This article argues that understanding “wild” land as terra nullius (“land belonging to no one”) emerged during historical colonialism, entered international law, and became entrenched in national constitutions and cultural mores around the world. This has perpetuated an unsustainable and unjust human relationship to land no longer tenable in the post-Lockean era of land scarcity and ecological degradation. Environmental conservation, by valuing wild lands, challenges the terra nullius assumption of the vulnerability of unused lands to encroachment, while indigenous (...) groups reasserting their rights to communal territories likewise contest individual property rights. This article addresses the underestimation of Medieval philosophy in the contemporary curriculum by engaging its very origins in the ‘postmodern’ dislocation of philosophy. The leading question is what would be the prospects in the 21st century of reorienting Western philosophy from its idea-historical sources, which would include its ancient traditions and the Medieval exposition, as well as the Renaissance elucidation thereof. Critically engaging the works of numerous ‘postmodern’ philosophers as well as critics of the ‘postmodern’ departure from traditional philosophy, this (...) article argues for the re-establishment of the late Medieval notion of sensus communis, both as common sense and community sense. Against this backdrop, the article reappraises Medieval thought within the context of sensus communis to combat the contemporary dislocation of philosophy, by raising the possibility of the presentation of first-order judgments via sensus communis in a new pursuit for wijsbegeerte. The present paper presents a philosophical analysis of earth science, a discipline that has received relatively little attention from philosophers of science. We focus on the question of whether earth science can be reduced to allegedly more fundamental sciences, such as chemistry or physics. In order to answer this question, we investigate the aims and methods of earth science, the laws and theories used by earth scientists, and the nature of earth-scientific explanation. Our analysis leads to the tentative conclusion that (...) there are emergent phenomena in earth science but that these may be reducible to physics. However, earth science does not have irreducible laws, and the theories of earth science are typically hypotheses about unobservable (past) events or generalised - but not universally valid - descriptions of contingent processes. Unlike more fundamental sciences, earth science is characterised by explanatory pluralism: earth scientists employ various forms of narrative explanations in combination with causal explanations. The main reason is that earth-scientific explanations are typically hampered by local underdetermination by the data to such an extent that complete causal explanations are impossible in practice, if not in principle. In this paper, I argue that the Hindmarsh and Wik cases stand as crucial case studies that evidence the ongoing production of terra nullius within contemporary Australian contexts. They bring into focus the critical importance the signifiers of property, capitalist ‘productivity’ and legality within the settler-colonial state. Alongside notions of ‘civility,’ discourses surrounding ‘economic productivity’ and ‘equality before the law’ are consistently mobilised in these cases to assert white sovereignty. In contradistinction to the discourses that construct Indigenous people’s relation (...) to land as a singular and affective ‘affinity,’ media, political and legal texts script white Australian land uses such as farming and mining as ‘productive’ and necessary for economic prosperity. They are posited with ‘monetary’ output and juridical standing in order to produce the narrative that the continent was lawfully ‘settled’ by ‘illustrious’ white Australians. Moreover, these signifiers ramify within colonial law. Following these cases, the state amended the Aboriginal and Torres Straight Islander Heritage Protection Act 1984 and the Native Title Act 1993 respectively. They ensured the material construction of the Hindmarsh Island Bridge and the revocation of specific Indigenous land rights in order to sustain the settler-colonial state’s claims to sovereignty. Der sensus communis vermittelt Apriori und Aposteriori, Intellektualität und Sinnlichkeit, Inter- und Intrasubjektivität. Die Studie analysiert die Bedeutungen und Funktionen des Begriffs in Kants Gesamtwerk, wobei sie Kants Einteilung der Philosophie folgt: Sie untersucht den sensus communis logicus im theoretischen Bereich, den sensus communis aestheticus im ästhetischen Bereich und den sensus communis practicus im praktischen Bereich.

In the literature on Hannah Arendt’s Lectures on Kant’s Political Philosophy, two sorts of claim have been made by different interpreters. First, there is Beiner’s observation that there is a shift in Arendt’s thoughts on judgment, which has led to the idea that Arendt develops two distinct theories of judgment. The second sort of claim concerns Arendt’s use of Kant’s transcendental principles. At its core, it has led to the critique that Arendt detranscendentalizes — or empiricalizes — Kant, by linking (...) Kant’s judgments of taste to an empirical sociability. In this article, I argue against both of these claims. Early fragments of Arendt’s on judgment make clear that she develops only one theory of judgment. It is only that it is not until later in her life that she fully elaborates it. Nor does Arendt confuse Kant’s idea of enlarged thinking with an actual dialogue with others. In fact, Arendt introduces an interesting interdependence between judgment and speech, or communication. I develop my argument by first outlining the problems Arendt hoped to resolve via judgment. Through my reading of the Lectures on Kant’s Political Philosophy, I show how Arendt interprets Kant’s Critique of Judgment not as his theory of aesthetic judgments, but as an answer to the more general question ‘How do I judge?’ I also clarify the difference Arendt draws between common sense and community sense. With community sense, Arendt uncovers a foundation not only for men as political beings but also for the idea of humanity. This finding is often overlooked in the literature. I conclude with another Arendtian distinction that is often overlooked, that between spectators and the solitary philosopher. (shrink)

For more than a century the paradigm inspiringcognitive neuroscience has been modular and localist.Contemporary research in functional brain imaginggenerally relies on methods favorable to localizingparticular functions in one or more specific brainregions. Meanwhile, connectionist cognitive scientistshave celebrated the computational powers ofdistributed processing, and pioneered methods forinterpreting distributed representations. This papertakes a connectionist approach to functionalneuroimaging. A tabulation of 35 PET (positronemission tomography) experiments strongly indicatesdistributed function for at least the ''medium sized''anatomical units, the cortical Brodmann areas. Moreimportant, when these PET (...) experiments were interpretedas distributed representations, multidimensionalscaling revealed a ''brain activation space'' with asalient structure organized primarily by the sensorymodality of the stimulus, and secondarily by the typeof motor response. These results suggest that currentanalytical techniques in functional neuroimagingshould be augmented by distributed processinganalyses, and that these analyses may lead to manydiscoveries about the structure of ''inner space.''. The current debate over the global distribution of COVID-19 vaccines once again highlights the many shortcomings of the modern intellectual property system, especially when it comes to equitable access to medicines. This essay argues that the conceptual center of struggles over access to new pharmaceuticals rests in the IP system's colonial legacy, which perceives the world as uncharted territory that is ripe for discovery and ownership. This vision of the world as a blank canvas, or terra nullius, sets aside (...) any other models of ownership and devalues other traditional modes of relating to territory and nature. Several examples show the long-lasting exclusionary effects of this hidden legacy of colonial conquest in the field of public health, ranging from the spiraling price of insulin to the distribution of COVID-19 vaccines to the negotiation of sharing mechanisms for virus samples. In all of these cases, the continuing marginalization of other interests by the IP system can lead to exploitation, without either the “sources” of materials, such as those from whom the samples were taken, or the recipients of the eventual product having any say in matters of price and access. This legacy of fundamental exclusion needs to be recognized and addressed in order to arrive at more equitable solutions to public health emergencies such as the current pandemic. (shrink)

Zakljucno ce se ovaj prvi deo rada baviti Kantovim shvatanjem sensus communis-a, i pokusati da ukaze na neke njegove specificnosti, koje omogucuju da se o njemu ne govori kao o empirijskom faktu. Peter Harrison's The Territories of Science and Religion throws down a serious challenge to advocates of dialogue as the primary means of engagement between science and religion. This article accepts the validity of this challenge and looks at four possible responses to it. The first—a return to the past—is rejected. The remaining three—exploring new epistemic frameworks for the encounter of science and religion, broadening out the engagement beyond the context of the physical sciences and Western culture, and looking at ways (...) in which scientific and theological practitioners may collaborate on practical problems—are all offered as potential ways in which science and religion may engage with one another, in ways which move beyond Harrison's critique. Este artigo é resultado de um projeto de pesquisa e registro de grafites e pichações inscritas nas paredes de Lisboa, e que advém de produção artística e política urbana feita pela população negra portuguesa e imigrante, que habita a cidade. O resultado é esta escrevivência sobre o corpo negro [feminino] em relação - e em atividade - com a experiência de ser e de estar (em) Lisboa, pensando como essas marcas da cidade afetam corpos negros, inclusive o meu. Dada a (...) oportunidade, e destinada ao reconhecimento de dados sobre o que é ser do outro lado do Atlântico, nesta cidade qualquer. Pelas ruas da Damaia, pelas ruas da Linha de Sintra, da Cova da Moura, vi o meu corpo em protagonismo com outros corpos. E desta visagem necessária, articulei uma série de imagens, que revelam as marcas de uma população igual a mim, e diferente a mim, registradas nas paredes dessas cidades específicas, que moram e habitam a Lisboa dourada, das gentrificações, dos turistas em excesso e dos muitos pequenos mundos internos - que a constroem e alimentam. I have long felt that graduate education in philosophy, when successful, produces in its beneficiaries a strong antipathy, almost an allergic reaction, to “ism” words. “Naturalism,” nevertheless, is not one that is easy to eschew. This is not because of anything like a widely shared or especially intuitive doctrine associated with the term. The numerous doctrines offered by way of characterization often seem either suspicious because of their strength, or else platitudinous, too easy and not sufficiently restrictive. O presente artigo tem como objectivo fundamental propor uma interpretação do poema de T.S. Eliot, The Waste Land, no qual a experiência do mal constitui ponto de referência central. Esta experiência, traduzida metaforicamente por "terra desolada", pode ser perspectivada tanto em termos pessoais como civilizacionais. O poema, depois de realizar o diagnóstico de uma situação de crise profunda, realiza o que poderíamos designar como um ritual catártico que permite a purificação das dimensões negativas, sedimentadas em nós, constrangedoras da nossa (...) liberdade. /// This paper proposes an interpretation of T. S. Elliot 's poem The Waste Land whose core is the experience of evil. Such experience, expressed by the metaphor of the "waste land", can be viewed either in personal or in civilizational terms. After diagnosing a profound crisis, the poem goes on to what could be called a cathartic ritual, which enables the purification of negative elements of life that constrain our freedom. (shrink)

This book reflects on the problematic relation of ethics to politics in our 'democratic' era.

In this paper I respond to Lois McNay’s article “The politics of exemplarity: Ferrara on the disclosure of new political worlds.” After contextualizing her appraisal of my views on exemplarity within the current debate about critical theory and postcolonialism, and after clarifying my interpretation of Kant’s notion of sensus communis, I defend the function that this concept plays within an immanent and experience-near approach to critical theory. Sensus communis is what makes of a subjective grievance a cogent critique. (...) I then elucidate how the transcontextual communicability of human flourishing can be understood, along lines still compatible with Kant’s theory of judgment. In the final section of the paper, McNay’s suggestion to reconceptualize critique in experience-near terms is integrated as a genealogical reconstruction of sensus communis as nourished by encounters with experiences of injustice. Sin embargo, expone, prospectivamente, diferentes vías para tratar de superar el desterramiento y/o enterramiento de la asignatura: ya sea la resurrección o la reencarnación. La inutilidad y la melancolía enmarcan un final aquejado de la tensión gramsciana entre el pesimismo de la inteligencia y el optimismo de la voluntad.
