This special issue of Etikk i Praksis – Nordic Journal of Applied Ethics features four articles that address a number of urgent ethical issues that arise in the COVID-19 pandemic.

Siden 2007 har HOD og KS satset store ressurser på prosjektet «Samarbeid om etisk kompetanseheving» i kommunale helse- og omsorgstjenester. Hensikten med prosjektet har vært å heve de ansattes etiske kompetanse, og ett av de iverksatte tiltakene har vært å etablere refleksjonsgrupper i etikk. Denne artikkelen er basert på en evaluering av arbeidet i refleksjonsgruppene med fokus på hvordan etikkveilederen, også kalt fasilitator, beskriver arbeidet i gruppene. Hensikten med studien var å utvikle kunnskap om hvordan arbeidet med etikk-refleksjon (...) foregår, samt å diskutere om måten det arbeides på kan forventes å bidra til etisk kompetanseheving blant gruppemedlemmene. Vinteren 2012 gjennomførte vi fokusgruppeintervju i åtte kommuner med ansatte fra ulike deler av den kommunale helse- og omsorgstjenesten, ett intervju i hver kommune, til sammen 33 personer. Data ble analysert og fortolket i tråd med hermeneutisk metode. Resultatene viser at de i refleksjonsgruppene diskuterer alt fra verdier, begreper, fiktive case, dilemmaer til vanskelig situasjoner fra egen praksis. Refleksjonsmetodene varierer i spennet fra fri diskusjon til en strukturert samtale. Fasiltatorenes helsefaglige grunnutdanning og kunnskap om etikk og refleksjon ser ut til å være avgjørende faktorer for om refleksjonsgrupper i etikk mest fungerer som et pusterom, eller blir en læringsarena for etisk kompetanseheving. Resultatene diskuteres i lys av lærings- og refleksjonsteori.Nøkkelord: Etikk, evaluering, fasilitatorer, kommunehelsetjenesten, læring, refleksjonsgrupper English Summary: Ethics reflection groups: Just a “time out” or a learning arena?Since 2007, there has been a nationally prioritised programme aiming to enhance ethics competence in Norwegian community health care. One of many measures has been to establish ethics reflection groups. The purpose of this study was to obtain knowledge about how ethics reflection is carried out and if the reflection strengthens the participants´ competence in ethics. In this article, we focus on how the role of the facilitator, and the objective is to describe and discuss how the facilitator work and facilitate in the groups. We conducted focus group interviews with facilitators from various clinical settings in eight different municipalities. Data were analysed and interpreted according to hermeneutic methodology. The findings show that the discussions in the reflection groups varied from values, concepts and fictional cases to dilemmas and ethically difficult situations from the participants own practice. The methods used varied from free conversation to structured reflection. Competence in ethics and methods of reflection are essential skills facilitators must employ/have to run the groups. This special issue of Etikk i praksis features papers that articulate and discuss approaches and methodology that seek to make normative research activity and research output productive in contexts of ongoing societal and technological decision-making. The articles in various ways and to a varying degree exemplify and reflect on the methodology of the study of normativity in innovation.

This special issue of Etikk i praksis - Nordic Journal of Applied Ethics deals with the largely underexplored connections between public domain and democracy in the digital age and features articles highlighting various aspects of this broader theme.

Artikkelen undersøker hvordan NIPT ble vedtatt implementert i det norske fosterdiagnostiske systemet gjennom en fagligpolitisk prosess mellom 2012 og 2017. Prosessen innebar at Nasjonalt kunnskapssenter for helsetjenesten, Helsedirektoratet, Bioteknologirådet og Helse- og Omsorgsdepartementet ga sine vurderinger av testen og sine råd omkring en eventuell innføring. Artikkelen viser at det i denne prosessen foregikk en forsiktig tilnærming eller sammensmelting mellom de tradisjonelt helt ulike måtene å forstå og å ramme inn fosterdiagnostikk på i Norge, dvs. i en ‘autonomi/ behandlingsramme’ og en (...) ‘sorteringsramme’. Artikkelen argumenterer videre for at denne tilnærmingen eller konvergensen var mulig fordi prosessen ble holdt innenfor de fagligpolitiske byråkratiene, og de ulike etatene var innstilt på å ‘samarbeide’ om å inkludere både kunnskap og verdier fra begge rammene i sine tilrådninger. Politikk for fosterdiagnostikk er imidlertid et svært politisk betent område i Norge, og denne konvergensen var et skjørt byggverk. Den sprakk da også opp i løpet av tre uker i mai 2020, da Fremskrittspartiet plutselig inngikk et ‘bioteknologiforlik’ med Arbeiderpartiet og SV etter at de hadde gått ut av Solbergregjeringen. Dermed endte spørsmålet om implementeringen av NIPT i Stortinget, hvor konvergensen i den fagpolitiske prosessen ble erstattet av de tradisjonelle frontene, og de gamle innrammingene igjen ble ‘satt i arbeid’. Artikkelen diskuterer avslutningsvis kort de bortimot uløselige dilemmaene disse innrammingene både representerer og produserer. Nøkkelord: NIPT, fosterdiagnostikk, humanmedisinsk bioteknologi, regulering English Title: Fetal diagnostics between medicine and ethics: Implementation of Prenatal Invasive Testing in a turbulent policy area: The article examines how the decision to implement Prenatal Invasive Testing in the Norwegian Fetal Diagnostic System was reached through a professional policy process between 2012 and 2017. The process involved the Norwegian Research Centre for Health Services, the Norwegian Directorate of Health, the Norwegian Biotechnology Advisory Board and the Ministry of Health and Care Services, which provided their individual assessments and advice regarding the potential implementation of the test. The article finds that a careful convergence took place between traditionally opposing ways to understand and frame fetal diagnostics in Norway – either as a ‘treatment frame’ or a ‘sorting frame’. The article further argues that this convergence was possible because the process was kept within these bureaucracies, and that the different agencies were willing to collaborate to include knowledge and values from both frames in their recommendations. However, policy for fetal diagnostics is a very turbulent political area in Norway, and this convergence was a fragile construction. During three weeks in May 2020, the convergence collapsed when the Norwegian Progress Party suddenly entered a “biotechnology settlement” with the Labour Party and the Socialist Left Party after exiting the conservative Government coalition. Hence, the question of implementing NIPT ended up in the Norwegian Parliament, where the convergence from the professional policy process was replaced by the traditional fronts, and the old framings were again set in motion. Lastly, the article briefly discusses the almost unsolvable dilemmas these framings both produce and represent. Kliniske etikkomiteer har vært etablert i norske helseforetak siden 1996, først som et prøveprosjekt, senere som et permanent tiltak med et nasjonalt mandat. I forbindelse med det nasjonale etikkprosjektet «Samarbeid om etisk kompetanseheving» har det også i noen kommuner blitt etablert KEK. Senter for medisinsk etikk ved Universitetet i Oslo er tildelt ansvaret for oppfølging av KEK i helseforetakene og er i tillegg gitt et langsiktig ansvar for etikkarbeid og forskning i den kommunale helse- og omsorgstjenesten. Hensikten med denne (...) studien har vært å fremskaffe kunnskap om hvordan det står til med KEK som er etablert i kommunene. Hva jobber de med, hvilken betydning erfarer de at KEK har og hvilke ressurser har de? Studien har et kvalitativt design. Materialet er basert på telefonintervjuer med ledere for KEK og gjennomgang av komiteenes årsrapporter. Det er gjennomført en kvalitativ innholdsanalyse av datamaterialet. Komiteene arbeider både med enkeltsaker, saker av mer prinsipiell karakter og etikkskolering. Arbeidet vurderes som betydningsfullt og gjennomføres til tross for få ressurser og svak forankring. Kanskje vil en styrket forankring og ressurssituasjon og et nasjonalt mandat bidra positivt til komiteenes arbeid. Clinical ethics committees have been established in Norwegian hospital trusts since 1996, first as a pilot project, later on a permanent basis with a national mandate. As part of the national ethics project "Cooperation on ethical competence" some municipalities have also established a CEC. Centre for Medical Ethics at the University of Oslo is given the responsibility to support CECs in hospital trusts, and is also given a long-term responsibility for ethics support and research in municipal health care services. The purpose of this study was to obtain knowledge about the situation of CECs established in municipalities. What are they working on, what impact do they find that CEC has, and what resources do they have? The study has a qualitative design. The material is based on telephone interviews with CEC chairs, and reviews of the committees' annual reports. We have carried out a qualitative content analysis of the data. The committees work with individual cases, issues of a more principle character, and ethics training. The work is considered to be significant, and is carried out despite limited resources and weak anchoring. Perhaps a stronger anchoring, resource situation and a national mandate could strengthen the committees’ situation. This open themed issue of Etikk i praksis compiles five diverse papers that overlap at key conceptual intersections around trust, care and responsibilities across national boundaries. Our globalized social environments have become more and more complex, and the information needed to understand society and our moral responsibilities have grown ever more challenging. The ‘fake news’ buzzword, used by various societal actors to cast doubt on political rivals, is shaking the trust needed to be confident about institutional sources of (...) information. The caring attitude that serves to cement social groups and communities seems to be weakening in certain contexts, resulting in individual acts of unimaginable violence that shock us to the core. On the other hand, we are inspired when the same caring attitude mobilizes groups and individuals to reach across national boundaries and aid those who are suffering. In sorting through the generalizations and attempts to categorize the many highly complex social phenomena that occur in our interconnected global realities, we apply careful analysis of both facts and values that facilitate ethical reflection, helping us to make ethical decisions. For this open issue of the _Etikk i Praksis: Nordic Journal of Applied Ethics_, we put together a broad mix of different articles tackling current important issues in the field.

_Helsevesenet har blitt en sentral samfunnsaktør og medisinen dets førende fag. Hvorfor har det blitt slik? En grunn er at medisinen fører sammen sfærer som ellers har vært adskilt: det sanne, det gode og det skjønne. Medisinen som fag og helsevesenet som institusjon, har blitt et fascinerende skjæringspunkt nettopp mellom evidens, etikk og estetikk. Her kobles kunnskap til det som er vondt og skjønnhet til det som er friskt. Kunnskapsproduksjonen dirigeres ut fra ønsket om å gjøre det gode ved (...) å unngå det vonde. Samtidig styres helsevesenets normer også av estetikkens normer. Koblingene mellom evidens, estetikk og etikk gir noen grunnleggende utfordringer, som det er viktig å være oppmerksom på. At the same time, medicine is also governed by aesthetics. Artikkelen er en analyse av to formaliserte etiske retningslinjer som skal gjelde i norske akademiske institusjoner. Den ene er utarbeidet for forvaltningen og den andre for forskningen. Analysen gjøres ved å sammenligne to dokumenter som inneholder etiske retningslinjer. Videre knyttes analysen til ulike «etos» som skiller forvaltningen og forskningen. Artikkelen går særlig inn på normene lydighet og frihet, som framstår som mest motsetningsfylte når de «møtes» i akademia. One is prepared for the governmental bureaucracy and the other is research ethics. The analysis is done by comparing two documents containing the code of conduct for each field. Further analysis is related to the differing «ethos» that separates the bureaucracy from the research. The article dwells on the norms of obedience and freedom that emerge as the most contradictory. _Taking issue with sustainable governance involves careful consideration of social, economic, and environmental dimensions of sustainability, and the interplay of those dimensions in political processes and decision-making. The current issue of Etikk i Praksis contributes to this task by offering analysis of central concepts in the discourse of sustainability, as well as examinations of political and moral issues raised by pressing environmental challenges such as climate change._.

Recently, philosophers and political theorists who defend a more practical or realistic approach to the issue of global justice have challenged the purely theoretical approaches. Nevertheless, the debate can be regarded as excessively restricted to the discussion about policies and institutions neglecting the non-contingent dimensions of the problem. In principle, both positions, theoretical and practical, may be understood as diverging from each other. However, abstract and concrete demands of justice can also be complementary to each other. Thus, in this special (...) issue of Etikk i Praksis we propose to explore the points of convergence and divergence between the theoretical and the practical approaches to global justice. We encourage submissions: arguing for or against the theoretical approach; arguing for or against the practical approach; exploring or rejecting the possibility of convergence between them. (shrink)

_Vi gennemførte i 2016 et omfattende empirisk studie på Aalborg Universitetshospital med henblik på at afdække de forskellige sundhedsprofessioners etiske holdninger. Hensigten var at afdække eventuelle forskelle mellem professionerne samt at få begrebsliggjort de etiske tankemønstre, der er tilstede i den kliniske praksis. Vi fandt i den indledende dataanalyse, at vi med signifikans kunne vise, at plejegruppen i højere grad bruger nærhedsetiske og omsorgsetiske vurderinger, til forskel fra lægegruppen, der er mere pligtetisk funderet__. Undersøgelsen blev sat op ved brug (...) af vignetmetoden, der giver mulighed for at indsamle kvantitative data, der er velegnede til en statistisk analyse, men som samtidig også muliggør en kvalitativ undersøgelse ved en efterfølgende hermeneutisk analyse af udvalgte besvarelser. The intention was to uncover any differences between professions as well as to conceptualize the ethical thought patterns present in clinical practice. We found in the preliminary data analysis that we could show with significance that the group of care givers uses relational ethics and care ethics assessments to a greater extent as opposed to the more duty ethics based group of physicians. The study was set up using the vignette method, which allows for the collection of quantitative data suitable for statistical analysis, but which also allows for a qualitative study by a subsequent hermeneutical analysis of selected answers. In this article we study the results of the study within the nursing group solely for the purpose of extracting what their assessments depend on and discussing how these factors relate to each other and create some form of moral coherence. Based on this we find how nurses' ethical attitudes are shaped by the particular values ​​that the relational ethical profile supports, but also how this profile is modified and flexible to the conditions of clinical settings and situations. "Ever Since This World Began" from Love Dog (Penny-Ante Editions, 2013) by Masha Tupitsyn continent. The audio-essay you've recorded yourself reading for continent. , “Ever Since the World Began,” is a compelling entrance into your new multi-media book, Love Dog (Success and Failure) , because it speaks to the very form of the book itself: vacillating and finding the long way around the question of love by using different genres and media. In your discussion of the face, one of the (...) themes of Love Dog , I think there is something to be said about the surfaces media create and how you constantly manipulate them in your work. This seems important for thinking also about your book LACONIA: 1,200 Tweets on Film ; a book on film written in tweets, interposing already three sets of expectations and pushing the boundaries of each medium's faciality, it's surface tension. In Love Dog , is there another kind of facial interaction? Perhaps the discursive faces of approaching love as topic and love as method? If so, how did/do these intersect for you, do/did they drive the creation of this book? MASHA TUPITSYN With LACONIA and Love Dog , I wanted to pay homage to the work modernism has done on subjective time and chronological time by carrying that experiment over into the digital economy. Because LACONIA is a time-based work of cultural criticism that employs the aphorism to look at 21 st century American culture, it is also an archival work of cultural mourning and memory. And in Love Dog , which is also a work about mourning as it relates to love, I wanted to think with all my senses, and to reflect that in the writing itself by using a multi-media form. LACONIA tackled the sound bite and the promotional image--the everyday language of consumer culture--which often wants to communicate ideological agendas through the repetition of a single image or reductive phrase. I had always been interested in the approaches of artists like Barbara Kruger and Jenny Holzer and essayistic, typographical filmmakers, like Chris Marker and Godard. In both cases, I felt it was important to try to compose a book in which deep—critical—thinking happens in so-called immediate, informal, and disposable contexts. That is, in places where you are either not supposed to be serious or are not required to take things seriously. To me the most intervention is needed in every day instances of culture and representation. In order to do that, I had to utilize and interrogate the very structures I was critiquing. In other words, the writing had to materialize in that live, digital, public space. It couldn’t simply happen at home on a piece of paper or in a word document on my computer that no one could see until it was finished. It had to unfold in real time, amidst everything else. And it had to literally be surrounded by the cultural landscape I wanted to assess. In both LACONIA and Love Dog , I wanted to know how and if we can get away from what we cannot get away from? From which there is no respite. Given this, I don’t think hypertexts can really be called hypertexts anymore. Hypertexts are simply the world today. This is not only the way we read the world now. It is the way the world reads. Likewise, interfaciality, as you put it, works on a number of levels for me, both on and off the page. There is my relation to epistemological and phenomenological surfaces—the screen, the body, the face, the voice, gender; the official story. Then there is the way this dovetails formally, and to which the digital adds yet another dimension. It’s also where sound comes into Love Dog (giving the book a sound; giving tonality to the book’s ideas and feelings). As Anne Carson pointed out in her essay “The Gender of Sound,” the two are connected, and of course so are love and gender. In “Ever Since This World Began,” I wanted to think about the phenomenology of the voice, which is why I visualize the sonic in the book and why in my writing about faces, I look at the tonal aspects (the things a face voices and a voice faces) of a face. This was standard to do when images and faces were “silent” in the silent era. Those images/faces were extraordinarily audible. The greatest screen face, to me, is still Falconetti’s in Dreyer’s The Passion of Joan of Arc . We can hear her face—even though there is no actual sound on screen of her speaking. The internet is a similarly “silent” space where actual voices are lacking. So intertextuality goes with interfaciality. I’ve also talked a lot about how categorization worked when it came to the reception of my first book, Beauty Talk & Monsters . How despite the fact that Beauty Talk is a text that crisscrosses form and content in a variety of ways, not pinpointing its exact genre—choosing one genre over another—only made things worse. Fiction was the category people were most adverse to me using, even though of course there is a lot of fiction in the book. Part of how fiction works in Beauty Talk is in the reader not knowing exactly where the fiction resides. In Godard’s 1967 film, Weekend , for example, everything matters. Everything is political, whether it’s real or imaginary, film or reality. In Weekend , life is not a game and neither is the game a game. The game is really life. Either everything is important or nothing is. But many people want clear answers and demarcations so that they can decide what is important and what is not important. My use of the “I,” subjective criticism, made everything “real” in Beauty Talk . But fiction is in the construction. It is in the blending. This is why I perforate the movie screen and connect the onscreen and the offscreen; the official story and the backstory. Although I don’t think there is a difference between onscreen and offscreen anymore. Nor is there a dialectic. It’s all screen all the time now. Non-fiction, on the other hand, was more tolerated as a moniker. Unlike Love Dog , Beauty Talk wasn’t explicitly or tangibly (what is tangible is a question in all these books) working with digital forms or within this digital economy, so some people resisted the book’s hypertextuality or intertextuality because they couldn’t see its other forms, if that makes sense. It was a problem of invisibility; of how to make something appear (this is where Nietzsche, big presence in Love Dog , comes in—the nature of appearances). Something people don’t necessarily want to see. Some readers couldn’t see the way forms were interfacing in that book. On the surface, Beauty Talk was simply a text about media culture—the domination of entertainment as a mode of being and knowing—and most readers could only see that one side of the book. But as Godard puts it in Wim Wenders’ documentary about the future of cinema, Room 666 , “Films are made, images are made, when there’s no one looking. That’s what the invisible is, that which we don’t see. That’s what the incredible is, that which we don’t see. And cinema shows you that which we don’t see, the incredible.” We are living in the aftermath of narrative and temporal collapse, which means we don’t read or feel in the same way. I began to use digital forms in my writing because I don’t see us as traditional book people anymore. I would add that power also resides in the invisible, in the things we make invisible by making them visible. Or it did for a long time. The new face of power is quickly becoming so-called transparency, which is even more corrupt because even though we now live in a behind-the-scenes culture, and see and know how the mechanisms of power and corruption operate, we still don't change. The world still doesn't change. Finally, another important thing that Godard says in Room 666 that relates to Love Dog is: “I’m here in front of the camera, and yet in my body and in my head, I’m behind it. My world is the imaginary and the imaginary is a journey between forwards and backwards.” This idea of visible/invisible, foresight and hindsight , backwards and forwards is an important dialectic in relation to time and the idea of the destinal. This is why I wanted Love Dog to travel, literally, figuratively, and discursively. You have to be open to not knowing. To epistemological, geographical, chronological, and emotional aporias. In Love Dog my story is both visible and invisible to me. Sometimes I could see where I was going. Other times I was completely in the dark existentially. Truth procedure, which love is, as bell hooks and Badiou tell us, requires expedition and openness to possibility. Unless you want a story you already know, but that is not truth procedure. So I tried to create this backwards and forwards journey in the book—this sense of travel and motion, hope and doubt—by jumping between forms, media, time; traveling to different places, texts, and emotional registers. The book’s “Time-Jump series,” which mostly takes the form of music—songs—but also a series of “green” videos that I shot, is the most obvious tribute to this idea of subjective and chronological time. continent. Your work aligns with writers that play with the form of their language, or have assumed the role of performance artist at some point: Kathy Acker, Chris Kraus, Avital Ronell, and Anne Carson to name a few representing varied approaches that show up in Love Dog . At the risk of ossifying the work, or missing the point—as these experimental modes of writing stack-up in piles of published works, do they approach a genre? MASHA As I noted in my book Life As We Show It , in Chelsea Girls the poet Eileen Myles points out, “You can’t get money without a category.” More importantly, you can’t get a category—or respect, rank—without a clear genre. This makes genre and gender an obvious pair. The two words are even linked etymologically and both genre and gender concern taxonomies of legitimacy—of sorting through what and who is valuable. So the words share common prejudices. The things one does not want to read is often synonymous with who one doesn't want to read about. Therefore a break-up of or with genre is maybe the genre or anti-genre that could be said to link these writers. Avital Ronell breaks up with philosophical tradition and modes of inquiry. Like Nietzsche, she revaluates methods of evaluation, testing out things you are not supposed to use philosophy to test (and, by the same token, testing philosophy in ways it’s not supposed to be tested), like drugs and stupidity—where philosophy fails and we fail philosophy. And Chris Kraus does something similar in her experimental fiction, using different forms to put female subjectivity “to the test,” so to speak. All these female writers and thinkers have tried to destabilize the systems that have been set up in (and against) writing. Thus missing the mark with genre, even intentionally, means that we have missed the point in some sense as writers and thinkers. And that to me is a good thing, however difficult. We’ve started at the wrong point and gone somewhere else instead. We’ve acknowledged that writing and thinking are also about failure, and that failure is always embedded in the act of writing and in our reasons for writing. So that missing the point is also the point. Derrida insisted: “We must invent a name for those ‘critical’ inventions which belong to literature while deforming its limits.” But how can you give something that resists and deforms, a name? Wouldn’t the name also be deformed? Isn't this why the aforementioned writers get hyphenated descriptors like ficto-criticism? Do we need a proper name to be able to read something carefully? I don’t think so. I don’t need it as a reader. I’ve always taken a work on its own terms. But for most people, if you don’t have an address, people don’t know how to find you. A lot of time, they won’t even know how to look. And in some cases, they’ll think you’re not even worth finding. You are not on the map because you have to literally make the map in order to exist. MASHA I think I responded to the parenthetical portion of this question in my previous answer. As far as how performance relates to Love Dog , in Acker’s Don Quixote , which is another big presence in the book, she writes, “there is no other reality than anthropomorphism.” In Don Quixote , the dog is human and the human is dog. Which brings us to the title of Love Dog and the totemic function of the dog in the book: giving human things animal characteristics and animal things human characteristics. Rather than investing all our human love ideals into dogs, which we do constantly as a culture of dog lovers, I wanted to put the dog into love. It is the difference between the consumption of love as a patriarchal institution or status position and the essence of a type of radical and liberatory relation that would benefit humans in their bonds with other humans. So the dog in Love Dog is not simply the book’s cover or performative affect, so to speak. Love has always needed the dog, which is why the dog is the very embodiment of belief in love . Recall Argos The Great Dog and Odysseus. Argos is the only one who remembers and recognizes the ragged and old Odysseus even after his 20-year absence. So love is the high ideal and the dog, both common and dependable, is the bridge between the sacred and the profane. The dog is the house of love. And because Love Dog is a digital project, it seemed impossible to think about the post-human, technology, the virtual, or difference (which Badiou says is essential to love in In Praise of Love ) without thinking about animal-being and being-animal. Instead of simply “performing” these ideas and characteristics as literary affects, I’m interested in being-becoming. Which means the book’s tropes, leitmotifs, series, and even its titles are in service of that truth procedure. In other words, I actually want to live this way, not just write this way. And, more importantly, I want to live this way not just think this way. So Love Dog became both my totem animal and my autobiographical animal. One of the books submitted for review to this journal was B.?A. Scharfstein's The philosophers: their lives and the nature of their thought (1980, Oxford). Although not explicitly concerned with logic, it raised various questions for history and historiography (possibilities for psycho-history, for example). Thus I sought a review, which was written by P. Loptson and published in volume 3 (1982), 105?107. The ensuing correspondence has been edited for publication by me, with the authors? approval.

I denne artikkelen fokuserer vi på kommersiell gestational surrogati og stiller spørsmålet: Bør man tillate at norske statsborgere benytter seg av surrogati i India? De etiske problemstillingene rundt surrogati er mange og sammensatte og blir spesielt utfordrende når tjenesten tilbys i et land med store kulturelle og økonomiske forskjeller både internt og i forhold til Norge. Vi baserer analysen og drøftingen av dette (...) etisk utfordrende spørsmålet på Beauchamps og Childress sin veletablerte metodiske tilnærming innen biomedisinsk etikk. Vi anvender de fire allmennmoralske prinsipper: respekt for autonomi, velgjørenhet, ikke-skade og rettferdighet på sakskomplekset for å synliggjøre spenningene involvert i dette etiske dilemmaet. In this article, we focus on commercial gestational surrogacy and debate the question: Should Norwegian citizens be permitted to use surrogacy in India? The ethical concerns regarding surrogacy are complex and are especially challenging when the service is offered in a country with big cultural and economic differences both internal and in comparison to Norway. We base our analysis of this ethical, challenging question on Beauchamp’s and Childress’s well-established approach within biomedical ethics. We apply the four principles of respect for autonomy, beneficence, nonmaleficence and justice to shed light on the conflicts of interests in this ethical dilemma. With full awareness that there are no simple and correct solutions to dilemmas in general and on this issue, especially, our conclusion is that the interests of the involved parties, and especially those of the surrogate mothers, might be better attended to if surrogacy is allowed with extensive regulations. If this practice is made illegal, the opportunity to influence the process and secure the rights of the involved parties is lost. (shrink)

_Denne autoetnografien diskuterer en situasjon som oppsto på et feltarbeid i Norge, der jeg opplevde å være i fare i rollen som forsker. Først i det øyeblikket gikk det opp for meg at jeg ikke hadde tatt noen forholdsregler for å ivareta min egen sikkerhet i felt. Det skjedde selv om de øvrige deltagernes sikkerhet var grundig diskutert og hensyntatt gjennom en rekke tiltak i studien, som brukte en kulturelt responsiv, relasjonell, refleksiv etikk. I artikkelen drøfter jeg mulige konsekvenser (...) av manglende oppmerksomhet i etiske retningslinjer og forskningspraksis rettet mot forskeres sikkerhet i felt. This happened even though the safety of the other participants had been thoroughly discussed and taken into account through a number of measures in the study, which used a culturally responsive, relational, reflexive ethic. In the article, I discuss the possible consequences of a lack of attention in ethical guidelines and research practices aimed at researchers' safety in the field. Opening the round table, I. T. Frolov, editor-in-chief of Voprosy filosofii, stated that discussing problems of this type today, the task lies not so much in emphasizing their general and traditional aspects but in finding a scientific and practical solution to new problems of interaction of man and nature that can now be solved only on a global scale. Furthermore, he observed that discussion of these problems as questions of morality, in terms of pessimistic or optimistic evaluation, is very important (...) but certainly entirely inadequate. Not only social and philosophical but many political conclusions follow from a discussion of problems of interaction between man and nature. Investigation and solution of these problems, which require concrete scientific and practical approaches, may facilitate the development of such policies as peaceful coexistence, strengthening of neighborly treaty relations, and so forth. Solving these problems will help peoples come closer together and contribute to the firmer establishment of peace throughout the world. (shrink)

I denne artikkelen drøfter jeg bruk av biomedisinsk teknologi i prestasjonsfremmende hensikt i konkurranseidrett. Mer presist utforsker jeg mulighetene for å skille mellom etisk akseptabel og etisk uakseptabel bruk. Jeg kritiserer WADAs normative grunnlag for å forby visse biomedisinske midler og metoder, og argumenterer for at eventuelle forbud må bygge på tydeligere verdisyn på idrett. Jeg undersøker to idealtypiske syn og deres teknologiske implikasjoner. Det smale synet er liberalt og avviser begrensninger i bruk av biomedisinske midler og metoder blant voksne (...) idrettsutøvere som dårlig begrunnet paternalisme. Det brede synet innebærer en mer restriktiv holdning og aksepterer en viss regulering av trening og prestasjonsutvikling også utenfor konkurransene. I en avsluttende del veier jeg det smale og det brede synet mot hverandre og reflekterer over hvilket syn som vil dominere framtidens idrett.Nøkkelord: etikk, idrett, biomedisinsk teknologi, dopingEnglish summary: The use of biomedical technology in sport: Are there any limits?In the article I examine the use of biomedical technology to enhance performance in competitive sport. More specifically I examine the possibilities for distinguishing between ethically acceptable and ethically unacceptable use of such technology. I criticize the World Antidoping Agency's normative criterion for banning certain technologies as it is vague and unclear. I argue that any ban by WADA has to build on a clear and operational normative view of sport. Two relevant ideal-typical views are examined together with their technological implications. The narrow view is liberal and rejects restrictions on the use of biomedical technology among professional athletes as unjustifiable paternalism. The wider view implies a more restrictive approach and accepts certain regulations of performance-enhancing means and methods outside of competitions. In the conclusion, I compare the narrow and the wider views and reflect upon their possible status in competitive sport in the future. (shrink)

This special issue presents developments in research on the cognitive mechanisms and consequences of surprise. Amidst much progress, surprise research has often been siloed, so, as editors, we have sought to juxtapose insights, theories, and findings, to support cross‐fertilization in future research. The present paper sets the stage by presenting a historical summary, highlighting contrasts in definitions, and tracing major threads running through this issue and the larger surprise literature.

De senere år har pleie- og omsorgstjenesten i mange norske kommuner startet med ulike former for etikkarbeid, oftest initiert av KS’ prosjekt “Samarbeid om etisk kompetanseheving”. Hensikten med vår studie var å evaluere innsatsen i de kommunene som deltok i prosjektet fra starten av, med vekt på hvilke tiltak som var iverksatt, hvilke virksomheter dette omfattet, og om tiltakene har fortsatt utover prosjektperioden. Studien har et kvalitativt design. Materialet er hovedsakelig basert på telefonintervjuer med kontaktpersoner for etikksatsingen i 34 kommuner. (...) Det transkriberte materialet er analysert ved kvalitativ innholdsanalyse. Med unntak av fem kommuner som aldri kom i gang med etikkarbeidet, hadde de fleste startet etikkrefleksjon innenfor flere tjenester, oftest i sykehjem og hjemmetjenester. Noen kommuner hadde imidlertid ikke klart å videreføre etikkarbeidet utover en prosjektperiode. Det var stor variasjon både i etikkarbeidets forankring i kommunen, omfang, hyppighet og metoder. Et gjennomgående funn er vektlegging av behovet for etikkkompetanse og oppfølging av dem som skal lede etikkarbeidet. Flertallet av kommunene som fortsatt gjennomfører etikkrefleksjon, tar utgangspunkt i egen praksis, men et mindretall anvender strukturerte metoder. Dersom etikkarbeidet i kommunen skal være levedyktig over tid, bør arbeidet forankres på flere nivåer i organisasjonen, og de som skal lede dette arbeidet, bør få styrket sin kompetanse i etikk og etikkrefleksjon.Nøkkelord: etikk, evaluering, kommunehelsetjenestenEnglish summary: Building ethical competence in Norwegian municipalities: What has been done and what has been sustainable?“Cooperation for building ethics competence” is a national project aimed to stimulate moral reflection and build competence in ethics in community health services in Norway. This article is based on an evaluation of the activities implemented by the first 34 participating municipalities, exploring which measures were implemented, which services and employees were involved, and if the measures are sustainable. The study has a qualitative design, and the data mainly consists of telephone interviews with “key” persons in 34 municipalities. With the exception of five municipalities that never really started ethics work, the majority had implemented ethical reflection in several areas, most often in nursing homes and home care services. There was great variation with regard to the implementation. Many had tried a variety of reflection models, and only a minority of the municipalities were using a structured method of ethical reflection. A consistent finding is the need for more competence; many of those who run ethical reflection are reported to need more competence both in ethics and methods for systematic reflection. There were also great variations in how well the ethics projects were anchored within the municipality. To make ethical interventions sustainable, this study indicates the importance of strong anchoring within the municipality, the need for ethical competence, as well as good methods for structuring ethical reflection. In the January 2020 issue of this journal, Rory Misiewicz penned an excellent review of Brandon Daniel-Hughes's book. His one complaint is that Daniel-Hughes appeals to my theory that the Ultimate is "entirely indeterminate and absolute nothingness that contextualizes all things." This he claims to be inconsistent with Peirce. I do not want to defend Daniel-Hughes's use of my idea, although I surely congratulate him. I do want to correct Misiewicz's understanding of it, however.My idea is that all thought is (...) determinate, at least in part, and is therefore consequent to its creation. Animal ethics has received a lot of attention over the last four decades. Its focus, however, has almost exclusively been on the welfare of captive animals, ignoring the vast majority of animals: those living in the wild. I suggest that this one-sided focus is unwarranted. On the empirical side, I argue that wild animals overwhelmingly outnumber captive animals, and that billions of wild animals are likely to have lives that are even more painful and distressing than those of their captive (...) counterparts. On the normative side, I argue that as long as we have duties of assistance towards humans suffering from natural causes, and we reject anthropocentrism, we also have duties of assistance towards animals suffering in the wild.Article first published online: 22 MARCH 2016. We think the present moment is a timely one for debating the relation between evidentiary protocols and academic disciplines. Since academic practices for constituting and deploying evidence tend to be discipline-specific, the much-discussed crisis of the disciplines in recent years has given rise to a series of controversies about the status of evidence in current modes of investigation and argument: deconstruction, gender studies, new historicism, cultural studies, new approaches to the history and philosophy of science, the critical legal studies movement, (...) and so on. Unfortunately, these controversies too often devolve into oversimplified debates about who has the evidence and who does not, who did their homework and who did not, or about the dangers of an ill-defined academic relativism. Attention needs to be better and otherwise directed: at the configuration of the fact-evidence distinction in different disciplines and historical moments, for example; or at the relative function of such notions as “self-evidence,” “experience,” “test,” “testimony,” and “textuality” in various academic discourses; or at the ways in which the invoked “rules of evidence” are themselves the products of historical developments, and themselves undergo redifferentiation and reformulation. James Chandler, professor of English at the University of Chicago, is the author of Wordsworth’s Second Nature . He is currently completing England in 1819, studies in and of romantic case history. Arnold I. Davidson, executive editor of Critical Inquiry, teaches philosophy and the history of science at the University of Chicago. I denne artikel undersøges kroniske patienters beslutninger om forsøgsdeltagelse og betydningen af deltagerinformation. På baggrund af et års feltarbejde på fire danske forskningsklinikker argumenterer jeg for, at de observerede patienter opererer efter andre logikker, når de tager beslutninger om at deltage i kliniske forsøg, end hvad der antages i den gældende forskningsetiske regulering. Feltarbejdet fulgte et klinisk lægemiddelforsøg og inkluderede observationer af forsøgskonsultationer; interviews med investigatorer, projektsygeplejersker, forsøgsdeltagere og virksomhedsrepræsentanter; samt en mindre spørgeskemaundersøgelse blandt de danske forsøgsdeltagere. Resultaterne indikerer, at (...) for en gruppe af erfarne forsøgsdeltagere handler beslutningerne om forsøgsdeltagelse ikke om forsøget i sig selv, men om at opretholde en nær relation til forskningspersonalet. Disse patienter orienterer sig ikke efter deltagerinformation, men i forhold til tillidsrelationer. De agerer ikke som autonome individer, men oplever, at de er afhængige af sundhedssystemet. De udtrykker altruistiske motiver, men håber samtidig, at forsøgsdeltagelse vil give dem bedre helbredskontrol. For dem er forsøgsdeltagelse blevet en måde at leve med kronisk sygdom. Mulige implikationer af denne situation diskuteres, idet det understreges, at tillidsfulde relationer er en forudsætning både for god behandling og god forskning, men at de tætte relationer samtidig kan bevirke, at patienter bliver mindre kritiske, i forhold til hvilke forsøg de accepterer at deltage i, og at en bevidsthed om forsøgsrelaterede risici fortrænges fra forsøgssituationen.Nøgleord: informeret samtykke, deltagerinformation, deltagermotivation, kliniske forsøg, kronisk sygdom, DanmarkEnglish summary: Informed consent in clinical trials: technicalities, trust and intimate relationshipsThis article explores decisions about clinical trial participation in a group of patients with chronic conditions, focusing especially on motivation for trial participation and trial information. Based on ethnographic research in four Danish hospitals in conjunction with a clinical drug trial, I argue that these patients’ decisions follow logics other than those anticipated in research ethics regulations. I build on observations, interviews with physician-investigators, project nurses, patient-participants and trial sponsors, and a survey of the participants. The results indicate that for a group of experienced trial participants, trial information plays a very limited role because their decisions do not concern the trial per se but the sustainment of a close relationship with the research staff. They do not act as autonomous individuals weighing pros and cons based on the written information they receive. Rather, they feel dependent on the healthcare system and navigate in trust relations. For them, trial participation has become a way of living with chronic disease. I discuss implications of this situation underlining that trustful relationships constitute a precondition for high quality chronic care and research, yet the social dynamics may also lead patients to pay less attention to risks associated with trial participation. II. Without mentioning what most of the article is about, Fish plucks out some remarks from a small part of it and condemns me as being antiblack, antifeminist, and so forth. It seems to me that Fish, after removing a few sentences from context , then does three other things: he summarizes or rephrases these remarks in such a way as to turn them into a polemical statement; he makes an inference—all his own; and he then attacks the inference he (...) has made. In his second paragraph, speaking unfavorably of the old-fashioned hope of finding universal values, he states: “It follows, then, … that works which advocate or have their origin in particular attitudes, strategies, sectarian projects, or political programs do not qualify as literature and should not be treated as such by literary scholars” . It by no means ”follows,” except perhaps in Fish’s mind. It follows merely that some of these concerns—if pursued in isolation from other contexts and in a spirit of propaganda—are not, by themselves, an adequate substitute, or replacement, for approaches that may provide a center from which to move to the subjects Fish mentions. I certainly have no wish to exclude these subjects from the curriculum. In fact, I have probably devoted as much of my teaching to some of them, especially political writing, as has Fish. I realize that for Fish himself our reactions in reading are inevitably subjective and that no text can be viewed as a settled thing. But I must plead that the reader, before condemning me because of Fish’s remarks, judge me by what I said rather than by what he inferred or magnified. I said only that, facing a decline in numbers of students, English departments found it more tempting than ever to provide courses on subjects often removed from larger contexts and treated in comparative isolation rather than to require more general study of history, philosophy, sociology, or psychology. I should like to repeat that I was not condemning departments for doing this. I felt it was rather sad that what Fish calls the “market,” and the fondness of so many students now for propagandistic approaches, should force us to jettison much that was more rigorous and demanding therefore less popular. I should like to qualify my remarks at the outset by saying that I lay no claim to a philosophical, rigorously scientific solution of the problem of the interaction between science and art. And although this problem has concerned me as an artist, for me it is, I must admit, even a bit uncomforatable to address an audience of philosophers with my random observations and notions on this subject. However, the problems posed by the development of modern science and technology (...) today concern all human beings; artists are no exception. Moreover, it is specifically from artists that many people await an explanatory presentation of today's "magi and sorcerers," upon whose activity so much in life now depends. In accordance with our capacities we, artists of the film, also seek to find some view of our own on the processes and changes currently occurring in the world. It is precisely for this reason , that I have been so bold as to undertake to share a number of my impressions, with the hope that the editors and readers of the journal will forgive my lack of training in philosophy.
