Abstract

Utilizamos a palavra lei para designar um eficiente veículo constitutivo de direito, o que nos remete a um âmbito de realidade onde algo de novo chega a ser introduzido, com caráter universal e obrigatório, numa ordem já estabelecida ou em vias de inaugurar-se. Enquanto expressão de um poder de determinação, consubstancia-se a lei em um enunciado regulador capaz de constranger as condutas humanas. Como compreender então a relação entre lei e liberdade em As obras do amor de Søren Kierkegaard? É possível distinguir uma compatibilidade entre liberdade de amar e lei do amor? Não parece ser uma contradição insanável que aquele que ama seja livre e tenha, ao mesmo tempo, que obedecer a um dever de amar? Pode a questão nos auxiliar a pensar a liberdade humana frente a uma realidade crivada pela intervenção da lei? As linhas que se seguem serão uma tentativa de enfrentar duas relações tradicionalmente conflituosas: lei e liberdade, por um lado, e, por outro, universalidade e particularidade.We use the word law to designate an efficient vehicle constitutive of rights, which brings us to a reality where something new is introduced, with general and obligatory character, in an established order or in a coming order. Being an expression of a determinative power, the law is able to constrain human behavior. How to comprehend therefore the relation between law and liberty in Works of love of Søren Kierkegaard? It is possible to distinguish any kind of compatibility between liberty to love and love’s law? Does not seem to be an irremediable contradiction that the one who loves is free and, at the same time, he has to obey the duty of love? Could those questions help us to think the human liberty, considering the reality marked by the intervention of law? The following lines are a tentative of facing two traditionally difficult relations: law and liberty, by one side, and, by the other side, universality and particularity
