature of faith and hope, and how they contrast with belief—belief has no essential conative component, whereas faith and hope essentially involve the conative. I discuss implications this has for evaluating faith and hope, and apply this to the propositional/doxastic distinction. There are two key upshots. One, bringing (...) in faith and hope makes salient additional normative categories, including the way the distinction between epistemic and practical justification interacts with the distinction between propositional and doxastic justification. Two, a paradigm example of propositional without doxastic justification is a belief that is evidentially supported but based on wishful thinking. Surprisingly, parallel cases of faith and hope may actually enjoy both propositional and doxastic justification. I conclude by exploring what it might look like for faith and hope to have propositional justification without doxastic justification. (shrink)

This paper argues that a successful philosophical analysis of models and simulations must accommodate an account of mathematically rigorous results. Such rigorous results may be thought of as genuinely model-specific contributions, which can neither be deduced from fundamental theory nor inferred from empirical data. Rigorous results provide new indirect ways of assessing the success of models and simulations and are crucial to understanding the connections between different models. This is most obvious in cases where rigorous results map different models on (...) to one another. Not only does this put constraints on the extent to which performance in specific empirical contexts may be regarded as the main touchstone of success in scientific modelling, it also allows for the transfer of warrant across different models. Mathematically rigorous results can thus come to be seen as not only strengthening the cohesion between scientific strategies of modelling and simulation, but also as offering new ways of indirect confirmation. The distinction between the contexts of discovery and justification has left a turbulent wake in the philosophy of science. This book recognizes the need to re-open the debate about the nature, development, and significance of the context distinction, about its merits and flaws. The discussion clears the ground for the productive and fruitful integration of these new developments into philosophy of science.

Some public reason liberals identify coercive law as the subject matter of public justification, while others claim that the justification of coercion plays no role in motivating public justification requirements. Both of these views are mistaken. I argue that the subject matter of public justification is not coercion or coercive law but political decision-making about the basic institutional structure. At the same time, part of what makes a public justification principle necessary in the first place (...) is the inherent coerciveness of a legally organized basic institutional structure. While most public reason liberals seem to presuppose that the meaning of “coercion” is sufficiently obvious so as not to warrant further analysis, my defense of the essay’s main thesis explicitly draws on an account of coercion as a powerful agent’s employment of enforceable constraints to determine the will of another agent. George Boolos has argued that the iterative conception of set justifies most, but not all, the ZFC axioms, and that a second conception of set, the Frege-von Neumann conception (FN), justifies the remaining axioms. This article challenges Boolos's claim that FN does better than the iterative conception at justifying the axioms in question.

THE central idea of modern empiricism has been that, if there is to be such a thing as justification at all, empirical knowledge must be seen as resting on experiential "foundations." To claim that knowledge rests on foundations is to claim that there is a privileged class of beliefs the members of which are "intrinsically credible" or "directly evident" and which are able, therefore, to serve as ultimate terminating points for chains of justification. An important development in current (...) epistemology has been a revival of the debate between philosophers who favor this conception of knowledge and those who think that an adequate account of justification can be given in terms of "coherence." Thus Dummett, Pollock, and Quinton, in varying degrees, have based their recent defenses of traditional empiricist views on what they take to be the clear untenability of coherentist alternatives. Harman and Lehrer, on the other hand, have tried to show that defensible versions of the coherence theory can be developed. (shrink)

Justification of believe in God had been one of the most challenging problem throughout history of philosophy. The problem is "is believe in god epistemically justified?" Gutting's theory in justification of theism is combined of two parts. He critiques Witgenstainian's view firstly, and then considers Aquinas’, Plantinga's, and some other views as incorrect views on theism. Gutting says that Witgenstainians and Tomistic approaches cannot draw a religious language exactly. He also considers Plantinga's view as an incorrect view, because (...) it is completely possible that the viewpoint of believers in believing to the existence of God to be evaluate epistemological as true as the non-believers’ view to the nonexistence of God. Discussing his own view, Gutting justifies believing in God regarding the religious experience. This article explains Gutting's critique of Witgenstainian's, Thomistic and Planting's approach on justification of believe in God. (shrink)

In recent times, realism in economic methodology has increasingly gained importance. Uskali Mäki and Tony Lawson are the best-known realists within the discipline and even though their approaches are fundamentally different, both provide pragmatic defences of realism by claiming anti-realism to be the reason for the low quality of economic models. My paper will show that a pragmatic defence of realism is untenable and furthermore, I will show that for both Mäki's and Lawson's normative ideas there is no need for (...) realism. (shrink)

In this paper I will discuss the problem of justification in moral particularism. The first part is concerned with Jonathan Dancy’s account of justification, which is a narrative one. To justify one’s choice is to present a persuasive description of the context in a narrative fashion, not to subordinate singular cases to universal rules. Since it dismisses arguments and employs persuasiveness, this view seems irrational, so the second part of my paper will consist of a personal reconstruction and (...) reformulation of Dancy’s account that will aim at defending particularist justification from being labeled as “irrational”.
