In contemporary culture, existing audiovisual recordings are constantly reused and repurposed for various ends, raising questions regarding the ethics of such appropriations, particularly when the recording depicts actual people and events. Every reuse of a preexisting recording is, on some level, a misuse in that it was not intended or at least anticipated by the original maker, but not all misuses are necessarily unethical. In fact, there are many instances of productive misuse that seem justified. At the same (...) time, there are other instances in which the misuse shades into abuse. Documentary scholars have long engaged with the question of the ethical responsibility of documentary makers in relation to their subjects. But what happens when this responsibility is set at a remove, when the recording already exists for the taking and repurposing? Reuse, Misuse and Abuse surveys a range of contemporary films and videos that appropriate preexisting footage and attempts to theorize their ethical implications. (shrink)

Background Several studies suggest that deviations from proper authorship practices are commonplace in medicine. The aim of this study was to explore experiences of and attitudes towards the handling of authorship in PhD theses at medical faculties in Denmark, Norway, and Sweden. Methods Those who defended their PhD thesis at a medical faculty in Scandinavia during the second half of 2020 were offered, by e-mail, to participate in an online survey. Survey questions dealt with experiences of violations of the first (...) three of the ICMJE authorship criteria and misuse of authorship order in the thesis articles, as well as respondents’ attitudes to these matters. Both questions with fixed response alternatives and questions with free-text responses were used. Quantitative data were analysed statistically using the Table functions in SPSS 25 and Chi-2 tests. Free-text responses were analysed qualitatively using manifest content analysis. Results 287 valid questionnaires were returned (response rate: 34.1%). Almost half (46.0%) of the respondents reported that the ICMJE authorship criteria were not fully respected in at least one of the papers in their thesis, while a vast majority (96.7%) found it important that authorship is handled according to the ICMJE authorship criteria. 24.4% reported inadequate handling of authorship order in at least one paper. The qualitative results provide a wide spectrum of examples of how the ICMJE authorship criteria are circumvented. Conclusion Despite increasing educational efforts to reduce deviations from good research practice at Scandinavian universities, the handling of authorship in medical papers remains problematic. Passages from the writings of Immanuel Kant concerning how a person should treat her body are often cited in the present‐day debate about a market for human body parts. In this paper, I demonstrate that this has been a misuse of Kant because unlike those who cite him, Kant was not primarily concerned with prohibiting the sale of body parts. In the first section, I argue that once these particular passages are understood against the background of Kant’s moral philosophy, (...) they indicate he had much broader concerns relating to the correct moral relationship a rational person should have with her body. In the second section, I examine Stephen Munzer’s unusually detailed analysis of these passages, but conclude that like those who have provided less detailed analyses, he also fails fully to understand the rationale for Kant’s various prescriptions and prohibitions concerning the treatment of human body parts, and in doing so misrepresents Kant’s position. Elliott Sober''s selection for/selection of distinction has been widely used to clarify the idea that some properties of organisms are side-effects of selection processes. It has also been used, however, to choose between different descriptions of an evolutionary product when assigning biological functions to that product. We suggest that there is a characteristic error in these uses of the distinction. Complementary descriptions of function are misrepresented as mutually excluding one another. This error arises from a failure to appreciate that selection (...) processes can be described at several different theoretical levels. (shrink)

In this open peer commentary, we categorize the possible “neuroscience in national security” definitions of misuse of science and identify which, if any, are uniquely presented by advances in neuroscience. To define misuse, we first define what we would consider appropriate use: the application of reasonably safe and effective technology, based on valid and reliable scientific research, to serve a legitimate end. This definition presents distinct opportunities for assessing misuse: misuse is the application of invalid or (...) unreliable science, or is the use of reliable scientific methods to serve illegitimate ends. Ultimately, we conclude that while national security is often a politicized issue, assessing the state of scientific progress should not be. (shrink)

Society is increasing its demands for more ethical behaviour by managers of organizations. However, societal and workplace ethical attitudes are constantly evolving as generational differences and demographic diversity make the workplace more complex. While a number of studies have attempted to classify ethical attitudes into different categories, more work in this area is needed. This paper reports on a study that examined attitudes towards the acceptability of workplace behaviour that might be considered unethical. Graduate business students at an Australian university (...) were asked to indicate the ethicality of 17 different behaviours, drawn from the business ethics literature. Exploratory factor analysis identified distinct factors, consisting of misuse of company resources, self-serving deceit, and the giving or receiving favours for personal gain. The derived factor structure was then tested with confirmatory factor analysis. Descriptive statistics indicated that misuse was considered less unethical than exchanging favours for personal gain. Deceit was considered the most unethical type of behaviour. Implications for managers and directions for further research are discussed. (shrink)

The evolutionary argument is an argument against epiphenomenalism, designed to show that some mind-body theory that allows for the efficacy of qualia is true. First developed by Herbert Spencer and William James, the argument has gone through numerous incarnations and it has been criticized in a number of different ways. Yet many have found the criticisms of the argument in the literature unconvincing. Bearing this in mind, I examine two primary issues: first, whether the alleged insights employed in traditional versions (...) of the argument have been correctly and consistently applied, and second, whether the alleged insights can withstand critical scrutiny. With respect to the first issue, I conclude that the proponents of the argument have tended to grossly oversimplify the considerations involved, incorrectly supposing that the evolutionary argument is properly conceived as a non-specific argument for the disjunction of physicalism and interactionist dualism and against epiphenomenalism. With respect to the second issue, I offer a new criticism that decisively refutes all arguments along the lines of the one I present. Finally, I draw positive lessons about the use of empirical considerations in debates over the mind-body problem. (shrink)

THE immense popularity which Bergson's philosophy enjoys is sometimes cast up against him, by those who do not agree with him, as a reproach. It has been suggested that Berg-son's writings are welcomed simply because they offer a theoretical justification for a tendency which is natural in all of us but against which philosophy has always fought, the tendency to throw reason overboard and just let ourselves go. Bergson is regarded by rationalists almost as a traitor to philosophy, or as (...) a Bolshevik inciting the public to overthrow what it has taken years of painful effort to build up. (shrink)

Kovacs argues that honorary authorship and regarding each co-author of multi-authored papers as if they were sole authors when the performance of researchers is being evaluated by their publications mean that we should require authors to identify what proportion of each publication should be attributed to each co-author. Even if such attributions could be made reliably, such a change should not be made. Contributions to authorship cannot be validly quantified, and the relative merits of different publications are also neither equal (...) nor validly quantifiable. Research administrators need to recognise that whatever criteria they adopt to evaluate the performance of researchers, researchers will find a way to game the system in order to maximise their personal benefit. Science is our best way of finding out about the natural world, and philosophers who write about that world ought to be sensitive to the claims of our best science. There are obstacles, however, to outsiders using science well. We think philosophers are prone to misuse science: to give undue weight to results that are untested; to highlight favorable and ignore unfavorable data; to give illegitimate weight to the authority of science; to leap from scientific premises to philosophical conclusions (...) without spelling out their relevance; to treat mere resonance between a scientific theory and a philosophical view as empirical evidence for the philosophical view. This article identifies and illustrates some of the ways in which philosophers misuse science, explains why these pitfalls are easy to fall into, and concludes with suggestions for avoiding them. In light of recent successful uterus transplantations, it is reasonable to expect that womb transplants will become more commonplace in the future. If this happens, important questions emerge about who should receive the donated wombs. Some arguments have been advanced that suggest that potential recipients should be screened for their anticipated childrearing capacity, as one component of a comprehensive process for determining eligibility. The main arguments provided in support of this position have to do with the presumed responsibility of the (...) state to protect future children from harm, and with avoiding complicity for any resulting harm experienced by the child born through the transplanted uterus. The purpose of this paper is to reject this position, based on two main criticisms: (1) screening potential uterus recipients for anticipated childrearing ability, but not also screening other kinds of morally equal family builders, is unjustly discriminatory; and (2) with respect to actions performed in good faith (e.g. providing a transplantable uterus to someone for the purpose of having a child), one is not morally blameworthy for the consequences of those actions (a) that one did not intend, and (b) that were directly caused by someone else, and (c) where others are directly responsible for making sure that those consequences do not come about. These criticisms are sufficient for concluding that the state is not justified in assessing the anticipated childrearing capacity of potential uterus recipients, and this is so regardless of whether or not there is a scarcity of transplantable uteruses available. In this paper I identify a fallacy. The fallacy is worth noting for practical and theoretical reasons. First, the rampant occurrences ofthis fallacy-especially at moments calling for careful thought-indicate that it is more pernicious to clear thinking than many of those found in standard logic texts. Second, the fallacy stands apart from most others in that it contains multiple kinds oflogical error (i.e., fallacious and non-fallacious logical errors) that are themselves committed in abnormal ways, and thus it presents a two-tiered (...) challenge to oversimplified accounts of how an argument can go bad. Purpose Prescription stimulant use as “cognitive enhancers” has been described among undergraduate college students. However, the use of prescription stimulants among future health care professionals is not well characterized. This study was designed to determine the prevalence of prescription stimulant misuse among students at an academic health sciences center. -/- Method Electronic surveys were e-mailed to 621 medical, pharmacy, and respiratory therapy students at East Tennessee State University for four consecutive weeks in fall 2011. Completing the survey was voluntary (...) and anonymous. Surveys asked about reasons for, frequency of, and side effects of nonprescription misuse of prescription stimulants. Given the sensitive material, an opportunity to win one of ten $50 gift cards was used as an incentive. -/- Results Three hundred seventy-two (59.9%) students completed the survey from three disciplines (47.6% medical, 70.5% pharmacy, and 57.6% respiratory therapy). Overall, 11.3% of responders admitted to misusing prescription stimulants. There was more misuse by respiratory therapy students, although this was not statistically significant (10.9% medicine, 9.7% pharmacy, 26.3% respiratory therapy; P = .087). Reasons for prescription stimulant misuse included to enhance alertness/ energy (65.9%), to improve academic performance (56.7%), to experiment (18.2%), and to use recreationally/get high (4.5%). -/- Conclusions Prescription stimulant misuse was prevalent among participating students, but further research is needed to describe prevalence among future health care workers more generally. The implications and consequences of such misuse require further study across professions with emphasis on investigating issues of academic dishonesty (e.g., “cognitive enhancement”), educational quality, and patient safety or health care quality. Deep brain stimulation — a novel surgical procedure — is emerging as a treatment of last resort for people diagnosed with neuropsychiatric disorders such as severe obsessive-compulsive disorder. The US Food and Drug Administration granted a so-called humanitarian device exemption to allow patients to access this intervention, thereby removing the requirement for a clinical trial of the appropriate size and statistical power. Bypassing the rigors of such trials puts patients at risk, limits opportunities for scientific discovery, and gives device manufacturers (...) unique marketing opportunities. We argue that Congress and federal regulators should revisit the humanitarian device exemption to ensure that it is not used to sidestep careful research that can offer valuable data with appropriate patient safeguards. In his 2000 Religious Studies article 'Ineffability', John Hick calls upon the Dionysian corpus to bear witness to the 'transcategorality' of God and thereby corroborate his comparative theology of pluralism. Hick's Dionysius avows God's transcendence of categories by negating God's names, while at the same time maintaining that such names are metaphorically useful means of uplifting humans to God. But herein reside three common misunderstandings of the Dionysian corpus: (1) the divine names are mere metaphors; (2) the divine names are (...) therefore negated of God; and (3) the negation of divine names is the means by which humans return to and unite with God. Three uses of critical thought experiments outlined in the paper are related to general questions of evaluation. A proposal offered by Karl Popper concerning the so-called "apologetic" use of Gedankenexperimente is critically assessed. Specifically, his methodological principle that one should not use a second theory in order to defend a first theory against a critical thought experiment is discussed with reference to the photon-box Gedankenexperiment and the Maxwell-demon paradox. It is argued that the rescuing of one theory from conceptual anomaly (...) by appealing to another need not constitute a misuse of a critical thought experiment. (shrink)

This study examines the cognitive resources underlying the attribution of stigma in substance use and misuse. A cultural model of substance misuse risk was elicited from students at a major U.S. state university. We found a contested cultural model, with some respondents adopting a model of medical risk while others adopted a model of moral failure; agreeing that moral failure primarily defined risk led to greater attribution of stigma. Here we incorporate general beliefs about moral decision-making, assessed through (...) Moral Foundations Theory. Specifically, we examined commitment to each moral foundation in relation to stigma attribution while controlling for the specific model of substance misuse risk. We found an interaction between the purity moral foundation and the cultural model of risk. This suggests that broad moral orientations, along with more specific understandings of substance misuse risk, combine to orient an individual with respect to stigma attribution. (shrink)

Teleological Theories of mental representation are probably the most promising naturalistic accounts of intentionality. However, it is widely known that these theories suffer from a major objection: the Indeterminacy Problem. The most common reply to this problem employs the Target of Selection Argument, which is based on Sober’s distinction between selection for and selection of . Unfortunately, some years ago the Target of Selection Argument came into serious attack in a famous paper by Goode and Griffiths. Since then, the question (...) of the validity of the Target of Selection Argument in the context of the Indeterminacy Problem has remained largely untouched. In this essay, I argue that both the Target of Selection Argument and Goode and Griffiths’ criticisms to it misuse Sober’s analysis in important respects. (shrink)

The aim of this study is to gain an understanding of why employees misuse information systems resources in the workplace. Rather than consider “intention,” as existing behavioral research commonly does, this study investigates actual behavior and employs IS resource misuse as the dependent variable. Data from a web-based survey are analyzed using the partial least squares approach. In light of the dual-process approach and the theory of planned behavior, the findings suggest that IS resource misuse may be (...) both an intentional type of behavior and an unreasoned action. Perceived behavioral control influences employees’ IS resource misuse actions via their desires or intentions, whereas attitude toward such misuse affects these actions via employees’ desires alone. Subjective norm is found not to affect employees’ IS resource misuse via either desires or intentions. In terms of its theoretical contribution, this study considers unethical behavior in information systems by incorporating a dual-process model and the theory of planned behavior. With regard to its managerial significance, the study’s results will help managers to better understand why employees commit IS resource misuse within organizations. (shrink)

The use of counterfactuals for considerations of algorithmic fairness and explainability is gaining prominence within the machine learning community and industry. This paper argues for more caution with the use of counterfactuals when the facts to be considered are social categories such as race or gender. We review a broad body of papers from philosophy and social sciences on social ontology and the semantics of counterfactuals, and we conclude that the counterfactual approach in machine learning fairness and social explainability can (...) require an incoherent theory of what social categories are. Our findings suggest that most often the social categories may not admit counterfactual manipulation, and hence may not appropriately satisfy the demands for evaluating the truth or falsity of counterfactuals. This is important because the wide- spread use of counterfactuals in machine learning can lead to misleading results when applied in high-stakes domains. Accordingly, we argue that even though counterfactuals play an essential part in some causal inferences, their use for questions of algorithmic fairness and social explanations can create more problems than they resolve. Our positive result is a set of tenets about using counterfactuals for fairness and explanations in machine learning. (shrink)

BackgroundThe merits and drawbacks of moral relevance models of addiction have predominantly been discussed theoretically, without empirical evidence of these potential effects. This study develops and evaluates a novel survey measure for assessing moral evaluations of patient substance misuse (ME-PSM).MethodsThis measure was tested on 524 health professionals (i.e., physicians, nurses, and other health professionals) in California (n = 173), urban France (n = 102), and urban China (n = 249). Demographic factors associated with ME-PSM were investigated using analyses of (...) variance (ANOVAs) and t-tests, with results suggesting that ME-PSM is higher among younger health professionals, nurses (when compared with physicians and other health professionals), and Chinese health professionals (when compared with French and American health professionals).ResultsResults provide preliminary support for the psychometric quality of the survey measure introduced in this study, including the existence of a single latent structure and partial invariance of collected data across countries.ConclusionThe survey measure for ME-PSM which was developed and tested in the current study appears to hold potential utility for use as a measure of moral views of patient substance misuse. With development, this measure may be used to examine moral evaluations, both as factors of stigma and of other clinical factors associated with the treatment of patients with substance use disorders. Children’s unpleasant experiences with misuse of their personal information online is among the rapidly increasing online ‘risks’. Among these, four were chosen for this study: dealing with their own hacked accounts, dealing with others’ fake accounts, dealing with fake accounts impersonating them and sending rude messages on their behalf with the intent of damaging their reputation, and dealing with receiving rude messages from hacked accounts of friends were reported as most bothersome in EU Kids Online III. These four subtypes (...) of problematic situations related to privacy were strategically chosen to illustrate children’s coping responses to situations that are related but increasingly complex, distinctions related to whether situations involved peers or strangers, whether children were direct victims of hacked accounts, or recipients of unwelcomed or rude messages sent from fake profiles and/or hacked accounts. Furthermore, the four situations were chosen to develop a more inclusive coping typology for EU Kids Online data, which can span across different types of risks. This article relies heavily on theoretical work put forward by research on coping with general and specific stressors but integrates approaches to children’s dealing with online issues relevant for online safety measures. Concerns have been raised around the alleged commercialisation of South African genetic material by various research institutes nationally and abroad. We consider whether the Protection of Personal Information Act in South Africa will conflict with or complement existing protections in health law and research ethics. The Act is not applicable to de‐identified samples that cannot be re‐identified but we question whether genetic samples can ever be truly de‐identified. The research participants in this matter provided consent for use of their samples (...) for research but did not consent to commercialisation by global research institutions, and neither did the researchers. We suggest that consent models incorporating broad consent as an option should include explicit discussions around benefit sharing and commercialisation. Mistrust between researchers and participants impedes scientific research and can harm relationships built up over the years between South African researchers and local communities. (shrink)
