Abstract

This paper examines fictional status of justice as elaborated by modernist and postmodernist approach. Its starting point is the assumption according to which a precarious character of democracy manifests itself in aporias inherent to contemporary theorising of law and justice. It is an attempt to resolve the aporetic relationship between modernist and postmodernist conceptualisation by appealing to Derrida's rethematisation ofjustice.
