This paper describes one way in which a precise reason model of precedent could be developed, based on the general idea that courts are constrained to reach a decision that is consistent with the assessment of the balance of reasons made in relevant earlier decisions. The account provided here has the additional advantage of showing how this reason model can be reconciled with the traditional idea that precedential constraint involves rules, as long as these rules are taken to be defeasible. (...) The account presented is firmly based on a body of work that has emerged in AI and Law. From a philosophical standpoint, the work presented here is based on van Fraassen [26]. The bulk of that paper is organized around a series of arguments against the assumption, built into standard deontic logic, that moral dilemmas are impossible; and van Fraassen only briefly sketches his alternative approach. His paper ends with the conclusion that “the problem of possibly irresolvable moral conflict reveals serious flaws in the philosophical and semantic foundations of ‘orthodox’ deontic logic, but also suggests a rich set (...) of new problems and methods for such logic.” My goal has been to suggest that some of these methods might be found in current research on nonmonotonic reasoning, and that some of the problems may have been confronted there as well.I have shown that nonmonotonic logics provide a natural framework for reasoning about moral dilemmas, perhaps even more useful than the ordinary modal framework, and that the issues surrounding the treatment of exceptional information within these logics run parallel to some of the problems posed by conditional oughts. However, there is also another way in which deontic logic might benefit from a connection to nonmonotonic reasoning. A familiar criticism among ethicists of work in deontic logic is that it is too abstract, and too far removed from the kind of problems confronted by real agents in moral deliberation. It must be said that similar criticisms of abstraction and irrelevance are often lodged against work in nonmonotonic reasoning by more practically minded researchers in artificial intelligence; but here, at least, the criticisms are taken seriously. Nonmonotonic logic aims at a qualitative account of commonsense reasoning, which can be used to relate planning and action to defeasible goals and beliefs; and at least some of the theories developed in this area have been tested in realistic situations. By linking the subject of deontic logic to this research, it may be possible also to relate the idealized study of moral reasoning typical of the field to a more robust treatment of practical deliberation. The purpose of this paper is to explore a new deontic operator for representing what an agent ought to do; the operator is cast against the background of a modal treatment of action developed by Nuel Belnap and Michael Perloff, which itself relies on Arthur Prior's indeterministic tense logic. The analysis developed here of what an agent ought to do is based on a dominance ordering adapted from the decision theoretic study of choice under uncertainty to the present account of (...) action. It is shown that this analysis gives rise to a normal deontic operator, and that the result is superior to an analysis that identifies what an agent ought to do with what it ought to be that the agent does. The result model of precedent holds that a legal precedent controls a fortiori cases—those cases, that is, that are at least as strong for the winning side of the precedent as the precedent case itself. This paper defends the result model against some objections by Larry Alexander, drawing on ideas from the field of Artificial Intelligence and Law in order to define an appropriate strength ordering for cases.

This paper points out some problems with two recent logical systems – one due to Prakken and Sartor, the other due to Kowalski and Toni – designedfor the representation of defeasible arguments in general, but with a specialemphasis on legal reasoning.

The first clinical ethics committees in Norway were established in 1996. This started as an initiative from hospital clinicians, the Norwegian Medical Association, and health authorities and politicians. Norwegian hospitals are, by and large, publicly funded through taxation, and all inpatient treatment is free of charge. Today, all the 23 hospital trusts have established at least one committee. Center for Medical Ethics , University of Oslo, receives an annual amount of US$335,000 from the Ministry of Health and Care Services to (...) coordinate the committees and to facilitate competency building for committee members. In Morals By Agreement, David Gauthier concludes that under certain conditions it is rational for an agent to be disposed to choose in accordance with a fair cooperative scheme rather than to choose the course of action that maximizes his utility. This is only one of a number of important claims advanced in that book. In particular, he also propounds a distinctive view concerning what counts as a fair cooperative arrangement. The thesis concerning the rationality of adopting a cooperative disposition (...) is, however, logically independent of his substantive view of a fair cooperative scheme and is itself central to the project as a whole. Gauthier's concern is to establish that certain moral principles are those that fully rational, self-interested persons would agree to take as regulative of their dealings with one another – that a contractarian approach, in this sense, can provide an adequate basis for a theory of morality. F. Thomas Burke believes that pragmatism, especially as it has been employed in politics and social action, needs a reassessment. He examines the philosophies of William James and Charles S. Peirce to determine how certain maxims of pragmatism originated. Burke contrasts pragmatism as a certain set of beliefs or actions with pragmatism as simply a methodology. He unravels the complex history of this philosophical tradition and discusses contemporary conceptions of pragmatism found in current US political discourse and explains what this (...) quintessentially American philosophy means today. For 20th century mathematicians, the role of Cantor's sets has been that of the ideally featureless canvases on which all needed algebraic and geometrical structures can be painted. (Certain passages in Cantor's writings refer to this role.) Clearly, the resulting contradication, 'the points of such sets are distinc yet indistinguishable', should not lead to inconsistency. Indeed, the productive nature of this dialectic is made explicit by a method fruitful in other parts of mathematics (see 'Adjointness in Foundations', Dialectia 1969). All Canadian bioethicists need to reflect on the meaning and value of their work, to see more clearly how the ethics of bioethics is being undermined from within. In the case involving Dr Olivieri, the Hospital for Sick Children, the University of Toronto, and Apotex Inc, there were countless opportunities for bioethical heroism. And yet, no bioethics heroes emerged from this case. Much has been written about the hospital’s and the university’s failures in this case. But what about the deafening (...) silence from the Canadian bioethics community? Given the duty of bioethicists to “speak truth to power”, this silence is troubling. To date, nothing has been written about the silence. This article is intended as a partial remedy. As well, the article pays tribute to heretofore unsung heroes among Dr Olivieri’s research colleagues. (shrink)

Zeller argued that the ‘innumerable worlds’ mentioned in accounts of Anaximander's system must be an endless succession of single worlds, not an unlimited number of coexistent worlds scattered through infinite space, some always coming into being while others are passing away. Zeller pointed out that a succession of single worlds is grounded in the principles of the system. ‘Things perish into that from which they had their birth… according to the order of Time,’ a cycle of birth, existence, and destruction. (...) A world ends, and the living divine stuff begets a new world to take its place. On the other hand, there is much in the system to contradict the idea of coexistent worlds. Anaximander's successors, Anaximenes, Anaxagoras, and Diogenes, show that this idea is not a necessary consequence of the unlimitedness of the original world-stuff. Nothing in the appearances of Nature suggests it. Anaximander is a monistic hylozoist, whereas Democritus is a pluralist with his innumerable independent atoms producing, by similar processes, independent world-systems in different parts of an infinite void. The question of what subjects Paul addresses in his letters has been a matter of debate in New Testament scholarship. This debate shows the evolution of Pauline studies, whereby early scholars argued that Paul addressed topics ranging from questions of human existence, to relations between Jews and Gentiles, and even topics connecting Paul with the Roman Empire. Most of these scholars view Paul mainly from a religious perspective, particularly in terms of the relationship between Judaism and Christianity. However, viewing Paul (...) from a Jewish versus a Christian religious perspective only fails to present the multivalent function of the Pauline corpus. This article employs social identity theory to read Galatians 3:1–10 in order to defend the argument that Paul employs his letters to construct a superordinate identity for his community which embraces not only political perspectives but also has religious and economic trajectories.Contribution: The application of identification, contest and comparison, concepts derived from sociology, to analyze Galatians 3:1-10 in reference to 1st century economic, religious and political contexts to explain the multivalent nature of early Christian identity, contributes to multidisciplinary research aspects of Biblical studies which is in tandem with the scope of HTS Theological Journal. An analogy is developed between action in an indeterministic setting and choice under uncertainty, as it is studied in decision theory. Various dominance relations among actions are explored, and used both to provide a semantic account of what agents ought to do and to formulate a notion of dominance act utilitarianism. The ideas are related to problems involving independence, conditionals, and sure‐thing reasoning.
