From classical antiquity to contemporary times, challenging situations of dilemmatic or paradoxical nature continue to fascinate both scholars and the casual reader. Although Western literature provides a fruitful source of philosophical discussion on the circumstances under which a morally competent agent faces incompatible moral requirements, Sinology has rarely accepted the idea of moral dilemmas in Chinese philosophy in general and Confucianism in particular. The present paper explores moral and morally motivated dilemmas in Liu Xiang’s 劉向 (...) Lienü Zhuan 列女傳 and the philosophical strategies employed for their resolution within the framework of the Confucian tradition, emphasizing similarities with Western traditions such as Greek tragedy or Thomistic philosophy. In this paper I argue for modesty concerning what theoretical reason can accomplish in the moral dilemmas debate. Specifically, I contend that philosophers' conclusions for or against moral dilemmas are driven less by rational argument and more by how the moral world intuitively appears to them.

Offers an explanation of Kant's denial that there can be any genuine moral dilemmas and criticizes Alan Donagan's claim that we can put ourselves into a moral dilemma by our own wrongdoing. Although genuine moral dilemmas, in which one would be wrong no matter what one did, are impossible, “gaps” in moral theory may leave us with no resolution in tragic cases of moral conflict. Kantian moral theory has such gaps, but attempts (...) to develop theories without such gaps are not necessarily desirable. Finally, the essay addresses “residues” of moral feeling and attitude after one has acted in a case of tragic conflict in which one could find no morally better option. Perhaps surprisingly, Kantians should affirm that, even though feeling guilty for the choice is inappropriate, there is an important sense in which one should feel especially bad about those one has harmed, and regret one's own role, in such cases. Psychiatrists working with war veterans have, in recent years, constructed ‘moral injury’ as a separate manifestation of war trauma that is distinct from Post-Traumatic Stress Disorder. This paper argues that for moral degradation to occur, it necessarily involves one’s commissions or omissions that transgresses one’s personal morality, and hence, distinguishes sufferers of moral injury from PTSD sufferers who were witnesses to traumatic and morally abhorrent events. To this end, it clarifies how some of the situations surrounding (...) class='Hi'>moral injury are misunderstood, by discussing the process of moral reasoning in the context of moral dilemmas, dirty hands, and moral blind alleys. Finally, it concludes that when we conceptualise moral injury as being caused by one’s commissions and omissions in moral dilemmas, we find that shame and guilt are situation-appropriate responses with a role to play in what ethics mean. This paper examines the structure of moral paradoxes, arguing that moral dilemmas are grounded in moral agents and necessitate the same explanation as the logical behavior of these agents. Consequently, logical and moral laws derive from a different source than nomological and metaphysical laws. Furthermore, it is asserted that logical and moral laws are pluralistic in nature, permitting numerous logical deviations without leading to absurdity.

A strong tradition in philosophy denies the possibility of moral dilemmas. Recently, several philosophers reversed this tradition. In this dissertation, I clarify some fundamental issues in this debate, argue for the possibility of moral dilemmas, and determine some implications of this possibility. ;In chapter I, I define moral dilemmas roughly as situations where an agent morally ought to adopt each of two alternatives but cannot adopt both. Moral dilemmas are resolvable if and (...) only if one of the moral oughts overrides the other. ;In chapter II, I criticize several opponents of moral dilemmas, including utilitarians, Kant, Aquinas, and Ross. My main criticism is that no opponent of moral dilemmas can adequately justify moral residue . ;Chapters III and IV concern the two main arguments against the possibility of moral dilemmas. First, the argument for 'ought' implies 'can' runs as follows. If the agent cannot adopt both, then it is not the case that the agent ought to adopt both. But the agent ought to adopt both, since the agent ought to adopt each . Thus, the defining judgements of a moral dilemma seem to imply a contradiction. In response, I argue that the relation between 'ought' and 'can' is not a logical implication but a conversational implicature. ;Chapter IV concerns the argument from 'ought' implies 'permitted': If the agent ought to adopt one alternative, then the agent is permitted to adopt that alternative, which means that it is not the case that the agent ought not to adopt that alternative. But the agent ought not to adopt that alternative, since the agent ought to adopt the other alternative and cannot adopt both. I respond that 'ought' does not logically imply but conversationally implicates 'permitted'. ;In chapter V, I argue that, despite recent claims, both moral realism and anti-realism are compatible with the possibility of moral dilemmas. He aims to show that this is not the case by examining debates on the subject of moral dilemma from the twelfth to the fifteenth centuries. According to medieval terminology, an agent in a moral dilemma is considered to be perplexed (perplexus) or to be suffering from perplexity (perplexitas). Dougherty emphasizes the importance to his study of the ontological and objective sense of perplexitas: an agent is said to be confused in the presence of a genuinely dilemmatic situation. The book deals with the topic through a selection of prominent thinkers from the major schools of the period (e.g. Franciscan, Dominican, and Thomistic).Canon law was the first discipline in which systematic discussion of moral dilemmas took place. Accordingly, in chapter 1 Dougherty discusses two opposing views from the twelfth and early thirteenth centuries that were equally authoritative and conveyed the canon law tradition to later medieval thinkers. Gratian asserts, in his Decretum, the existence of genuine moral dilemmas (through conflicts within natural law itself) and counsels agents in those situations to choose the lesser of two evils. Gratian’s views were commented on by many glossators who argued against him in the Glossa ordinaria, contending that moral agents can fulfill all moral obligations, as the well-known maxim “ought implies can” asserts, and so avoid moral wrongdoing. If an agent finds himself in a perplexed state, it is due to his own culpable negligence, never the result of the disordered moral order.In addition to canon law there were other forums for discussions of moral perplexitas. In chapter 2, Dougherty expands the theme to two influential thirteenth-century summaries of theology: the Summa aurea, authored by William of Auxerre, and the Summa Halesiana, associated with Alexander of Hales. In these, Dougherty thoroughly examines a number of dilemma cases and shows both works concluding that moral agents can find themselves trapped in such situations, with some degree of moral wrongdoing being inescapable. The maxim “ought but cannot” is evident, then, in these works. Further, their concrete advice for agents in a moral dilemma is to apply the principle of choosing the lesser evil, or, as William of Auxerre specifies in certain cases, “what obliges more greatly is to be done”; however, his connection between these two principles seems not so clear: why would the choice of that which obliges more be identified with the choice of a lesser evil?Chapter 3 is one of the book’s highlights. It presents the distinctive medieval moral dilemma position of Raymond Lull (ca. 1232–1316) through an analysis of four of Lull’s own dilemmas in his autobiographical work, Vita coaetanea. Dougherty argues that Lull is opposed to the traditional solution of medieval commentators on Lombard, since Lull did not claim that a judgment of conscience, which dictates something contrary to natural law or a command of God, had to be in error. The aim of the consequentializing project is to show that, for every plausible ethical theory, there is a version of consequentialism that is extensionally equivalent to it. One challenge this project faces is that there are common-sense ethical theories that posit moral dilemmas. There has been some speculation about how the consequentializers should react to these theories, but so far there has not been a systematic treatment of the topic. In this article, I show that there are at (...) least five ways in which we can construct versions of consequentialism that are extensionally equivalent to the ethical theories that contain moral dilemmas. I argue that all these consequentializing strategies face a dilemma: either they must posit moral dilemmas in unintuitive cases or they must rely on unsupported assumptions about value, permissions, requirements, or options. The authors’ aim is to bring to the attention of readers the inadequacies of care for people in Hungary who are terminally ill. They believe that both objective and subjective factors cause these inadequacies. Most of these factors arise from moral dilemmas that could be eased or even solved if ethics education had a much more prominent place in the nursing curriculum. Even if nurses would not become automatically better persons morally, a much wider knowledge of medical/nursing ethics (...) could significantly improve nursing care both before and at the end of life. Although the article is also critical of the nursing care provided, it is not its purpose to make any generalizations. The study utilized selected passages from essays written by 76 practicing nurses on their personal experience of ethical dilemmas in their work environment, and a questionnaire administered to 250 students (registered nurses and health care students) studying for a college degree. This article is written by two authors who have formed an unusal alliance: a registered nurse with 29 years’ experience of bedside nursing, but who is currently a teacher of nursing ethics at a local health college, and a lawyer turned bioethicist. Marcus argues that moral dilemmas are real, but that they are not the result of inconsistent moral principles. Moral principles are consistent just in case there is some world where all principles are 'obeyable.' They are inconsistent just in case there is no world where all are 'obeyable.' What this logical point is meant to show is that moral dilemmas do not make moral codes inconsistent. The current chapter provides an overview of research on responses in moral dilemmas where maximization of outcomes for the greater good (utilitarianism) conflicts with adherence to moral norms (deontology). Expanding on a description of the traditional paradigm to study moral-dilemma judgments (i.e., the trolley problem), the chapter reviews the most prominent dual-process account of moral-dilemma judgments, normative conclusions that have been derived from this account, and criticisms raised against this line of work. In 1963 Roderick Chisholm proposed a category of acts called “offences” to capture what he called acts of “permissive ill-doing.” Chisholm’s proposal has proven to be controversial. Here I propose that some progress can be made in validating acts of offence by focusing upon moral dilemmas. Given the problems which have been alleged to beset moral dilemmas, this may initially seem like a puzzling strategy. However, I will call attention to a type of moral dilemma (...) unlike what is standardly discussed in the literature and attempt to show that those who acknowledge that such dilemmas are possible are likewise obliged to acknowledge that acts of offence are possible. My suggestion, then, is that, since the former are plausible to acknowledge, so are the latter. (shrink)

Could it be that one morally ought to do something morally bad? Some people think the answer is obviously ‘No’. Indeed, these theorists may say, it is contradictory to suppose that one morally ought to do something morally bad. Others hold that it is not a contradiction but a sad fact of life that one may be morally required to do something morally bad. This latter position is the one I'll be supporting. If it's the right view, it really matters (...) in practical affairs. For example, almost everyone would agree that it's morally bad to kill an innocent fetus. The author defines moral dilemmas as situations where there is a moral requirement for an agent to adopt each of two alternatives, And the agent cannot adopt both, But neither moral requirement overrides the other. The author then argues that moral dilemmas are possible because conflicting moral requirements can be either symmetrical or incomparable in a way that is limited enough to be plausible but still strong enough to yield moral dilemmas.

Influential theories on moral judgments propose that they rely either on emotions or on innate moral principles. In contrast, the mental model theory postulates that moral judgments rely on reasoning, either intuition or deliberation. The theory allows for the possibility that intuitions lead to utilitarian judgments. This paper reports two experiments involving fifth-grade children, adolescents, and adults; the results revealed that children reason intuitively to resolve moral dilemmas in which action and inaction lead to different (...) outcomes. In particular, the results showed female children to be more utilitarian than female adults in resolving classical moral dilemmas: they preferred an action that achieved a good outcome for a greater number of people. Within the mental model theory’s framework there is no reason to expect that females and males differ in their ability to reason, but at the moment the results for females cannot be generalized to males who were not properly represented in the adults groups of the two experiments. The result revealing that (female) children are more utilitarian than (female) adults, which is hard to explain via many current theories, was predicted by the mental model theory. (shrink)

During the last two decades there has been an enormous development in treatment possibilities in the field of neonatology, particularly for (extremely) premature infants. Although there are cross-cultural differences in treatment strategy, an overview of the literature suggests that every country is confronted with moral dilemmas in this area. These concern decisions to initiate or withhold treatment directly at birth and, later on, decisions to withdraw treatment with the possible consequence that the child will die. Given that the (...) neonate cannot express his or her own will, who will decide? And on the basis of what information, values and norms? We explored some of these issues in daily practice by interviewing a small sample of health care practitioners in a Dutch university Neonatal Intensive Care Unit (NICU). It turned out that experiencing moral dilemmas is part of their daily functioning. Nurses underline the suffering of the newborn, whereas physicians stress uncertainty in treatment outcome. To make the best of it, nurses focus on their caring task, whereas physicians hope that future follow-up research will lead to more predictable outcomes. As for their own offspring, part of these professionals would hesitate to bring their own extremely premature newborn to a NICU. For the most oppressing dilemma reported – terminating an already initiated treatment – we propose the concept of ‘evidence shift’ to clarify the ambiguous position of uncertainty in decision making. The demands of morality can seem straightforward. Be kind to others. Do not lie. Do not murder. But moral life is not so simple. We are often confronted with difficult situations in which someone is going to get hurt no matter what we do, in which we cannot meet all of our obligations, in which loyalties come into conflict, in which we cannot help everyone who needs it, or in which we must compromise on important values. It is natural (...) to describe such situations as moral dilemmas. This chapter is about the psychology of how we represent, process, and make decisions about what to do when moral life is difficult in this way. Our first aim is to provide some conceptual clarity on what exactly turns a choice situation into a moral dilemma. Here, we propose a normative account of moral dilemmas in terms of moral appropriate feelings of conflict in response to strongly conflicting reasons. Our second aim is to critically survey existing psychological work, providing an overview of some important findings, while raising questions for future research. (shrink)

Great historical crises oblige us to choose not between violence and nonviolence, but between two different forms of violence. Nonviolent movements are no exception to this rule. In the US, with the outbreak of the War of Secession, the Christian-nonviolent movement was obliged to choose between the violence of the Union-army and the violence of slavery. With the outbreak of World-War One, Lenin chose revolution, while, in India, Gandhi became the ‘recruiting agent-in-chief’ for the British army. At that moment, he (...) struggled not for the general emancipation of colonial peoples, but only for the co-optation of the Indian people under the ruling races, and this co-optation was to be gained on the battlefield. While in the past, in spite of their mistakes and oscillations, the protagonists of nonviolence were an integral part of the anticolonialist movement, today nonviolence is the watchword of imperialism, which tries to discredit as violent its enemies and challengers. Slow codes—insincere attempts at resuscitation—are widely regarded in medicine and medical ethics as morally impermissible. My goal here is to enrich this special issue on the slow code with an argument for the permissibility of slow codes that is rooted in moral psychology. Specifically, if we take seriously the results from moral psychology, the slow code is not only permissible, it is often the best option. The context of the decision about whether to perform a slow code is (...) analogous to thoroughly investigated moral dilemmas such as the trolley problem. In particular, when the trolley problem is framed as a trilemma, it becomes clear that the decisional context of the slow code is analogous to the famous moral dilemma. Since in the trolley problem the choice analogous to the slow code is the best choice, the slow code may be the best choice when facing patient or family requests for futile CPR. In establishing this claim, I address a range of objections to the slow code. I conclude with an empirically supported explanation of the conventional wisdom. Resistance to the slow code doesn’t sprout from the act’s moral properties, but from moral judgments influenced by factors such as emotion, physical distance, and personal force. (shrink)

In this paper I argue that a phenomenological account of moral sense-bestowal can provide valuable insight into the possibility of moral dilemmas. I propose an account of moral sense-bestowal that is grounded in the phenomenology of expression that Maurice Merleau-Ponty developed throughout the course of his philosophical work, and most explicitly in the period immediately following the publication of Phenomenology of Perception. Based on this Merleau-Pontian account of moral sense-bestowal, I defend the view that there (...) are genuine moral dilemmas, i.e., that we can be faced with situations of conflicting oughts that we cannot resolve without moral remainder. E j lemmon, B a o williams, Bas van fraassen, And ruth marcus have argued on behalf of the existence of moral dilemmas, I.E., Cases where an agent is subject to conflicting absolute moral obligations. The paper criticizes this support and contends that no moral dilemma is possible.

In this paper we point out some interesting structural similarities between vagueness and moral dilemmas as well as between some of the proposed solutions to both problems. Moral dilemma involves a situation with opposed obligations that cannot all be satisfied. Transvaluationism as an approach to vagueness makes three claims concerning the nature of vagueness: (1) it involves incompatibility between mutually unsatisfiable requirements, (2) the underlying requirements retain their normative power even when they happen to be overruled, and (...) (3) this incompatibility turns out to be rather benign in practice. Given that transvaluationism is inspired by moral dilemmas, these claims are assessed in respect to them. Transvaluationism provides a smooth account of the mentioned claims concerning vagueness. Following a brief discussion of Sorensen’s views on moral dilemmas and conflict vagueness, we offer a model of moral pluralism accommodating structurally similar claims about the nature of moral conflict and moral dilemmas. In some cases, the term ‘Responsible Innovation’ has been considered a type of ethical solution to the Collingridge predicament in control of technology development. In this article, I claimed that two different approaches for responsible innovation (i.e. Van den Hoven’s innovation-based approach and Owen’s social-based approach) can be considered as two different dimensions that, while being conflicting, dialectically interact and thus can be useful for solving the problem of Collingridge. For this purpose, I argue that the first approach that resorts (...) to innovations for solving moral dilemmas is successful in rearranging and removing unhelpful (i.e. amoral) obligations, but it is unable to determine useful (i.e. moral) obligations. On the other hand, the second approach believes that Responsible Innovation occurs through social processes and by virtue of concepts such as reflection, deliberation, anticipation, and responsiveness, although is effective in determining useful (i.e. moral) obligations, it cannot remove or rearrange all useless (i.e. amoral) obligations. Although these two approaches are conflicting, the result of each approach is a necessary condition for the other approach, so the problem can only be solved by a dialectical interaction. (shrink)

In this book, I consider whether the hypothesis of moral dilemmas undermines ethics' pretensions to objectivity. I argue against the view that moral dilemmas challenge the very possibility of ethical theory, as a practical and theoretical enterprise. By examining Kantian, Intuitionist and Utilitarian arguments about moral dilemmas, I show that no ethical theory is capable of avoiding them. I further argue that an adequate ethical theory should admit dilemmas. Dilemmas do not reveal (...) a logical or normative flaw in the theory that permits them to arise, nor are they necessarily generated by subjective mistakes. Rather, dilemmas are a sign of the deliberative capacity of an agent who operates in non-ideal conditions of rationality and cooperation. The inevitability of moral dilemmas shows that we should reconsider the bounds of deliberation, and the purposes of ethical theory. My argument for the philosophical significance of moral dilemmas rests on the claim that an adequate ethical theory should make sense of moral phenomenology, and that moral phenomenology should to be understood from the perspective of an agent who conceives of herself as an agent. The view of moral dilemmas I advocate does not invite skepticism about ethical theory, but suggests that we redefine its scope and its many practical aims. (shrink)

The paper is concerned with the question of the existence of moral dilemmas, conceived of as situations involving a subject in a conflict of non‐overridden moral obligations. I reject some of the presuppositions underlying discussions of this question and argue that certain morally relevant choices cannot be evaluated in relation to an all‐things‐considered moral obligation as permissible or impermissible, right or wrong. In arguing for the inadequacy of our ordinary moral predicates for fully capturing the (...) nature of such choices, I argue that they are, in certain respects, inexpressible. (shrink)
