Abstract

Resumo: Este trabalho procura reconstruir a teoria da ação comunicativa a partir de sua opção fundamentadora por uma teoria da evolução social com amplas conseqüências para as instituições político-jurídicas do nosso tempo. A psicologia genética de Jean Piaget e a teoria do desenvolvimento moral de Lawrence Kohlberg são investigadas a partir das possibilidades que oferecem para essa estratégia teórica. As homologias sugeridas na teoria do discurso entre o desenvolvimento psicológico ontogenético e a evolução social própria de sociedades modernizadas tornam mais fácil a compreensão das crises de democracia e de legitimidade identificadas nessas sociedades. Ao mesmo tempo, as acusações contra a teoria do discurso, sobretudo de idealismo e etnocentrismo, podem encontrar respostas mais satisfatórias no rastro de tal compreensão, sendo possível explicar de modo mais convincente as formas que assumem uma consciência moral pós-convencional nas instituições de um Estado de Democrático de Direito.Palavras-chave: Teoria do Discurso - Psicologia genética - Teoria da Argumentação jurídica - Teoria da evolução social.: This paper intends to proceed to a reconstruction of the theory of communicative action through its option for a social evolutionary strategy of foundation, as well taking in account the profound consequences of this theory for the political and legal institutions of the structures related to social recognition. The psychological theories of Lawrence Kohlberg and Jean Piaget are investigated as sources which offer helpful conceptual instruments on realizing such theoretical strategy. The homologies suggested by Habermas between the ontogenetic development of children and the social evolution of modern societies make easier to understand the crises of democracy within these societies. At the same time, the accusations of ethnocentrism and idealism against the Theory of Discourse can also, under these points of view, find more satisfying answers
