The processes of state formation in the agrarian states of Southeast Asia lend themselves to fruitful comparative analysis using Eliasian concepts. However, in the difficult physical environment of a region endowed with plentiful land relative to population, the control of labour was more important than control of territory, as demonstrated by the cases of Siam and Java. Moreover, the religious, ceremonial and symbolic significance of kingship remained very important even when the coercive power of the centre was weak. (...) Courts made absolutist claims, but their dominance depended on symbolic power and on complex intrigues and networks of patronage. Elias is useful to analyse these endogenous processes of state formation. However, the modern states of the region were forged by colonialism, nationalist movements and the more recent technocratic developmentalist programmes of authoritarian elites. Rapid economic transformation and industrialization have brought new classes and new tensions to test the adequacy of state structures, now far removed from the elite territorial competition of the past. This article asks how state formation processes informed the normative frameworks of late-Medieval and early-Modern Latin European and Muslim Middle Eastern regimes. The question at hand is not why pre-Modern regimes discriminated against religious minorities (as well as other groups) during the pre-Modern period, but why Western European states consistently engaged in mass expulsions of their non-Christian subjects from the late thirteenth century onward and the neighboring states of the Middle East did not. Rather than addressing these peculiar (...) policies as a function of religion, culture, or law the article adopts a comparative, contextual method. With the aid of Charles Tilly’s theoretical perspectives it isolates critical variables in pre-Modern Middle Eastern state formation. These variables are then used to shed light on the circumstances and relationships that led to Latin Europe’s mass expulsions of Jews and Muslims between 1290 and 1614. (shrink)

A perennial concern among scholars of globalization is the relationship between global social formations and national and subnational political and economic developments. While sociological understanding of “the global” has become increasingly rich, stressing the complex relationship between material and cultural pressures, an undertheorized nation state often sits on the receiving end of the sociologist’s model of globalization. The goal of this article is to help move the sociology of globalization out of the analytical trap of global-national dualism by developing (...) an account of the transnationalization of political authority. Building on neo-Marxist and Weberian theories of the transnational, or global state, which explicate the macro-structural dynamics that have led to the transnationalization of the state as such, I look at the process of the transnationalization of political authority from an institutional perspective, one that focuses on processes of transnationalization within, and across, specific state agencies. These theoretical points are empirically motivated through an historical investigation of the transnationalization of monetary authority and its relationship to the international diffusion of policies of austerity from the era of the classical gold standard through the economic crisis of 2008. On the basis of this, the state-building concepts of the prominent Ukrainian thinkers of the 20th century become very important. Ibn KhaldØun’s theory of history has been extensively discussed and interpreted in widely divergent ways by Western scholars. In the context of present debates, it seems most appropriate to read his work as an original and comprehensive version of civilizational analysis (the key concept of ‘umran is crucial to this line of interpretation), and to reconstruct his model in terms of relations between religious, political and economic dimensions of the human condition. A specific relationship between state formation and (...) the broader context of civilizational processes appears as the most central theme. This civilizational approach is then contrasted with the most influential recent Western interpretation, put forward by Ernest Gellner. Gellner translates Ibn KhaldØun’s analysis into functionalist terms and thus tones down its historical and civilizational specificity. The consequences are most obvious when it comes to discussing the unity and diversity of the Islamic world, especially with regard to the Ottoman Empire. (shrink)

This article considers concrete manifestations of the politogenesis multilinearity and the variation of its forms; it analyzes the main causes that determined the politogenetic pathway of a given society. The respective factors include the polity's size, its ecological and social environment. The politogenesis should be never reduced to the only one evolutionary pathway leading to the statehood. The early state formation was only one of many versions of development of complex late archaic social systems. The author designates various (...) complex non-state political systems as early state analogues. The early state analogue posed a real alternative to the state for a rather long period of time, whereas in many ecologically marginal regions they could compete quite seriously with the state sometimes until recently. Thus, it was only in the final count that the state became the leading form of political organization of complex societies. The very pathways to statehood had a few versions. One may group them into two main types: ‘vertical’ and ‘horizontal’. Within the ‘vertical’ model the state formation took place in a direct way, i.e. directly from small pre-state polities to primitive statehood. Within the ‘horizontal’ model we first ob-serve the formation of early state analogues that were quite com-parable to the state as regards their complexity, whereas later those analogues were transformed into states . This book represents a unique endeavor to elucidate the story of Kosovo's unilateral quest for statehood. It is an inquiry into the international legal aspects and processes that shaped and surrounded the creation of the state of Kosovo. Being created outside the post-colonial context, Kosovo offers a unique yet controversial example of state emergence both in the theory and practice of creation of states. Accordingly, the book investigates the legal pathways, strategies, developments and policy positions of international agencies/actors (...) and regional players (in particular the EU) that helped Kosovo to establish its independence and gradually acquire statehood. Although contested, Kosovo, and its quest for statehood, represents a unique example of successful unilateral secession. The book therefore explores and analyses patterns of state formation and nation-building in Kosovo, and its transition to democracy. It presents a three-level assessment. First, seen from a historical perspective, the book examines the validity of the right of Kosovar-Albanians to self-determination and remedial secession. Second, from a legal positivist perspective, it scrutinizes all of the legalist arguments that support Kosovo's right to statehood, and claims that both traditional and legality-based criteria for statehood remain insufficient to determine whether Kosovo has achieved statehood. Third, from a post-factum perspective, the book analyzes the scope and extent to which the internationally blended element was decisive in Kosovo's state-formation and state-building processes. It explains how the EU's involvement as an 'internationally blended element' in Kosovo's efforts to achieve statehood was instrumental and played a crucial role in shaping the emerging state. In 2013-2022, the Ukrainian ethnic group faced numerous external and internal challenges, which were largely the result of its previous historical development and profound transformations in the public consciousness.These changes, in turn, have become a natural reaction to a number of historical processes and phenomena that have taken place in the territory of the people from ancient times to the present. In this article, the author aims to analyze some factors of stress genesis of the ethnic legal mentality of the (...) Ukrainian ethnic group and show their impact on the content of its behavioral stereotypes. The methodology of this study is comprehensive and is based on socio-philosophical and philosophical and legal analysis of behavioral attitudes of Ukrainians in the field of legal understanding.Results. In the course of analyzing the scientific works of a number of researchers, we found that during its historical existence, the Ukrainian ethnic group has experienced a number of events, phenomena and processes of objective reality, which led to the transformation of the content of its behavioral stereotypes. Factors of stress genesis can be divided into endogenous and exogenous. Exogenous sources of Ukrainian ethnopsychologists include, for example, continuous invasions of various aggressors (Tatar, Polish, Russian, German) and various attempts to acculturate Ukrainians.According to them, endogenous factors include various migration processes that have generated marginality and betrayal by Ukrainian leaders of their people. In the future, the established guidelines play or may play a destructive role in the process of nationbuilding.Conclusions. We found that the stress genesis of domestic political and legal can be defined as the process of creating political and legal mentality of the Ukrainian ethnos under the influence of events, phenomena, processes of its sociohistorical development, as well as factors of geographical location and environmental conditions. community and, as a consequence, cause transformations in the content of its guidelines. In addition, the border situation of Ukrainian lands, long statelessness of the ethnic group, serfdom in the homeland and other factors of socio-historical development of the national ethnic group have led to the emergence or deepening in the people’s consciousness such destructive stereotypes as anarchism, legal nihilism, freedom “, absenteeism and civic passivity, deep corruption traditions and nepotism, low status of state property, etc. (shrink)

The philosophical symbolism of H. Skovoroda’s works lies in wisdom, congenial work, seeing the big in the small, unveiling mysteries through the symbolic world. Skovoroda states that to be a human-being is to be a philosopher. The aim of philosophy is to reawaken the main mottos of the Age of Enlightenment (honor, dignity, freedom, justice, solidarity, morality). Creating open society in Ukraine on the basis of these mottos is the aim of the modern national state-building. The aim of the (...) article is to ascertain the influence and meaning of the philosophical and anthropological problems in the works of H. S. Skovoroda for building open society in the modern Ukraine. Methodology of the study is complex and based on the social-philosophical and historic-philosophical analysis of anthropological problems in the works by H. S. Skovoroda and its significance for finding personal freedom and building open society. The leading methodological tools are fundamental research basics of the scientific analysis – principles of objectivity, systematicity, integrity, unity of the historic and the logical, determinism, development, and interrelation. Methodology of social and symbolic representations, ethnic representations, and structural functionalism has been used. Results. As Ukraine is experiencing complex social and political processes, the philosophical works by H. S. Skovoroda acquires special importance: formation and preservation of the Ukrainian national identity, national values, morality, and culture. The society needs politically-minded citizens with clear ideas about the prospects of the state development. Researching works of Skovoroda, one can trace the development of the human spirit: an internally-devastated person devoid of life reference points is gradually adapting to the life in society, overcomes the discrepancies between the singular and the whole finding a compromise in the relations with the world around them. The fates of the people and the nation, language and the state were the key problems which H. S. Skovoroda thoroughly and passionately analyzed through the perspective of universal human values. Conclusions. The modern Ukrainian society needs people in harmony with themselves and the world who work on improving themselves and the society. Such people should be able to overcome both their own internal contradictions and the conflicts in society and the world. Putting significant hope on the human-being as the creator of the new morality, H. Skovoroda believed in the possibility of building solid foundations of the state. An internally rich person and citizen is going to contribute to harmony of the nature, the world, human relations focusing on the issues of good and love as integral attributes of the human existence. The writer considered such personalities to be able to carry peace and unity to the unstable reality full of life challenges and to oppose the alienation, absurdity, and insignificance of the human existence. Social network analysis has become an increasingly important tool among political scientists for understanding legislative cooperation in modern, democratic nation-states. Recent research has demonstrated the influence that group affinity (homophily) and mutual exchanges (reciprocity) have in structuring political relationships. However, this literature has typically focused on political cooperation where costs are low, relationships are not exclusive, and/or partisan competition is high. Patterns of legislative behavior in alternative contexts are less clear and remain largely unexamined. Here, we compare theoretical expectations of (...) cooperation in these contexts from the political and biosocial sciences and implement the first assessment of political alliance formation in a novel legislative environment where costs to cooperation are high and party salience low. We implement a stochastic actor-oriented model (SAOM) to examine bill floor sponsorship, a process in which a “floor sponsor” becomes the exclusive advocate for a colleague’s piece of legislation, in the Utah state legislature from 2005 to 2008—a context in which gender (male) and political party (Republican) supermajorities exist. We find that (1) party and gender homophily predict who legislators recruit as floor sponsors, whereas seniority does not, and (2) legislators frequently engage in reciprocal exchanges of floor sponsorship. In addition, whereas gender homophily increases the likelihood of reciprocity, party homophily decreases it. Our findings suggest that when the cost of cooperation is high, political actors use in-group characteristics for initiating alliances, but once a cooperative relationship is established with an out-group political member, it is reinforced through repeated exchanges. These findings may be useful for understanding the rise of political polarization and gridlock in democracies internationally. (shrink)

If we are looking for an Ur-explanation for the persistence of the Ur-myth, or any other myth, in our literature, could we not more directly find it in the structure of a mind which does not have to remember in order to imitate? The occasion of both myth and literature is the social life of the species which, in Starobinski's sense, is a history of continual eviction; but as regards the apparatus of thought by which this social life is reflected (...) in art it is more a history of assimilation and repetition. "The work of the brain," to cite a recent article in Scientific American, "is to create a model of a possible world rather than to record and transmit to the mind a world that is metaphysically true…Different worlds are presumably constructed by similar species."1 And, presumably, similar worlds are constructed by similar species. The article explores the historicity of political subjecthood, making the case that through a process of subjectification “subjects of the king” gradually became the political subjects of the state. This in turn contributed to reconstitute the state as an abstract notion that nevertheless was real through the allegiance owed to it by its subjects. Addressing the making of subjecthood in relation to state formation helps fill an important lacuna in the literature on state (...) class='Hi'>formation, namely the double oversight of subjecthood. Either studies of state formation have taken both territory and subjecthood—the two objects of state power—for granted, or, more recently, they have assumed that changes in subjecthood were a function of changes in territoriality. I propose to address this by inquiring into early modern subjecthood in its own right, through a historical exploration of the emergence of political subjecthood in English statutes during the Tudor period (1485–1602). The thesis advanced in this book is that feeling and cognition actualize through a process that originates in older brain formations and develops outward through limbic and cortical fields through the self-concept and private space into (as) the world. An iteration of this transition deposits acts, objects, feelings and utterances. Value is a mode of conceptual feeling that depends on the dominant phase in this transition: from desire through interest to object worth. Among the topics covered are subjective time (...) and change, the epochal nature of objects and their temporal extensibility and the evolution of value from inorganic matter into organic form. The theory of microgenesis informs this work. According to this theory, acts and objects evolve in milliseconds through phases that replicate patterns in forebrain evolution. The progression in the actualization of the mind/brain state is from archaic to recent in brain formation, from unity to diversity, from past to present and from mind to world. An account is given of the diversity of felt experience avoiding the reductionist moves characteristic of biological materialism and the inherent dualism of psychoanalytic and related theories. This article, the first of a two-part series, examines how Saint Ignatius of Loyola’s (1548/ 1991 ) nearly 500 year-old approach to the transformation of others in their leadership journeys is still being actualized, with applications to transformations in workplaces and the graduate education of business leaders, by drawing upon both the handbook Ignatius wrote to guide his work—called the _Spiritual Exercises_—and upon the account of his own transformation experience captured in his _Autobiography_. Our exploratory prelude to practice is guided (...) by the following questions that approximate (both in content and order) Ignatius of Loyola’s approach to personal and spiritual transformation: First, “What are my deepest desires?” (and this question has two distinct parts: “What don’t I want?” and “What do I want?”); once that has been clarified, the next question is “What does this require of me?” (In other words, what must be done to avoid the things you don’t want and achieve the things that you do want?); and finally, the last question requires an answer that lasts a lifetime: “How does this shape the person I am becoming?”. After characterizing the stages of Ignatius of Loyola’s (1548/ 1991 ) own transformation as: Deconstruction (the cannonball at Pamplona); Choice (while convalescing at Loyola); Reconstruction (during his retreat at Montserrat); and Integration (actualized by his mystical experience in Manresa), our contribution concludes by returning to the questions that frame our interrogative inquiry, but with an eye toward the professional formation of online graduate students of organizational leadership. In the second article (Tran and Carey 2023 ), our exploration continues by integrating academic theory with andragogical practice. There are many studies and theories in the literature on the source of power in the formative years of the Mamlūk state. In these studies, the importance of power and influence as a form of becoming a sultan in the Mamlūks has been emphasized, although the oligarchic power of the umara has been indirectly mentioned in terms of the source of power by discussing the distinction between a puppet sultan and an authoritarian sultan. However, this axiom causes a number (...) of problems and ambiguities within itself and leads to the supersession of the determinism of the elite amirs. This work will try to overcome this problem by focusing on the political developments during the foundation years of the state and discussing how powerful and influential amirs were restricted by the umara on their way to becoming sultans. At the same time, by focusing on the chronicles of the period in question, the administrative determinism of the Mamlūk factions as a decision-making mechanism in the Mamlūk state will be pointed out. On the other hand, the statement that power emanated from both the sultan’s household faction and the military support of the elite amirs or khushdāshs who held the Mamlūk oligarchy in their hands leads to overlooking the tension or conflict between the two throughout Mamlūk political history. Considering the state of conflict between the two sides, it is a logical contradiction for the two opposing poles to agree on the same candidate. For instance, considering Muʿizz Aybak’s accession to power, the Sālihiyya-Bahriyya amirs unanimously endorsed his sultanate, but in the process, Muʿizz Aybak prevailed over the tensions he experienced with the elite that brought him to power and managed to become the absolute sultan, albeit for a short time. Therefore, it is essential to keep in mind that there was no uniform relationship between the sultan and the elite amirs, but rather a dynamic functioning. In other words, the future sultan, who had to establish good relations with the amirs until he became sultan, had to go against the amirs who brought him to power if he wanted to become an absolute ruler after he became sultan. In this study, the source of Mamlūk power is traced to the collective interests of the Mamlūk factions. It is emphasized that these interests were usually centered on candidates who were seen as more moderate among the factions. At the same time, by revealing the shortcomings of the understandings presented as a rule such as “the one who kills the sultan becomes the sultan” and “the powerful and influential become the sultan”, the analysis of the period from the founding years of the Mamlūks to Baybars’ sultanate mostly emphasizes the continuity of the status quo of the elite amirs by highlighting the “sultanate of weak and middle-ranking amirs”. The analysis has pointed out that those who killed sultans or usurped the throne were punished rather than usurping the throne as a legitimate right. Similarly, the consensus of the umara on the candidate for sultanate was pointed out by mentioning that those who were powerful and influential were being challenged rather than made sultan. A decade has passed since the breaking out of the ‘Arabic Spring’ revolutionary phenomena all over the Arab World’s societies. Many challenging and radically intriguing developments and ramifications have eventuated out of that era and led the Arab World’s context into unchartered territories of existence and self-understanding. This essay pauses at one of the particular challenges that faces this Sitz im Leben, namely the question of identity-formation and self-perception processes. It argues that the Arab states do manifest in their (...) political and statehood situations a political situation of democracy that is run by ‘non-democrats’. The essay then suggests that this democracy of non-democrats is the outcome of the prevalence of an identity-formation and self-perception rationales that are rooted in crudely religious Weltanschauung that, far from maintaining distinction and particularity individually and communally, turns alterity into a self-otherizing dogma expressive of contrariety and stark divisive and discriminative relatedness to the other. The essay, finally, suggests that liberating the identity-formation process from the dogmatic attempt at turning religion into ‘identity’ per se is the first required step towards a more cross-pollinating and symbiotic relationality between the different persons and groups who live in that context. This paper tries to combine Peirce’s cosmology and metaphysics with current understanding in physics of the evolution of the universe, regarded as an ongoing semiotic process in a living cosmos. While the basic property of Life is viewed as an unexplainable Firstness inherent in the initial iconic state of the vacuous continuum we shall consider and exemplify two sign developing processes: (a) the transition from icon to index is considered as a symmetry breaking emergence of order actualising one (...) among the possibilities of the iconic vacuum; (b) the transition from index to symbol, regarded as a habit formation — an adaptation of the surroundings to the order that has emerged. While the iconic state is characterized by fractal self-similarity the transitions to index and symbol are modelled by the mean field theory of second order phase transitions. (shrink)

The process of Slovak political tradition formation during the establishment of an independent state is discussed in the article. Special attention is paid to the authoritarian tendencies, which developed after the breakup of Czechoslovakia, atypical for Central and Eastern Europe character of political transformation and the establishment of the entire state power system are analyzed. A brief historical background of the evolution of ‘the Slovak question‘ and its influence on the development of the state is (...) given. Authors highlight features of the social structure of Slovakia, emphasizing the special mentality, greatly influenced on the formation of the political system of the state in historical perspective. It is also noted, that formation of political tradition in Slovakia at the end of the twentieth century was marked by constant struggle between coalition and the opposition, which led to increased political instability in 1995-1997, which contributed to the emergence of the political tendencies, called ‘Slovak way of transformation‘. This had an impact on the integration processes in the state, which in 1994 declared its desire to join the European Union. The authors conclude that as long as the disparate political forces were unable to find a compromise and to determine priority in order to improve life of society rather than their personal ambitions, the Slovak political life was in a state of stagnation. Introspection has traditionally been defined as a privileged way of obtaining beliefs about one’s occurrent mental states, and the idea that it is psychologically and epistemically different from non-introspective belief formation processes has been widely defended. At the same time, philosophers and cognitive scientists alike have pointed out the unreliability of introspective reports in consciousness research. In this paper, I will argue that this dissonance in the literature can be explained by differentiating between infallible and informative introspective beliefs. I (...) will argue that the latter are formed similarly to beliefs about the external world, and are therefore susceptible to similar success and failure conditions. Understanding introspection as belief-like will help to locate possible sources of error in regular as well as in pathological cases, carrying relevant implications for the relationship between experience, belief, and delusion. We investigate a simple stochastic model of social network formation by the process of reinforcement learning with discounting of the past. In the limit, for any value of the discounting parameter, small, stable cliques are formed. However, the time it takes to reach the limiting state in which cliques have formed is very sensitive to the discounting parameter. Depending on this value, the limiting result may or may not be a good predictor for realistic observation times.

This review analyzes the book Rental Society: In the Shadow of Labor, Capital, and Democracy. The book’s authors consider factors and conditions for the transition from a social state and a society of mass labor to a rental type of society. The main reasons for this transformation are the depletion of resources on a global scale and the replacement of humans by machines, which entails the growth of social groups living off various forms of rent (benefits, unconditional basic income, (...) additional payments, etc.). Meanwhile, fewer and fewer people are involved in the production of wealth. Under these conditions, the only active political subject becomes a non-democratic and non-egalitarian state, which distributes rents to various social groups. Simultaneously with the transformation of economic, political, and social structures, the content of moral consciousness also changes during the transition from a labor society to a rent society. There is a transition from labor morality to rent-parasitic morality, which, in view of the objective conditions for the existence of the rent majority, is internalized and gradually becomes a new moral norm. Two possible scenarios for the further development of the rental society are discussed. The positive scenario is a formation of a new type of economy due to the development of science, personality, new socialization forms. Negative scenario is associated with the deepening and globalization of rent processes, leading to “neoliberal feudalism,” to a society without mass labor and economic growth but with a hierarchy of class-rent groups, between which the state distributes rents and privileges using non-economic methods. In addition, the article shows significant shortcomings of the reviewed research: inconsistent understanding of the concept of rent, overly broad understanding of the subjects of rental processes, unjustified extrapolation of rent relations to the whole history of mankind (so called rent presentism). Today’s Lithuania is the historical-legal result of many processes, including the creation of the country in the thirteen century, ongoing life during five hundred years, two annexations resulting in the disappearance from the political map and two rebirths. The tradition of statehood and extended experience has greatly contributed to its survival and its ability to regain statehood in the light of the changed political, economic and social circumstances. Upon the climax of the First World War, the reinstatement of the statehood (...) of Lithuania has been influenced by favourable international situation, the popularity of the principle of nation’s free choice, and the decisive actions by the Lithuanian politicians. The relationship of the modern Lithuanian statehood with the historical state of Lithuania meant the continuity of this statehood, even though it was a multinational country. Without any other prospects upon the fall of other European empires, it has been replaced by the statehood based on national ethnicity. Together with the determination to manage the reinstated country of Lithuania according to the democratic principles, this was the main difference from the historical Lithuania. The state of Lithuania has managed to keep its own legal formal framework even though it has lost sovereignty upon annexation by the Soviet Union. The statehood has been reinstated once favourable circumstances came into place within the Union. The High Council of Lithuania has transformed from being a marionette structure forced upon by alien country into an instrument of parliamentary struggle for independence that has represented the second rebirth of the statehood of Lithuania. The formation of own law in both cases occurred by temporarily using current alien legislation that was not in conflict with the newly adopted constitutional legislation. The former has been gradually replaced by own legislation. (shrink)

Contemporary nation‐states commonly meet all these criteria simultaneously. But historically, this complex governmental form evolved slowly and partially, with particular characteristics developing unevenly in different locales and becoming generalized over long time periods. The processes of state formation have been strongly influenced by many factors – the transition from feudalism to capitalism, changes in military technology, wars, revolutions, imitative effects, geopolitical situations, the rise of nationalism and of liberal democracy, and the experience of communism, fascism and other forms (...) of ‘exceptional regimes’ in industrialized countries. Within the defining characteristics set out above, there can be many different state variants, with contrasting institutional arrangements. Circumstances quite often arise where most defining characteristics are present but one or several features are missing or called in question – creating difficult cases where the attribution of statehood becomes problematic. This paper explores contemporary Jewish identity-formation and the centrality of official Holocaust memory and Zionism – understood as the ongoing settler-colonial project aiming at the formation and maintenance of a Jewish-exclusivist state in Palestine – to this process. It argues that identity politics within the Jewish community are based on an understanding of identity, which assumes it to be static and individual. In doing so, this political approach reproduces the essentialisation of Jewish communities under the banner (...) of Zionism and official state history. The paper aims to show how this process of identification between Judaism, official Holocaust memory and Zionism has been a state-led process, rooted in the historical development of antisemitism and European colonialism. In order to do so, it builds on a critique of classical Marxist analyses of the Jewish question. It finally proposes a more fluid approach to identity, which understands it as socially constructed, contested, and subject to political contestation. (shrink)

This article presents a critical discursive analysis around the concept of menstrual health in a series of texts published in book format and in social networks in the last five years (2019-2023) by different activists and menstrual educators in Argentina. In a reading itinerary that goes from the singular to the collective, I identify the configuration of an experiential episteme that redefines the menstruating body as informational and multidimensional, which enables that, in addition to a physiological dimension, its role in (...) different social, political, cultural, environmental and economic contexts is vindicated. I place these examples in the context of the neoliberal precariousness that installs the therapeutic-managerial culture as a moral imperative, while at the same time it challenges certain subjectivities with relative privilege —white, urban, trained and educated women— to dispute and strain meanings. The article examines how the rules on formation of contract and on mistake, contained in the various transnational model rules that have been published over the past two decades, have taken shape. The approach adopted here is based on an analysis of the ‘textual stratification’ of European private law. The relevant instruments (Convention on Contracts for the International Sale of Goods, Principles of European Contract Law, UNIDROIT Principles of International Commercial Contracts, Draft Common Frame of Reference, Principes contractuels communs) (...) are analysed and compared in their historical sequence. To what extent and why have the texts been transformed in the process? The article demonstrates that there is a very considerable common ground reflecting the state of the art of comparative research in these fields over the past hundred years. It also highlights issues on which consensus must still be reached and it suggests patterns towards reaching such consensus. It is argued that the Principles of European Contract Law, rather than the Draft Common Frame of Reference, should provide the point of departure for future discussions. This article devoted to study of the issues of formation and functioning of national political elites in the context of globalization processes. According to the author, processes of globalization, socio-political, public-legal, and financial-economic development in national societies and States led to the formation of the national political elites in a single global governing elite in the face of the global Manager class, which, in turn, forms the main approaches, requirements and principles that underlie the formation and functioning (...) of national political elites. However, all this leads to the fact that global and national management of the elite are unable on the one hand, to quickly solve global problems facing humanity, and on the other hand, to ensure the progressive development of humanity as a whole, resulting in the creation and development of a revolutionary situation in the national and international scale. The only alternative to the existing trends of the formation and development of national political elites in anti-state and anti-social manner, which inevitably can lead humankind to destruction or self-destruction, is the growing activity of civil society to the state of leveling of power and influence of the global ruling elite in the face of the global Manager class. This second volume of ReConFort, published open access, addresses the decisive role of constitutional normativity, and focuses on discourses concerning the legal role of constitutional norms. Taken together with ReConFort I (National Sovereignty), it calls for an innovative reassessment of constitutional history drawing on key categories to convey the legal nature of the constitution itself (national sovereignty, precedence, justiciability of power, judiciary as constituted power). In the late 18th and early 19th centuries, constitutional normativity began to complete the legal fixation (...) of the entire political order. This juridification in one constitutional text resulted in a conceptual differentiation from ordinary law, which extends to alterability and justiciability. The early expressions of this 'new order of the ages' suggest an unprecedented and irremediable break with European legal tradition, be it with British colonial governance or the French ancien régime. In fact, while the shift to constitutions as a hierarchically 'higher' form of positive law was a revolutionary change, it also drew upon old liberties. The American constitutional discourse, which was itself heavily influenced by British common law, in turn served as an inspiration for a variety of constitutional experiments - from the French Revolution to Napoleon's downfall, in the halls of the Frankfurt Assembly, on the road to a unified Italy, and in the later theoretical discourse of twentieth-century Austria. If the constitution states the legal rules for the law-making process, then its Kelsian primacy is mandatory. Also included in this volume are the French originals and English translations of two vital documents. The first - Emmanuel Joseph Sieyès' Du Jury Constitutionnaire (1795) - highlights an early attempt to reconcile the democratic values of the French Revolution with the pragmatic need to legally protect the Revolution. The second - the 1812 draft of the Constitution of the Kingdom of Poland - presents the 'constitutional propaganda' of the Russian Tsar Alexander I to bargain for the support of the Lithuanian and Polish nobility. These documents open new avenues of research into Europe's constitutional history: one replete with diverse contexts and national experiences, but above all an overarching motif of constitutional decisiveness that served to complete the juridification of sovereignty. This chapter reviews Europe's contributions to basic assumptions made in international law and governance. It examines the internal legal models that Europe created and that became foundational blueprints for modern liberal democracies. The chapter also focuses on international legal structures that were designed to operate in a manner consistent with the domestic European model e.g., liberalization of trade, legal protections for foreign investors, or uniform codes of commercial law for international transactions. The post‐Second World War regulation of commerce and livelihood (...) in the European statecraft model came hand‐in‐hand with the protection of personal rights. The modern liberal democratic state derived its legitimacy from management of a social and political structure that bettered the material lot of its nationals. We argue that Bohrian complementarity is a framework for making new ontological sense of scientific findings. It provides a conceptual pattern for making sense of the results of an empirical investigation into new realms or fields of natural properties. The idea of “formation length” engenders this mutual attunement of evidence and reality. Physicists want to be able to ascribe ontological features to atomic constituents and atomic processes such as “emission”, “impact”, or “change of energy-state”. These expressions supposedly refer (...) to “local” forms of physical change that in sum constitute the possibility of there being a “global” (for example an atomic) system of possible states. We argue that it is only because we can act it out in the design of experiments that we canmake sense of the link between classical and quantum theoretical systems. We need the notion of formation length in order to express the principle that the atom is a causal unity. This not in the sense of being the ground for a particular kind of causality, but in the sense of unifying the grounds for the variety of causal manifestations that constitutes the atom. (shrink)

Norbert Elias's The Civilizing Process, which was published in German in 1939 and first translated into English in two volumes in 1978 and 1982, is now widely regarded as one of the great works of twentieth-century sociology. This work attempted to explain how Europeans came to think of themselves as more “civilized” than their forebears and neighboring societies. By analyzing books about manners that had been published between the thirteenth and eighteenth centuries, Elias observed changing conceptions of shame and (...) embarrassment with respect to, among other things, bodily propriety and violence. To explain those developments, Elias examined the interplay among the rise of state monopolies of power, increasing levels of economic interconnectedness among people, and pressures to become attuned to others over greater distances that led to advances in identifying with others in the same society irrespective of social origins. Elias's analysis of the civilizing process was not confined, however, to explaining changing social bonds within separate societies. The investigation also focused on the division of Europe into sovereign states that were embroiled in struggles for power and security.This article provides an overview and analysis of Elias's principal claims in the light of growing interest in this seminal work in sociology. The analysis shows how Elias defended higher levels of synthesis in the social sciences to explain relations between “domestic” and “international” developments, and changes in social structure and in the emotional lives of modern people. Elias's investigation, which explained long-term processes of development over several centuries, pointed to the limitations of inquiries that concentrate on short-term intervals. Only by placing short-term trends in long-term perspective could sociologists understand contemporary developments. This article maintains that Elias's analysis of the civilizing process remains an exemplary study of long-term developments in Western societies over the last five centuries. (shrink)

The countries of the Gulf Cooperation Council are most typically understood from the perspective of their position as the world’s key oil- and gas-producing states. This essay explores the largely-overlooked processes of class-formation in the GCC, and argues that very profound tendencies of capital-internationalisation are occurring alongside Gulf regional integration. The circuits of capital are increasingly cast at the pan-Gulf scale, and a capitalist class – described as khaleeji-capital – is emerging around the accumulation-opportunities presented within the new regional (...) space. The formation of khaleeji-capital represents the development of a class increasingly aligned with the interests of imperialism and has important ramifications for understanding the region’s political economy. In cognitive science, the dynamical systems theory (DST) has recently been advocated as an approach to cognitive modeling that is better suited to the dynamics of cognitive processes than the symbolic/computational approaches are. Often, the differences between DST and the symbolic/computational approach are emphasized. However, alternatively their commonalities can be analyzed and a unifying framework can be sought. In this paper, the possibility of such a unifying perspective on dynamics is analyzed. The analysis covers dynamics in cognitive disciplines, as well (...) as in physics, mathematics and computer science. The unifying perspective warrants the development of integrated approaches covering both DST aspects and symbolic/computational aspects. The concept of a state-determined system, which is based on the assumption that properties of a given state fully determine the properties of future states, lies at the heart of DST. Taking this assumption as a premise, the explanatory problem of dynamics is analyzed in more detail. The analysis of four cases within different disciplines (cognitive science, physics, mathematics, computer science) shows how in history this perspective led to numerous often used concepts within them. In cognitive science, the concepts desire and intention were introduced, and in classical mechanics the concepts momentum, energy and force. Similarly, in mathematics a number of concepts have been developed to formalize the state-determined system assumption [e.g. derivatives (of different orders) of a function, Taylor approximations]. Furthermore, transition systems - a currently popular format for specification of dynamical systems within computer science - can also be interpreted from this perspective. One of the main contributions of the paper is that the case studies provide a unified view on the explanation of dynamics across the chosen disciplines. All approaches to dynamics analyzed in this paper share the state-determined system assumption and the (explicit or implicit) use of anticipatory state properties. Within cognitive science, realism is one of the problems identified for the symbolic/computational approach - i.e. how do internal states described by symbols relate to the real world in a natural manner. As DST is proposed as an alternative to the symbolic/computational approach, a natural question is whether, for DST, realism of the states can be better guaranteed. As a second main contribution, the paper provides an evaluation of DST compared to the symbolic/computational approach, which shows that, in this respect (i.e. for the realism problem), DST does not provide a better solution than the other approaches. This shows that DST and the symbolic/computational approach not only have the state-determined system assumption and the use of anticipatory state properties in common, but also the realism problem. The paper presents a draft model of the relationship between shame, treated as one of the self-conscious emotions, and the identity formation process. Two main concepts of shame have been discussed here: shame as an adaptive emotion, in line with the evolutionary approach, and as a maladaptive emotion, according to cognitive attribution theory. The main thesis of this paper states that shame has an essential, both constructive and maladaptive, importance for identity development and that its effect is indirect (...) as it works through the mechanisms of emotion regulation. The destructive and disrupting influence of shame is not an immanent feature of this emotion, but it is a consequence of malfunctioning mechanisms of shame regulation. The association of shame with identity formation relates to the exploration dimensions - exploration in breadth, exploration in depth and ruminative exploration, as well as to commitment making and identification with commitment. One of the most significant, incontestable, and relatively ignored aspects of modernity is the new role states play as generators and facilitators of disasters, on the one hand, and as authors — or at least facilitators, sponsors, and coordinators — of survival and relief operations, on the other hand. The relation of the modern state to disaster has played an important role in the emergence of the state as a "totalizing totality" and in the constitution of its image (...) as a historical subject. This Article argues that state’s relation to disaster and its unfolding consequences has developed in two opposite directions that should be distinguished carefully. In line with these two opposite relations to disaster, I suggest a theoretical distinction between two state formations: a providential state and a catastrophic state. This distinction is based on Agamben’s concept of "bare life," which a sovereign may forsake by declaring an exception but which it may also save by taking extraordinary measures of protection or relief. The Article examines two aspects of the difference between the two state formations. From a formal point of view, it distinguishes and discusses two different notions of sovereignty, its authority, foundation, and legitimacy, along with two different understandings of the subjectivity of the state. These two conceptions involve and are intimately related to two distinct sets of theological presuppositions and two different conceptions of the political. From a chronological point of view, the Article sketches two diverging genealogies that go back to distinct, even if related, moments in the history of the modern West. Recognizing the fact that in certain historical moments these two genealogies were intertwined and that in our time this intertwinement has yielded a rapid process of hybridization, the Article claims that this process is not dialectical, and that the difference between the two genealogies should be maintained for theoretical and political reasons alike. Next‐generation sequencing (NGS) technologies have revolutionised the analysis of genomic structural variants (SVs), providing significant insights into SV de novo formation based on analyses of rearrangement breakpoint junctions. The short DNA reads generated by NGS, however, have also created novel obstacles by biasing the ascertainment of SVs, an aspect that we refer to as the ‘short‐read dilemma’. For example, recent studies have found that SVs are often complex, with SV formation generating large numbers of breakpoints in a single (...) event (multi‐breakpoint SVs) or structurally polymorphic loci having multiple allelic states (multi‐allelic SVs). This complexity may be obscured in short reads, unless the data is analysed and interpreted within its wider genomic context. We discuss how novel approaches will help to overcome the short‐read dilemma, and how integration of other sources of information, including the structure of chromatin, may help in the future to deepen the understanding of SV formation processes. The question of immigration and its corollary community and minority formation has always been analysed in relation to states. However, the increasing importance of solidarity beyond national borders on the grounds of one or several identities – national, religious, ethnic, regional – removes the claim of recognition of a collective identity from a national level to an international level and, in the European Union, to a supranational level. Such an evolution places territory at the core of the analysis of (...) citizenship and nationhood, for communities as well as states. This article will attempt to show that in this new configuration, negotiations between states and immigrants are brought beyond borders in order for states to maintain the ‘power’ of incorporation and citizenship while expanding their influence beyond their territories and to compete with transnational communities in their engagement in the process of globalization. A hypothesis on the physiological conditions for the occurrence of phenomenal states is presented. It is suggested that the presence of phenomenal states depends on the rate at which neural assemblies are formed. Unconsciousness and various disturbances of phenomenal consciousness occur if the assembly formation rate is below a certain threshold level; if this level is surpassed, phenomenal states necessarily result. A critical production rate of neural assemblies is the necessary and sufficient condition for the occurrence of phenomenal states.

From experience, we know that some cognitive processes are effortless and automatic (or nearly automatic), while others are hard and deliberate. Dual process (DP) accounts of human cognition explain these differences by positing two qualitatively distinct types of cognitive processes within the human mind—types that cannot be reduced to each other. Because DP constructs are bound to show up in discourse on human cognition, decision-making, morality, and character formation, moral philosophers should take DP accounts seriously. Here, I provide (...) an overview of the current state of DP accounts—their basic tenets, major concepts, and the various models of the DP framework—and note some of its more salient criticisms from the psychological research community. Finally, I show that DP accounts’ commitment to a real qualitative distinction between rational and non-rational human behavior puts them at odds with a Thomistic/Aristotelian view of practical rationality. The purpose of this study seeks to analyze the problem of Unity in Diversity as a Source of Politics and Cultural Identity of the Indonesian Nation in Legal Formation. In general, the process of establishing customary, national, regional and international law in various parts of the world no one knows even uses Bhineka Tunggal Ika as the source of legal formation. However, often the formation of law in Indonesia refers to the philosophical meaning of Unity in (...) Diversity. The formulation of the research problem: 1) What are the markers of Unity in Diversity in Legal Formation?; 2) Why is Bhineka Tunggal Ika so important in the Formation of Law in Indonesia?; 3) Is there a contribution of Bhineka Tunggal Ika in the formation of customary law? This research was completed using qualitative methods. All data in this study are descriptive which have been collected directly or indirectly. Data acquisition is optimized through a literature study. All data were analyzed qualitatively to solve the research problem. The results showed that: 1) Unity in Diversity can be a marker of Indonesian national cultural identity in Legal Pluralism; 2) Bhineka Tunggal Ika in the formation of state law is considered relevant as a political source that is able to accommodate Customary Law and Religious Law into State Law; 3) Unity in Diversity as the identity of Indonesian Nation Culture, as well as political sources, has contributed in the spirit of the formation of Customary Law in the midst of the times. The author, using a systematic approach, forms a picture of the process of historical development as the process of formation of the system "man and nature", the interaction of which is mediated by the system "public consciousness — public practice". The cycle of formation of the system "man and nature" goes through four stages: from unity with the nature of primitive man through the stages of contradictions: from dependence on nature and domination over it to conscious (...) unity with nature. The onset of each stage of this process is associated with the achievement of a new quality of the individual's system, with the dominance of the picture of the unity of the world in the public consciousness, with the strengthening of the interaction of subjective and objective. The completion of the formation of the system "man and nature" and the transition to the stage of unity is associated with the formation and dissemination of the worldview of unity — a systemic worldview. In this picture of the developing world, as the basis of a systemic worldview, the logic of the development of the individual's system, social consciousness and social practice has a non-linear character of the formation of opposite hierarchies with the subsequent transition to dialectical unity in full accordance with the dialectical logic identified by G.W.F. Hegel: thesis — antithesis — synthesis. This is exactly how the development of Russian society takes place, in which the new quality of the individual's system is associated with the development of social consciousness: idealism — materialism — a systemic worldview, and social practice: capitalism — socialism — a social state with a market economy. The article is devoted to revealing the phenomenon of contemporary changes in the language space, in accordance with the processes of transition that take place in the economy of Ukraine in the context of knowledge representation, neuro-modeling and artificial intelligence. The relevance and expediency of the study are due to the uncertainty to some extent of innovative processes occurring in the development of the contemporary Ukrainian language in connection with the transitional processes in the economy. The relevance of the study (...) is determined by: 1) the importance for contemporary linguistics of identifying and describing the structural and typological features of the “dominant” lexical and semantic subsystems of the contemporary Ukrainian language, reflecting the most significant concepts of contemporary Ukrainian conceptosphere; 2) the importance of the lexical subsystem of public administration not only for the contemporary Ukrainian language and contemporary Ukrainian national consciousness, but also for the effective economic policy of the state; 3) a lack of special generalizing research on the problems of formation, development and current state of the Ukrainian vocabulary of state regulation of the economy; 4) the need to clarify and improve the methodology of complex analysis of lexical and semantic systems in the Ukrainian language, methods and techniques of describing lexical units in synchronous and diachronic aspects. 5) current needs in the use of artificial intelligence, based on the principles of neuro-modeling in the representation of knowledge in the conditions of transition economy of Ukraine.
