Gross negligence manslaughter and the duty of care

Abstract

This article considers the offence of gross negligence manslaughter and in particular the requirement that the defendant owe the victim a duty of care. It considers whether the concept of duty of care has the same meaning in this context as it does in the law of tort. It argues that that essential it does and it should.
