In this paper, the author develops an instrument for the rational reconstruction of argumentation in which a judicial decision is justified by referring to the consequences in relation to the purpose of the rule. The instrument is developed by integrating insights from legal theory and legal philosophy about the function and use of arguments from consequences in relation to the purpose of a rule into a pragma-dialectical framework. Then, by applying the instrument to the analysis of examples (...) from legal practice, it is demonstrated that the instrument can offer a heuristic and critical tool for the analysis and evaluation of legal argumentation that can ‘bridge’ the gap between more abstract discussions of forms of legal argumentation on the one hand, and legal arguments as they occur in actual legal practice on the other hand. We aim to compile some means for a rational reconstruction of a named part of the start-over of Baruch (Benedictus) de Spinoza's metaphysics in 'de deo' (which is 'pars prima' of the 'ethica, ordine geometrico demonstrata' ) in terms of 1st order model theory. In so far, as our approach will be judged successful, it may, besides providing some help in understanding Spinoza, also contribute to the discussion of some or other philosophical evergreen, e.g. 'ontological commitment'. For this (...) text we assume the reader familiar with 'de deo' as well as with some basic concepts and results of 1st order model theory. Before we start reconstruction, we will first revisit shortly the concept of 'attributum' (definitio IV) in it's setting in 'de deo' , next scan for formalizable aspects of 'in suo genere finita' ('de deo', definitio II), subsequently list the model theoretic constructs we will make use of. Then we begin reconstruction by stating "coordinative definitions" for the notions of 'attribute (of a substance)', 'modus (as conceived via an attribute)' and 'substance (as conceived via an attribute)', reasoning shortly for each of them. The "coordinative definitions", we will arrive at, must not be understood as literal translations of Spinoza's concepts - of course, there can't be such a thing as a literal translation - they are meant as formal analoga of these concepts, mapping some logical structure. But even with this caveat they may seem strange to the reader at this stage of discussion. In this contribution the author develops an argumentation model for the reconstruction of weighing and balancing on the basis of teleological-evaluative considerations. The model is intended as a heuristic and critical tool for the rational reconstruction of the justification of judicial decisions. From the perspective of a rational discussion, it makes explicit the choices underlying the weighing and balancing on the basis of goals and values so that they can be made explicit and submitted to (...) rational critique. This paper concerns the rational reconstruction of physical theories initially advanced by F. P. Ramsey and later elaborated by Rudolf Carnap. The Carnap–Ramsey reconstruction of theoretical knowledge is a natural development of classical empiricist ideas, one that is informed by Russell's philosophical logic and his theories of propositional understanding and knowledge of matter ; as such, it is not merely a schematic representation of the notion of an empirical theory, but the backbone of a general account of (...) our knowledge of the physical world. A method of linguistically-oriented reasoning comprehension is proposed. It is based on semiological principles of text comprehension. Both content and form are essential for comprehending argumentative texts. A text recipient is viewed as a rational judge trying to detect all the components of the argument he/she considers and thus to see if the argument is consistent. Elementary and higher level argumentative units of the text are discovered by applying a modified S. Toulmin's model of argumentative functions. The paper considers the role of modality in the rational reconstruction of standpoints and arguments. The paper examines in what conditions modal markers can act as argumentative indicators and what kind of cues they provide for the reconstruction of argument. The paper critically re-examines Toulmin’s hypothesis that the meaning of the modals can be analyzed in terms of a field-invariant argumentative force and field-dependent criteria in the light of the Theory of Relative Modality developed within linguistic semantics, (...) showing how this theory can provide a more adequate model for exploiting the modals as indicators. The resulting picture confirms Toulmin’s intuition only in part: on the one hand the modals are always relational in nature and dependent on a contextual conversational background of propositions; on the other hand only epistemic-doxastic modals directly express a speech-act level inferential relation between a set of premises and a standpoint. Other modalities express relations (e.g. causal or final relations) better seen as part of the content of the argument whose argumentative relevance depends on the argumentation scheme employed. Thus non-epistemic modals function as argumentative indicators only indirectly. (shrink)

In modern argument theory argumentative practice is often analyzed and evaluated in terms of its correspondences with or deviations from a normative model. Such a methodology implies that there are three moments at which evaluations takes place which are not guided by the norms of the model itself because they imply an interpretation of the model by the analyst. This is demonstrated by an analogy with legal practice. this implies that an evaluation of an argumentative practice is not only relative (...) to choice of the normative model as such, but also relative to the threefold interpretation of the model. The Eurotransplant Kidney Allocation System (ETKAS) emerged from the XCOMB model by Wujciak and Opelz (1993a,b), who applied computer simulation studies to create an allocation algorithm. The present study investigated how experts would allocate a donated organ to patients on the waiting list with respect to the five allocation factors proposed in the ETKAS (number of mismatches, mismatch probability, waiting time, distance, international exchange balance). The experts’ evaluations were compared to the ETKAS points as well as to factor weights established (...) in mandatory allocation guidelines which are based on the German law for organ allocation (Transplantationsgesetz). The investigation was carried out using a conjoint analysis. Overall, the results indicate a fairly high degree of agreement between the experts’ opinions and the existing allocation system ETKAS and even more so for the allocation guidelines, in particular, with respect to the factors Mismatches, Mismatch probability, and Waiting time. The essays in Powerful Arguments reconstruct the standards of validity underlying argumentative practices in a wide array of late imperial Chinese discourses, from the Song through the Qing dynasties. The fourteen case studies analyze concrete arguments defended or contested in areas ranging from historiography, philosophy, law, and religion to natural studies, literature, and the civil examination system. By examining uses of evidence, habits of inference, and the criteria by which some arguments were judged to be more persuasive than others, the (...) contributions recreate distinct cultures of reasoning. Together, they lay the foundations for a history of argumentative practice in one of the richest scholarly traditions outside of Europe and add a chapter to the as yet elusive global history of rationality. "Habermas introduces the concept of “reconstructive science” with a double purpose: to place the “general theory of society” between philosophy and social science and reestablish the rift between the “great theorization” and the “empirical research”. The model of “rational reconstructions” represents the main thread of the surveys about the “structures” of the life-world (“culture”, “society” and “personality”) and their respective “functions” (cultural reproductions, social integrations and socialization). For this propose, the dialectics between “symbolic representation” of “the structures subordinated to (...) all worlds of life” (“internal relationships”) and the “material reproduction” of the social systems in their complex (“external relationships” between social systems and environment) has to be considered. This model finds an application, above all, in the “theory of the social evolution”, starting from the reconstruction of the necessary conditions for a phylogeny of the socio-cultural-life forms (the “hominization”) until an analysis of the development of “social formations”, which Habermas subdivides into primitive, traditional, modern and contemporary formations. This paper is an attempt, primarily, to formalize the model of “reconstruction of the logic of development” of “social formations” summed up by Habermas through the differentiation between vital world and social systems (and, within them, through the “rationalization of the life-world” and the “growth in complexity of the social systems”). Secondly, it tries to offer some methodological clarifications about the “explanation of the dynamics” of “historical processes” and, in particular, about the “theoretical meaning” of the evolutional theory’s propositions. Even if the German sociologist considers that the “ex-post rational reconstructions” and “the models system/environment” cannot have a complete “historiographical application”, these certainly act as a general premise in the argumentative structure of the “historical explanation”.". Feature structures are employed in various forms in many areas of linguistics. Informally, one can picture a feature structure as a sort of tree decorated with information about constraints requiring that specific subtrees be identical (isomorphic). Here I show that this informal picture of feature structures can be used to characterize exactly the class of feature structures under their usual subsumption ordering. Furthermore, once a precise definition of tree is fixed, this characterization makes use only of standard domain-theoretic notions regarding (...) the information borne by elements in a domain, thus removing (or better, explaining) all apparentlyad hoc choices in the original definition of feature structures. In addition, I show how this characterization can be parameterized in order to yield similar characterizations of various different notions of feature structure, including acyclic structures, structures with appropriateness conditions and structures with apartness conditions (used to model path inequations). The generalizations to other notions of feature structure also emphasize that the construction given here is in fact independent of the application to feature structures. (shrink)

It is a popular view thatpractical deliberation excludes foreknowledge of one's choice. Wolfgang Spohn and Isaac Levi have argued that not even a purely probabilistic self-predictionis available to thedeliberator, if one takes subjective probabilities to be conceptually linked to betting rates. It makes no sense to have a betting rate for an option, for one's willingness to bet on the option depends on the net gain from the bet, in combination with the option's antecedent utility, rather than on the offered (...) odds. And even apart from this consideration, assigning probabilities to the options among which one is choosing is futile since such probabilities could be of no possible use in choice. The paper subjects these arguments to critical examination and suggests that, appearances notwithstanding, practical deliberation need not crowd outself-prediction. (shrink)

Minimal adversariality consists in the opposition of contradictory conclusions in argumentation, and its usual metaphorical expression as a game between combating arguers has seen it be criticized from a number of perspectives: the language used, whether cooperation best attains the argumentative telos of epistemic betterment, and the ideal nature of the metaphor itself. This paper explores primarily the idealization of deductive argumentation, which is problematic due to its attenuated applicability to a dialectic involving premises and justificatory biases that (...) are left hidden and unelucidated. To clarify the issue and offer up a solution, we consider minimal adversariality as an involuntary state of affairs before relating this interpretation to a link between rational persuasion and the attainment of epistemic betterment. Through this we see how the idealizing tendencies of minimal adversariality can be reduced even in argumentation involving premises whose justifications for any arguer are inaccessible to any other arguer. This paper examines critically Kretzmann's reconstruction of the project of natural theology as exemplified by Aquinas's Summa Contra Gentiles. It is argued that the notion of natural theology, as understood and advocated by Kretzmann, is particularly indebted to the epistemologically biased natural theology of modernity with its focus on rational justification of theistic belief. As a consequence, Kretzmann's view of the arguments for the existence of God and their place within Aquinas's theological project is insufficiently sensitive to the (...) ontological conception of truth and intelligibility which underlies the argumentation. From his epistemological point of view Kretzmann differs from Aquinas in two aspects. First, he contends that it is not necessary to establish the existence of God with absolute certainty at the outset; one may begin with the hypothesis that there is a God. Second, the arguments do not yet conclude to the existence of God in the specific theistic sense; they show at most the existence of a primary explanatory entity, which may be identified with God later on. Both claims are criticized in the light of a discussion of Aquinas's theological method. (shrink)

This paper contrasts a picoeconomic approach to theexplanation of akrasia with Davidson's divided-mind approach and defends theformer in a wider context. The distinctive merits of a picoeconomic model of mindlie in the following aspects: First, it relies on a scientifically well-groundeddiscovery about motivational dynamics of animals for its explanation of preference change,which elucidates or materializes some philosophers' speculations both about thepossible mismatch between valuation and motivation and about the relevance of temporalfactors to akrasia. Second, it grounds the necessity of endogenous (...) higher-order constraints,expressible in forms of judgment, in an intrapersonal dynamic process of interactivefirst-order temporary preferences. The paper draws on scientific resources formed around the notion of Free Energy Principle to reconstruct two well-known defences of panpsychism. I reconstruct the argument from continuity by expanding the mind-life continuity thesis under the rubric of the Free Energy Principle (FEP), by showing that FEP does not provide an objective criterion for demarcating the living from the inanimate. Then I will reconstruct the argument from intrinsic nature. The FEP-based account of consciousness is centred on the notion of ‘temporal depth’ (...) of generative models. I argue that even evolution can be modelled as a temporally deep system. Since we have no access to the intrinsic perspective of evolution to see whether or not it models itself as a temporally deep system, we must draw an analogy from our own case and conclude that evolution is consciousness involving. Thus the paper reconstructs two main arguments for panpsychism. (shrink)

Here, for the first time in English, is volume one of Jurgen Habermas's long-awaited magnum opus: The Theory of Communicative Action. This pathbreaking work is guided by three interrelated concerns: to develop a concept of communicative rationality that is no longer tied to the subjective and individualistic premises of modern social and political theory; to construct a two-level concept of society that integrates the 'lifeworld' and 'system' paradigms; and to sketch out a critical theory of modernity that explains its sociopathologies (...) in a new way. Habermas approaches these tasks through a combination of conceptual analyses, systematic reflections, and critical reconstructions of such predecessors as Marx and Weber, Durkheim and Mead, Horkheimer and Adorno, Schutz and Parsons. Reason and the Rationalization of Society develops a sociological theory of action that stresses not its means-ends or teleological aspect, but the need to coordinate action socially via communication. In the introductory chapter Habermas sets out a powerful series of arguments on such foundational issues as cultural and historical relativism, the methodology of Verstehen, the inseparabilty of interpretation from critique. In addition to clarifying the normative foundations of critical social inquiry, this sets the stage for a systematic appropriation of Weber's theory of rationalization and its Marxist reception by Lukacs, Horkheimer and Adorno. There are some premise-by-premise reconstructions in political philosophy which are flawed, because they omit at least one premise or misword at least one premise. This paper focuses on a reconstruction by Richard Child. The original argument is by Andrea Sangiovanni and is about whether egalitarian values of distributive justice apply both within a state and globally. Child’s reconstruction has been reproduced in a paper by Ian Davis, who approves of it. But I point out five logical problems with (...) the reconstruction. (shrink)

Although the controversy between Malthus and Ricardo has long been considered to be an important source for the history of economic thought, it has hardly been the object of a careful study qua controversy, i.e. as a polemical dialogical exchange. We have undertaken to fill this gap, within the framework of a more ambitious project that places controversies at the center of an account of the history of ideas, in science and elsewhere. It is our contention that the dialogical co-text (...) is essential for reconstructing the meaning and the evolution of science. In the present paper we try to substantiate this contention by means of a pragma-rhetorical study of this particular controversy. First, we reconstruct, through an analysis of a chunk of the correspondence, a micro-level of specific moves and countermoves which constitute a sequential structure within which also meta-scientific and meta-controversial considerations play a role. We then move to a macro-level of analysis, looking for recurrent patterns of argumentation. Finally, we draw epistemological conclusions on the nature of rationality and progress as manifested in actual scientific controversies. (shrink)

In this paper a candidate for a rational reconstruction of skeptical arguments is presented and defended against a competitor called ‘The Argument from Ignorance’. On the basis of this defense, Michael Williams’ claims that foundationalism and epistemological realism serve as presuppositions for skepticism are criticized. It is argued that rejecting these two theses, as his version of contextualism does, is not sufficient for answering the skeptical challenge.

Reasons internalists claim that facts about normative reasons for action are facts about which actions would promote an agent’s goals and values. Reasons internalism is popular, even though paradigmatic versions have moral consequences many find unwelcome. This article reconstructs an influential but understudied argument for reasons internalism, the “if I were you” argument, which is due to Bernard Williams and Kate Manne. I raise an objection to the argument and argue that replying to it requires reasons internalists to accept controversial (...) metaethical or epistemological commitments with which their theory has not traditionally been associated. Rawls offers three arguments for the priority of liberty in Theory, two of which share a common error: the belief that once we have shown the instrumental value of the basic liberties for some essential purpose (e.g., securing self-respect), we have automatically shown the reason for their lexical priority. The third argument, however, does not share this error and can be reconstructed along Kantian lines: beginning with the Kantian conception of autonomy endorsed by Rawls in section 40 of Theory, we (...) can explain our highest-order interest in rationality, justify the lexical priority of all basic liberties, and reinterpret Rawls’ threshold condition for the application of the priority of liberty. Perhaps unsurprisingly, this Kantian reconstruction will not work within the radically different framework of Political Liberalism. (shrink)

In this paper, we discuss formal reconstructions of Anselm’s ontological argument. We first present a number of requirements that any successful reconstruction should meet. We then offer a detailed preparatory study of the basic concepts involved in Anselm’s argument. Next, we present our own reconstructions—one in modal logic and one in classical logic—and compare them with each other and with existing reconstructions from the reviewed literature. Finally, we try to show why and how one can gain a better understanding (...) of Anselm’s argument by using modern formal logic. In particular, we try to explain why formal reconstructions of the argument, despite its apparent simplicity, tend to become quite involved. (shrink)

In this essay, I will examine Broome’s argument in Weighing Goods (1991; sections 5.4 and 5.5) that aims to show that moderate Humeanism, according to which any coherent sets of preferences should be rationally acceptable, is not a sustainable view of decision theory. I will focus more specifically on the argument Broome uses to support his claim, and show that although it may get some traction, it does not undermine moderate Humeanism as we know it. After reconstructing Broome’s argument, I (...) argue that standard decision theory supposes that the representation of a decision problem fully captures what is relevant to the agent, and therefore has nothing to say about the legitimacy of the representation in question. I argue that although Broome’s criticism does not jeopardize moderate Humeanism, it does pave the way for a new area of research in decision theory. (shrink)

There has been much recent work in philosophy of science on idealization – the way inaccurate representations can be used to understand a target system. My dissertation concerns a particular sort of idealization that is familiar but often overlooked: rational reconstruction. Rational reconstructions are “cleaned-up” – more coherent and accurate – versions of an individual’s or a group’s attitudes. They are the kind of idealized model that facilitates a crucial aim of the interpretive sciences, the understanding of (...) another’s point of view. I provide an account of rational reconstruction and argue that such an account can help us make sense of many intellectual projects in the humanities and the interpretive social sciences. I then argue that this account can also be used to resolve a problem in democratic theory: how deliberative institutions can facilitate understanding and discursive engagement with “inchoate” points of view. A theory of rational reconstruction thus elucidates an important way that the humanities and interpretive social sciences can be politically significant. (shrink)

Dado que hay dos formas de concebir la racionalidad y la justificación epistémicas, a saber, la internalista y la externalista, cabe preguntarse ¿de qué modo tales argumentos afectan al teísmo? El objetivo de este artículo es responder a esta cuestión mediante una reconstrucción y evaluación de tres argumentos evolutivos desacreditadores subproductistas contra (...) la racionalidad del teísmo que Dennett sostendría. Sostendré que solo uno de los tres argumentos de Dennett es posiblemente válido. igualmente, mostraré que el argumento adicional del sesgo cognitivo es probablemente exitoso en socavar la justificación internalista y externalista del teísmo. Finalmente, mostraré que estos argumentos evolutivos desacreditadores pueden ser invalidados indirectamente a partir del argumento evolutivo desacreditador en contra del naturalismo desarrollado por Plantinga, al cual se le puede contraponer el argumento lógico cancelador de la epistemología reformada.Recently, the cognitive science of religion has allowed the development of evolutionary debunking arguments, which seek to challenge not only rationality but the truth of theism. Since there are two ways of conceiving epistemic rationality and justification, viz., the internalist and the externalist, one may wonder ¿how such arguments affect theism? The purpose of this article is to answer this question through a reconstruction and evaluation of three evolutionary debunking arguments against the rationality of theism that Dennett would hold. I will argue that only one of the three Dennett's evolutionary debunking arguments is possibly valid. I will also show that the argument of cognitive bias is probably successful in undermining both the internalist and externalist justification of theism, under certain conditions. Finally, I will show that this arguments can be indirectly disproved from evolutionary argument against naturalism developped by Plantinga, argument to which one can counterpose logical defeater argument against the reformed epistemology. What if gravity satisfied the Klein-Gordon equation? Both particle physics from the 1920s-30s and the 1890s Neumann-Seeliger modification of Newtonian gravity with exponential decay suggest considering a "graviton mass term" for gravity, which is _algebraic_ in the potential. Unlike Nordström's "massless" theory, massive scalar gravity is strictly special relativistic in the sense of being invariant under the Poincaré group but not the 15-parameter Bateman-Cunningham conformal group. It therefore exhibits the whole of Minkowski space-time structure, albeit only indirectly concerning volumes. Massive (...) scalar gravity is plausible in terms of relativistic field theory, while violating most interesting versions of Einstein's principles of general covariance, general relativity, equivalence, and Mach. Geometry is a poor guide to understanding massive scalar gravity: matter sees a conformally flat metric due to universal coupling, but gravity also sees the rest of the flat metric in the mass term. What is the 'true' geometry, one might wonder, in line with Poincaré's modal conventionality argument? Infinitely many theories exhibit this bimetric 'geometry,' all with the total stress-energy's trace as source; thus geometry does not explain the field equations. The irrelevance of the Ehlers-Pirani-Schild construction to a critique of conventionalism becomes evident when multi-geometry theories are contemplated. Much as Seeliger envisaged, the smooth massless limit indicates underdetermination of theories by data between massless and massive scalar gravities---indeed an unconceived alternative. At least one version easily could have been developed before General Relativity; it then would have motivated thinking of Einstein's equations along the lines of Einstein's newly re-appreciated "physical strategy" and particle physics and would have suggested a rivalry from massive spin 2 variants of General Relativity. The Putnam-Grünbaum debate on conventionality is revisited with an emphasis on the broad modal scope of conventionalist views. Massive scalar gravity thus contributes to a historically plausible rational reconstruction of much of 20th-21st century space-time philosophy in the light of particle physics. An appendix reconsiders the Malament-Weatherall-Manchak conformal restriction of conventionality and constructs the 'universal force' influencing the causal structure. Subsequent works will discuss how massive gravity could have provided a template for a more Kant-friendly space-time theory that would have blocked Moritz Schlick's supposed refutation of synthetic _a priori_ knowledge, and how Einstein's false analogy between the Neumann-Seeliger-Einstein modification of Newtonian gravity and the cosmological constant \Lambda generated lasting confusion that obscured massive gravity as a conceptual possibility. This essay presents a commentary on and rational reconstruction of Stephen Heath's influential and groundbreaking essay from 1976: “On screen, in frame: Film and ideology.” As a commentary, it attempts to make explicit the implicit assumptions behind Heath's dense and challenging essay; rewrite and clarify his inexact formulations; and develop a microanalysis of the essay's language. As a rational reconstruction, this essay follows Rudolf Botha's philosophical study into the conduct of inquiry to analyze Heath's formulation of (...) conceptual and empirical problems and the strategies he uses to deproblematize them. This rational reconstruction rearranges the parts of Heath's essay according to the four central activities Botha identifies in the formulation of theoretical problems: 1) identifying the problematic state of affairs; 2) describing the problematic state of affairs; 3) constructing problems; and 4) evaluating problems according to well-formedness and significance. The result is a close reading of Heath's essay that reveals in minute detail his reasoning strategies, and highlights how he revolutionized film theory by attempting to integrate Lacanian psychoanalysis and Althusserian Marxism into continental semiotics, under the influence of Kristeva's theories of the signifying practice and the subject-in-process. The analysis of multimodal argumentation in advertising is a crucial and problematic area of research. While its importance is growing in a time characterized by images and pictorial messages, the methods used for interpreting and reconstructing the structure of arguments expressed through verbal and visual means capture only isolated dimensions of this complex phenomenon. This paper intends to propose and illustrate a methodology for the reconstruction and analysis of “double-mode” arguments in advertisements, combining the instruments developed in social (...) semiotics, pragmatics, and argumentation theory. An advertisement is processed through a five-step path. The analysis of its context, text genre, and images leads to a first representation of the messages that it encodes both pictorially and verbally (step 1). These first semantic representations are further enriched by including their polyphonic articulations and presuppositions (step 2), their explicatures (step 3), and their dialogical functions and illocutionary forces (step 4). These pragmatic steps retrieve the commitment structure of the ad, which allows a further argument analysis conducted through argumentation schemes (step 5). (shrink)

Three common strategies used by informal logicians are considered: (1) the appeal to standard cases, (2) the attempt to partially formalize so-called "informal fallacies," and (3) restatement of arguments in such a way as to make their logical character more perspicuous. All three strategies are found to be useful. Attention is drawn to several advantages of a "stock case" approach, a minimalist approach to formalization is recommended, and doubts are raised about the applicability, from a logical point of view, of (...) a principle of charitable construal in the reconstruction of arguments.
