Abstract
Definition of the problem:
Since the 1950s, knowledge about the human chromosome complement has enabled reproduction medicine to carry out prenatal gender selection by prenatal diagnosis and abortion. In Germany, this approach is legally permitted, but limited by professional rules for physicians. In the 1990s, gender selection became possible in the context of in vitro fertilisation (IVF) by performing preimplantation genetic diagnosis (PGD) on embryos. PGD is legally unregulated but forbidden in the prevailing interpretation of the German Embryo Protection Law. This approach is strictly limited by law to severe, sex-linked hereditary diseases. In a new approach, preconceptional gender selection by separation of X- and Y-chromosome-bearing spermatozoa is about to become a realistic option. In Germany, the ethical attitudes towards preconceptional gender selection for social (non-medical) reasons differ widely. These range from strong opposition through indifference to substantial support for it as a valued component of providing freedom of choice in questions of reproduction.
Arguments:
Here, we discuss ethical concerns with respect to socially motivated preconceptional gender selection and, especially, possible negative social consequences, such as demographic effects or the discrimination of women. At the same time, we scrutinize arguments supporting the permission of socially motivated preconceptional gender selection.
Conclusion:
This paper contains suggestions for the ethical evaluation of socially motivated preconceptional gender selection and for the discussion about whether or not it should be legally restricted. In particular, the issue is not settled so far whether freedom of procreation overrides certain concerns of society which might require further legislative action. Our approach is therefore one in which we do not seek to provide definite answers to unresolved issues but instead to specify them and to provide preliminary ideas in order to stimulate the discussion.
