The Kālacakra tradition positions itself in the philosophical system of Madhyamaka, from whose perspective it criticizes the doctrinal tenets of Hindu philosophical schools and of Buddhist schools other than Madhyamaka. The concept of emptiness is the most essential tenet of the Kālacakratantra practice. Before analyzing the practical applications of the doctrine of emptiness in the Kālacakra tantric tradition, it may be useful to examine first the ways in which emptiness is defined and explained in this tantric system. Diverse manners (...) of explaining emptiness result from the various contexts in which this tradition applies and actualizes the doctrine of emptiness. In conclusion, one can say that the sole purpose of the intricate system of the Kālacakratantra's yogic practices is to awaken the yogi to the gnosis of emptiness. Is practical reason a cognitive faculty? Do practical judgments make claims about a subject matter that are appropriately assessed in terms of their agreement with that subject matter? According to Kantians like Christine Korsgaard, the answer is no. To think otherwise is to conflate the theoretical and the practical, the epistemic and the ethical. I am not convinced. In this paper, I motivate my skepticism through examination of the very figure who inspires Korsgaard’s rejection of cognitivism: Kant. (...) For as I read him, Kant does not construe the distinction between theoretical and practical reason in terms of a distinction between cognitive and non-cognitive faculties but in terms of two distinct applications of a single faculty of reason, which is through-and-through cognitive. Thus, practical, no less than theoretical, reason cognizes a subject matter, and so practical, no less than theoretical, reason is straightforwardly subject to familiar epistemic standards of truth, warrant, and knowledge. Of course, even if I am right about Kant, this does not show that Korsgaard is wrong about reason; and I will offer no direct argument against her position here. Nonetheless, I believe that reflection on Kant’s true view, with its careful treatment of and respect for both the practicality and rationality of reason, should perhaps lead us to rethink what it means to be a rationalist in ethics. In many Western science systems, funding structures increasingly stimulate academic research to contribute to practical applications, but at the same time the rise of bibliometric performance assessments have strengthened the pressure on academics to conduct excellent basic research that can be published in scholarly literature. We analyze the interplay between these two developments in a set of three case studies of fields of chemistry in the Netherlands. First, we describe how the conditions under which academic chemists work have changed (...) since 1975. Second, we investigate whether practical applications have become a source of credibility for individual researchers. Indeed, this turns out to be the case in catalysis, where connecting with industrial applications helps in many steps of the credibility cycle. Practical applications yield much less credibility in environmental chemistry, where application-oriented research agendas help to acquire funding, but not to publish prestigious papers or to earn peer recognition. In biochemistry practical applications hardly help in gaining credibility, as this field is still strongly oriented at fundamental questions. The differences between the fields can be explained by the presence or absence of powerful upstream end-users, who can afford to invest in academic research with promising long term benefits. 일찍이 필자는 미래세대나 자연적 존재가 법적 권리능력을 발휘할 수 있는 ‘생태법인 (eco legal person)’ 제도의 도입을 제기한 바가 있다. 이글의 목적은 생태법인의 구체적 인 적용 모델 제시를 통해 생태법인 제도 도입의 의의와 실용성을 논증하는 데 있다. 법치주의 체제에서는 법인 제도를 통해 인간 이외의 존재에게 법인격을 부여하여 그들 의 권리를 스스로 행사할 수 있도록 한다. 그러나 현행 법체제에서는 자연의 존재물을 법 인격의 주체로 인정하지 않는다. 하지만 법인 제도는 사회의 원활한 운용을 위해 창조된 것이다. 그리고 법인의 대상과 내용은 사회적 필요성에 의해서 다양해지고 (...) 확장되었다. 따 라서 자연의 존재물에 법인격을 부여하지 말라는 절대 원칙은 없다. 스톤(Christopher D. Stone)은 미네랄 킹 계곡에서 추진되는 스키장 건설을 반대하는 소송에서 개발로 인해 파괴될 자연에도 법적 지위가 부여되어야 한다고 주장하였다. 2017 년 뉴질랜드 의회는 원주민 마우리족의 오랜 삶의 터전인 환가누이강에 법인격을 부여하 는 법률을 만들었으며 필리핀에서는 아직 태어나지도 않은 아이가 소송 당사자의 일원이 되어 밀림 개발을 막는 재판에서 승소한 사례가 있다. 제주남방큰돌고래는 세계자연보전연맹(IUCN)에서 보호가 필요하다고 지정한 멸종위기 해 양생물이다. 하지만오늘날 제주남방킁돌고래는 해양오염과난개발, 해양관광산업의난립으로 심각한 위협에 처해있다. 제주남방큰돌고래에 법인격을 부여하고 그 권리를 행사할 수 있는 생태법인 제도를 운용한다면 제주남방큰돌고래가 스스로 자기보호에 나설 수 있게 된다. 생태법인 제도의 도입은 자연을 바라보는 인간의 인식과 태도를 근본적으로 전환하는 계기가 될 수 있다. 이 글을 통해 헌법에 자연의 권리가 명시되고 특별환경법원 기능을 담 당하는 생태법원 설치 논의가 촉발되기를 기대한다. There is a growing interest in researching the plight, health, and social care needs of forced migrants and the complex ethical issues related to researching this vulnerable group. Conducting health and social care research with forced migrants is a sensitive and complex issue and can place emotional demands on contributors, requiring high ethical and moral standards which safeguard participants, researchers and the integrity of the study. Researchers and those who review research need to be sensitive to the needs, privacy and (...) fears of participants. In addition to the medical and personal benefits that can be obtained from undertaking research with forced migrants, there comes the risk of stigmatization, exploitation and harm. This paper identifies some, but by no means all, key ethical issues confronting researchers, these dilemmas include the complex issues of language and translation, immigration status, contextual issues, lack of familiarity with the research process, issues of informed consent and safeguarding anonymity. Confidentiality, sensitivity to cultural traditions and values, and avoiding re-traumatization also need to be considered as this knowledge can minimize research risks and protect the rights and welfare of research participants. This paper will draw upon experience of working with refugees and asylum seekers for many years and from experience gained from small-scale qualitative research undertaken with Somali and Ethiopian forced migrants. It argues for the need for a consistent, robust, ethical framework to ensure that the ‘researcher’ does not inadvertently ‘do harm’ by infringing on the security, privacy and well-being of the subjects of the research. This paper in turn adds to the knowledge base on good practice and research ethics and is hoped that it will provide useful guidance for those undertaking the ethical review for this type of research. Lainie Friedman Ross suggests that clinicians increase our efforts to meet children’s most basic needs in several ways. These include prioritizing, to a greater extent, children’s present and future feelings; placing greater decisional weight on other family members’ needs; spotting earlier threats from surrogate decision makers so that we can better prevent these threatened harms; and finding ways to intervene earlier so that we can allow parental surrogate decision makers to remain in this role. With the great increase in litigation, insurance costs, and consumer prices, both managers and businesses should take a proactive position in avoiding liability. Legal liability may attach when a duty has been breached; many actions falling into this category are also considered unethical. Since much of business liability is caused by a breach of a duty by a business to either an individual, another business, or to society, this article asserts that the practice of liability prevention is a practical (...) business application of ethics. Avicenna, beside his theoretical discussions about experimentation, practically applied his experimental method to natural sciences studies such as medicine, biology, and meteorology. His theoretical discussions subsume propositions concerning the conditions under which experimental knowledge is attained, the components of this knowledge and its functions. Some of these propositions are as follows: necessity of recurrent observations for acquiring experimental knowledge, certainty plus conditional universality of such knowledge, and its role as demonstrative premises. Investigating the application of his theory in natural (...) sciences propound two new features which were not elaborated in the theoretical discussions: fallibility of experimental knowledge and necessity of systematic observation. This research, using the analytic method and referring to both philosophical and scientific works of Avicenna, clarifies that a comprehensive definition of experimentation is dependent on considering extracted points from practical application of experimental knowledge, beside its theoretical components. There is much debate on how social values should influence scientific research. However, the question of practical applicability of philosophers’ normative proposals has received less attention. Here, we test the attainability of Matthew J. Brown’s (2020) Moral Imagination ideal (MI ideal), which aims to help scientists to make warranted value-judgements through reflecting on goals, options, values, and stakeholders of research. Here, the tools of the MI ideal are applied to a climate modelling setting, where researchers are developing aerosol-cloud interaction (...) (ACI) parametrizations in an Earth System Model with the broader goal of improving climate sensitivity estimation. After the identification of minor obstacles to applying the MI ideal, we propose two ways to increase its applicability. First, its tools should be accompanied with more concrete guidance for identifying how social values enter more technical decisions in scientific research. Second, since research projects can have multiple goals, examining the alignment between broader societal aims of research and more technical goals should be part of the tools of the MI ideal. Cultural congruence is the idea that to the extent a belief or experience is culturally shared it is not to feature in a diagnostic judgement, irrespective of its resemblance to psychiatric pathology. This rests on the argument that since deviation from norms is central to diagnosis, and since what counts as deviation is relative to context, assessing the degree of fit between mental states and cultural norms is crucial. Various problems beset the cultural congruence construct including impoverished definitions of culture (...) as religious, national or ethnic group and of congruence as validation by that group. However, this study and the contribution of many scholars show that environmental ethics has much to contribute to the solution of global environmental problems. Various governments and policy makers can bring the insights of environmental ethics into various natural resource management settings. The ideas of environmental ethicists have had an impact on the natural environment. Among others, the “Precautionary principle” is an ethical principle that is increasingly being embodied in the legislation of various governments. If environmental ethics broadens its scope and addresses the injustice done to the majority of poor and powerless people and to nonhuman species, it will have a paramount role in creating awareness within countries and globally about the actions of transnational corporations, irresponsible capitalist countries and local industries which damage the environment. Environmental ethicists may alert peasant farmers, pastoralists and other indigenous people to understand the long range effects of environmental degradation that are beyond the purview of local people and otherwise unavailable. Environmental ethicists with varied backgrounds can join peasant farmers and pastoralists who have multidimensional knowledge of the natural environment and help them develop further knowledge of it. The efforts of many people will one day bring change in favour of the majority of the people, nonhuman species, and the planet Earth. In fact, the paper stresses that environmental questions are not simply ethical.
