오늘날 가족의 개념과 위상은 근대화의 과정에서 빠르게 변하고 있다. 특히 주목할 만한 것은 가족의 규범이 어떤 모순적 상황에 처해 있다는 것이다. 먼저 서구 근대화의 물결에 따라 개인의 자유와 권리가 강조되고 이것이 가족관계에도 침투하고 있다. 이는 사회구성의 기본단위인 가족에도 가족 구성원을 독립적 인간으로 또는 하나의 자유로운 개인으로 파악해야 한다는 요구와 결합된다. 따라서 가족 구성원들에게도 전통 사회에서의 위계질서가 아니라 수평적 관계가 강조된다. 그러나 이런 변화에 따라 개인의 자유와 독립을 강조하는 것은 개인을 집단과 세계에 맞선 개별자, 단독자로 만들고 이는 필연적으로 불안과 자유의 무게에 짓누르게 한다. 따라서 개인과의 연대와 사랑이 가족 구원성 사이에 다시 강조되며, 이는 가족 집단주의로 귀결되기도 한다.
자유주의와 공동체주의의 대결 장소로서 가족이 처해 있는 이런 모순적 상황은 현대 윤리학의 주요 문제인 정의와 연대의 대결과 조화라는 문제를 가족 내에서 다시금 일으키고 있다. 그러나 기존의 현대 윤리학자들이 취하고 있는 방법으로 가족에서의 이런 모순적 상황을 해결하기에는 쉽지 않다. 자유주의 진영의 윤리학자들은 사적영역과 공적영역을 구별하며 공적영역에 정의를, 가족에 친밀성을 부여하는 전략을 취하고 있다. 그러나 오늘날 시장과 국가권력의 확장은 기존의 사적영역과 공적영역의 구분을 모호하게 만들고 있다. 또한 공동체주의 윤리를 통해 가족 구성원의 연대를 강조하는 것은 가족 내 기존의 권력관계를 고착화시키고 가족 외부에 대한 폐쇄적 가족집단주의를 강화할 뿐이다. 따라서 이 논문의 목적은 가족이 사회 내에서 갖는 특수한 위치를 고려하면서 가족관계를 질서지울 수 있는 규범과 규범의 정당화를 모색하는 것이다. 이는 인정개념을 통해 가족 내에 사랑과 권리, 그리고 연대를 종합하는 하나의 길이 될 것이다.

The concept of modern family is changing rapidly in the process of modernization. Particularly noteworthy is that the family faces some contradictory situation. First is the spread of liberal individualism which emphasizes individual freedom and rights according to the wave of Western modernization. This means that each family member should be identified as an independent person or a free individual. However, these changes lead to the dismantling of the family and the situation in which the individual is responsible for everything. Today, the cause of anxiety, dangerous, and anger society may have come from the dissolution of the family. Faced with this phenomenon, family intimacy and solidarity are again being emphasized.
This contradictory situation in which the family is in conflict as a place of confrontation between liberalism and communitarianism can be grasped as a problem of reconciling justice and solidarity. However, it is not easy to solve this contradictory situation in the family by the method that existing modern ethicists are taking. Liberals seek to reconstruct the intimacy of family as a priority of justice by distinguishing the private domain from the public domain. However, due to the expansion of market and state power today, the distinction between existing private and public areas has become ambiguous. In addition, emphasizing the solidarity of family members through community ethics only fixes existing power relations in the family and strengthens closed family groupism. Therefore, the purpose of this paper is to explore the normative meaning that family should have in social order considering the special position of family. This is to present a norm to restore love, rights, and solidarity within the family through the concept of recognition.
