Custom and positivity: An examination of the philosophic ground of the Hegel-Savigny controversy

Abstract

The author investigates the relation of Hegel and Savigny both in biographic and intellectual terms. Even though the notion of custom (Gewohnheit, Sitte) is central in the work of both authors, it nevertheless leads them to quite different assessments of the role of law, reason and philosophy.
