Recent advances in mobile electroencephalogram (EEG) systems, featuring non-prep dry electrodes and wireless telemetry, have urged the needs of mobile brain-computer interfaces (BCIs) for applications in our daily life. Since the brain may behave differently while people are actively situated in ecologically-valid environments versus highly-controlled laboratory environments, it remains unclear how well the current laboratory-oriented BCI demonstrations can be translated into operational BCIs for users with naturalistic movements. Understanding inherent links between natural human behaviors and brain activities is the key (...) to ensuring the applicability and stability of mobile BCIs. This study aims to assess the quality of steady-state visual-evoked potentials (SSVEPs), which is one of promising channels for functioning BCI systems, recorded using a mobile EEG system under challenging recording conditions, e.g., walking. To systemati-cally explore the effects of walking locomotion on the SSVEPs, this study instructed subjects to stand or walk on a treadmill running at speeds of 1, 2, and 3 mile (s) per hour (MPH) while con-currently perceiving visual flickers (11 and 12 Hz). Empirical results of this study showed that the SSVEP amplitude tended to deteriorate when subjects switched from standing to walking. Such SSVEP suppression could be attributed to the walking locomotion, leading to distinctly deteriorated SSVEP detectability from standing (84.87±13.55%) to walking (1 MPH: 83.03±13.24%, 2 MPH: 79.47±13.53%, and 3 MPH: 75.26±17.89%). These findings not only demonstrated the applicability and limitations of SSVEPs recorded from freely behaving humans in realistic environments, but also provide useful methods and techniques for boosting the translation of the BCI technology from laboratory demonstrations to practical applications. Heyman's target article contributes to our understanding of addictions by offering solutions to several paradoxes and by recognizing the stable nature of addictive behavior. Previous classical and operant conditioning models have emphasized molecular processes, such as acquisition and extinction, and have failed to address the aggregate effects of long-term exposure to the contingencies of drug and alcohol use.

In a realistic steady-state visual evoked potential (SSVEP) based brain-computer interface (BCI) application like driving a car or controlling a quadrotor, observing the surrounding environment while simultaneously gazing at the stimulus is necessary. This kind of application inevitably could cause head movements and variation of the accompanying gaze fixation point, which might affect the SSVEP and BCI’s performance. However, few papers studied the effects of head movements and gaze fixation switch on SSVEP response, and the corresponding BCI performance. (...) This study aimed to explore these effects by designing a new ball tracking paradigm in a virtual reality (VR) environment with two different moving tasks, i.e., the following and free moving tasks, and three moving patterns, pitch, yaw, and static. Sixteen subjects were recruited to conduct a BCI VR experiment. The offline data analysis showed that head moving patterns [F(2, 30) = 9.369, p = 0.001, effect size = 0.384] resulted in significantly different BCI decoding performance but the moving tasks had no effect on the results [F(1, 15) = 3.484, p = 0.082, effect size = 0.188]. Besides, the canonical correlation analysis (CCA) and filter bank canonical correlation analysis (FBCCA) accuracy were better than the PSDA and MEC methods in all of the conditions. These results implied that head movement could significantly affect the SSVEP performance but it was possible to switch gaze fixation to interact with the surroundings in a realistic BCI application. Multiple sensory signals from visual, somatosensory and vestibular systems are used for human postural control. To maintain postural stability, the central nervous system keeps the center of mass (CoM) within the base of support. The influence of the stomatognathic motor system on postural control has been established under static conditions, but it has not yet been investigated during dynamic steady-state balance. The purpose of the study was to investigate the effects of controlled stomatognathic motor activity on the (...) control and stability of the CoM during dynamic steady-state balance. A total of 48 physically active and healthy adults were assigned to three groups with different stomatognathic motor conditions: jaw clenching, tongue pressing and habitual stomatognathic behavior. Dynamic steady-state balance was assessed using an oscillating platform and the kinematic data were collected with a 3D motion capturing system. The path length (PL) of the 3D CoM trajectory was used for quantifying CoM sway. Temporal dynamics of the CoM movement was assessed with a detrended fluctuation analysis (DFA). An uncontrolled manifold (UCM) analysis was applied to assess the stability and control of the CoM with a subject-specific anthropometric 3D model. The statistical analysis revealed that the groups did not differ significantly in PL, DFA scaling exponents or UCM parameters. The results indicated that deliberate jaw clenching or tongue pressing did not seem to affect the sway, control or stability of the CoM on an oscillating platform significantly. Because of the task-specificity of balance, further research investigating the effects of stomatognathic motor activities on dynamic steady-state balance with different movement tasks are needed. Additionally, further analysis by use of muscle synergies or co-contractions may reveal effects on the level of muscles, which were not visible on the level of kinematics. This study can contribute to the understanding of postural control mechanisms, particularly in relation to stomatognathic motor activities and under dynamic conditions. (shrink)

Focus of attention is one of the most influential factors facilitating motor performance. Previous evidence supports that the external focus strategy, which directs attention to movement outcomes, is associated with better motor performance than the internal focus strategy, which directs attention to body movements. However, recent studies have reported that the EF strategy is not effective for some individuals. Furthermore, neuroimaging studies have demonstrated that the frontal and parietal areas characterize individual optimal attentional strategies for motor tasks. However, whether the (...) sensory cortices are also functionally related to individual optimal attentional strategy remains unclear. Therefore, the present study examined whether an individual’s sensory processing ability would reflect the optimal attentional strategy. To address this point, we explored the relationship between responses in the early sensory cortex and individuals’ optimal attentional strategy by recording steady-state somatosensory evoked potentials and steady-state visual evoked potentials. Twenty-six healthy young participants first performed a motor learning task with reaching movements under IF and EF conditions. Of the total sample, 12 individuals showed higher after-effects under the IF condition than the EF condition, whereas the remaining individuals showed the opposite trend. Subsequently, we measured SSSEP from bilateral primary somatosensory cortices while presenting vibrotactile stimuli and measured SSVEP from bilateral primary visual cortices while presenting checkerboard visual stimuli. The degree of increasing SSSEP response when the individuals in the IF-dominant group directed attention to vibrotactile stimuli was significantly more potent than those in the EF-dominant individuals. By contrast, the individuals in the EF-dominant group showed a significantly larger SSVEP increase while they directed attention to visual stimuli compared with the IF-dominant individuals. Furthermore, a significant correlation was observed such that individuals with more robust IF dominance showed more pronounced SSSEP attention modulation. These results suggest that the early sensory areas have crucial brain dynamics to characterize an individual’s optimal attentional strategy during motor tasks. The response characteristics may reflect the individual sensory processing ability, such as control of priority to the sensory inputs. Considering individual cognitive traits based on the suitable attentional strategy could enhance adaptability in motor tasks. (shrink)

Word in noise identification is facilitated by acoustic differences between target and competing sounds and temporal separation between the onset of the masker and that of the target. Younger and older adults are able to take advantage of onset delay when the masker is dissimilar to the target word, but only younger adults are able to do so when the masker is similar. We examined the neural underpinning of this age difference using cortical evoked responses to words masked by either (...) Babble or Noise when the masker preceded the target word by 100 or 600 ms in younger and older adults, after adjusting the signal-to-noise ratios to equate behavioural performance across age groups and conditions. For the 100 ms onset delay, the word in noise elicited an acoustic change complex response that was comparable in younger and older adults. For the 600 ms onset delay, the ACC was modulated by both masker type and age. In older adults, the ACC to a word in babble was not affected by the increase in onset delay whereas younger adults showed a benefit from longer delays. Hence, the age difference in sensitivity to temporal delay is indexed by early activity in the auditory cortex. These results are consistent with the hypothesis that an increase in onset delay improves stream segregation in younger adults in both noise and babble, but only in noise for older adults and that this change in stream segregation is evident in early cortical processes. This chapter suggests that the state of nature is a continuum notion that lies in a segment along a larger continuum of the scope of private judgment, as does the continuum notion of civil authority. Jean Hampton saw Thomas Hobbes's state of nature as a “presocietal” condition of “isolated asocial individuals,” “stripped of their social connections.” There is plentiful evidence against Hampton's interpretation of the state of nature as an “asocial” condition in Hobbes's insistence across all his (...) political writings that men care deeply about their relative social standing and reputations, and that this is a major source of conflict in a state of nature. A potentially more promising way of understanding the state of nature is as a lawless condition. Societies exhibiting a high degree of consensus among private judgments may be able to tolerate incomplete removal from the mere state of nature, without threat to their stability. (shrink)

In response to recent work on the aggregation of individual judgments on logically connected propositions into collective judgments, it is often asked whether judgment aggregation is a special case of Arrowian preference aggregation. We argue for the converse claim. After proving two impossibility theorems on judgment aggregation (using "systematicity" and "independence" conditions, respectively), we construct an embedding of preference aggregation into judgment aggregation and prove Arrow’s theorem (stated for strict preferences) as a corollary of our second result. They encourage their readers to think differently about what “politics” is by thinking beyond the parameters for political activity set by the dominant voices and practices of the nation-state or the market.In Migrations of the Holy, Cavanaugh pulls together a number of thematically linked essays in an effort to “give Christians and others some critical tools with which to turn the despair of modern politics toward real hope” (6). That hope is to be found in the church’s promotion and creation of complex social spaces “in which alternative economies and authorities flourish” (42). According to Cavanaugh, Christians ought to acknowledge that the modern nation-state is not oriented toward the pursuit of the common good. Instead, it is fueled by a desire to secure greater power and to perpetuate itself. The nation-state thrives by instilling in its citizens a religious kind of devotion to its ideals and to its continued existence. This religious devotion, animated by the state’s distinctive liturgies and methods of indoctrination, is the vehicle through which the state secures the loyalty of its citizens. Under these idolatrous conditions, Christian citizens become willing to justify and endorse the nation-state’s use of extreme violence; tempted to identify the will of God with the will of the nation-state; and stunted in their ability to imagine alternative political possibilities because they have accepted the limits on religiously informed political activity set by the nation-state. Past research showed that the ability to focus on one’s internal states positively correlates with the self-regulation of behavior in situations that are accompanied by somatic and/or physiological changes, such as emotions, physical workload, and decision-making. The analysis of moral oriented decision-making can be the first step for better understanding the legal reasoning carried on by the main players in the field, as lawyers are. For this reason, this study investigated the influence of the decision context and interoceptive manipulation on (...) the moral decision-making process in the legal field gathering the responses of two groups of lawyers. A total of 20 lawyers were randomly divided into an experimental group, which was explicitly required to focus the attention on its interoceptive correlates, and a control group, which only received the general instruction to perform the task. Both groups underwent a modified version of the Ultimatum Game, where are presented three different moral conditions and three different offers. Results highlighted a significant increase of Acceptance Rate in those offers that should be considered more equal than fair or unfair ones, associated with a general increase of Reaction Times in the equal offers. Furthermore, the interoceptive manipulation oriented the Lawyers toward a more self-centered decision. This study shows how individual, situational, contextual, and interoceptive factors may influence the moral decision-making of lawyers. Sosa : 7–18, 2005) argues that we should reject the orthodox conception of dreaming—the view that dream states and waking states are “intrinsically alike, though different in their causes and effects”. The alternative he proposes is that “to dream is to imagine”. According to this imagination model of dreaming, our dreamt conscious beliefs, experiences, affirmations, decisions and intentions are not “real” insofar as they are all merely imagined beliefs, experiences, affirmations, decisions and intentions. This paper assesses the epistemic implications of (...) Sosa’s imagination model of dreaming. Section 1 outlines and assesses the reasons Sosa gives for thinking that his imagination model of dreaming introduces a new dimension to debates about dream scepticism. Sosa argues that his imagination model of dreaming invites a more radical version of dream scepticism, and also makes available a novel and more powerful response to dream scepticism. Objections are raised to both of those claims. This leads to a challenge to Sosa’s imagination model of dreaming. This is the concern that Sosa’s imagination model of dreaming lacks the resources to accommodate the intuition that there is something illusory or misleading about one’s situation when one is dreaming, and as a result his account of dreams fails to accommodate the common intuition that there is a sceptical problem about dreaming but not about dreamless sleep. Section 2 of the paper elaborates a version of the imagination model of dreaming that can overcome that challenge. This version of the imagination model of dreaming goes beyond what Sosa explicitly commits to when he outlines his view of dreams, however, it exploits ideas that are integral to a key theme in Sosa’s recent writings on virtue reliabilism—namely his proposal that epistemic agency should be accorded a central place in that approach to knowledge, and his related proposal that agency is exercised in conscious judgement. An implication of this version of the imagination model of dreaming is that an elucidation of a connection between the wakeful condition and our capacity to exercise agency over our mental lives should be central to an account of the nature, and epistemic significance of, wakeful consciousness. In the framework of judgment aggregation, we assume that some formulas of the agenda are singled out as premisses, and that both Independence (formula-wise aggregation) and Unanimity Preservation hold for them. Whether premiss-based aggregation thus defined is compatible with conclusion-based aggregation, as defined by Unanimity Preservation on the non-premisses, depends on how the premisses are logically connected, both among themselves and with other formulas. We state necessary and sufficient conditions under which the combination of both approaches leads to (...) dictatorship (resp. oligarchy), either just on the premisses or on the whole agenda. This framework is inspired by the doctrinal paradox of legal theory and arguably relevant to this field as well as political science and political economy. The Critique of the Quantum Power of Judgement analyzes the a priori principles which underlie the empirical knowledge provided by quantum theory. In contrast to other transcendental approaches to quantum physics, none of the transcendental principles established by Kant is modified in order to cope with the new epistemological situation that arises with the asumption of the quantum postulate. Rather, by considering Bohr's views, it is argued that classical concepts provide the mathematical formalism of quantum theory with physical reference through (...) symbolic analogies in the strict Kantian sense. The main result of the investigation is the determination of the highest principle under which quantum objects are subsumed. This principle states that the conditions of the possibility of the systematic unity of contextual experience are at the same time the conditions of the possibility of quantum objects. Upon this principle rests the possibility of any a priori synthetic knowledge of quantum objects. Therefore, the Critique of the Quantum Power of Judgement yields the prolegomena to any future quantum metaphysics. (shrink)

Cell division is a local, elementary topological transformation which establishes statistical equilibrium of the structure. We describe the physical conditions to maintain stationary the epidermis (of mammals or of the cucumber), in spite of the fact that cells constantly divide and die. Specifically, we study the statistical equilibrium of the basal layer, a corrugated surface filled with cells, constituting (...) a two-dimensional topological froth. Cells divide and detach from the basal layer, and these two topological transformations are responsible for the stationary state of the epidermis. The topological froth is capable of responding rapidly and locally to external constraints, and is a good illustration of the plasticity of random cellular networks.Statistical equilibrium is controlled by entropy, both as a measure of disorder and as information, and is characterized by observable relations between average cell shapes and sizes. The technique can be applied to any random cellular network in dynamical equilibrium. Mitosis as the dominating topological transformation and the fact that the distribution of cell shapes is very narrow are the only inputs specific to biology. (shrink)

In Social Life and Moral Judgment, author and philosopher Antony Flew examines the social problems induced by the mature welfare state. Welfare states make ever-increasing financial demands on their citizenry, yet the evidence clearly supports that such demands are not sustainable. In this superlative collection of thematic essays, Flew investigates and explains why this is so, and calls for a return to individual responsibility. The first essay establishes the philosophical basis for his argument. "Is Human Sociobiology Possible?" answers its (...) titular question in the negative, asserting that we are all members of a peculiar type of creature that can, and therefore must, be responsible for whatever choices between various courses of action or inaction that are open to us as individuals. In other essays, Flew shows how state welfare systems inevitably corrupt and demoralize their citizens by encouraging ever-more people to apply for welfare entitlements and reducing the incentives to avoid or escape the conditions warranting those entitlements. He investigates the origins of this new kind of welfare entitlement, and shows how very different what politicians and public sector employees produce is from what these people claim to be producing. Flew shows that the drive for "social" justice appears to require that the justly acquired income and wealth of all citizens should be progressively taxed away or supplemented by the state so that the eventual result is more, though never perfect, equality. This objective, he asserts, must be radically distinguished from old-fashioned, without prefix or suffix, justice. It was this type of justice Adam Smith referred to when he famously said that it is a virtue "of which the observance is not left to the freedom of our wills" but "which may be extorted by force." Flew question the aims of those who would discredit wealth creators and wealth-creating investment, showing that these are the same people who promote the rising "progressive" taxation needed to finance expenditure in the growing welfare state. Social Life and Moral Judgment is a timely critique, one that will be appreciated at a point in history when governments on both sides of the Atlantic have begun to describe spending on state health, social, education, and welfare services as investments, instead of mechanisms to achieve social justice. Old Cato... has left us a curious phrase which aptly sums up the political principle implied in the enterprise of reclamation. We can only determine what an emotion is if we first ask whether or not there are intrinsically emotional entities. To ask if there are intrinsically emotional entities is to ask if there are entities that are necessary and sufficient conditions for the correct application of emotion-words. Recently, Robert Solomon has developed a view of the emotions according to which there are intrinsically emotional entities. Specifically, he claims that emotions are a kind of judgment. Our task in this paper (...) is to state and criticize Solomon's view. We argue that he has failed to distinguish emotional and non-emotional judgments. We also argue that Solomon fails to establish his "unitary form" analysis of emotions. He has not, therefore, vindicated the questionable assumption that there are intrinsically emotional entities. In (...) later works, Vattimo insisted on the epistemological virtues of mimetic theory to reform the classical theory of adequacy2 and the theological implications of this reform.3 Mimetic theory definitely unmasks the violence of the "strong metaphysic," to enable the advent of a weak metaphysics and a kenotic theology based on love: "According to him, it is the survival of the victim-based mechanism, albeit in attenuated form, that explains the recurrence of violence in the history of Christianity. A dynamic learning method is developed for an uncertain n-link robot with unknown system dynamics, achieving predefined performance attributes on the link angular position and velocity tracking errors. For a known nonsingular initial robotic condition, performance functions and unconstrained transformation errors are employed to prevent the violation of the full-state tracking error constraints. By combining two independent Lyapunov functions and radial basis function neural network approximator, a novel and simple adaptive neural control scheme is proposed for the dynamics of (...) the unconstrained transformation errors, which guarantees uniformly ultimate boundedness of all the signals in the closed-loop system. In the steady-state control process, RBF NNs are verified to satisfy the partial persistent excitation condition. Subsequently, an appropriate state transformation is adopted to achieve the accurate convergence of neural weight estimates. The corresponding experienced knowledge on unknown robotic dynamics is stored in NNs with constant neural weight values. Using the stored knowledge, a static neural learning controller is developed to improve the full-state tracking performance. A comparative simulation study on a 2-link robot illustrates the effectiveness of the proposed scheme. (shrink)

The goal of this study was to implement a Riemannian geometry -based algorithm to detect high mental workload and mental fatigue using task-induced electroencephalogram signals. In order to elicit high MWL and MF, the participants performed a cognitively demanding task in the form of the letter n-back task. We analyzed the time-varying characteristics of the EEG band power features in the theta and alpha frequency band at different task conditions and cortical areas by employing a RG-based framework. MWL and (...) MF were considered as too high, when the Riemannian distances of the task-run EEG reached or surpassed the threshold of the baseline EEG. The results of this study showed a BP increase in the theta and alpha frequency bands with increasing experiment duration, indicating elevated MWL and MF that impedes/hinders the task performance of the participants. High MWL and MF was detected in 8 out of 20 participants. The Riemannian distances also showed a steady increase toward the threshold with increasing experiment duration, with the most detections occurring toward the end of the experiment. To support our findings, subjective ratings and behavioral measures were also considered. (shrink)

The Last Judgement, heaven, hell, purgatory, the wrathful God: today, these notions seem to belong to a remote past we have - thank goodness! - left behind. The more remarkable is that, today, prisoners sometimes refer to the representation of God as Judge, as in the proposition ‘Only God can judge me’ you can find as graffito on a cell wall, or tattooed on the body of an inmate. Is this statement born from defiance of the constitutional state, from (...) fundamentalism, or from the fiction of an all-forgiving God? Nowadays, we, modern democrats, have a suspicion towards criminals and fanatics who seem to think that they can get away with an Only God can judge me. Much more common today is the reversal: not a judging God but people assuming judgement over God and over those who persist in referring to God. But the tradition of the ‘theodicee’ shows that this reversed movement of man judging God is not in the least a gesture limited to those outside the religions. In a theodicee, man summons God to appear in front of an imaginary tribunal, only for God to be defended and subsequently acquitted. As Odo Marquard argues, the modern problem of the theodicee – bringing into question God’s justice – in the end favoured atheism. Human autonomy which exonerates God by eliminating him, would imply something like an ‘atheism ad maiorem Dei gloriam’. But when humankind becomes responsible for the creation of its own history, God can no longer be summoned to any tribunal. Now only man can be summoned, and more particularly: humans which may be held accountable for the persistence of evil, responsible for our enduring discontent, obstacles of human progress or annoying remnants of the past. Here we find the beginning of the secularization of the Last Judgement. As Peter Sloterdijk argues, the vindictive God who judges and punishes at the end on times is succeeded by revolutionary groups from the nineteenth century onwards. These not only transform feelings of humiliated anger and powerlessness into those of pride and hope, but also into an effective force of revenge. In short, the theological constellation of rage and eternity has been succeeded by a political-psychological constellation of rage and history. Our representative democracy can be seen as an answer to the dangerous modern tendency to ‘tribunalising’ , because conditions of division and conflict are regarded as normal and lasting, and not as Fremdkörper or indicative of pathology. The Last Judgement becomes indefinitely suspended. However, a certain kind of ‘populism’ holds that unity and homogeneity can very well be made visible and audible’; and nowadays this seems to be accompanied by the longing to give evil, thus a form of negative transcendence, a face and parade it in front of the tribunal of the people. For prisoners, this is bad news. Against its background, the Only God can judge me may yet well up from a different source than that which I had suggested at the beginning of my argument. (shrink)

For a large proportion of our daily lives, spontaneously occurring thoughts tend to disengage our minds from goal-directed thinking. Previous studies showed that EEG features such as the P3 and alpha oscillations can predict mind-wandering to some extent, but only with accuracies of around 60%. A potential candidate for improving prediction accuracy is the Steady-State Visual Evoked Potential, which is used frequently in single-trial contexts such as brain-computer interfaces as a marker of the direction of attention. In this (...) study, we modified the sustained attention to response task that is usually employed to measure spontaneous thought to incorporate the SSVEP elicited by a 12.5-Hz flicker. We then examined whether the SSVEP could track and allow for the prediction of the stickiness and task-relatedness dimensions of spontaneous thought. Our results show that the SSVEP evoked by flickering words was able to distinguish between more and less sticky thinking but not between whether a participant was on- or off-task. This suggests that the SSVEP is able to track spontaneous thinking when it is strongly disengaged from the task but not off-task thought in general. Future research should determine the exact dimensions of spontaneous thought to which the SSVEP is most sensitive. (shrink)

A central source of support for expressivist accounts of normative discourse is the intimate relationship between normative judgment and motivation. Expressivists argue that normative judgments must be noncognitive, desire-like states in order to be so tightly linked with motivation. Normative statements are then construed as expressions of these noncognitive states. In this paper, I draw on dual-process models in cognitive psychology to respond to this argument. According to my proposal, normative judgments are ordinary beliefs that are typically produced by two (...) kinds of process: intuitive-affective processes and domain-general reasoning. When produced by the first kind of process, motivation and judgment tend to align. When produced by the second kind, motivation and judgment might not align. Since the first kind of process is the most common pathway of normative belief formation, normative judgments are typically accompanied by aligning motivation. This proposal enables cognitivists to explain the intimate link between normative judgment and motivation, thereby removing the major obstacle to interpreting normative statements truth-conditionally. Indigenous peoples encounter restrictions on their modes of reasoning and account-giving within democratic sites of negotiation and deliberation. Political theorists understand these restrictions as forms of exclusion related to what theorist Iris Young has called the ‘internal exclusion’ of subordinated perspectives and theorist James Bohman has referred to as the ‘asymmetrical inclusion’ of such perspectives. ‘Internal exclusion’ refers to ways in which actors are formally accepted into decision-making processes, only to find their perspectives disqualified due to informal but no less (...) pervasive criteria of exclusion. ‘Asymmetrical inclusion’ refers to the undue burdens placed on marginalized peoples to persuade dominant communities. It is argued in light of these problems that more inclusive institutions as well as the cultivation of an ethos of receptivity will be necessary for genuine inclusion. I argue that this focus on enriching dialogue can mischaracterize the nature of disagreement between Indigenous and non-Indigenous peoples.Disagreement does not only arise between opinions or discourses that can be articulated and judged, but also at a deeper level, between the background assumptions against which practices of articulation and judgment are understood. Territorial state sovereignty, I argue, is a background understanding that can render sites of democratic negotiation inhospitable to Indigenous claims. I conclude that when thinking through Indigenous equality and autonomy, theorists should be attuned to the sites and conditions of dialogue that might serve to reinscribe relations of domination and exclusion. This paper critically examines two objections and raises a new objection against the besire theory of moral judgment. Firstly, Smith (1994) observes that a belief that p tends to expire whereas a desire that p tends to endure on the perception that not p. His observation does not refute the sophisticated version of the besire theory that to besire that p is to believe that p and to desire to act in accordance with the belief that p. Secondly, Zangwill (2008) (...) claims that the strength of motivation may vary while the degree of belief remains constant. Besirists would reply that a besire admits of both degree and strength. Finally, I argue that the belief that p endures while the desire to act on the belief that p expires with the introduction of a new bodily condition, and hence that the belief and the desire are distinct mental states. Pellegrino has argued that end-of-life decisions should be based upon the physician's assessment of the effectiveness of the treatment and the patient's assessment of its benefits and burdens. This would seem to imply that conditions for medical futility could be met either if there were a judgment of ineffectiveness, or if the patient were in a state in which he or she were incapable of a subjective judgment of the benefits and burdens of the treatment. I argue that (...) a theory of futility according to Pellegrino would deny that latter but would permit some cases of the former. I call this the circumspect view. I show that Pellegrino would adopt the circumspect view because he would see the medical futility debate in the context of a system of medical ethics based firmly upon a philosophy of medicine. The circumspect view is challenged by those who would deny that one can distinguish objective from subjective medical judgments. I defend the circumspect view on the basis of a previously neglected aspect of the philosophy of medicine -- an examination of varieties of medical judgment. The likelihood of a statement is often derived by generating an explanation for it and evaluating the plausibility of the explanation. The explanation discounting principle states that people tend to focus on a single explanation; alternative explanations compete with the effect of reducing one another’s credibility. Two experiments tested the hypothesis that this principle applies to inductive inferences concerning the properties of everyday categories. In both experiments, subjects estimated the probability of a series of statements and the conditional probabilities of (...) those conclusions given other related facts. For example, given that most lawyers make good sales people, what is the probability that most psychologists make good sales people? The results showed that when the fact and the conclusion had the same explanation the fact increased people’s willingness to believe the conclusion, but when they had different explanations the fact decreased the conclusion’s credibility. Sentiment operating alone, as a basis for morality, would threaten to engulf humanity with as many relativistic moral truths as there are individuals. Reason alone would produce objective, impersonal truths, but these would be powerless to move us. Hume's developed theory ingeniously (...) shows how Reason and Sentiment can operate together, to produce judgments based on feelings which are nonetheless impersonal and objective (T 581-584; E 227-229). Hume is acutely aware (as we shall see below) that there exists a considerable disparity between the impartiality required of us by moral theory and what in practice people think when it comes to moral matters. There would seem to be only two ways of accommodating this fact. One is to regard the disparity as a mark of the moral mediocrity of ordinary people; we are not as objective in our judgments as we could be. The other way is to treat the disparity as a token of failure and inadequacy in the theory; our best philosophical reasoning about morals fails to capture its subject matter without distortion. Our rational powers fall short, not only in Book I of the Treatise, where the task is to explain the foundation of our beliefs, but also in Book III, where Hume attempts to elucidate moral life. Certainly the first way would reduce the gap to some extent; some people, perhaps many, are moral truly low achievers. I want to show that Hume also suggests the second way; he is willing to deflate the 192 pretensions of philosophy, even when it comes to his own state-of-the-art efforts. I. The Objectivity of Certain Feeling-Based Judgments In the moral arena of life we make judgments which are based on feelings, on 'certain sentiments of pleasure or disgust' (T 581). "To have the sense of virtue, is nothing but to feel a satisfaction of a particular kind from the contemplation of a character" (T 471). Of course not just any feeling will do; it must be of a peculiar kind, which we can experience only under specific conditions. At first Hume characterizes the necessary condition as follows: 'Tis only when a character is considered in general, without reference to our particular interest, that it causes such a feeling or sentiment, as denominates it morally good or evil (T 472). Later on Hume provides a fuller account. Characteristically he elaborates in response to an anticipated objection. The objection is that our sympathetic feelings of pleasure and pain fluctuate wildly, depending mainly upon our distance, so to speak, from the character we assess, in space, time, and kind of relationship. Our moral judgments do not vary in this way; we give the same approbation to the same moral qualities in China as in England (T 581). So (it is concluded) our moral judgments do not rest upon sympathy. Cloth, $70.00.At a time when our attention is overwhelmed by the practical manifestations of power in pursuit of personal, political, and economic gain, it is timely to read a book urging the spirit of the Enlightenment as a palliative for contemporary ills. Katerina Deligiorgi's recent study, Kant is the spectre haunting the halls of the Enlightenment project, reminding the living that it is a "culture" shaped by the "social ideal" of rational enquiry, self-criticism, and public debate (1). Drawing on Kant, Deligiorgi aims both to contribute to understanding the legacy of the Enlightenment and to demonstrate its "relevance" to current political and philosophical concerns (3). She pursues these ends by emphasizing how the power of the Enlightenment is embodied in its own "reflection on the meaning of the term 'enlightenment'" (4); and since this self-critical questioning has a history, unlocking the Enlightenment's past and revealing its future requires reconstructing a path through the philosophical forms that gave it shape. Deligiorgi's chosen route is not systematic, but it does reflect her concern to reveal the steady and reflective progress of human reason towards intellectual, social, and political self-consciousness.In chapter 1, she reminds readers that the guiding light of reason was as much explanandum as explanans for Enlightenment thinkers, dramatized by the failed "social criticism" of Diderot and Rousseau (16) and the retrograde step taken by Mendelssohn and Reinhold, who reached the "unsatisfactory" conclusion that the "final court of judgment" lay with enlightened individuals like themselves rather than with a "public that can act as standing jury... participating in its own enlightenment" (52). Indeed, as we learn in chapter 4, this uncomfortable truth is indicative of the more general problem that Kant's breezy faith in the "shared vision of enlightenment" (134) became anachronistic before the ink had dried, sullied by the grim realities of the modern state articulated in Schiller's pessimistic portrayal of the "struggle of existence," the material conditions of which leave little room for the luxuries of intellectual emancipation (140). The ideas of creatio ex nihilo of the universe and creatio continua of new matter out of nothing entered the arena of natural science with the advent of the Big Bang and the steady-state theories in the mid-twentieth century. Adolf Grünbaum has tried to interpret the steady-state theory in such a way, to show that the continuous formation of new matter out of nothing in this theory can be explained purely physically. In this paper, however, it (...) will be shown that Grünbaum's interpretation encounters at least three problems: not distinguishing between material and efficient causes, inconsistency, and misconceiving the law of density conservation. A new member of a growing class of unresolved second law paradoxes is examined.(1–7) In a sealed blackbody cavity, a spherical gravitator is suspended in a low density gas. Infalling gas suprathermally strikes the gravitator which is spherically asymmetric between its hemispheres with respect to surface trapping probability for the gas. In principle, this system can be made to perform steady-state work solely at the expense of heat from the heat bath, this in apparent violation of the second (...) law of thermodynamics. Detailed three-dimensional test particle simulations of this system support this prediction. Standard resolutions to the paradox are discussed and found to be untenable. Experiments corroborating a central physical process of the paradox are discussed briefly. The paradox is discussed in the context of the Maxwell demon. (shrink)

Modern standard big bang cosmology was preceded by a 15-year controversy with the rival steady-state theory of the universe. At a time when cosmologically relevant observations were scarce and cosmology was widely regarded as an immature science, or not a science at all, much of the debate took place by means of arguments that were essentially philosophical. Remarkably, professional philosophers, including some of the key figures of Anglo-American philosophy of science, took an active part in the debate; no (...) less remarkably, the involved astronomers and physicists sometimes listened to them. This article reviews the controversy over the steady-state theory as seen from the perspective of contemporary philosophy of science and offers an appraisal of how and to what extent philosophers and scientists entered a dialogue. -/- . Given the recent trend in Kant scholarship to seek a kinder, more caring philosopher behind the familiar rules and imperatives, a study focusing on the (...) place of "character" in Kant's thought is a timely contribution to a growing body of work. Indeed, G. Felicitas Munzel intends to go where no Kantian has gone before and show not only that Kant has a conception of character, but that it is "rich" (1) and "unique in the history of philosophy" (5). Considering his "corpus as a whole" (6), she sets out to demonstrate the "systematic importance" of the concept for Kant's thought (1) and reveal "a richer sense of familiar notions of his moral philosophy than is generally appreciated" (11).From the outset, however, high hopes prove hard to sustain. In Chapter 1, Munzel's exegetical efforts to link "character" with Denkungsart ("conduct of thought") and Gesinnung ("comportment of mind"), either delineate only familiar elements of Kant's thought or attribute to him views which philosopher and non-philosopher alike could hardly deny: in Kant's "rich" conception, character involves clear thinking and perfection, and is an "accomplished state" (67) presupposing sound reasoning and the capacity to think. In what becomes the dominant theme of the study, Munzel concludes that, for Kant, character is an activity in which the objective moral law is realized in subjects acting on maxims and from firm principles.In Chapter 2 the reader is subsequently led across a familiar terrain of causality, desire, and feeling, to learn that Kant is disinclined to inclination, but very much inclined to reason (71-2); and that character has a foot in both the empirical and intelligible orders of causality (74). The same goes for desire (95ff.) and aesthetic capacity (126ff.), where the "moral form" of character represents the union of reason and nature. A [End Page 445] similar story continues in Chapter 3 where Munzel considers Kant's view of religion and hopes to cast "new light" (142) upon and foster "fresh appreciation" (182) for "radical evil." Again, the reader spots comforting landmarks along the way and emerges into a world unchanged: for Kant, Munzel concludes, human conflict is a manifestation of evil with its roots in human nature; virtue involves progress or advance; and a well-established character brings inner and outer peace to human life (134-6).In the remainder of the book Munzel turns to the "structure and cultivation of character." Chapter 4 focuses on orientation, reflective principles, conscience, and discourse where, rambling through the Kantian landscape, one learns that common sense is a source of principles (198ff); maxims should be steadfastly adopted (208-9); and that morally upright persons should know their duty (210), tell the truth (246), and develop their capacities to the full (249). By this stage, that "character must be made subjectively rational" (252) has become a mantra, but lest the point remain unclear, Munzel expounds a metaphor (from Mendelssohn's Morgenstunden) of a traveler on life's journey, in order to emphasize that moral character involves being rational, competent, and accountable for one's actions (191ff.).In the final chapter, pedagogy becomes the main focus. It is a practice, Munzel contends, which determines the conditions under which character is formed (260). Mixed in the appropriate fashion, its elements combine to make "cultivation of moral judgment" the "essence of moral character" (259). Again, Munzel connects character to well-known Kantian doctrines, linking pedagogy to self-mastery (292) and a community of civic-minded citizens (258) in which the good of one promotes the well-being of all (288). Sexual and gender minorities in contemporary India are formed in the interstices between the neoliberal, Hindutva state; transnational discourses of liberal democracy and sexual ‘rights’; as well as cosmopolitan culture and global LGBT movements. As is evident in recent court judgments and legislation, particularly since 2014, postcolonial Hindu nationalism has created cultural conditions where forms of queer gender are permissible while queer sexuality is generally unacceptable. In recent years, significant developments have focused on transgender communities, complicating activism surrounding (...) sexual and gender identities. By positing some identities as state-sanctioned acceptable citizens and others as not, certain ‘transgender’ individuals are conceptualised as bearers of rights while finding other facets of their identities discriminated against and maintained as illegal. The 2014 Supreme Court NALSA v. Union of India judgment and The Transgender Persons (Protection of Rights) Bill, 2016 passed by the Lok Sabha, alongside further judgments and legislation affecting wider LGBT communities, have kept discourses fixed on sexual and gender identities and their relationship to Indian citizenship at the forefront of discussions of gender justices and injustices in India today. Focusing on recent judicial and legislative developments, this paper examines how transgender rights are being granted in the context of the neoliberal, Hindutva state and considers which forms of transgender identity are currently being conceptualised as legitimate and authentic in such discourses, which can serve to bolster larger right-wing visions and ideologies of the nation and its citizens. It contemplates the ways in which gender ‘justices’, framed in relation to both transnational LGBT rights discourses and right-wing agendas, are conceptualised and played out on the bodies of sexual and gender minorities. What remains anti-democratic in our criminal justice systems, and where does it come from? Geoffroy de Lagasnerie spent years sitting in on trials, watching as individuals were judged and sentenced for armed robbery, assault, rape, and murder. His experience led to this original reflection on the penal state, power, and violence that identifies a paradox in the way justice is exercised in liberal democracies. In order to pronounce a judgment, a trial must construct an individualizing story of actors and (...) their acts; but in order to punish, each act between individuals must be transformed into an aggression against society as a whole, against the state itself. The law is often presented as the reign of reason over passion. Instead, it leads to trauma, dispossession, and violence. Only by overturning our inherited legal fictions can we envision forms of truer justice. Combining narratives of real trials with theoretical analysis, Judge and Punish shows that juridical institutions are not merely a response to crime.
