Comparative political theory is at best an embryonic and marginalized endeavor. As practiced in most Western universities, the study of political theory generally involves a rehearsal of the canon of Western political thought from Plato to Marx. Only rarely are practitioners of political thought willing (and professionally encouraged) to transgress the canon and thereby the cultural boundaries of North America and Europe in the direction of genuine comparative investigation. Border Crossings presents an effort to remedy this situation, fully launching a (...) new era in political theory. Thirteen scholars from around the world examine the various political traditions of West, South, and East Asia and engage in a reflective cross-cultural discussion that belies the assumptions of an Asian "essence" and of an unbridgeable gulf between West and non-West. The denial of essential differences does not, however, amount to an endorsement of essential sameness. As viewed and as practiced by contributors to this ground-breaking volume, comparative political theorizing must steer a course between uniformity and radical separation--this is the path of "border crossings.". What principles explain or justify legal institutions or decisions, thereby transforming coercion to authority? Are there or could there be any such universal principles? Can any philosophical theory account for such principles? How, if at all, do philosophical theories of law and politics apply to particular issues? And finally, what, if any, do such practical applications tell us about general theories and principles? This chapter offers an overview of experimental legal philosophy with a special focus on questions in general jurisprudence, that part of legal philosophy that asks about the concept and nature of law. Much of the experimental general jurisprudence work has tended to follow the questions that have interested general jurisprudence scholars for decades, that is, questions about the relation between legal norms and moral norms. Wholesale criticism of experimental general jurisprudence is scant, but, given existing debates (...) about experimental philosophy generally, one can anticipate where disagreement is likely to occur. Outside of experimental general jurisprudence, there is plenty of vibrant discussion about how experimental results can enrich our understanding of various concepts that figure in everyday legal thought such as causation, intention, consent, or meaning. In the future, experimental legal philosophers should continue to consider the degree to which their project is purely descriptive or whether it is revisionary or pragmatic in its ambitions. Also, future work might consider whether to focus more attention on legal experts. (shrink)

This is the general introduction to the edited collection "A companion to Experimental Philosophy".

An important question facing contemporary philosophy of science is whether the natural sciences in terms of their historical records exhibit distinguishing developmental patterns or structures. At least two philosophical stances are possible in answering this question. The first pertains to the plurality of the individual sciences. From this stance, the various sciences are analyzed individually and compared with one another in order to derive potential commonalities, if any, among them. The second stance involves a general philosophy of science in (...) which a thorough theory of the natural sciences is developed. The latter stance strives to account for more than possible commonalities among the sciences but also to provide a broad-spectrum philosophical framework to account for, or to explicate, the nature of science itself and its progress. In this paper, the second stance is taken in which an evolutionary philosophy of science is proposed. To that end, Thomas Kuhn’s evolutionary philosophy of science is initially discussed and critiqued. An evolutionary philosophy of science is then proposed based on a revision of Kuhn’s evolutionary philosophy of science in terms of George Gaylord Simpson’s various tempos and modes for biological evolution. Next, two historical case studies from the biological sciences are reconstructed to illustrate the robustness of the proposed evolutionary philosophy of science for explicating the progress of the natural sciences. A concluding section discusses the proposed evolutionary philosophy of science with respect to providing a broad-spectrum framework or general philosophy of science for understanding the nature and progress of the natural sciences. Scientists may sometimes generalize from their samples to broader populations when they have not yet sufficiently supported this generalization. Do such hasty generalizations also occur in experimental philosophy? To check, we analyzed 171 experimental philosophy studies published between 2017 and 2023. We found that most studies tested only Western populations but generalized beyond them without justification. There was also no evidence that studies with broader conclusions had larger, more diverse samples, but they nonetheless had higher citation impact. Our analyses reveal (...) important methodological limitations of many experimental philosophy studies and suggest that philosophical training may not protect against hasty generalizations. (shrink)

Lipsey and Lancaster's "general theory of second best" is widely thought to have significant implications for applied theorizing about the institutions and policies that most effectively implement abstract normative principles. It is also widely thought to have little significance for theorizing about which abstract normative principles we ought to implement. Contrary to this conventional wisdom, I show how the second-best theorem can be extended to myriad domains beyond applied normative theorizing, and in particular to more abstract theorizing about the (...) normative principles we should aim to implement. I start by separating the mathematical model used to prove the second-best theorem from its familiar economic interpretation. I then develop an alternative normative-theoretic interpretation of the model, which yields a novel second best theorem for idealistic normative theory. My method for developing this interpretation provides a template for developing additional interpretations that can extend the reach of the second-best theorem beyond normative theoretical domains. I also show how, within any domain, the implications of the second-best theorem are more specific than is typically thought. I conclude with some brief remarks on the value of mathematical models for conceptual exploration. (shrink)

Examining the significance of the General’s enlightenment in the Platform Sutra, this article clarifies the fundamental role that emotions play in the development of one’s spiritual understanding. In order to do so, this article emphasizes that the way to enlightenment implicit in the story of the General and the Master involves first granting negative emotions a means for productive expression. By acting as a preparatory measure for calming the mind and surrendering control over it, human passions become a (...) necessary, antecedent condition to wisdom—a conclusion that this article argues is a major, and sometimes underappreciated, lesson embedded in the teachings of the Sixth Patriarch. Penelope Maddy’s Second Philosophy is one of the most well-known ap- proaches in recent philosophy of mathematics. She applies her second-philosophical method to analyze mathematical methodology by reconstructing historical cases in a setting of means-ends relations. However, outside of Maddy’s own work, this kind of methodological analysis has not yet been extensively used and analyzed. In the present work, we will make a first step in this direction. We develop a general framework that allows us to clarify the procedure (...) and aims of the Second Philosopher’s investigation into set-theoretic methodology; pro- vides a platform to analyze the Second Philosopher’s methods themselves; and can be applied to further questions in the philosophy of set theory. Dewey blurs the distinction between poetry and philosophy. This is clearest in his aesthetics where he affirms Matthew Arnold’s dictum that “poetry is criticism of life.” The maxim, though, fails to say “how poetry is a criticism.” The role of art in general is imagining and creating images of the actual beyond the possible that (from a moral perspective) ought to exist. One can derive an ought from an is if one understands the is of poetic possibility. Dewey asserts (...) that “poetry teaches us as friends and life teach, by being, and not by express intent.” He affirms that it is “by way of communication that art becomes the incomparable organ of instruction.” Blurring the distinction between poetry and philosophy requires reconsidering the character—especially the moral character—of education as cultural criticism. For anyone with an interest in the philosophical teachings of Ch’an (Zen Buddhism), the Platform Sutra is arguably the classic source of philosophical as opposed to religious Ch’an. The text is exclusively concerned with expounding the nature of Ch’an and its key feature: enlightenment achieved by the mind alone or by pure understanding without the assistance of textual authority, religious devotion, charitable acts, meditative practices or monastic discipline. Yet, despite its centrality in Zen Buddhism, the book presents one account of (...) enlightenment that has received very little attention: the story of the General. It is commonly thought that emotions are to be repressed in order to attain enlightenment. The argument I would like to present is that one case of attaining enlightenment recounted in the Platform Sutra shows that one ought to take a very different attitude to desire and emotions than annihilation, tranquilization or repression. From the account of the General, it would appear that desires and emotions are not to be simply eradicated or repressed. Rather, they must first be expressed and then acknowledged as possessed before one can attain enlightenment. (shrink)

In this theme essay for the addressed special-theme section in this special issue of the journal Comparative Philosophy commemorating the first anniversary of the International Society for Comparative Philosophy toward World Philosophy, I intend to give an elaboration of the theme “comparative philosophy as a general way of doing philosophy through cross-tradition engagement toward world philosophy”, which has been explicitly presented and formally stated through its recent academic-organizational channel CPWP and focuses on via the Journal’s and CPWP’s jointly organized (...) international conference. The theme “comparative philosophy toward world philosophy” as a whole marks a momentous accumulating point of the significant development of comparative philosophy as a general way of doing philosophy through cross-tradition engagement regarding its “direction” dimension, through the constructive-engagement strategy in theoretic exploration and reflective practice especially since the beginning of this century.
