Reserve systems are a tool to allocate scarce resources when stakeholders do not have a single objective. This paper introduces some basic concepts about reserve systems for pandemic medical resource allocation. At the onset of the Covid-19 pandemic, we proposed that reserve systems can help practitioners arrive at compromises between competing stakeholders. More than a dozen states and local jurisdictions adopted reserve systems in initial phases of vaccine distribution. We highlight several design issues arising in some of these implementations. This paper discusses global reserve currencies from the perspective of structural global justice. Drawing on notions of structural justice and background justice, it suggests that the structures of global finance, by creating positions of privilege and disadvantage, can lead to injustices both with regard to distributive outcomes and with regard to domination. While the role of the dollar and Euro as global reserve currencies are not the only factors that contribute to these structural injustices, they need to be taken into (...) account to fully grasp the dynamics of global finance. They also have an impact on other mechanisms, such as sovereign debt, capital flows, and the governance of international financial institutions. The paper’s arguments support the claim that one cannot conceptualize global justice as justice between independent states. Rather, the global monetary regime constitutes a case of “background injustice” (Ronzoni 2009). (shrink)

In this article the author analyses specific reservations that are being done to the international documents for the protection of human rights and whether Vienna Convention on the Law of the Treaties applies to those human rights treaties or not. Also, the author analyses if reservations, which are incompatible with object and purpose of the treaty, can be done or not and what consequences they might bring. For this reason the author describes the practice of the state members (...) under the Convention on the Elimination of All Forms of Discrimination against Women and International Covenant on Civil and Political Rights. These treaties were chosen not only because they laid down the most significant principles of the protection of human rights, but also due to the great number of reservations made to the fundamental provisions of these treaties. The importance of the topic is that in the human rights treaties the implementation of Vienna Convention on the Law of Treaties provisions on reservations brings several issues, even though on theoretical level the regulation of reservations seems unproblematic. Firstly, there is a major group of states (especially Islamic countries, which base their explanation on the incompatibility with Islamic law), which want to become parties to the treaties that protect human rights and make reservations to fundamental provisions of them at the same time. Secondly, the state parties that make objections to the reservations have to decide if the reservation is compatible with the object and purpose of the treaty or not. The regulation that is laid down in Vienna Convention on the Law of Treaties creates difficulties for the state parties and withdrawal of reservations seems to be more problematic in reality than it is in theory. In order to find the solutions for the above mentioned issues, the author analyses whether the Vienna Convention on the Law of the Treaties regime works properly within the mechanism of making reservations to the human rights treaties or not, what reservations should be kept invalid under the human rights treaties and what could be the solutions for the most effective protection from the invalid reservations that address fundamental rights of human beings in the human rights law. Notwithstanding constant “crises of confidence,” a high number of international disputes lay at the docket of the International Court of Justice in The Hague. In the word of Judge Rosalyn Higgins, states are turning to the ICJ for the peaceful settlement of their disputes. The option provided by the Charter of the United Nations in limiting the compulsory jurisdiction of the Court to certain categories of disputes, clearly contributes to convening a greater number of states to accept this international jurisdiction, (...) resolve their disputes peacefully and in accordance with international law. Not surprisingly, only a few declarations provided in Article 36 of the Statute of the Court do not contain any reservation as to the limits of the Court’s competence. Interwar Lithuania contributed heavily to the strengthening of international justice. It was amongst the first members of the League of Nations to recognise the compulsory jurisdiction of the Permanent Court of International Justice and remained its faithful supporter until the very end of the Court’s activities. International justice provided at least titular security guarantees for the young nation. This faith of the Lithuanian government in relying on international justice was rewarded in full. The Lithuanian State defended its legitimate place amongst the independent nations and successfully stood up for its interests in all three cases before the Permanent Court. (shrink)

The two most popular approaches to Carnap's 1928 Aufbau are the empiricist reading of Quine and the neo-Kantian readings of Michael Friedman and Alan Richardson. This paper presents a third "reserved" interpretation that emphasizes Carnap's opposition to traditional philosophy and consequent naturalism. The main consideration presented in favor of the reserved reading is Carnap's work on a physical construction system. I argue that Carnap's construction theory was an empirical scientific discipline and that the basic relations of its construction systems need (...) not be eliminated. (shrink)

Synthetic biology, an emerging field of science and technology, intends to make of the natural world a substrate for engineering practice. Drawing inspiration from conventional engineering disciplines, practitioners of synthetic biology hope to make biological systems standardized, calculable, modular, and predictably functional. This essay develops a Heideggerian reading of synthetic biology as a useful perspective with which to identify and explore key facets of this field, its knowledge, its practices, and its products. After overviews of synthetic biology and Heidegger’s account (...) of technology, I discuss calculability, utility, function, setting-upon, and ordering, with the aim of discussing the manner in which synthetic biology works to render the biological world intelligible as something to be used, rather than something that is in and of itself. Having developed this Heideggerian reading, I proffer a number of corrections to his account that enable a more accurate, nuanced understanding of synthetic biology. Specifically, I discuss the notion of Ge-stell and submit that multiple systems of “enframing” may help to make Heidegger’s argument more robust. I suggest that synthetic biology may work to reveal the natural world as a standing-reserve of function. (shrink)

We describe food transfer patterns among Ache Indians living on a permanent reservation. The social atmosphere at the reservation is characterized by a larger group size, a more predictable diet, and more privacy than the Ache typically experience in the forest while on temporary foraging treks. Although sharing patterns vary by resource type and package size, much of the food available at the reservation is given to members of just a few other families. We find significant positive correlations between amounts (...) transferred among pairs of families, a measure of the "contingency" component required of reciprocal altruism models. These preferred sharing partners are usually close kin. We explore implications of these results in light of predictions from current sharing models. (shrink)

This paper traces the recent debate over the legitimacy of maturity mismatching and fractional reserve banking. It shows that there is common ground between Bagus and Howden :399–406, 2009, 106:295–300, 2012) on the one hand and Evans on the other regarding contractual arrangements that lead to fractional reserve banking, while both agree that fractional reserve banking that arises out of a bailment or storage contract constitutes fraud. Block and Barnett :711–716, 2009, 100:229–238, 2011) stress the illegitimacy of fractional reserve banking (...) for creating more money substitutes than there is actual money. While it is true that fractional reserve banks are capable of creating money, this activity still cannot be regarded as fraudulent using a common law definition of fraud for it can only take place with requisite client collaboration that makes it impossible to identify a victim. The Cognitive Reserve (CR) hypothesis suggests that the brain actively attempts to cope with neural damages by using pre-existing cognitive processing approaches or by enlisting compensatory approaches. This would allow an individual with high CR to better cope with aging than an individual with lower CR. Many of the proxies used to assess CR indirectly refer to the flexibility of thought. The present paper aims at directly exploring the relationships between CR and creativity, a skill that includes flexible thinking. We (...) tested a sample of 72 adults (aged between 45 and 78) assessing both their level of CR and their creativity. To evaluate CR we used the proxies commonly used in literature, namely, three subtests from the WAIS (vocabulary, similarities, and digit span) and the years of education. We also used an ad-hoc test asking people to report how frequently they tend to perform activities that are believed to increase CR. We used verbal creativity tasks (alternative uses and generation of acronyms) to assess individual levels of creativity. We asked participants to describe their main occupation (present or past) and coded each occupation as creative or not creative. Results (controlling for age-related differences) showed that scores from the WAIS correlated positively with creativity performance, even though correlations varied across the subtests. Focusing on the frequency and type of activities that people perform, and comparing individuals who have or had a creative job to those with a routine job, a clear relationship between creativity and CR emerged. This effect was more relevant than the level of job complexity. Implications for the study of CR and aging are discussed. (shrink)

The hermeneutic turn in Ricœur’s phenomenological ontology of the 1960 cannot be considered a break with his methodological approach of philosophy. In fact, as early as 1950 he had already initiated a first attempt to conjoin phenomenology and hermeneutics by relating eidetic description and explanation. The main purpose of the present analysis is to clarify the constellations constituting the structure of mutual determination between phenomenology and hermeneutics. The paper will focus on the question of the Lebenswelt, as reserve of meaning, (...) a concept requiring a structural conjunction of the phenomenological (perception, imagination, re-presentation) and hermeneutical arcs (explication, interpretation, understanding). These three models are introduced specially to analyze the biased role of the print media on 27 percent reservation for the Other Backward Classes (OBCs) in educational institutions run by the Indian Central Government.

L’une des plus notoires limites en droit international est la possibilité pour les États parties d’émettre des réserves afin de diminuer leur obligation de mettre en œuvre les droits enchâssés dans un traité. Les réserves formulées lors de la ratification de la Convention relative aux droits de l’enfant au regard du droit à l’éducation sont particulièrement notables et seront le sujet d’analyse de cet article. Nous allons dans un premier temps considérer le sens, l’intention sous-jacente, et la portée des réserves (...) en droit international, dans le cadre de la théorie de la « signifique» élaborée par l’éminente sémioticienne Victoria Lady Welby. Dans un deuxième temps, nous allons étudier le contenu des réserves au droit à l’éducation, l’intention des États lors de la rédaction des dispositions en nous référant aux travaux préparatoires de la CDE, et enfin leur « signification». Nous tenterons de répondre à la question suivante: les réserves au droit à l’éducation ont-elles des limites? Finalement, nous effectuerons une analyse sémioéthique de la Convention afin d’identifier des mesures permettant de désamorcer le signe pernicieux que constitue toute réserve au droit à l’éducation. BackgroundResearch on prevalence of cognitive frailty phenotypes in community-dwelling older adults in different countries is important to estimate their prevalence and to determine the influence of cognitive reserve and mental health in order to prevent frailty. The aims of this study were to estimate the prevalence of reversible and potentially reversible cognitive frailty in a Portuguese sample of old adults and explore the associations between these phenotypes and demographic, comorbidity, social support, cognitive reserve and mental health factors.MethodsWe assessed frailty in (...) 250 community-dwelling older adults aged 60 years or over without dementia, neurological or psychiatric disorders. Subjective cognitive decline and Mild cognitive impairment were diagnosed according to standard criteria. The questionnaires Charlson Index, Medical Outcomes Study Social Support, Cognitive Reserve Index and General Health were used for assessing comorbidity, social support, cognitive reserve and mental health, respectively.ResultsPrevalence of R-CF was 14%, and that of PR-CF, 15.2%. Cognitive frailty profiles differed significantly in relation to education, comorbidity, mental health, and cognitive reserve, but not in age or sex. Multivariate logistic regression showed that age, sex, comorbidity, social support, mental health, and cognitive reserve together predicted R-CF and PR-CF with significant OR for mental health and cognitive reserve.DiscussionCognitive reserve and mental health are important factors predicting R-CF and PR-CF. We recommend assessing these factors for early detection of cognitive frailty and promoting psychological well-being and lifestyles that increase cognitive reserve in adults. (shrink)

The decade in which the Business Ethics Quarterly has flourished has been a good one for business and business ethics, in which new guiding theories (like stakeholder theory), new interpretations of older ethical concepts (trust, virtue, and the social contract, for instance), and whole new paradigms of doing business (the Triple Bottom Line) have entered the literature. Studying the funny trends within historically marginalized populations has historically been used as a means of making them seem nonthreatening to dominant cultures. Scholars, furthermore, have often applied dominant-culture contexts toward reading minority artifacts without taking the time to understand the premises for other cultures’ funny enthymemes. This paper proposes two solutions to the dilemma of recognizing the importance of representing marginalized populations’ humor in the scholarly canon but also studying those funny artifacts with a mind toward ethics, using Native (...) In May 1973 a new collaboration between NASA, the Indian Health Service, and the Lockheed Missiles and Space Company promised to transform the way members of the Papago (now Tohono O’odham) Tribe of southern Arizona accessed modern medicine. Through a system of state-of-the-art microwave relays, slow-scan television links, and Mobile Health Units, the residents of the third-largest American Indian reservation began to access physicians remotely via telemedical encounters instead of traveling to distant hospitals. Examining the history of the STARPAHC (Space (...) Technology Applied to Rural Papago Advanced Health Care) project from the perspective of NASA and its contractors, from the perspective of the Indian Health Service, and from the perspective of O’odham engineers and health professionals offers a new focus, emphasizing the American Indian reservation as a site of medical research and technological development in the late twentieth century, with specific attention to the promise of information technology to address health disparities and the role of American Indians as actors in the late twentieth-century history of science, technology, and medicine. Ethical objections to the use of mass media and the internet help explain why the Plain People of North America avoid new communication technologies. Each subgroup of plain folk-including Amish, Mennonites, and Brethren adopt differing amounts of new technology, and the use variesfrom region to region or even,from community to community. Old media such as the radio and telephone and newer media such as television and the internet introduce diferent and unwelcome moral values into plain communities, although the telephone is (...) often a borderline case. With a couple of exceptions those scholars who have discussed it during the last fifteen years agree that it contains a sexual innuendo. Where they differ is on the exact nature of its meaning. What vase shape does ληκύθιον or λήκυθοс denote and hence what part of the male (...) genitalia is envisaged? Or is it mistaken to press for anatomical detail? May not the phrase simply suggest ‘become detumescent’? These are the questions that have been posed regarding Ar. Ran. 1200–47. In what follows I shall try to show that the context, far from demanding that we give an underlying sexual meaning as well as its surface meaning to the phrase, could almost be said positively to exclude such a meaning. In an attempt to be as brief as possible I shall not deal with all of the suggestions made by the scholars mentioned in my second footnote and rarely indicate points of agreement, disagreement or indebtedness. When I confront the arguments of these scholars they are mostly those of two of the most recent contributors to the debate, Snell and Anderson. At first sight there is some plausibility in the suggestion that lekythion might denote a penis or a pair of testicles or both things. Several vase shapes have a suggestive appearance. If the object denoted is actually the vase we are accustomed to call the aryballos, the reference would be to an object whose name possibly derived from a word which had a genital reference. In a 2005 paper, John Burgess and Gideon Rosen offer a new argument against nominalism in the philosophy of mathematics. The argument proceeds from the thesis that mathematics is part of science, and that core existence theorems in mathematics are both accepted by mathematicians and acceptable by mathematical standards. David Liggins (2007) criticizes the argument on the grounds that no adequate interpretation of “acceptable by mathematical standards” can be given which preserves the soundness of the overall argument. In this discussion (...) I offer a defense of the Burgess-Rosen argument against Liggins’s objection. I show how plausible versions of the argument can be constructed based on either of two interpretations of mathematical acceptability, and I locate the argument in the space of contemporary anti-nominalist views. According to a simple form of consequentialism, we should base decision on our judgments about their consequences for achieving out goals. Our goals give us reason to endorse consequentialism as a standard of decision making. Alternative standards invariably lead to consequences that are less good in this sense. Yet some people knowingly follow decision rules that violate consequentialism. For example, they prefer harmful omissions to less harmful acts, they favor the status quo over alternatives they would otherwise judge to be (...) better, they provide third-party compensation on the basis of the cause of an injury rather than the benefit from the compensation, they ignore deterrent effects in decisions about punishment, and they resist coercive reforms they judge to be beneficial. I suggest that nonconsequentialist principles arise from overgeneralizing rules that are consistent with consequentialism in a limited set of cases. Commitment to such rules is detached from their original purposes. The existence of such nonconsequentialist decision biases has implications for philosophical and experimental methodology, the relation between psychology and public policy, and education. (shrink)

This essay offers a philosophical defense of deception about reservation prices in business negotiation. Its discussion is prompted by arguments that Charles N.C. Sherwood makes in a recent issue of Business Ethics Quarterly and develops ideas I put forward in an earlier issue of Business Ethics Quarterly. The essay argues that although reservation price deception cannot be justified by appeal to the consent of negotiating parties, it can be justified by appeal to a separate but related notion, assumption of risk, (...) as long as the assumption of risk occurs in a suitably fair context. It is shown that in a range of models, the probability that a forager dies from starvation is, to a good approximation, an exponential function of energy reserves. Using a time and energy budget for a 19g passerine, we explore the consequences, in terms of starvation and predation, of various levels of energy reserves. It is shown that there exists an optimal level L of reserves at which total mortality (starvation plus predation) is minimized. L increases when the environment deteriorates (...) as a result of a decrease in either temperature or mean gross gain or an increase in the mean search time. The effect of combined deteriorations is greater than the sum of their individual effects. At L, the probability of predation is much higher than the probability of starvation. A simple analytic model suggests that this result will be fairly general, but also indicates conditions under which the result might not hold. (shrink)

Using Least Square Residual Minimization techniques, this paper develops an optimal reserve model, known as the OPREM model, which is essential in optimizing the costs of reserve holding. The paper also sets-out to test and compare the relative predictions of economic trends of the OPREM model as well as the predictions of alternative models in literature. Establishing the predictive accuracy of economic trends of these models are crucial for the gradual and cost-effective accumulation of reserves. The research concludes that, the (...) decision to optimize the cost of reserves under a stable currency environment is reliant on the gold impact factor and not on inflation or interest rates. We also found on further analysis of the OPREM that the OPREM model is better positioned to eliminate the procyclicality and perverse rush in reserve build-ups experienced in developing and emerging countries by effectively setting the reserve stock against economic trends. The research fixes the optimal reserves around a benchmark of 0.7–1.2 of previous year's optimal value. However, in the absence of past optimal values, a benchmark between 2 and 6 times of average inflows for short-term analysis or analysis with small data observations. However, for long-term analysis or analysis with large data frequency, the reserve stock should be fixed on a benchmark of 2–9 times of the average inflows. (shrink)

Military activities with the framework of the IDF [Israel Defense Force] is carried out by citizens in a variety of positions. In addition to the ordinary positions of career officers and NCOs, the IDF consists of conscripted men and women as well as reservists. Some of the latter serve under an ordinary command to serve for a certain relatively short period. Other reservists, including pilots and special forces officers have served since they volunteered to serve. Facing the political clash between (...) the government, who have been viewed as trying to change the democratic nature of the state, and the popular opposition, who have tried to protect the judiciary and other elements of democracy, many officers who belong to the latter reservist group have suspended their voluntary service or even retired. Their decision has raised the obvious issue of whether such decisions can be justified, morally, ethically, and democratically. This is the topic of the present paper. (shrink)

Cognitive reserve postulates that individual differences in task performance can be attributed to differences in the brain’s ability to recruit additional networks or adopt alternative cognitive strategies. Variables that are descriptive of lifetime experience such as socioeconomic status, educational attainment, and leisure activity are common proxies of CR. CR is mostly studied using neuroimaging techniques such as functional MRI in which case individuals with a higher CR were observed to activate a smaller brain network compared to individuals with a lower (...) CR, when performing a task equally effectively, and electroencephalography where a particular EEG component that reflects the attention and working memory load, has been targeted. Despite the contribution of multiple factors such as age, education, working, leisure, and household activities in CR formation, most neuroimaging studies, and those using EEG in particular, focus on formal education level only. The aim of the current EEG study is to investigate how the P300 component, evoked in response to an oddball paradigm, is associated with other components of CR besides education, such as working and leisure activity in older adults. We have used hereto a recently introduced CR index questionnaire that quantifies both professional and leisure activities in terms of their cognitive demand and number of years practiced, as well as a data-driven approach for EEG analysis. We observed complex relationships between CRIq subcomponents and P300 characteristics. These results are especially important given that, unlike previous studies, our measurements do not require active use of the same executive function and, thus, render our results free of a collinearity bias. This research isolates the distinctive features of recent Amazonian reserves, illustrates parallel features in a fifty year-old management experiment in the United States, and explores the advantages extractive reserves offer land reformers interested not only in social equity and efficiency but in biological conservation. By philosophy of reservation system, we mean philosophical examination of the issues arising as a result of introduction, implementation with its acceptance and denial of the process of reservation system. My main intention is to analyze the problems and discuss prospects in connection with the philosophy of reservation system introduced in India. B.R. Ambedkar always tried to uplift the backward and lower sections of our society. He says that Hindus have an innate and inveterate conservatism and they have a religion (...) incompatible with liberty, equality and fraternity. My point is that if we are going to initiate and incorporate the Ambedkarite thought of reservation for the betterment and upliftment of the weaker people of our society then those weaker people must be included in and have the benefit of reservation system irrespective of any caste and creed. But in practice it appears unreal and unjust to those weaker people of higher classes. (shrink)

In this article we consider an argument put forth by Selgin in support of the claim that there exists a mechanism for limiting coordinated expansions of fiduciary media under a system of fractional reserve free banking. Selgin argues that such banks hold risk-adjusted reserves against expected losses, and even if the expectation of reserve losses remains zero, the variance of such losses increases under an in-concert expansion . It is this increased variability that is claimed to act as a brake (...) on the expansion. We take issue with this argument on the basis of the fact that such a characterization of observed clearings would require that characteristics of the underlying data-generating process be obtainable from pathwise realizations of that process. In other words, there is an implicit assumption of stationarity in Selgin’s argument, and this assumption is at odds with well-known empirical facts of non-stationarity associated with most economic time series. We also point out ways in which techniques of risk management commonly found in the modern financial industry are unlikely to be effective in addressing this problem. (shrink)

The cognitive reserve is widely accepted as the active ability to cope with brain damage, using preexisting cognitive and compensatory processes. The common CR proxies used are the number of formal years of education, intelligence quotient or premorbid functioning, occupation attainment, and participation in leisure activities. More recently, it has employed the level of literacy and engagement in high-level cognitive demand of professional activities. This study aims to identify and summarize published methodologies to assess the CR quantitatively. We searched for (...) published studies on PubMed, ScienceDirect, and Web of Science between September 2018 and September 2021. We only included those studies that characterized the CR assessment methodology. The search strategy identified 1,285 publications, of which 25 were included. Most of the instruments targeted proxies individually. The lack of a gold standard tool that incorporates all proxies and cognitive tests highlights the need to develop a more holistic battery for the quantitative assessment of CR. Further studies should focus on a quantitative methodology that includes all these proxies supported by normative data to improve the use of CR as a valid measure in clinical contexts. (shrink)

Generous parental leave policies are popular in a number of countries around the world and are usually seen as a sign of the ‘family friendliness’ of the state. Relying on in-depth interviews with mothers on parental leave in Hungary, the authors argue that the context in which the policies are implemented should be examined when evaluating their consequences. In semi-peripheral, resource-poor Hungary lengthy parental leave policies turn women into an invisible ‘reserve army of labourers’. While their employment is mostly unaccounted (...) for in aggregate statistics, and political discourse suggests that their ‘job’ is to look after children, nevertheless many women do end up doing some work for wages during the almost five years they spend on parental leave. However, given the rigidity of the labour market and rampant discrimination against mothers with small children, their chances of obtaining formal employment are small. They therefore resort to doing ad hoc, temporary, informal work, which is often underpaid and well below their qualifications. Thus generous family policies do not necessarily indicate the ‘women friendliness’ of the state and may not lead to the relatively favourable trade-off between stable public sector work and lower wages suggested recently by comparative researchers. Instead, in this specific context, which combines legacies of state socialism, a backlash against women’s emancipation before 1990 and a peripheral, vulnerable labour market, familialist policies are associated with a high degree of marginalisation for women with small children in which the state is at best complicit, at worst, an active agent.
