In 1968, Jürgen Habermas claimed that, in an advanced technological society, the emancipatory force of knowledge can only be regained by actively recovering the ‘forgotten experience of reflection’. In this article, we argue that, in the contemporary situation, critical reflection requires a deliberative ambiance, a process of mutual learning, a consciously organised process of deliberative and distributed reflection. And this especially applies, we argue, to critical reflection concerning a specific subset of technologies which are actually oriented towards optimising human cognition. (...) In order to create a deliberative ambiance, fostering critical upstream reflection on emerging technologies, we developed the concept of a mutual learning exercise. Building on a number of case studies, we analyse what an MLE involves, both practically and conceptually, focussing on key aspects such as ambiance and expertise, the role of ‘genres of the imagination’ and the profiles of various ‘subcultures of debate’. Ideally, an MLE becomes a contemporary version of the Socratic agora, providing a stage where multiple and sometimes unexpected voices and perspectives mutually challenge each other, in order to strength-en the societal robustness and responsiveness of emerg-ing technologies. The current study draws on in-depth public engagement activities in ten European countries giving a bottom-up perspective on the ethics and desirability of enhancement. This informed the design of an online contrastive vignette experiment that was administered to representative samples of 1000 respondents (...) in the ten countries and the United States. The experiment investigated how the gender of the protagonist, his or her level of performance, the efficacy of the enhancer and the mode of enhancement affected support for neuroenhancement in both educational and employment contexts. Of these, higher efficacy and lower performance were found to increase willingness to support enhancement. A series of commonly articulated claims about the individual and societal dimensions of neuroenhancement were derived from the public engagement activities. Underlying these claims, multivariate analysis identified two social values. The Societal/protective highlights counter normative consequences and opposes the use enhancers. The Individual/proactionary highlights opportunities and supports use. For most respondents these values are not mutually exclusive. This suggests that for many neuroenhancement is viewed simultaneously as a source of both promise and concern. (shrink)

A central concern is how to foster a culture of “Responsible Research and Innovation” (RRI) among scientists and engineers. This paper focuses on RRI teaching at higher education institutions. On the basis of interviews and reviews of academic and policy documents, it highlights the generic aspects (...) of teaching aimed at invoking a sense of care and societal obligation, and provides a set of exemplary cases of RRI-related teaching. It argues that the Aristotelian concept of phronesis can capture core properties of the objectives of RRI-related teaching activities. Teaching should nurture the students’ capacity in terms of practical wisdom, practical ethics, or administrative ability in order to enable them to act virtuously and responsibly in contexts which are often characterized by uncertainty, contention, and controversy. El principal fundamento de la legitimidad de la ley es su origen democrático. Pero legislar, aparte de implicar una manifestación de voluntad del pueblo o de sus representantes, es un proceso en el que se intercambian argumentos de muy diverso tipo. De la argumentación legislativa emergen exigencias de justificación que se dirigen a quienes participan en la tarea de legislar, pero ello no necesariamente representa una intromisión en la democracia. Antes bien, una ley guiada en su producción por pautas de (...) deliberación y justificación es más resistente a la discrecionalidad jurisdiccional, comenzando porque la claridad e intelegibilidad de una ley, contribuye a la certeza del Derecho. La argumentación legislativa, como aproximación científica a la legislación, presupone un modo de comprender las relaciones entre Política y Derecho, en la que la legitimidad de la política reside en último término el carácter justificado de las decisiones. De hecho, desde una perspectiva metateórica, el elemento que permite diferenciar mejor entre las distintas aproximaciones científicas a la producción de normas se halla la noción de racionalidad legislativa (bastaría decir de ley) subyacente, de modo que la teoría y la técnica o técnicas legislativas serán muy distintas en función de si el punto de partida es una razón instrumental o consecuencialista (enfoque minimalista) o, por el contrario, una noción más compleja, que sin excluir otros aspectos, se encuentre abierta a exigencias de justificación práctica (enfoque maximalista). Por lo demás, la argumentación legislativa se asemeja en unos aspectos y difiere en otros de la argumentación en el ámbito jurisdiccional. Asimismo, presenta peculiaridades en función del ámbito temporal y espacial en el que se desarrolle la argumentación. Tales consideraciones son relevantes, tanto para determinar hasta qué punto son aplicables a la argumentación legislativa las aportaciones de la teoría estándar de la argumentación jurídica, como para concretar el papel que otras disciplinas, como la economía, la sociología o la ciencia política, pueden desempeñar en el proceso de legislación. Within current trends in cultural and narrative Victimology, the role of direct and indirect victims’ narrative testimonies is highlighted considering the limits of scientific knowledge to transmit and understand victims’ experiences across time in relation to the social processes of victimisation and reparation. Through the selection of some excerpts of open narratives, as examples of those experiences, within and outside Spain, this text explores some parallelisms and differences in the stories of victims of terrorism and victims of other serious crimes, (...) in terms of a critical interpretation of the concepts of epistemic justice and resilience, both understood under interdisciplinarity. La mujer todavía tiene numerosas barreras para poder acceder al Deporte (Pérez-Ugena, 2020). Esto se debe, tal y como indica Monforte y Úbeda-Colomer (2019) a que los estereotipos de género siguen existiendo en nuestra sociedad. El objetivo de estudio fue analizar los estereotipos de género en la Actividad Física y el Deporte en 51 adolescentes, utilizando para ello variables sociodemográficas y el instrumento de CEGAFD (Granda et al., 2018). Los resultados muestran que, en la mayoría de los ejemplos, se toma (...) como referente el sexo masculino, destacando también, diferencias significativas en la variable de Estereotipos de Género en el Deporte. Resumen: El presente artículo explora los rendimientos de la teoría de la justicia de Axel Honneth para comprender las experiencias del sujeto en las sociedades contemporáneas. Para esto primeramente define la teoría de la justicia a través de las esferas del reconocimiento y posteriormente construye un modelo analítico posible considerando la justicia social a través de grados. Se proponen tres grados de justicia, que no son camisas de fuerza a lo social, sino puntos de partida para pensar la constitución y (...) las prácticas de los sujetos. Se concluye que las esferas del reconocimiento, pensadas a través de grados de justicia social permiten analizar las disímiles experiencias de los sujetos, pero comprendiendo las esferas y finalmente la justicia, a la luz de relaciones de poder y dominación que configuran ciertos contenidos morales de la justicia, pero no necesariamente contenidos que favorecen un mayor progreso moral en los órdenes sociales que prevalecen. El modelo analítico presentado permite considerar cómo se institucionalizan órdenes morales que definen formas de justicia que coactan la crítica, la lucha y el cambio.: This article explores the performances of Axel Honneth’s theory of justice to understand the subject’s experiences in contemporary societies. For this, it first defines the theory of justice through the spheres of recognition and then builds a possible analytical model considering social justice through degrees. Three degrees of justice are proposed, which are not social straitjackets, but starting points for thinking about the constitution and practices of the subjects. It is concluded that the spheres of recognition, thought through degrees of social justice, allow to analyze the different experiences of the subjects, but understanding the spheres and finally justice in the light of relations of power and domination that configure certain moral contents of the justice, but not necessarily content that will favor greater moral progress in the prevailing social orders. The analytical model allows us to consider how institutionalized moral orders, which define forms of justice that coerce criticism, struggle and change. (shrink)

Resumen: Los estudios críticos en discapacidad se han convertido durante las últimas tres décadas en un campo académico interdisciplinario que introduce un camino plural y diverso para la comprensión de la discapacidad. Estos estudios se enfocan en una serie de desarrollos teóricos que privilegian las comprensiones culturales, discursivas y relacionales de la discapacidad, conectando las aspiraciones de las personas con discapacidad con las agendas de los estudios feministas, queer, poscoloniales, postestructuralistas y posthumanos. Este trabajo tiene como objetivo esbozar los aportes (...) epistemológicos de estos estudios a través de la identificación de ejes teóricos que se han ido consolidando: poder, producción de los cuerpos y opresión internalizada; interseccionalidad e identidades múltiples; y ensamblajes posthumanos. La contribución de estos ejes radica, por un lado, en la salida del binarismo discapacidad-impedimento propio de los estudios sociales de la discapacidad más convencionales, lo que permite comprender la variabilidad de experiencias de la discapacidad, y, por otro lado, hace entender el concepto discapacidad como estratégico para explicar las formas en las que se producen los sujetos en las sociedades actuales.: Critical disability studies have become over the last three decades an interdisciplinary academic field that introduces a plural and diverse path to understanding disability. These studies focus on a series of theoretical developments that privilege cultural, discursive, and relational understandings of disability, connecting the aspirations of people with disabilities with the agendas of feminist, queer, postcolonial, poststructuralism and posthuman studies. This work aims to outline the epistemological contributions of these studies through the identification of theoretical axes that have been consolidated: power, production of bodies and internalized oppression; intersectionality and multiple identities; and posthuman assemblages. The contribution of these axes lies on the one hand, in the departure from the disability-impediment binary characteristic of the more conventional social studies of disability, which allows us to understand the variability of experiences of disability, and, on the other hand, it makes disability concept strategic to explain the ways in which subjects are produced in current societies. Psychology related to areas such as gender, language, education and violence has provided scientific knowledge that is contributing to reducing coercive social relationships and to expanding freedom in sexual-affective relationships. Nonetheless, today there are new challenges that require additional developments. In the area of consent, professionals from the fields of law, gender, education and others, are in need of evidence about conditions in human communication that produce consent differentiating them from conditions that coerce. Up to now, consent has been focused (...) on verbal language, for example, “no means no” or “anything less than yes is no”. Despite the fact that focusing consent on verbal language is a very important part of the problem, and has meant a huge advance, it does not solve most of the issues currently raised, like the famous case of “La Manada” in Spain. This article presents the most recent results of a new line of research, which places the problem and the solution in communicative acts, and not only in speech acts. Even though there might be a “yes” in a sexual-affective relationship, there might be no consent, and it is indeed a coercive relationship if that “yes” has been pronounced in a relationship determined by institutional power or by interactive power. Institutional power may occur if who made the proposal for the relationship is a person in charge of the process of selecting personnel in a company and one of the candidates is the person who received the proposal. Interactive power may occur if who makes the proposal is situated in an equal or inferior position for instance in the company to the person receiving it, but the former threatens to make sextortion to the latter. The potential social impact of this research has been already shown in the cases analyzed for this study. (shrink)

Prolongando los trabajos de Horst Bredekamp y de Quentin Skinner, la hipótesis que pretendo defender aquí consiste en demostrar que si el célebre frontispicio que adorna el Leviatán, obra mayor del pensamiento de Hobbes, hace de la figura del Leviatán el sustento estructurante de nuestra iconografía..

The aim of the present study was to determine statistical differences in a set of badminton competition matches in five different modalities with regard to competition level (Group Phase versus Eliminatory Phase). Data from 453 sets (125 in men’s singles; 108 sets in women’s singles; 77 sets in men’s doubles; 73 in women’s doubles and 70 in mixed doubles) from the RIO 2016 Olympics Games were recorded and classified in two groups of variables to analyse variables related to match (5) (...) and set (15). A descriptive analysis and univariate test (Mann Whitney U) for non-parametric data were conducted. The results show in men’s and women’s singles all the variables related to match were higher in the Elimination Phase than in the Group Phase (p<0.01). In Sets 1 and 3, the longest set duration, rally and average rally were found in the Elimination Phase than Group Stage (p<0.05). In women’s singles, these differences were also recorded in Set 2. For doubles, the results are more stable among groups. Men’s doubles had a longer duration of the match and set (set 1 and set 2) (p<0.01), and also scored highest for average rally strokes (set 1 and set 3) (p<0.05) and shuttles used in the Elimination Phase versus the Group Phase along the match (p<0.01). In women’s doubles, more shuttles were used in a match in the Elimination than in the Group Phase. Moreover, the same results are established for Set 2, including for average rally. Mixed doubles saw no match going to three sets. However, the greatest differences showed a longer rally and average rally being registered in the Elimination than in the Group Phase. In conclusion, the timing factors of the badminton singles and doubles games were different in the Elimination and Group Phases. This information may help players and coaches prepare and administer different types of workouts or, more specifically, competition schedules adapted to the characteristics of modern badminton. National legal systems increasingly appear to be burdened with the necessity of coping. Situations of an “outdating” of the Law can arise when law-making tasks insist on being entirely joined with the nation-state viewpoint. These everyday situations can introduce matters whose legal solutions may not be found within systemic boundaries, rather, beyond them. To an extent, the Law, as it has been respectively defined through time, is losing its effectiveness as a means of regulation in correlation with increasing globalization. This (...) paper seeks to confine the unforeseen consequence of the current economic and financial crises by arguing that the constitutional recognition of the rule of budgetary stability can precisely serve as a solution to exit the current crisis. Whether or not this rule is adequate, necessary, feasible, and/or acceptable to a modern Democracy is subject to current legal and political, academic debate. The theory-of-mind account of autism has been central to cognitive research in the field for nearly 40 years. It initially proposed that the diversity of symptoms in autism could derive from a deficit in the ability of autistic people to infer other individuals’ mental representations. An extraordinary amount of research has been carried out within or questioning this perspective, including numerous and different tasks that assess first-order, second-order, and advanced theory of mind. We review and describe in detail some of (...) the more prominent studies in the field. We also explore two of the main challenges to this theory, namely the research highlighting the role of executive function and language development as alternative explanations of autistics’ performance on experimental theory-of-mind tasks. But all these accounts tend to focus on the limitations of the person with autism, ignoring the way they respond to and adapt to a world organized around the viewpoints of people without autism, and how that context functions in response to them. Recent studies into camouflaging and compensation, and hypotheses like the double-deficit model, further expand the field in this direction. (shrink)

The judgment of proportionality—i.e. the weighing or balancing of two or more competing Legal principles—is often said to be the core of legal reasoning. One of the premises underlying such a contention is that judges adhere to a non-positivistic legal approach: when justifying their rulings, that is, they are certainly “bound by the Law”, but not as this is understood within Legal positivism. A non-positivistic conception of law entails the claim that judges interpreting and applying legal norms do combine, in (...) fact, legal and moral reasoning. On the other hand, Constitutionalism, as a paradigm in law and jurisprudence, implies that a culture of justification extends to all public authorities, i.e. not only to the executive branch and the judiciary but also to legislatures. Thus, the sole fact that a parliament has been democratically elected is not enough to entirely satisfy its claim to Legitimacy—in other words, winning elections cannot be the only basis of legislative authority. Against this backdrop, the focus of this chapter is to explore the possibility of broadening the principle of proportionalityProportionality principle, as characterized by Robert Alexy, to legislative decisions. Additionally, and in connection with the non-positivistic legal approach just mentioned, the second part of the essay will highlight some misunderstandings about the study of lawmaking which one can find in the province of legal theory. El trabajo tiene por objeto reflexionar sobre el auge de los códigos deontológicos profesionales, así como sobre la tendencia a extenderlos a las instituciones o los poderes públicos, como el parlamento, el gobierno, la administración y el poder judicial. Las normas deontológicas profesionales pueden ser entendidas como normas morales, propias de un colectivo profesional, que estipulan los principios y valores por los que han de regirse quienes se dedican a tal profesión. Al tratarse de un tipo de normatividad, resulta relevante (...) para la teoría jurídica dar cuenta de las relaciones entre los estándares deontológicos y las normas jurídicas. Por último, se pone el acento en los problemas que surgen a la hora de dilucidar el ámbito de conductas de los poderes que pueden estar bajo regulaciones éticas, con valor de recomendación, y cuáles, por el contrario, resultan de inexorable regulación legal por cuanto entrañan responsabilidades jurídicas. Resumen: Prolongando los trabajos de Horst Bredekamp y de Quentin Skinner, la hipótesis que pretendo defender aquí­ consiste en demostrar que si el célebre frontispicio que adorna el Leviatán, obra mayor del pensamiento de Hobbes, hace de la figura del Leviatán el sustento estructurante de nuestra iconografí­a polí­tica; este doble éxito de Hobbes, a la vez teórico e iconográfico, amerita una explicación. En efecto, existe una razón de peso por la cual el autor no pudo limitarse a la sola expresión (...) conceptual escrita: la filosofí­a polí­tica no puede limitarse al discurso demostrativo, ella requiere también de la retórica literaria y visual debido a la naturaleza intersubjetiva de lo polí­tico. En consecuencia, nuestra visión del Estado se juega también en la historia de su representación iconográfica. Para discutir y confrontar esta hipótesis se identifican y se comparan dos momentos de la historia de la recepción de la figura del Leviatán: en la Crí­tica del juicio de Kant y en la obra del pintor espaí±ol Francisco de Goya.: After the work of Horst Bredekamp and Quentin Skinner, the hypothesis I pretend to defend here consists in demonstrating if the famous Prologue that adorns the major philosophical work of Hobbes, the Leviathan, makes of the figure of Leviathan the foundation of our political iconography. The double success of Hobbes, at the same time theoretical and iconographical deserves an explanation. As a matter of fact, there is solid reason to believe that the author could not limit himself to the written conceptual explanation, as political philosophy cannot limit itself to demonstrative discourse. It also requires literary and visual rhetoric due to the intersubjective nature of politics. Consequently, our vision of State plays a part in the history of its iconographical representation. To discuss and compare this hypothesis two moments in the history of reception of Leviathan are considered: Kant"™s Critic of judgment and the works of the Spanish painter Francisco de Goya.
