Putnam says that "In one way of conceiving it, realism is an empirical theory." In the present work it is maintained that, in another way of conceiving it, realism is a grammatical thesis. That is, many of the principles taken to be definitive of realism, e.g., "Truth is objective," "Truth is mind-independent," Dummett's "a thought can be true only if there is something in virtue of which it is true," are what Wittgenstein would have called "grammatical remarks." They simply call (...) attention to certain features of the grammar of truth and related concepts. Thus, e.g., it is a feature of the way we use "is true" that statements are not spoken of as true for one person and not true for another. ;The character of grammar and of grammatical remarks in general is spelled out in some detail; it is argued in particular that Wittgenstein is not intending to provide, by means of these notions, a particular account of necessary truth. He is suggesting, rather, that looking upon certain philosophical claims as grammatical is a way of "deflating" them, stripping them of their appearance of profundity. Neither can grammatical remarks imply substantive philosophical theses. This is why realism, conceived as comprising grammatical remarks, does not imply scepticism, as is often supposed, and is not itself a controversial or exciting doctrine. ;There are of course some controversial formulations of realism, versions which are not simply underwritten by grammar. Thus some philosophers have held that, because the truth conditions of a proposition are essentially independent of any evidence we may have for the proposition, truth may not be accessible at all. I believe, however, that Putnam has shown, by means of an argument which is instructively viewed as a grammatical investigation, that truth is accessible, at least to an "ideal" theory. ;Recent expressions of idealism are argued to provide helpful accounts of language use and understanding, but fail to establish that truth is nothing but warranted assertibility, or that it must in some sense "arise within us." Such a conclusion runs afoul of the grammar of truth, of which realism is shown to provide the proper account. (shrink)

L'ordre juridique qui se met en place, en France, aux derniers siècles du Moyen Âge a encore tout récemment été l'objet de riches débats : l'auto-développement des coutumes, l'autorité des droits savants et l'interventionnisme du roi de France ont notamment été au cœur de vives controverses historiographiques. La lecture des sources est à l'origine de querelles interprétatives, auxquelles s'ajoutent des difficultés méthodologiques que rencontrent les historiens du droit. Tandis que l'historien n'a accès qu'à une proportion infime du concret, celui-ci s'efforce (...) de combler ces lacunes, parfois même à l'aide d'une projection des catégories juridiques contemporaines. Cet anachronisme des concepts – parfois couplé à un anachronisme des faits – ne constitue-t-il pas l'un des vices rédhibitoires de la discipline? Cette méthode ne présente-t-elle pas, à l'inverse, une indéniable vertu heuristique et disciplinaire? Certains estiment alors que la théorie du droit est anhistorique, quand d'autres critiquent l'emploi par les historiens des concepts contemporains, comme la hiérarchie des normes, la souveraineté ou encore l'État. Outre de telles projections, c'est le sens donné à certains signifiants médiévaux ou modernes qui peut être relativisé, comme c'est le cas notamment pour les notions de droit positif, de droit commun ou encore de loi. Ces difficultés révèlent aussi à certains égards l'ambivalence de l'histoire du droit, écartelée entre science historique et dogmatique juridique. Background: Clinical tests for detecting central and peripheral shoulder fatigue are limited. The discrimination of these two types of fatigue is necessary to better adapt recovery intervention. The Kinematic Theory of Rapid Human Movements describes the neuromotor impulse response using lognormal functions and has many applications in pathology detection. The ideal motor control is modeled and a change in the neuromuscular system is reflected in parameters extracted according to this theory. Objective: The objective of this study was to assess whether (...) a shoulder neuromuscular fatigue could be detected through parameters describing the theory, if there is the possibility to discriminate central from peripheral fatigue, and which handwriting test gives the most relevant information on fatigue. Methods: Twenty healthy participants performed two sessions of fast stroke handwriting on a tablet, before and after a shoulder fatigue. The fatigue was in internal rotation for one session and in external rotation during the other session. The drawings consisted of simple strokes, triangles, horizontal and vertical oscillations. Parameters of these strokes were extracted according to the Sigma-Lognormal model of the Kinematic Theory. The evolution of each participant was analyzed through a U-Mann-Whitney test for individual comparisons. A Hotelling’s T² test and a U-Mann-Whitney test were also performed on all participants to assess the group evolution after fatigue. Moreover, a correlation among parameters was calculated through Spearman coefficients to assess intrinsic parameters properties of each handwriting test. Results: Central and peripheral parameters were statistically different before and after fatigue with a possibility to discriminate them. Participants had various responses to fatigue. However, when considering the group, parameters related to the motor program execution showed significant increase in the handwriting tests after shoulder fatigue. The test of simple strokes permits to know more specifically where the fatigue comes from, whereas the oscillations tests were the most sensitive to fatigue. Conclusion: The results of this study suggest that the Sigma-Lognormal model of the Kinematic Theory is an innovative approach for fatigue detection with discrimination between the central and peripheral systems. Overall, there is a possibility to implement the setting for clinics and sports personalized follow-up. (shrink)

Spinal muscular atrophy (SMA) is the most common genetic disease that causes infant mortality. Its treatment and prevention represent the paradigmatic example of the ethical dilemmas of 21st‐century medicine. New therapies (nusinersen and AVXS‐101) hold the promise of being able to treat, but not cure, the condition. Alternatively, genomic analysis could identify carriers, and carriers could be offered in vitro fertilization and preimplantation genetic diagnosis. In the future, gene editing could prevent the condition at the embryonic stage. How should these (...) different options be evaluated and compared within a health system? In this paper, we discuss the ethical considerations that bear on the question of how to prioritize the different treatments and preventive options for SMA, at a policy level. We argue that despite the tremendous value of what we call ‘ex‐post’ approaches to treating SMA (such as using pharmacological agents or gene therapy), there is a moral imperative to pursue ‘ex‐ante’ interventions (such as carrier screening in combination with prenatal testing and preimplantation genetic diagnosis, or gene editing) to reduce the incidence of SMA. There are moral reasons relating to autonomy, beneficence and justice to prioritize ex‐ante methods over ex‐post methods. (shrink)

Pre-Implantation Genetic Diagnosis represents the first fusion of genomics and assisted reproduction and the first reproductive technology that allows prospective parents to screen and select the genetic characteristics of their potential offspring. However, for some, the idea that we can intervene in the mechanisms of human existence at such a fundamental level can be, at a minimum, worrying and, at most, repugnant. Religious doctrines particularly are likely to collide with the rapidly advancing capability for science to make such interventions. This (...) paper focuses on opinions and arguments of selected religious scholars regarding ethical issues pertaining to PGD. In-depth interviews were conducted with religious scholars from three different religious organizations in the Klang Valley, Malaysia. Findings showed that Christian scholars are very sceptical of the long-term use of PGD because of its possible effect on the value of humanity and the parent-children relationship. This differs from Islamic scholars, who view PGD as God-given knowledge in medical science to further help humans understand medical genetics. For Buddhist scholars, PGD is considered to be new medical technology that can be used to save lives, avoid suffering, and bring happiness to those who need it. Our results suggest that it is important to include the opinions and views of religious scholars when it comes to new medical technologies such as PGD, as their opinions will have a significant impact on people from various faiths, particularly in a multi-religious country like Malaysia where society places high value on marital relationships and on the traditional concepts of family. In a widely acclaimed study from 2002, researchers found a case of gene-environment interaction for a gene controlling neuroenzymatic activity (low vs. high), exposure to childhood maltreatment, and antisocial personality disorder (ASPD). Cases of gene-environment interaction are generally characterized as evincing a genetic predisposition; for example, individuals with low neuroenzymatic activity are generally characterized as having a genetic predisposition to ASPD. I first argue that the concept of a genetic predisposition fundamentally misconstrues these cases of gene-environment interaction. This misconstrual will (...) be diagnosed, and then a new concept—interactive predisposition—will be introduced. I then show how this conceptual shift reconfigures old questions and raises new questions for genetic screening. Attempts to screen embryos or fetuses for the gene associated with low neuroenzymatic activity with an eye towards selecting against the low-activity variant fall prey to the myth of pre-environmental prediction; attempts to screen newborns for the gene associated with low neuroenzymatic activity with an eye towards early intervention will have to face the interventionist’s dilemma. Looking at responsibility within a Lévinasian sense, human beings are firstly seen not in the philosophically traditional sense, of being egocentric, but rather seen as ethical subjects based on “the other” (Lévinas & Hand, 1989). The purpose of this paper is to examine the notion of responsibility as Lévinas conceptualized in the idea that human beings are responsible for not only themselves but for others. Lévinas within “Ethics as First Philosophy” (Lévinas & Hand, 1989) states that before all other forms (...) of being in the world there must be responsibility to the Other (Lévinas & Hand, 1989). Lévinas defines this to mean that before freedom of the subject, and their subjectivity, before self-consciousness, before the consciousness of consciousness, before being, and before relativity there is “responsibility for the Other pre-exists any self-consciousness” (Lévinas & Hand, 1989, p.75). Perhaps, Lévinas is saying that a human beings obligation comes before all of what follows from our being in this world, our obligation to the Other beginning with the “face to face” (Lévinas & Hand, 1989, p.75), interaction, which is our first and foremost responsibility, the responsibility to the Other. And to be ethical beings who begin with responsibility we rely on the fundamental relationship of others. This notion of responsibility appears when we encounter, in the face-to-face interaction, the unknowable other. However, does this responsibility extend to more than two individuals and to those outside our immediate proximity? For example, Lévinas states that it is the “face to face” notion of seeing one in distress, yet what if it is a group of people, and what if they are not in close proximity but on the other side of the world? What if they are on the other side of a screen that can also be artificial intelligence in our modern era. Are we still responsible? And if we are responsible, how does Lévinas’s concept of responsibility fit into that situation or is it limited? I want to examine responsibility in terms of proximity through a Lévinasian ethical lens and plurality, defined as more than two individuals, by questioning responsibility in terms of relationality, and vulnerability. I will be looking mainly at five authors Emmanuel Lévinas, Ernst Van Alphen, Judith Butler, Kevin Quashi, and Lisa Guenther, to answer the question of whether Lévinas’s definition of responsibility includes proximity, and plurality. BackgroundCarrier screening is generally performed with the aim of identifying healthy couples at risk of having a child affected with a monogenic disorder to provide them with reproductive options. Expanded carrier screening, which provides the opportunity for multiple conditions to be screened in one test, offers a more cost-effective and comprehensive option than screening for single disorders. However, implementation of ECS at a population level would have implications for genetic counseling practice.MethodsWe conducted semi-structured interviews with sixteen European (...) clinical and molecular geneticists with expertise in carrier screening to explore their views on the implementation of ECS in the clinical setting.ResultsUsing inductive content analysis, we identified content categories relevant to the pre- and post-test settings. Participants believed ECS would ideally be targeted at couples before pregnancy. There was some disagreement regarding the acceptability of performing ECS in individuals, with several participants actively opposing individual-based screening. In addition, participants discussed the importance of ensuring informed and voluntary participation in ECS, recommending measures to minimize external pressure on prospective parents to undergo testing. A need for adequate counseling to foster informed, autonomous reproductive decision-making and provide support for couples found to be at risk was emphasized.ConclusionsPractical challenges in optimizing pre-test education and post-test counseling should not be underestimated and they should be carefully addressed before implementing ECS in the clinical setting. I offer an alternative account of modal harms based on counterpart theory such as that offered by David Lewis (1986). On this account, individuals can make legitimate harm claims in regard to pre-conception choices made in determining their genetic constitution by appeal to their counterparts across possible worlds. A hallmark of good antenatal care is to respect prospective parent’s choices and provide information in a way that encourages their autonomy and informed decision making. In this paper, we analyse the meaning of autonomous and informed decision making from the theoretical perspective and attempt to show how those concepts are described among prospective parents in early pregnancy and in the public media in a society where NT screening is almost a norm. We use interviews with Icelandic prospective parents (...) in early pregnancy (N = 40) and material covering the discourse around prenatal screening in the media over 5 years period. Our analysis indicates that both prospective parents and the public media include ethical terms in their rhetoric around prenatal screening although those concepts differ in their expression. We conclude that the context in which these decisions are taken does not encourage moral reflection. Prospective parents describe that there is a lack of dialogue with professionals when decisions are made about screening. With routine offer of screening the conceptualization of bioethical concepts finds its own way through a mainstream discourse which has limited connections to the theoretical notions. This has been neglected in the implementation of screening, as limited effort has been subject to audit with reference to explore how the offer of screening and informed choice is experienced among prospective parents. It is a puzzling fact that the Greek term for Nature ‘physis’ could be used to refer to i) reality as a whole, ii) the nature of something, iii) to individual material beings or materiality and iv) all things that are self-generating. In order to understand and tie together this wide array of possible meanings, I will consider the thesis that ‘physis’ was in fact used as a concept of being, a term naming the fundamental property of all of reality (...) in the early pre-Socratics, poets and scientists before 500 BCE. Investigating ‘physis’ in this way can give us a way of thinking about Nature as a dynamic and creative but material process that goes far beyond the classical understanding of Nature as the sum of things that self-generate or the modern mathematical understanding of Nature born with Galileo, dominant to this day. The aim of the article is to outline an interpretation of the philosophical understanding of the concept of the good in pre-Platonic thought. The interpretation is based on those fragments only in which the concept actually appears. As a result of the adopted assumption, the ideas of the first philosophers, i.e. Thales, Anaximander and Anaximenes, were outside the scope of the investigation, as well as those of Xenophanes, Eleatics, Empedocles, Anaxagoras and Leucippus. In the case of the first philosophical systems (...) of the pre-Platonic philosophy one notices a connection between the good and the One. It can also be found that understanding of the `the Best' is depended on, and results from, ‘the good’. This is true also in Heraclitus, though, at the same time, he introduces an significant reversal in this respect, for he abolishes the absolute difference between the good and evil, and turns it to a subjective relation. The good has no ontological basis in the Democritus' system as well, though the good’s connection with truth, accessible for every human being, allows to interpret him as arguing for an objectivistic conception of the good. In this second chapter of the book 'Human Dignity in the Judaeo-Christian Tradition' the case is made that human dignity is a concept which is also rooted outside this tradition, namely in the philosophical and educational tradition of Greek and Roman Antiquity. It was to this tradition that the Renaissance and the Enlightenment appealed with their concept of human dignity, and the commitment to the concept in modern human rights and constitutional legislation too is indebted to it. The chapter traces (...) the concept from early Greek legal sources via early philosophical documents to Plato and Aristotle and the Hellenistic philosophical schools down to Cicero, where it finds its most philosophical and idealistic expression. The presence of the concept in classical Greek and Roman thought calls in question the view, frequently heard today, that human dignity is a faith-based concept without any basis in philosophical reflection. Instead it demonstrates that even a materialistic philosophy such as Epicureanism was unable to speak adequately of the human being and its place in the universe without raising the question of its unique nature and destiny. During the coronavirus disease 2019 (COVID‐19) pandemic, bioethical analyses often emphasized population health and societal benefit. Hospital policies frequently focused on reducing risk of transmitting SARS‐CoV‐2 by restricting visitors; requiring protective equipment; and screening staff, patients and visitors. While restrictions can be burdensome, they are often justified as essential measures to protect the whole population against a virus with high rates of transmission, morbidity and mortality. Yet communities are not monolithic, and the impacts of these restrictions affect different groups (...) differently. An ophthalmological unit outreach program in Ethiopia serves to illustrate. Pre‐operative screening policies were designed to protect as many patients as possible but had adverse impacts on underserved communities. As this case study demonstrates, creating hospital policies that truly serve the good of the society may require a more holistic review of impacts on inequitably positioned communities. (shrink)

In this paper I argue, contrary to Chad Hansen’s view , that pre-Han 漢 Chinese philosophy has the semantic concept of truth. Hansen argues that, first, pre-Han Chinese thinkers do not have motivations to introduce the concept of truth in their philosophy due to their peculiar theory of language; second, the concept does not fit well with philosophical texts at that time, and in particular, the Mozi 墨子 text about the three standards of doctrine. However, I argue that Chinese thinkers (...) indeed have reasons to introduce the concept of truth. Hansen’s reading of the three standards of doctrine takes the standards as standards of correct word use, thus attributing to the authors of the Mozi an understanding of yan 言 as something without complete propositional content. However, I argue, a reading that sees the three standards as standards for something with complete propositional content explains better the passages in which the authors apply the standards to various issues. Finally I argue that the term ran 然 is sometimes used as a truth predicate in classical Chinese texts, because it has several important features identical to that of the truth predicate “is true” in English. The continuing existence and operation of the traditional law of Aboriginal and Torres Strait Islander peoples has – relatively recently – been explicitly acknowledged in Australian law. In emerging case law on the subject, the High Court of Australia has confirmed the common law recognition of the survival of Indigenous Australian law. However, in determining what it is that is recognized by the common law – in interpreting Indigenous Australian ‘traditional laws and customs’ – the High Court has disregarded the (...) knowledge reposed in those with authority or expertise in Indigenous Australian law, relying instead upon concepts and assumptions from the jurisprudence of English legal philosopher, HLA Hart. The influence of Hart’s theory in the Australian High Court’s interpretation of Indigenous Australian ‘traditional laws and customs’ is problematic, because it contains an obvious pre-legal–legal dualism reminiscent of the ‘state of nature’ – ‘civil society’ mechanism that was instrumental in the application of terra nullius to Australia. At the heart of The Concept of Law lies the notion of progression from a ‘primitive community’ with only primary rules, to an advanced legal system with a combination of both primary and secondary rules. In this article, I investigate how Indigenous Australians are positioned in relation to Hart’s pre-legal–legal dualism. I examine the ‘primitive’, pre-legal society in The Concept of Law, and its counterpart, the advanced legal system, to analyze the position of Indigenous Australian societies and law in Hart’s scheme. Finally, I analyze the construction of the dualism and consider its impact on the High Court’s interpretation of Indigenous Australian ‘traditional laws and customs’. (shrink)

In the debate surrounding the introduction of non-invasive prenatal testing in prenatal screening programmes, the concept of routinisation is often used to refer to concerns and potential negative consequences of the test. A literature analysis shows that routinisation has many different meanings, which can be distinguished in three major versions of the concept. Each of these versions comprises several inter-related fears and concerns regarding prenatal screening and particularly regarding NIPT in three areas: informed choice, freedom to choose and (...) consequences for people with a disability. Three of the strongest arguments raised under the flag of routinisation are assessed for their validity: the threat that NIPT poses to informed choice, the potential increase in uptake of first-trimester prenatal screening and its consequences for social pressure to participate in screening or terminate affected pregnancies, and the negative consequences for disabled people. These routinisation arguments lack empirical or normative ground. However, the results of this analysis do not imply that no attention should be paid to possible problems surrounding the introduction of NIPT. At least two problems remain and should be addressed: there should be an ongoing debate about the requirements of informed choice, particularly related to an expanded scope of prenatal screening. Also, reproductive autonomy can only be achieved when expecting parents’ options are variegated, real and valuable, so that they can continue to choose whether or not to screen or to terminate a pregnancy. The conceptual changes of Jian儉 in the pre-Qin period were the results of changes in the social and political structure. It originally referred to Jian virtue, which was a kind of political norm of clan states. This required the aristocrats to be moderate in accordance with the patriarchal hierarchy and generously share their wealth with their own clansmen. The opposite of Jian virtue is Tan and Chi. In the middle of the Spring and Autumn Period, many states formed their politics (...) based on ministerial families. The aristocrats glorified greed and extravagance as Fu, and stigmatized Jian virtue as Pin. After the collapse of the clan-based state order, the states in the Warring States Period gradually developed into territorial states, and the institutional political norm became a new, abstract concept, indicated by the compound Jian Yue and was used to describe the consumption attitudes of individuals and families. Meanwhile, with the increase of social mobility, the pursuit of riches was highly popular in the ideological world. The new expression of “means-ends” advocated by Legalists, which stipulated that individuals and families acquire wealth through Jian Yue, took shape and endures to this day. (shrink)

L'oeuvre d'art sur laquelle " philosophe " Olivier Revault d'Allonnes n'est pas l'oeuvre achevee, celebree, sacralisee, sanctifiee, mais au contraire l'oeuvre qui, de tout temps, deroute, irrite, scandalise, dejoue le discours apprete et conciliant de l'esthetique traditionnelle. Le concept est l'autre nom de la critique, parole enfin donnee aux oeuvres, passees et presentes, afin qu'elles puissent dire non aux ordres etablis... Leur interpretation se (...) joue donc a l'infini, mais non pas dans l'indetermination, car ce qu'elles expriment, qu'il s'agisse d'un tableau de Rembrandt, d'un quatuor de Beethoven, ou d'une piece pour piano de Schonberg, est chaque fois identique, a savoir l'irreductible et " irrespectueuse " liberte de la creation artistique. Cette esthetique, a l'ecart des dogmatismes, des systemes et des modes, est ici pretexte aux reflexions et aux temoignages qui composent cet ouvrage. (shrink)

Obwohl in der Forschung es nicht selten ist, Heideggers Gedanken im Lichte des Verhältnisses zwischen Theorie und Praxis zu betrachten, benimmt Heidegger sich selbst gegen diese Dichotomie. Um die Kritik Heideggers an dieser Dichotomie und seine Konzeption der ursprünglichen Einheit zwischen Theorie und Praxis zu verstehen, muss auf Heideggers Lektüre der aristotelischen praktischen Philosophie zurückgeführt werden. Es wird zu zeigen versucht, dass Heideggers Ontologisierung der Praxis darauf abzielt, den vortheoretischen Praxisbegriff, der im Unterschied zur Einheit von Theorie und Poiesis ist, (...) herauszuarbeiten. Die Ontologisierung kommt durch die Methode der formalen Anzeige zustande, die in diesem Sinne im Mittelpunkt Heideggers Philosophie steht. (shrink)

Brandon ([1982] 1984, 1990) has argued that Salmon's (1971) concept of screening-off can be used to characterize (i) the idea that natural selection acts directly on an organism's phenotype, only indirectly on its genotype, and (ii) the biological problem of the levels of selection. Brandon also suggests (iii) that screening-off events in a causal chain are better explanations than the events they screen off. This paper critically evaluates Brandon's proposals.

The advent of new genetic and genomic technologies may cause friction with the principle of respect for autonomy and demands a rethinking of traditional interpretations of the concept of informed consent. Technologies such as whole‐genome sequencing and micro‐array based analysis enable genome‐wide testing for many heterogeneous abnormalities and predispositions simultaneously. This may challenge the feasibility of providing adequate pre‐test information and achieving autonomous decision‐making. At a symposium held at the 11th World Congress of Bioethics in June 2012 (Rotterdam), organized by (...) the International Association of Bioethics, these challenges were presented for three different areas in which these so‐called ‘new genetics’ technologies are increasingly being applied: newborn screening, prenatal screening strategies and commercial personal genome testing. In this article, we build upon the existing ethical framework for a responsible set‐up of testing and screening offers and reinterpret some of its criteria in the light of the new genetics. As we will argue, the scope of a responsible testing or screening offer should align with the purpose(s) of testing and with the principle of respect for autonomy for all stakeholders involved, including (future) children. Informed consent is a prerequisite but requires a new approach. We present preliminary and general directions for an individualized or differentiated set‐up of the testing offer and for the informed consent process. With this article we wish to contribute to the formation of new ideas on how to tackle the issues of autonomy and informed consent for (public) healthcare and direct‐to‐consumer applications of the new genetics.
