ABSTRACT Whether explicitly or implicitly, Kant's critical project weighs heavily upon Merleau-Ponty's Phenomenology of Perception. This article argues that we can understand Merleau-Ponty's text as a phenomenological rewriting of the Critique of Pure Reason from within the paradoxical structures of lived experience, effectively merging Kant's Transcendental Aesthetic and Transcendental Analytic. Although he was influenced by Husserl's and Heidegger's interpretations of Kant's first version of the Transcendental Deduction, Merleau-Ponty develops a unique position between Kant, Husserl, and Heidegger via an embodied and (...) lived synthesis that collapses Kant's distinction between sensibility and the understanding, and that makes sense of temporality and subjectivity as a paradoxical trajectory. Two key themes structure the work of French philosopher of science Gilbert Simondon: the processes of individuation and the nature of technical objects. Moreover, these two themes are also at the heart of contemporary debates within Ethics and Bioethics. Indeed, the question of the individual is a key concern in both Virtue Ethics and Feminist Ethics of Care, while the hyper-technical reality of the present stage of medical technology is a key reason for both the urgency for and the success (...) of the field of Bioethics. And yet, despite its potential for thinking about these issues, Simondon’s philosophy remains largely unknown. Rather than exploring Simondon’s complex ontology for itself, the aim of this paper is to establish what contribution his work can make in Ethics and Bioethics on two essential questions: the relational structure of the self and the nature of the human-technology relation. I argue that Simondon’s re-conceptualization of the individual harmonizes with perspectives in Feminist Bioethics and points toward what I call an “open” Virtue Ethics that takes relations to be essential. In order to establish this connection, I explore at length the relational approach to Feminist Bioethics offered by Susan Sherwin’s work. I argue that a Simondonian account of technology and of the individual furthers the relational understanding of the self, offers a characterization of Virtue Ethics that is in harmony with the Ethics of Care, and clarifies a notion of responsibility that is implicated in the complex reality of the modern technological milieu. In the Nicomachean Ethics, Aristotle places the art of medicine alongside other examples of technē. According to Gadamer, however, medicine is different because in medicine the physician does not, properly speaking, produce anything. In The Enigma of Health, rather than introducing Aristotle’s intellectual virtue of phronēsis (practical wisdom) as a way of understanding medical practice, Gadamer focuses on how medicine is a technē “with a difference”. In this paper, I argue that, despite the richness of his insights, this focus prevents (...) Gadamer from reaching an adequate account of health and the practice of medicine, and I demonstrate how making phronēsis central via a phenomenological description furthers our understanding of the art of healing in important ways. The paper begins with an exploration of Gadamer’s understanding of phronēsis and technē (via Heidegger) to provide a foundation for a phenomenological analysis of the art of healing. After considering the shortcomings of Gadamer’s analyses, I introduce a working definition of “health” that both captures the spirit of Gadamer’s insights and prepares the ground for a phenomenological description. Finally, I introduce concepts from Merleau-Ponty in order to establish an adequate account of the relation between technē and phronēsis and a more nuanced understanding of experience as unfolding within the expressive trajectories forged by bodies that are subject to the weight of the past and the weight of the ideal. The art of medicine, I argue, needs to be understood as expressive behavior in the context of historically and socially situated individuals, institutions, and open trajectories of sense. (shrink)

As a descriptive philosophy, it might seem that the ethical nowhere has its place in phenomenology. And yet, phenomenology is every-where shot through with normative concerns. This section includes articles from the 2018 conference Toward a Phenomenological Ethics, where two themes emerged regarding the elusive place of the ethical in phenomenology: first, research demonstrates that early phenomenology was indeed oriented by the ethical; second, Critical Phenomenology examines ethical questions in terms of intersubjectivity and oppression. In this introduction, I suggest that (...) the place of the ethical in phenomenology implies a certain paradoxical logic of expression, and I consider the relationship between expression and encroachment. This points to a double responsibility for the cultivation of our own virtual and the virtual that we collectively sustain. The figure is the vestige of an expressive gesture; it represents neither a separable idea nor the one who traced it but, rather _exscribes_ their presence and their world in the event of expression. As such, Nancy’s aesthetics in _The Muses_ deploys a certain logic of expression best understood in the tradition of (...) Merleau-Pontian phenomenology. Echoing Merleau-Ponty’s notion of speech accomplishing, rather than translating, thought, Nancy’s understanding of the expressive gesture suggests an event that brings forth a self that does not pre-exist its expression and that is paradoxically always already past, always already fallen into material vestiges. By connecting Merleau-Ponty’s notion of a “past that has never been present” to Nancy’s concept of _exscription_, I argue that reading Nancy’s _The Muses_ and Merleau-Ponty’s “Eye and Mind” together suggests an importantly restructured “phenomenology” of painting that is in fact more of an ontology of intercorporeality. Although Merleau-Ponty and Blanchot both seek to undermine the classical subject of philosophical discourse as embodied in the self-transparent “I think,” their methodologies appear to be worlds apart. In his early work, Merleau-Ponty is engaged in a phenomenological rethinking of subjectivity via an elaboration of Husserl’s “I can,” whereas Blanchot seems to defer all subjectivity in his nomadic exploration of the space between literature, criticism, and theory. Rather than seeking to avoid this tension by focusing on Merleau-Ponty’s later work, this (...) paper demonstrates the philosophical significance of reading Blanchot alongside Merleau-Ponty’s early work. This, I argue, reveals the radical nature of Merleau-Ponty’s early account of subjectivity (from the “I can” to the “I speak” to the violence of perception) as well as a certain phenomenological and ethical significance in Blanchot’s readings of the myths of the Sirens and of Orpheus and Eurydice.Bien que Merleau-Ponty et Blanchot cherchent tout deux à ébranler le sujet classique du discours philosophique tel qu’il est incarné dans la transparence à soi du “je pense”, leur méthodologies semblent être très éloignées. From this perspective, sensing is thus a privileged point of departure for the deconstruction of classical theories of subjectivity and for the construction of a new notion of a decentered subjectivity. Even though it may appear that these two thinkers diverge precisely with regard to the definition of the subject to be theorized, by bringing them together on the topic of sensing (and “listening” in particular), we are able to bring out a radical tone in Merleau-Ponty’s early work as well as a phenomenological timbre in Nancy’s thought. In this paper I demonstrate that listening reveals how subjectivity is an activity of “co-existence” rather than “co-incidence,” of “co-birth” (co-naissance) rather than “knowledge” (connaissance), and is a trajectory rather than a static presence. In other words, by listening to listening we rediscover a radical theory of subjectivity already at work in Phenomenology of Perception and a phenomenological tonality in the work of Nancy. Although the suggestion that Kant offers a significant contribution to Virtue Ethics might be a surprising one, in The Metaphysics of Morals Kant makes virtue central to his ethics. In this paper, I introduce a Merleau-Pontian phenomenological perspective into the ongoing study of the convergence between Kant and Virtue Ethics, and argue that such a perspective promises to illuminate the continuity of Kant’s thought through an emphasis on the implicit structure of moral experience, revealing the insights his perspective contains for (...) establishing an embodied phenomenology of virtue. These two aims are accomplished by exploring Kant’s ‘proto-phenomenological’ descriptions of the weight of the moral law, his implicit ‘existential’ account of human nature, and his notion of the art of navigating the complex moral terrain that involves a certain Spielraum. When thus viewed, Kant’s virtue ethics sketches out a subtle understanding of embodiment and temporality. (shrink)

An essay on the compatibility of Jewish and Muslim aspirations for the Land that argues that a vision of peaceful coexistence to provide a spur to the settling of grievances, but that this vision must respect the deeply felt aspirations of both communities, including in particular those underpinned by religious lore. Existing formulations of the aims of each community are blatantly inconsistent; it is time to attempt to characterise the just and religiously authentic goals of each community in ways that (...) are compatible. I argue that there religious and personal dimensions of the conflict that have been displaced by less deep-seated political goals, but which can be addressed more readily. I outline a tiered constitutional settlement that could address legitimate aspirations by avoiding the anathema of partition. (shrink)

The current interest in bioregionalism, stimulated in part by Kirkpatrick Sale’s Dwellers in the Land, shows that people are looking for a form of political praxis which addresses the importance of region. In this paper, I argue that much of the bioregional literature written to date mystifies the concept of region, discounting the role of subjectivity and culture in shaping regional boundaries and veers toward asimplistic view of “nature knows best.” Bioregionalism can be rehabilitated, provided we treat it not as (...) a “revealed wisdom” for the reconstruction of human society, but as a sensibility and environmental ethic that can infuse our work even as we make use of the functional regionalisms that increasingly shape people’s consciousness. I conclude by citing Lewis Mumford’s concept of a region as capturing the dialectical interplay of natural and cultural elements. (shrink)

Indigenous Zuni farming, including cultural values, ecological and biological diversity, and land distribution and tenure, appears to have been quite productive and sustainable for at least 2000 before United States influence began in the later half of the 18th century. United States Government Indian agriculture policy has been based on assimilation of Indians and taking of their resources, and continues in more subtle ways today. At Zuni this policy has resulted in the degradation and loss of natural resources for farming, (...) reduction in the number of Zuni farmers and their control over farming resources, individualization of rights in farmland, consolidation of farm fields, and declining biological diversity in agriculture. The Zuni Sustainable Agriculture Project with the Zuni Irrigation Association and the Zuni community, are now working to revitalize sustainable Zuni farming, based on traditional values, knowledge, and technology, combined with modern knowledge and technology where appropriate. The United States government can support these efforts through appreciation of the need for Zuni control and the potential value of cultural and biological diversity. (shrink)

Mitchell Purdue University In his essay, Kenneth K. Tanaka considers two important elements of Christian prayer when he presents young Megan praying. First is the petitionary element of her prayer, and second is the relational element. Saint John Damascene expresses these same two dimensions in his classical definition of (...) Christian prayer: "Prayer is the raising of one's mind and heart to God, or the requesting of good things from God." 1 This movement of the mind and heart to God makes Christian prayer a living relationship that is itself a gift of God through Christ. The "heart" of a person is that hidden center in which Christ resides and from where his spirit moves both heart and mind toward God in a relation of love and devotion. As Saint Thérèse of Lisieux puts it, "For me, prayer is a surge of the heart... it is a cry of recognition and of love, embracing both trial and joy." 2 One responds to trials, one's own or those of others, with prayers of petition or intercession; and to joys or blessings with prayers of adoration, praise and thanksgiving. In all cases, the prayers are the dynamics of a person's relationship with God, where God is both ultimate source and object of the prayers.Tanaka also makes two comments about Christian prayer in its public forms. First, he questions the appropriateness of public prayers for civic leaders or for teams at athletic events. Does God choose to aid only some political leaders or nations, or choose sides in athletic games? Though I may feel that God must prefer my son's Little League team, or at least Notre Dame football for heaven's sake, certainly God loves and cares for everyone. Perhaps Tanaka's final characterization of Christian prayer is helpful here: "conversational, personal and hopeful." In a public event, one expresses in prayer one's hope, while understanding that God's providence embraces everyone in ways that are larger than one can comprehend.In the essay by Taitetsu Unno on the Jesus Prayer and Nembutsu, the question of dualism and both the initiative and the consequence of prayer is addressed. Unno points out that according to the Jesus Prayer tradition in Eastern Orthodoxy, the initiative of the prayer is from God, much like the intoning of Nembutsu arising from the Vow of Great Compassion. Here, as in Saint Thérèse's "surge of the heart," the ultimate subject and object of prayer are the same. Unno points out that the consequence [End Page 101] of such a Christian prayer is a sense that the world is infused with the presence of God in a way that is similar to finding the Land of Bliss everywhere. Indeed, I would add that this similarity applies to more than just the Jesus Prayer. Saint Teresa of Avila refers to a prayer experience that is not uncommon in mature Christian spirituality "in which is revealed to the soul how all things are in God, and how within himself he contains them all." 3After presenting these similarities between the Jesus Prayer and Nembutsu, Unno raises what he sees as a fundamental difference: the treatment of sin, blind passions, and ignorance. Unno quotes a Christian Orthodox text that calls for the utter rejection of sin and evil, and depicts grace as entering the soul and driving evil outside. Unno then says, "To negate evil, sin, and death means to deny a part of one's reality; to affirm them through transformation means to make one's life complete and whole." The latter approach is, for Unno, key to the spirituality of Shinran and Shin Buddhism. I would like to make two comments here. First, it is unclear as to what Unno is saying about the Shin approach to evil. How can one transform evil into its opposite without evil being "nullified and eradicated"? Abstractabstract:This article describes three utopian attempts to ameliorate the negative effects of income inequality that are less revolutionary than those of More and Bellamy. Rather than dispensing with money or gold, these three utopias modify existing institutions with the aim of lopping off the extremes of both wealth and poverty without upending the entire social and economic structure. Discussion includes Theodor Hertzka’s Freeland (1891), Theodor Herzl’s Altneuland: The Old New Land (1902), and H. G. Wells’s A Modern Utopia (1905). The (...) three utopias provide potential solutions by undercutting causes of poverty and intergenerational wealth accumulation rather than by economic leveling, and by stressing a fresh start for each generation. The primary tools in this effort are education, universal healthcare, a safety net of basic income, fiscal transparency, confiscatory estate taxes, and common ownership of land. (shrink)

Legislation in various jurisdictions alters the common law right to control access to one’s land by allowing the imposition of rights of access in favour of one landowner over the land of another. The relevant legislation can be divided into two categories. The first-generation legislation and s 180, Property Law Act 1974 ) permits the creation of easements over servient land to facilitate the development of dominant land. The second-generation legislation permits the creation of temporary rights of access over servient (...) land to facilitate work on dominant land. This thesis examines the extent to which this change in the law can be justified by three modes of ethical discourse: right-based, duty-based, and goal-based reasoning. An examination of the first-generation legislation and the cases in which it has been applied suggests that a form of goal-based reasoning can be used to justify its enactment. The legislation is needed to facilitate the efficient use of land where the existence of a bilateral monopoly and the possibility of strategic bargaining puts at risk the conclusion of a mutually beneficial agreement regarding access. A review of the second-generation legislation and the law reform reports and parliamentary debate that preceded its enactment indicates that the legislation can be justified by a form of duty-based reasoning. The legislation is needed to bring about a proper social ordering by imposing access rights where this would be consistent with the ideal of good neighbourliness. The thesis concludes that although these goal-based and duty-based discourses make an arguable case for the enactment of both generations of the legislation, neither of them, in an unadulterated form, provides a conclusive justification. Rather, an eclectic approach that draws on both discourses is required. It proposes that the legislation’s compensation provisions be amended to reflect the commingling of the ideas of efficiency, a properly ordered society and intensive land use, and to allow the servient owner to share in the benefits generated by the imposition of access. Mitchell Purdue University In his essay, Kenneth K. Tanaka considers two important elements of Christian prayer when he presents young Megan praying. First is the petitionary element of her prayer, and second is the relational element. Saint John Damascene expresses these same two dimensions in his classical definition of (...) Christian prayer: "Prayer is the raising of one's mind and heart to God, or the requesting of good things from God." 1 This movement of the mind and heart to God makes Christian prayer a living relationship that is itself a gift of God through Christ. The "heart" of a person is that hidden center in which Christ resides and from where his spirit moves both heart and mind toward God in a relation of love and devotion. As Saint Thérèse of Lisieux puts it, "For me, prayer is a surge of the heart... it is a cry of recognition and of love, embracing both trial and joy." 2 One responds to trials, one's own or those of others, with prayers of petition or intercession; and to joys or blessings with prayers of adoration, praise and thanksgiving. In all cases, the prayers are the dynamics of a person's relationship with God, where God is both ultimate source and object of the prayers.Tanaka also makes two comments about Christian prayer in its public forms. First, he questions the appropriateness of public prayers for civic leaders or for teams at athletic events. Does God choose to aid only some political leaders or nations, or choose sides in athletic games? Though I may feel that God must prefer my son's Little League team, or at least Notre Dame football for heaven's sake, certainly God loves and cares for everyone. Perhaps Tanaka's final characterization of Christian prayer is helpful here: "conversational, personal and hopeful." In a public event, one expresses in prayer one's hope, while understanding that God's providence embraces everyone in ways that are larger than one can comprehend.In the essay by Taitetsu Unno on the Jesus Prayer and Nembutsu, the question of dualism and both the initiative and the consequence of prayer is addressed. Unno points out that according to the Jesus Prayer tradition in Eastern Orthodoxy, the initiative of the prayer is from God, much like the intoning of Nembutsu arising from the Vow of Great Compassion. Here, as in Saint Thérèse's "surge of the heart," the ultimate subject and object of prayer are the same. Unno points out that the consequence [End Page 101] of such a Christian prayer is a sense that the world is infused with the presence of God in a way that is similar to finding the Land of Bliss everywhere. Indeed, I would add that this similarity applies to more than just the Jesus Prayer. Saint Teresa of Avila refers to a prayer experience that is not uncommon in mature Christian spirituality "in which is revealed to the soul how all things are in God, and how within himself he contains them all." 3After presenting these similarities between the Jesus Prayer and Nembutsu, Unno raises what he sees as a fundamental difference: the treatment of sin, blind passions, and ignorance. Unno quotes a Christian Orthodox text that calls for the utter rejection of sin and evil, and depicts grace as entering the soul and driving evil outside. Unno then says, "To negate evil, sin, and death means to deny a part of one's reality; to affirm them through transformation means to make one's life complete and whole." The latter approach is, for Unno, key to the spirituality of Shinran and Shin Buddhism. I would like to make two comments here. He was the third of six children, and his father was a physician. His mother was the only person in the family who practiced religion, namely, Jōdo Shinshū or Shin Buddhism. As a university student, Abe attended what is now Osaka Municipal University, where he studied economics and law. While (...) at the university, he read the Tannishō, a text by Shinran. Abe later said that he understood from that text that “self-power” was futile and the only hope for salvation was “other-power” faith in the grace of Amida Buddha. However, he also understood that this life of grace entailed the relinquishment of “self-centered calculation.” Abe felt that he was not able to set aside his ego-self and began for the first time in his life to experience the tension between Buddha and ego, or, in more Western terms, the duality of God and self. This concern led Abe into a very personal spiritual quest that would define his life and work.Given this concern, after graduation, Masao Abe wanted to attend Kyōto University to study Buddhism. Because of family issues, however, he took a position at a trading company in Kōbe, where he worked for four years. Those years were marked by a sense of meaninglessness, and in the end Abe quit his job and entered Kyōto University, where he studied Western philosophy under Tanabe Hajime, who was himself influenced by Shin Buddhism. It was during that time that Abe met Hisamatsu Shin’ichi, an associate professor at Kyōto University and a well-known and committed practitioner of Zen Buddhism.At one point, Abe took his spiritual concerns about the tension he felt between his ego-centeredness and the religious life to Hisamatsu. He asked, “I am nothing more than a lump of selfish passions. Yet, isn’t it true that in Mahāyāna Buddhism one can be saved just as one is, selfish passions and all?” Hisamatsu responded, “The very thought that there are selfish passions is a selfish passion. Originally there is no such thing.” 1 Abe understood from Hisamatsu that there was a more fundamental ground below the dualism between Buddha and ego, a ground in which this dualism is overcome and salvation from any such dualistic struggle could be found.But Abe was not ready to surrender his Pure Land religiosity. In fact, it was during [End Page 107] this time at Kyōto University that he had an experience of Amida Buddha’s grace. As Abe put it, he realized that while he thought that he was “running toward” Amida Buddha in his struggle with faith, he realized that Amida Buddha was not something to go to, but, rather, Amida was already right there with him all the time. Abe said that at that moment he threw himself on the tatami floor and wept in gratitude. It was gratitude for Amida’s presence and grace that embraced Abe just as he was, full of passions and ego. When he told Hisamatsu about this experience, Hisamatsu was very happy and never questioned Abe about his Pure Land views again.Gradually, under the influence of Hisamatsu and with his deeper study of Buddhism, Abe realized that while his Pure Land experience was valid, there was a more fundamental or original religious standpoint to be discovered. Abe still struggled with the duality between the life of Amida’s grace and embracement of Abe with his ego, and Abe’s ego-centered passions themselves. He felt, under Hisamatsu’s influence, that it might be on that more fundamental standpoint that this duality would be overcome. He also saw the undeniable realization of this original nondualistic standpoint in Hisamatsu himself, and this led him to turn more fully to Zen practice under Hisamatsu’s guidance in the context of the F.A.S.
