This book presents the theory of the validity of legal norms, aimed at the practice of law, in particular the jurisdiction of the constitutional courts. The postpositivist concept of the validity of statutory law, grounded on a critical analysis of the basic theories of legal validity elaborated up to now, is introduced. In the first part of the book a contemporary German nonpositivist conception of law developed by Ralf Dreier and Robert Alexy is analysed in order to answer the question (...) whether the juristic concept of legal validity should include moral standards or criteria. In the second part, a postpositivist concept of legal validity and an innovative model of validity discourse, based on the juristic presumption of the validity of legal norms, are proposed. Gdy zaś próbuje się ją podczytywać, wtedy z kolei natrafia się na język filozoficzny. Mamy łączenie radykalnie odmiennych porządków sensu. Z jednej strony staje filozoficzna interpretacja pierwszych dziesięciu zdań Biblii, z drugiej szczególny opis kilku obiektów matematycznych i fizycznych. Pierwszym wrażeniem jest doznanie nieprzystawalności. Co jedno może mieć wspólnego z drugim? Oryginalność zestawienia jest uzasadniona celem prezentowanych rozważań. Najogólniej, (...) chodzi tu o możliwie odpowiedzialną, metodycznie kontrolowaną, racjonalną próbę interpretacji początku Biblii za pomocą pojęć filozoficznych, a następnie o odświeżenie wybranych symboli z początku Genesis za pomocą zmetaforyzowanych pojęć matematycznych i fizycznych. This paper defends the Blockian Proviso against its critics, Kinsella in particular, and interprets it as a law of non-contradiction in the theory of just property rights. I demonstrate that one may not lawfully appropriate in such a way as to forestall others from appropriating an unowned land because such appropriation would result in conflict-generating norms, and conflict-generating norms are not rationally justifiable and just norms. The Blockian Proviso, which precludes forestalling, operates therefore at the level of original appropriation and (...) determines, according to the homestead principle of justice in first acquisition, what may and what may not be lawfully appropriated. Hence, the Blockian Proviso is not an add-on to the homestead principle but part and parcel thereof. (shrink)

Wtedy całe partie Biblii można traktować jako wynik rzeczywistej refleksji nad człowiekiem, jego naturą, kondycją, losem, którą przeprowadzili archaiczni myśliciele i wyrazili przemyślnym, symbolicznym językiem. W perspektywie takiego interpretacyjnego założenia Pismo Święte staje się tyle wyjątkowym, ile niedocenionym źródłem wiedzy o człowieku. Nigdzie indziej nie zgromadzono tak konsekwentnie i w takiej liczbie opi­sów ludzkich losów uwzględniających żywe i bogate doświadczenie religijne. (...) Uznając swoistość tego doświadczenia, zyskuje się ogrom materiału do badań w ramach filozoficznej antropologii. Metodami tej dyscypliny, za pomocą jej systemu pojęciowego można czytać i interpretować mit adamiczny, historię patriarchów, sędziów. Modern technology offers an increasing number of tools for teaching mathematics, but technology adoption in schools encounters many barriers. The Technology Acceptance Model explains that technology usage is dependent on intentions, which rest on perceived ease of use and perceived usefulness. Less is known about the relationship between intentions and actual behaviour. In the current study we show that the level of cognitive investment on the part of the teachers, captured by the construct of Need for Cognition (NC), is crucial (...) in the use of technology in mathematical instruction, while controlling for a variety of background factors. Furthermore NC moderates the relationship between intentions and technology use, such that high NC weakens the relationship between the perceived usefulness of technology in pedagogy and its actual use. Can ownership status influence probability judgements under condition of uncertainty? In three experiments, we presented our participants with a recording of a real horse race. We endowed half of our sample with a wager on a single horse to win the race, and the other half with money to spend to acquire the same wager. Across three large studies, we found the endowment effect – owners demanded significantly more for the wager than buyers were willing to pay to acquire it. (...) However, we also found that probability estimates of each horse winning the race did not differ between owners and non-owners of the betting slip. Our results demonstrate that distorted perception of probability is unlikely to be a mechanism explaining the endowment effect. (shrink)

The study is an intercultural comparison of the theory of reasoned action and the theory of planned behavior to predict students’ intentions for academic cheating. The sample included university students from 7 countries: Poland, Ukraine, Romania, Turkey, Switzerland, United States, and New Zealand. Across countries, results show that attitudes, perceived behavioral control, and moral obligation predict students’ intentions to engage in academic dishonesty in the form of cheating. The extended modified version of the theory of planned behavior emerged as the (...) best explanatory model predicting intentions to cheat. Significant cross-cultural differences were found and discussed. (shrink)

In this commentary, I critically assess Rex Welshon’s position on the neural substrates of ownership unity. First, I comment on Welshon’s definition of ownership unity and underline some of the problems stemming from his phenomenological analysis. Second, I analyze Welshon’s proposal to establish a mechanistic relation between neural substrates and ownership unity. I show that it is insufficient and defend my own position on how neural mechanisms may give rise to whole subjects of experience, which I call the neuro-integrative account (...) of consciousness. Lastly, I comment on Welshon’s philosophical contribution and claim that it leaves the reader theoretically stranded. (shrink)

According to contemporary understanding of the universal tree of life, the traditionally recognized kingdoms of eukaryotic organisms—Protista, Fungi, Animalia and Plantae—are irregularly interspersed in a vast phylogenetic tree. There are numerous groups that in any Linnaean classification advised by phylogenetic relationships would form sister groups to those kingdoms, therefore requiring us to admit them the same rank. In practice, this would lead to the creation of ca. 25-30 new kingdoms that would now be listed among animals and plants as “major (...) types of life”. This poses problems of an aesthetic and educational nature. There are, broadly speaking, two ways to deal with that issue: a) ignore the aesthetic and educational arguments and propose classification systems that are fully consistent with the Hennigian principles of phylogenetic classification, i.e. are only composed of monophyletic taxa; b) ignore Hennigian principles and bunch small, relatively uncharacteristic groups into paraphyletic taxa, creating systems that are more convenient. In the paper, I present the debate and analyze the pros and cons of both options, briefly commenting on the deeper, third resolution, which would be to abandon classification systems entirely. Recent advances in eukaryotic classification and phylogeny are commented in the light of the philosophical question of the purpose and design principles of biological classification systems. The concept of evolvability—the capacity of a population to produce and maintain evolutionarily relevant variation—has become increasingly prominent in evolutionary biology. Paleontology has a long history of investigating questions of evolvability, but paleontological thinking has tended to neglect recent discussions, because many tools used in the current evolvability literature are challenging to apply to the fossil record. The fundamental difficulty is how to disentangle whether the causes of evolutionary patterns arise from variational properties of traits or lineages rather than being (...) due to selection and ecological success. Despite these obstacles, the fossil record offers unique and growing sources of data that capture evolutionary patterns of sustained duration and significance otherwise inaccessible to evolutionary biologists. Additionally, there exist a variety of strategic possibilities for combining prominent neontological approaches to evolvability with those from paleontology. We illustrate three of these possibilities with quantitative genetics, evolutionary developmental biology, and phylogenetic models of macroevolution. In conclusion, we provide a methodological schema that focuses on the conceptualization, measurement, and testing of hypotheses to motivate and provide guidance for future empirical and theoretical studies of evolvability in the fossil record. This essay sketches the fundamental views of reality common to all the defenses and the main lines of the most prominent defenses, some based on natural law, on the theology of the body, and on the physical, psychological, and social consequences of the use of contraception. The Congregation of the Doctrine of the Faith’s Dignitas personae does not offer a definitive rejection of the practice of human embryo adoption as intrinsically evil, but neither does it simply leave the matter an “open question.” The document does indeed oppose the practice, but its reasons for doing so are not clearly stated and seem to be in tension with its own affirmations of the personal dignity of embryos and the goodness of adoption. The Congregation’s opposition is therefore best (...) read as a prudential judgment that embryo adoption cannot be justified in the present circumstances due to the potential for scandal and the cooperation with the fertility industry which it involves. Three studies address the role of social consensus on evaluative standards in different comparative contexts. Previous research has documented that self-categorisation at the individual or group level changes social comparison effects in terms of assimilation and contrast. With regard to self-ratings of physical attractiveness, the present studies show that people who focus on group membership can benefit from including outstanding others in their reference group, whereas people who focus on their individual attributes run the risk of self-devaluation. It is argued (...) that high consensus strengthens the association between evaluative standards and group membership and renders the inclusion of outstanding others more likely. Study 3 shows that the need to protect self-esteem moderates the influence of perceived consensus. Stressing the individual self led participants who received negative feedback to exclude outstanding others when consensus was low. Stressing the social self, however, led participants to include outstanding others when consensus was high. (shrink)

The paper addresses a contemporary Polish debate on the limits and functions of juristic interpretation of law. After presenting the main theses and features of Jerzy Wróblewski’s clarificative theory of juristic interpretation and Maciej Zieliński’s derivational theory of juristic interpretation, the author critically discusses various arguments used in the debate. Finally, a tentative solution of the controversy, based on the criticism of Zieliński’s conception of legal norm, is proposed. The purpose of this study was to investigate the relationship between work engagement and the psychological traits of employees, such as attitudes towards work and work ethic. Additionally, the study included demographic characteristics of employees and organizational characteristics. Research was conducted using the Polish adaptations of two well known methods: Multidimensional Work Ethic Profile and Utrecht Work Enagagement Scale, as well as the Work Attitude Questionnaire - a new Polish method. 360 adult employees of two large Polish regions took part (...) in the study. The analysis showed a significant influence of hedonic-autotelic attitude, as well as four dimensions of work ethic on work engagement. It seems to be an important conclusion that work engagement turned out to be far more determined by the subject’s psychological traits than demographic and organizational ones. These results, indicating the special role of the perception of work as a central value, can be used only in the area of attitudes towards work formed during adolescence but also in the area of motivating the employees by the organization. Two studies examined how different linguistic forms affect the way in which people access memories of former close relationships that are irrevocably over. Remembering former relationships can activate either positive or negative attitudes. Whether people feel sorrow that bygones are in fact bygones depends on attitudinal valence, but also on the linguistic form in which people express their attitudes. More abstract linguistic forms prevent people from retrieving specific and detailed memories, and thus prompt them to generating more counterfactual thoughts and (...) to experience stronger regret. In contrast, more concrete linguistic forms lead people to remember their personal past more vividly and accurately, and this subjective impression can forestall counterfactual thinking. Study 2 further shows that people are more prone to generate counterfactual thoughts when they focus on the final stage of their relationships rather than the beginning even when the valence of recalled attitudes and objective time are controlled. Research on temporal comparison has shown that people dissociate themselves from their past to attain a positive self view. Social comparison research has demonstrated that the distinctness of contextually activated information determines whether a recalled self exerts assimilation or contrast effects on the current self. However, hardly any study addressed individual differences. Also, very little is known about whether the ease or difficulty to date past events and experiences influences current self-judgments. We present a new scale capturing the degree of (...) the current self time extension. Three studies support the notion that temporal self-extension determines how past selves are accessed and processed, regarding both the abstractness with which self-knowledge is retrieved and the experienced temporal distance to the past. These findings have important implications for temporal as well as social comparison processes. (shrink)

The concept of generalized observable in the scheme of Hilbert quantum mechanics is discussed. We give an example of a possible ambiguity of this notion. The role of interpretation and the strong connection with concrete experimental procedures in the discussion of generalized observables are stressed to explain the above ambiguity.

In this paper we study the status of the arithmetical completeness of dynamic logic. We prove that for finitistic proof systems for dynamic logic results beyond arithmetical completeness are very unlikely. The role of the set of natural numbers is carefully analyzed.
